Industrial Arbitration (Union Elections) Regulations 1980

The Regulations organise an election process around a handful of core operational concepts: returning officer authority and duties, the electoral roll, nomination mechanics, postal ballot issuance and receipt, ballot form and counting, scrutiny, custody and preservation of records, and limited appeal and exemption mechanisms. Each concept is defined or described in regulatory text and allocated responsibilities.

Returning officer: The Regulations vest a central role in the returning officer. Where union rules are silent or impracticable, the returning officer may determine office titles, terms, committee composition, eligibility requirements to be a candidate, and voter eligibility (regulation 5). The returning officer sets dates and places for nomination and the issue and close of ballot (regulations 6 and 11). The returning officer is responsible for issuing and initialling ballot papers (regulation 15(2)(a)), checking counterfoils against the roll and marking the roll before opening ballot envelopes (regulation 19(1)(a)-(c)), deciding challenges about whether a ballot paper is formal or informal when scrutineers object (regulation 19(4)), and declaring results in accordance with union rules where practicable or by written notice otherwise (regulation 20).

Electoral roll: The union must supply the returning officer with a copy of the membership register referred to in section 63 of the Act and that register becomes the electoral roll for the election (regulation 12(1)). The roll is to be consecutively numbered and is subject to additions and deletions by the union after receipt (regulation 12(2)-(3)). The roll must be made available for inspection at the returning officer’s place of work during ordinary business hours until the result is declared (regulation 12(4)).

Nomination mechanics: Nominations require the candidate’s signature signifying willingness to accept office and the signatures of the number of nominating members required by the union’s own rules (regulation 8(1)). A candidate may withdraw consent by lodging a signed notice before the close of nominations, witnessed by an elector, thereby becoming deemed not nominated (regulation 8(2)). The returning officer must publicise invitation to nominate in a State newspaper 14 to 21 days before nominations commence and ensure the nomination window is at least seven days (regulation 7). If only one candidate remains at close of nominations, the returning officer must declare that candidate elected (regulation 9), and if no nominations are received the returning officer must advise the union as soon as practicable (regulation 10).

Postal ballots and counterfoils: The Regulations assume postal voting mechanics by default. Ballot material must be sent by prepaid post to each person on the roll (regulation 15(1)). Each pack is to include an initialled ballot paper, an inner envelope marked “ballot paper”, and an addressed return envelope that may double as a counterfoil. Where a separate counterfoil is used it must be numbered to match the voter’s number on the roll and must record identifying information including the voter’s name, address and signature (regulation 15(2)-(3)). The return addressed envelope is to be posted free of expense to the voter (regulation 15(1)(c)). A printer must certify the number of ballot papers printed (regulation 14(4)).

Receipt and custody: Receipt of postal ballots is tied to exclusive private post office boxes or, if the Electoral Commissioner conducts the election under the Electoral Act 1907, the permanent Electoral Commission post office box (regulation 13). Ballot boxes are locked and sealed and must be kept in safe custody until opened for counting (regulation 17). Where the union conducts its own election, envelopes are collected from the private box only at the time of close of ballot and opened in the presence of scrutineers or with notice arrangements (regulation 17(2)).

Scrutiny and counting: Candidates may appoint scrutineers (regulation 18(1)). Scrutineers may attend counts, raise attention to irregularities and carry out union‑rule scrutineer functions but must comply with lawful returning officer directions and may be directed to leave if they interrupt scrutiny improperly or fail to follow lawful requests (regulation 18(4)-(6)). Before opening ballot envelopes the returning officer must check each counterfoil against the roll and mark the roll if in order, then place unopened ballot paper envelopes into a separate container and only open ballot envelopes after all counterfoils are checked (regulation 19(1)). Ballot papers are to be rejected as informal if they do not bear the returning officer’s initials (or facsimile), bear identifying marks, or are not marked substantially in accordance with the instructions (regulation 19(3)).

Recordkeeping and preservation: The Regulations require sealed, signed and dated containment of nomination papers, formal and informal ballot papers, counterfoils, late envelopes, the marked roll and unused materials, retained by the union in custody for a minimum of one year after the election (regulation 21). The returning officer must endorse rejected envelopes with reasons for rejection (regulation 19(2)).

Appeals and exemptions: An appeal against a Registrar decision under section 69(12) of the Act is to be in Form 1 of the Schedule (regulation 4 and Schedule). Applications for exemption from section 57 of the Act must be made by the union’s Secretary or President in writing with stated grounds and accompanied by a statutory declaration confirming authority and truth of information (regulation 22).

These are the primary operational concepts that structure day‑to‑day compliance and administration of union elections in Western Australia as provided by the Regulations.

Directly affected parties are unions and their members, returning officers, the Registrar under the Act, the Electoral Commissioner where engaged, and persons who act as scrutineers, printers and postal service providers. The Regulations allocate duties and entitlements that create discrete obligations and operational impacts for each of these stakeholders.

Unions: The union must supply the returning officer with the register of members referred to in section 63 of the Act for use as the electoral roll (regulation 12(1)), and must provide updates to add or delete names after the roll is supplied (regulations 12(2)-(3)). Unions are responsible with the returning officer for making provision for preservation and custody of election records for at least one year (regulation 21). If a union wishes an exemption from section 57 of the Act, that application must be made by the union’s Secretary or President and be accompanied by a statutory declaration verifying the application (regulation 22). Where a union’s rules provide for publication of nomination notices in a different manner, the returning officer must publish the newspaper notice required by regulation 7(1) and, where practicable, also publish notice in the manner provided by union rules (regulation 7(2)), which requires unions to coordinate with the returning officer.

Union members (voters and nominators): Members listed on the register form the electoral roll (regulation 12(1)); they are entitled to inspect the roll at the returning officer’s place of work during ordinary business hours until declaration (regulation 12(4)). Members who nominate a candidate must provide the signatures required by the union rules for nomination (regulation 8(1)), and members may act as scrutineers if they are eligible under union rules (regulation 18(1)). Members who receive ballot packs have counterfoils linked to roll numbers and must sign the counterfoil as provided (regulation 15(3)). Members who no longer appear on the roll but were issued a ballot prior to deletion are still deemed entitled to vote if the ballot was issued (regulation 15(5)), which affects members who change status in the run up to close of ballot.

Candidates: Candidates must sign to indicate willingness to accept office (regulation 8(1)). A nominated candidate may withdraw by lodging a signed notice witnessed by an elector before the close of nominations, becoming deemed not to have been nominated (regulation 8(2)). Candidates may appoint scrutineers in writing not less than seven days before the close of the ballot (regulation 18(1)). Where only one candidate is nominated at close, the returning officer must declare the candidate elected (regulation 9). Candidates are subject to the union rules and to the returning officer’s determinations where those rules are silent or cannot be complied with (regulation 5).

Returning officers and Electoral Commissioner: The returning officer carries central administrative responsibility for making determinations where union rules do not provide or cannot be complied with (regulation 5), setting nomination and ballot windows (regulations 6 and 11), determining ballot paper form where union rules are silent or insufficient (regulation 14(1)), issuing ballot packs (regulation 15), handling duplicate ballot requests (regulation 16), performing the verification of counterfoils against the roll and conducting the count (regulation 19), and declaring results (regulation 20). Where the Electoral Commissioner under the Electoral Act 1907 conducts the election on behalf of a union, some logistics vary: the returning officer must use the permanent Electoral Commission post office box or a private box used exclusively for that election to receive ballot papers (regulation 13(1)).

Postal service providers and printers: The Regulations require a printer to provide a certificate stating the number of ballot papers printed (regulation 14(4)). Postal logistics are central: ballot packs must be posted prepaid and returned free of expense to the voter (regulation 15(1)(c)), and private post‑office boxes must be used exclusively for ballot receipts (regulation 13). The person conducting the election must collect envelopes from the private box only at specified times for secure custody and counting (regulation 17).

Registrar, Full Bench and Commission: The Registrar receives requests to conduct elections under section 69 of the Act and may accept late requests if practicable (regulation 3). Decisions of the Registrar under section 69(12) may be appealed to the Full Bench using the prescribed Form 1 (regulation 4 and Schedule). The Schedule and notes identify that the reference to the Industrial Commission is now the Western Australian Industrial Commission (notes to Schedule), so appeals are framed within the Commission’s current institutional structure.

Third parties and privacy: The form and handling of the counterfoil and the requirement that it contains identifying information and the voter’s signature (regulation 15(3)) mean that administrators will have a record enabling verification of voter identity against the roll at counting time (regulation 19(1)(a)), which implicates privacy handling and record retention obligations for unions and returning officers. This affects any third party that may seek access to or be entrusted with custody of these materials.

In sum, the Regulations affect a mix of public office‑holders (Registrar, returning officer, Electoral Commissioner), private entities connected with election administration (printers, postal service), unions and their members, and the union officers who must sign exemption applications. Each role has prescriptive duties and timelines anchored in the regulatory text.

The Regulations allocate a discrete set of duties to the returning officer and the union, while embedding rights and procedural protections for candidates and scrutineers. Below are the principal duties and reciprocal rights, with the regulating provisions cited.

Returning officer duties and discretion

• Preliminary determinations: Where union rules do not specify or cannot be complied with, the returning officer may determine the title of each office, the term for each office, the composition of the Committee of Management, candidate eligibility requirements and voter eligibility (regulation 5). This is explicit statutory discretion to fill gaps or resolve impracticabilities in union rules.

• Timing and venue: The returning officer must determine the times and dates for commencement and close of nomination periods (regulation 6(1)) and for the issue and close of ballot (regulation 11). In making timing decisions the returning officer must have regard to the expiring term of incumbents, time needed to lodge nominations, postal return time and union rule provisions (regulations 6(1)(a)-(d) and 11(a)-(d)).

• Notices and ballot form: The returning officer must cause a notice inviting nominations to be published 14 to 21 days before nominations begin and ensure the nomination period is at least seven days (regulation 7(1)). The returning officer must determine the ballot paper form where union rules are silent or insufficient and include specified instructions on the ballot (regulation 14(1)-(3)).

• Ballot issuance and verification: The returning officer must issue ballot packs by prepaid post to each person on the roll or subsequently added voters, ensure packs include an initialled ballot paper and a numbered counterfoil (regulation 15(1)-(3)), check each counterfoil against the roll before opening ballot envelopes and mark the roll where voting papers are in order (regulation 19(1)(a)-(c)), and decide objections raised by scrutineers during scrutiny, endorsing the decision on the ballot paper (regulation 19(4)).

• Custody and preservation: Maintain safe custody of ballot boxes and envelopes, open boxes in presence of scrutineers or in their absence with notice arrangements, endorse rejected envelopes with reasons and retain all election materials in separate sealed containers endorsed with union name and office for at least one year (regulations 17, 19(2) and 21).

Union duties

• Supply and maintain the roll: Provide the returning officer with the register referenced in section 63 of the Act as the electoral roll and provide additions and deletions to the roll after the initial supply (regulation 12(1)-(3)).

• Cooperation on preservation: In consultation with the returning officer, make provision for the preservation of nomination papers, ballot papers, counterfoils and other election documents in custody of the union for not less than one year (regulation 21).

• Exemption applications: If the union seeks exemption from the application of section 57 of the Act for an election, the written application must be made by the union’s Secretary or President and accompanied by a statutory declaration verifying authority and truth of the application (regulation 22).

Candidate and voter rights and procedural protections

• Candidate signature and withdrawal: Candidates must sign their nomination consenting to office and must be nominated by the number of members required by union rules (regulation 8(1)). A nominated candidate can withdraw by notice signed and witnessed and lodged before the close of nominations (regulation 8(2)).

• Uncontested declaration: Where only one candidate is nominated at the close of nominations, the returning officer must declare that candidate elected in accordance with the Regulations (regulation 9).

• Right to inspect roll: Members and authorised persons may inspect the electoral roll at the returning officer’s place of work during ordinary business hours until the result is declared (regulation 12(4)).

• Scrutineer appointment and access: Each candidate can appoint a scrutineer by written notice given not less than seven days before close of ballot (regulation 18(1)). Scrutineers have the right to be present during opening of the post box or ballot box and the count, to draw attention to irregularities, and to carry out union‑rule functions, subject to lawful returning officer directions (regulation 18(2)-(4)). Scrutineers must comply with directions and may be directed to leave for improper interruption or failure to follow lawful requests, with a stated penalty for non‑compliance (regulation 18(5)-(6)).

• Voting procedures: Voters receive ballots posted prepaid and return envelopes that may act as counterfoils, with instructions on how to mark ballots and how to place them into envelopes. The voter’s counterfoil is checked against the roll before ballots are opened (regulations 14(3)(c), 15(1)-(3) and 19(1)(a)).

Other procedural rights and duties

• Duplicate ballots: On written application prior to the close of ballot, a person may receive a duplicate ballot paper or return envelope if the returning officer is satisfied the original has not been received or has been lost, destroyed or spoilt, and the applicant must declare they have not voted (regulation 16(1)-(2)).

• Printer certificate: The returning officer must obtain from the printer a certificate stating the number of ballot papers printed (regulation 14(4)).

• Declaration of results and transparency: The returning officer must declare the result in accordance with union rules where practicable and provide written notice where not (regulation 20(1)-(2)). The declaration must itemise the number of ballot papers issued (including duplicates), number admitted as formal, number rejected as informal, unused ballot papers, number certified by the printer and the number of votes for each candidate (regulation 20(3)(a)-(g)).

These duties create a procedural architecture that balances verification against the roll, a presumption in favour of postal voting with prepayment and counterfoils, and transparency in counts and record retention. They also allocate discretion to the returning officer to resolve ambiguous or impracticable union rule situations. The Regulations therefore create both prescriptive tasks that must be performed and rights (inspection, scrutiny, withdrawal) intended to protect procedural fairness.

The Regulations themselves contain a limited direct monetary penalty and a set of procedural enforcement mechanisms embedded in duties, recordkeeping and appeal pathways. Enforcement is largely administrative and procedural rather than criminal in nature.

Express penalty

• Scrutineer noncompliance: The only express pecuniary penalty in the Regulations is for a scrutineer who fails to comply with a lawful direction by the returning officer or who interrupts the scrutiny otherwise than as permitted. Regulation 18(5) authorises the returning officer to direct such a scrutineer to leave; regulation 18(6) states the scrutineer must comply and attaches a Penalty: $40.00. This is a small monetary penalty for noncompliance with returning officer directions during the scrutiny process.

Administrative enforcement mechanisms

• Returning officer authority: The returning officer has statutory powers to determine matters not provided for in union rules or where union rules cannot be complied with (regulation 5). This includes eligibility criteria and voter entitlement. The returning officer’s determinations are operationally central and serve as an enforcement mechanism for ensuring elections proceed despite gaps in union rules.

• Ballot rejection and endorsement: The returning officer may reject voting papers and must endorse rejected envelopes with the reasons for rejection and set them aside for safe keeping (regulation 19(2)). The returning officer must reject as informal ballot papers that do not bear the required initials or facsimile, that bear identifying marks, or that are not marked substantially in accordance with instructions (regulation 19(3)). These provisions give the returning officer immediate administrative control to exclude non‑compliant votes and to document reasons.

• Custody, sealing and retention: The returning officer and union must place election materials in separate endorsed containers, seal, sign and date them and retain them for at least one year (regulation 21). The retention obligation enforces record keeping and enables later scrutiny or challenge.

Appeal pathway

• Appeal to the Full Bench: A party may appeal a Registrar decision under section 69(12) of the Act to the Full Bench. Regulation 4 prescribes that such appeals must be in accordance with Form 1 in the Schedule. The Schedule provides the notice of appeal format and requires particulars of the matters appealed and grounds of appeal. The appeal mechanism channels disputes about Registrar decisions into the industrial commission’s appellate structure rather than into the courts. The Regulations do not specify time limits for lodging the Form 1 appeal; the controlling Act (section 69 and related provisions) would determine statutory time limits and procedural requirements for appeals. The Schedule’s use of the industrial commission formality reflects administrative review via the tribunal.

• Registrar discretion and judicial oversight: Regulation 3 permits the Registrar to accept a request to conduct an election made less than one month before the nomination period if satisfied that it is practicable to conduct the election under section 69. The legal effect of that discretion and specific Registrar decisions are subject to appeal to the Full Bench under section 69(12) in the form prescribed (regulation 4 and the Schedule).

• Exemptions subject to statutory declaration: The process for obtaining an exemption from section 57 of the Act is a written application by specified officers and must be accompanied by a statutory declaration that the information is true and that the applicant is authorised (regulation 22). The statutory declaration requirement creates a legal threshold that may expose the signatory to the consequences of false statutory declarations under relevant laws.

Scope and limits of enforcement

• No broad criminal sanctions: The Regulations do not create a suite of criminal offences or large fines for procedural failures by returning officers or unions beyond the narrow $40 penalty for scrutineer misbehaviour and the implied administrative consequences of non‑compliance (for example, a count that cannot be certified or an appeal outcome). Enforcement is therefore mainly administrative, through the returning officer’s operational powers and through the appeals channel to the Full Bench.

• Reliance on the Act: Broader enforcement or sanctions, if any, are likely to be found in the Act itself (for example, section 69 or section 57 as referenced by regulation 22). The Regulations provide procedural detail but direct enforcement of misconduct beyond their limited explicit penalty will typically engage the Act and the Industrial Commission’s jurisdiction.

In short, enforcement under the Regulations relies primarily on administrative controls exercised by the returning officer, sealed custody and retention of materials enabling later challenge, a prescribed appeal pathway to the Full Bench, and one expressed pecuniary penalty for scrutineer noncompliance.

The Regulations explicitly cross‑reference and operationally interact with the Industrial Relations Act 1979 and the Electoral Act 1907, and implicitly interface with statutory regimes governing statutory declarations and the work of the Western Australian Industrial Commission. The Notes and Compilation table also indicate historical interactions and renaming of statutes and institutions.

Industrial Relations Act 1979 (the Act)

• Foundational authority and context: Regulation 2 defines “the Act” as the Industrial Relations Act 1979. The Regulations implement the election provisions under that Act, particularly section 69 which governs the Registrar’s power to conduct elections on request and includes appeal rights that the Regulations operationalise (regulations 3 and 4). The electoral roll used for union elections is the register of members referenced in section 63 of the Act, which the union must provide to the returning officer (regulation 12(1)). Regulation 22 deals directly with exemptions from section 57 of the Act and prescribes the form and declaration required for such applications, thereby creating a procedural bridge between the two instruments (regulation 22).

• Union rules versus Regulations: The Regulations repeatedly assume the primacy of both the Act and the union rules. They provide default mechanics where the union rules are silent or impracticable (regulation 5 and regulation 14(1)). They also require the returning officer to comply with union rules where practicable , for example, declaration of results “in accordance with the rules of the union” where practicable (regulation 20(1)). This creates a layered relationship where the Act and union rules sit at substantive level and the Regulations fill gaps and impose procedural uniformity.

Electoral Act 1907

• Electoral Commissioner role: Where an election is conducted by the Electoral Commissioner under the Electoral Act 1907, the Regulations require the returning officer to use the permanent Electoral Commission post office box or a private box used exclusively for that purpose to receive ballot papers (regulation 13(1)). This is a specific operational alignment with the infrastructure and personnel of the Electoral Act regime and signals that the Electoral Commissioner’s procedures may be used for union elections.

Statutory declarations and other legal instruments

• Exemption applications: Regulation 22 requires that an application by a union for exemption from section 57 of the Act be accompanied by a statutory declaration attesting to the maker’s authority and the truth of the information. Statutory declarations are governed by separate legislation (for example, the Oaths, Affidavits and Statutory Declarations Act or its WA equivalent), which imposes legal consequences for false declarations. The Regulations therefore import liabilities and formalities from the statutory declaration regime into the election exemption process.

Administrative and tribunal practice

• Appeal form and tribunal identity: Regulation 4 prescribes use of Form 1 in the Schedule for appeals to the Full Bench under section 69(12) of the Act. The Schedule uses the historical name “Industrial Commission”. The Notes clarify that this body is now known as the Western Australian Industrial Commission (note 2). This is an internal cross‑reference to tribunal procedures and the institutional apparatus for appeals, and it situates appeals within the Commission’s jurisdiction rather than a court jurisdiction.

Privacy and postal law intersection

• Counterfoils and postal return envelopes: The Regulations require counterfoils that record full names, addresses and signatures of voters (regulation 15(3)), and the return envelope may act as or contain the counterfoil (regulation 15(2)(c)). This intersects with privacy law and any statutory obligations on collection, storage and disclosure of personal information. The Regulations do not displace privacy obligations; rather, they create records whose handling must conform to applicable privacy and recordkeeping statutes and regulations.

Electoral law and postal services

• Use of exclusive private boxes and prepayment: Requirement to use a private post office box used exclusively for the election (or the permanent Electoral Commission box where the Electoral Commissioner conducts the election) and to ensure prepaid return envelopes are used (regulations 13 and 15) creates an operational intersection with postal services and any applicable postal regulations regarding private boxes and handling of election material.

Renaming and repeal history

• Citation and reprint notes: The Notes explain that earlier instruments used the title “Industrial Arbitration” and that the short title of the Act changed over time. The Compilation table lists amendments by statutory instruments in 2024 (SL 2024/168 and a repealed SL 2024/169). These are statutory interactions about legislative history and how the Regulations were re‑enacted and amended.

In summary, the Regulations are procedural elaborations of the Act’s election powers and must operate together with the Act’s substantive provisions, the Electoral Act where the Electoral Commissioner is used, statutory declaration laws for exemption applications, postal service rules for private boxes and prepayment, and privacy and recordkeeping laws for the handling of counterfoils and sealed election materials. They set defaults where union rules do not provide, but also require regard for union rules “where practicable”, generating operational interactions that administrators must manage.

The Regulations were originally promulgated in 1980 as the Industrial Arbitration (Union Elections) Regulations 1980 and have been recompiled and amended over time; the compilation table and notes in the source document record the principal legislative history items included in the printed compilation.

Key dates and instruments in the compilation table and notes

• Original enactment: The instrument was originally published as the Industrial Arbitration (Union Elections) Regulations 1980 on 4 March 1980 (published at 4 Mar 1980 p. 747-53). The original commencement date was 4 March 1980 according to the compilation table.

• Reprint: The source includes a Reprint 1 notation for the Regulations as at 16 January 2004. Reprints consolidate amendments up to that date into an integrated text for ease of reference; the compilation table records that reprint.

• 2024 amendments: Two related instruments appear in the compilation notes. The Industrial Arbitration (Union Elections) Amendment Regulations (No. 2) 2024 (SL 2024/168) are recorded and in the compilation table, the published date is 12 August 2024 with commencement notes: regulations 1 and 2 commenced on 12 August 2024; the remainder of the Regulations commenced on 13 August 2024 (see SL 2024/168 r. 2(a) and r. 2(b)). Regulation 1 in the present text was amended by SL 2024/168 r. 4 and regulation 13 was amended by SL 2024/168 r. 5, as noted in the margin annotations in the source. A separate instrument, the Industrial Arbitration (Union Elections) Amendment Regulations 2024 (SL 2024/169) did not come into operation and was repealed by SL 2024/168 on 13 August 2024 (see the other notes in the compilation).

• Citation change and renaming: The Notes record that the short title of the underlying Act and some references changed historically. The Act was formerly referred to as the Industrial Arbitration Act 1979; that short title changed to the Industrial Relations Act 1979 by the Acts Amendment and Repeal (Industrial Relations) Act (No. 2) 1984 s. 4, and the reference was updated under the Reprints Act 1984 s. 7(3)(gb) (note 1). The Regulations’ title has also been adjusted from Industrial Arbitration (Union Elections) Regulations 1980 to Industrial Relations (Union Elections) Regulations 1980 (note 3).

• Institutional name change: The Schedule used the name “Western Australian Industrial Commission” in a note to clarify the body formerly referred to in the Forms as the Industrial Commission (note 2). This indicates an institutional renaming that affects how appeals and forms are framed.

Document annotations reflecting amendments

• Margin annotations in the text show explicit amendment markers for regulation 1 and regulation 13: “Regulation 1 amended: SL 2024/168 r. 4.” and “Regulation 13 amended: SL 2024/168 r. 5.” The compilation table likewise records SL 2024/168 as the amending instrument with commencement dates in August 2024.

Implications of this amendment history

• Recent amendments in 2024 have affected the Regulations, including citation and postal receipt arrangements. The source shows that some 2024 amendment instruments were enacted and commenced while at least one proposed instrument (SL 2024/169) was repealed and did not come into operation. This pattern indicates active updating in 2024 with at least some changes to the Regulations effective from August 2024.

• The statutory notes indicate that names and cross‑references have been modernised over time to match institutional changes (for example, aligning references to the Western Australian Industrial Commission and updating the short title of the Act).

The compilation table and notes in the source are the authoritative record provided; any further amendment details, including exact textual changes and the full content of the 2024 amending instruments, would need to be consulted in the amending statutory instruments themselves for a clause‑by‑clause history beyond the compilation summary in the present text.

The Regulations as provided do not contain or cite any cases or judicial decisions. The Schedule and main text provide an administrative appeal pathway rather than a catalogue of litigation outcomes.

What the Regulations provide about disputes and appeals

• Appeal to the Full Bench: Regulation 4 prescribes that an appeal to the Full Bench under section 69(12) of the Act against a decision of the Registrar must be in accordance with Form 1 in the Schedule. The Schedule provides the specific format and content requirements to lodge such an appeal, including particulars of the decision and grounds of appeal.

• Administrative resolution first: The Regulations concentrate authority in the returning officer for procedural determinations (regulation 5) and contingency decisions such as accepting late requests for the conduct of an election (regulation 3). The appeals mechanism is therefore targeted at disputing Registrar decisions rather than routine returning officer decisions, although decisions of a returning officer which relate to Registrar decisions or to matters appealable under the Act may also be subject to further review under the Act’s processes.

Absence of cases in the source

• No reported litigation referenced: The Regulations and Schedule do not name any reported cases, no judicial authorities are cited, and no summary of litigation history appears in the instrument. The Notes do not list any court or tribunal decisions that interpreted the Regulations. The only tribunal avenue mentioned is the Full Bench of the industrial commission for Registrar decisions.

Implication for practitioners

• Appeals will follow the statutory and tribunal practice governed by the Act and the Commission: While the Regulations prescribe Form 1, the substantive and procedural law governing appeals, timelines, leave and remedies will be determined by the Act and the procedural rules of the Western Australian Industrial Commission. Practitioners should consult the Act’s text, the Commission’s practice directions and any relevant case law available elsewhere to understand substantive appellate remedies and standards of review.

• Evidence and recordkeeping are critical: Given the Regulations require retention of election materials for at least one year (regulation 21) and a precise count declaration with enumerated items (regulation 20(3)), the preserved materials will be the evidence base for any post‑election challenge. Absence of case law in the instrument means the Regulations leave the resolution of contested issues to tribunal processes under the Act, using the documents and processes the Regulations require.

In short, the Regulations themselves provide the procedural form for appeals to the Full Bench but do not summarise any litigation history. Any practitioner seeking precedent or judicial interpretation will need to search tribunal and court databases for decisions under section 69 of the Act or related provisions, and for cases referencing or interpreting these Regulations. The Schedule and regulation 4 make provision for lodging an appeal but do not define appeal timelines or grounds beyond the Form structure; those elements will be governed by the Act and tribunal practice.

The Regulations prescribe a detailed process but several operational features may produce practical pitfalls, compliance risks or tensions between privacy, verification and ballot secrecy. The following are salient risks and traps to watch for, with statutory citations.

Tight and discretionary timelines for requests to the Registrar

• One‑month rule with narrow discretion: A request to the Registrar to conduct an election under section 69 must be made not less than one month before the commencement of the nomination period (regulation 3). The Registrar can accept later requests only if satisfied it is practicable and an accepted late request is deemed made in due time. This creates a compliance trap for unions and officers who delay initiation: there is uncertainty because acceptance is at the Registrar’s discretion and the Regulation does not specify objective criteria for practicability.

Ballot anonymity versus counterfoil verification

• Counterfoil records identifying information: Each counterfoil must be numbered to coincide with the voter’s consecutive roll number and must make provision for endorsement of the office(s), full name, address and signature of the voter (regulation 15(3)). During counting the returning officer checks counterfoils against the roll and marks the roll (regulation 19(1)(a)). While the Regulations instruct voters not to place identifying marks on ballot papers (regulation 14(3)(e)), the counterfoil requirement means administrators will hold voter identity linked to ballot issuance and that linkage may be used to verify entitlement and to reject votes. This creates a tension: the process preserves voter anonymity on the ballot paper but leaves identifying data in the counterfoil, which could raise privacy or perception of traceability issues.

Issued ballots remain valid despite subsequent deletion

• Voter deletion after issuance: Where a ballot paper has been issued to a person and that person is later deleted from the roll under regulation 12(3), the person remains deemed to be entitled to vote because of regulation 15(5). This can be a source of contention because the union may delete members (for example for membership lapses) after ballot issuance but such deletions do not revoke their ballot entitlement. Administrators must properly track issuance dates and avoid back‑dating deletions to disenfranchise voters.

Postal mechanics and private post office boxes

• Exclusive private box requirement and collection timing: Receipt of ballots must be to a private box used exclusively for that purpose or the permanent Electoral Commission box (regulation 13). Where the union conducts its own election, the returning officer must collect envelopes from the private box at the time of close of ballot and proceed to make the count in the presence of scrutineers (regulation 17(2)(a)-(c)). Using the wrong post box, failing to secure an exclusive box, or improper timing of collection could expose the chain of custody to challenge. In addition, regulations require that posted packs be prepaid and returned without expense to the voter (regulation 15(1)(c)), so any error in postage could cause rejected returns.

Duplicate ballot vulnerability and declarations of non‑voting

• Duplicate ballot procedure depends on declaration: The returning officer may issue a duplicate ballot if satisfied an original has not been received or has been lost, destroyed or spoilt, but the applicant must make a written declaration that they have not voted and set out grounds and any available evidence (regulation 16(1)-(2)). Determining whether applicants have, in fact, not voted depends on the accuracy of counterfoil checks and the returning officer’s judgment. There is potential for double voting if recordkeeping or counterfoil reconciliation is lax.

Ballot paper formality requirements

• Initials or facsimile requirement: A ballot paper must bear the returning officer’s initials or a facsimile of them; failure to include these is a ground for rejection as informal (regulation 19(3)(a)). If the returning officer or the printing process omits or corrupts initials, votes may be disqualified en masse. The returning officer must obtain a certificate from the printer of the number printed (regulation 14(4)), but the initialling requirement remains a single point of procedural failure.

Scrutineer appointment and conduct pitfalls

• Timing for appointment and notice: Scrutineers must be appointed by written notice not less than seven days prior to close of the ballot (regulation 18(1)), and they must be given “sufficient notice in writing” to attend counts (regulations 18(2)-(3)). Candidates who miss the seven‑day window may lose practical scrutiny rights. Scrutineers that interrupt scrutiny improperly or fail to obey lawful requests can be removed and fined $40 (regulation 18(5)-(6)), but the Regulations do not define “interrupts the scrutiny otherwise than in accordance with” the permitted functions; this leaves room for disputes about what conduct justifies removal.

Returning officer discretion versus union rules

• Determinations where union rules cannot be complied with: Regulation 5 gives the returning officer broad authority to determine office titles, terms, committee composition, eligibility and voting entitlement where union rules are silent or cannot be complied with. That discretion is necessary for administrability but is a potential flashpoint if unions and candidates prefer the strict application of their rules. Disagreements over when a rule “cannot be complied with” could give rise to appeals under section 69.

Record preservation and access issues

• One‑year retention requirement: Election documents must be sealed, signed, dated and retained for at least one year in the custody of the union (regulation 21). This could conflict with document destruction policies or records management regimes unless unions plan for the retention period. The Regulations require that each type of material be placed in separate containers endorsed with union name and office; failure to segregate properly could hinder post‑election reviews.

Formality of the appeal process

• Appeal form prescribed but procedural detail in Act: Regulation 4 states appeals to the Full Bench must be in Form 1. The Form requires particularity in grounds of appeal, but the Regulations do not set out time limits or all procedural steps; those are in the Act and Commission practice rules. Practitioners must pair the Form with the Act’s appeal procedures to ensure correctness.

Printer certification quantity and unused ballots

• Printer certificate and unused ballots count: The returning officer must obtain a printer certificate stating the number of ballot papers printed (regulation 14(4)) and must report the number of ballot papers certified by the printer in the declaration of result (regulation 20(3)(f)). Mismatch between printed and issued numbers can trigger scrutiny or challenge; careful reconciliation is required.

These “gotchas” arise from the intersection of counterfoil identification, postal voting logistics, tight timelines and returning officer discretion. Administrators and practitioners should design checklists and document trails addressing these specific provisions to reduce contest risk and procedural errors.

The Regulations prescribe specific steps and recordkeeping requirements. The following is an operational checklist-style deep dive, mapped to the principal regulatory provisions, intended for unions, returning officers and campaign teams to ensure procedural compliance.

Pre‑election initiation and Registrar engagement (regulation 3)

• Timing for requests: A request for the Registrar to conduct an election under section 69 must be made not less than one month before the commencement of the nomination period (regulation 3). If the union is unable to meet this one‑month minimum, submit a written request to the Registrar as early as practicable and include supporting reasons that make the election practicable on shorter notice to increase the chance the Registrar will accept it under the discretion in regulation 3. Record any acceptance in writing and retain it.

Preliminary determinations and union rule review (regulation 5)

• Review union rules: Before asking the returning officer to act, audit the union’s rules for provisions on office titles, terms, committee composition, eligibility to nominate and electorate eligibility. Identify any gaps or provisions that cannot be complied with so the returning officer can make determinations under regulation 5. Provide a clear statement of the rules and proposed positions to the returning officer.

Set nomination and ballot windows (regulations 6, 7 and 11)

• Nomination timetable: Ask the returning officer to determine nomination start and close dates, taking into account the incumbent’s term expiration and time needed for notice and postal return. Ensure the nomination period is at least seven days (regulation 7(1)(e)) and that the notice inviting nominations is published in a widely circulating State newspaper not less than 14 and not more than 21 days before nominations commence (regulation 7(1)).

• Notice content and additional publications: Prepare the newspaper notice including union name, office title, nomination form, place and times for lodging nominations and the dates. If union rules require other forms of notice, provide those notices as practicable in addition to the newspaper notice (regulation 7(2)).

Nomination mechanics and candidate consent (regulation 8)

• Nomination forms: Use nomination forms that capture the candidate’s signed consent and include the signatures of the number of nominators required by union rules. Include witness blocks for withdrawal notices so candidates can properly withdraw their consent before the close of nominations (regulation 8(2)).

Electoral roll management (regulation 12)

• Supply and update the roll: Provide the returning officer with the register of members as the initial electoral roll under section 63 of the Act (regulation 12(1)). Keep a process to add names of newly eligible voters and delete names of those who cease to be eligible after the roll is supplied, and deliver timely written updates to the returning officer (regulations 12(2)-(3)).

• Inspection arrangements: Ensure the returning officer has a place of business where the electoral roll will be available for inspection during ordinary business hours until the result is declared and publicise how members can inspect (regulation 12(4)).

Ballot paper form and printing (regulation 14)

• Ballot format: If union rules provide ballot form and ordering, follow them. Otherwise instruct the returning officer to use full names in alphabetical order by surname and to include instructions required in regulation 14(3). Ensure the printer will include the returning officer’s initials or a facsimile on each ballot (regulation 15(2)(a)).

• Printer certificate: Require the printer to provide a certificate stating the number of ballot papers printed for the election and obtain that certificate for inclusion in the result declaration (regulation 14(4) and regulation 20(3)(f)).

Ballot issuance and postal logistics (regulation 13 and regulation 15)

• Post box procurement: Arrange for a private post office box to be used exclusively for the election and confirm its exclusive use. If the Electoral Commissioner is to conduct the election under the Electoral Act 1907, confirm use of the permanent Electoral Commission post box (regulation 13).

• Ballot packs: Ensure each posted pack contains an initialled ballot paper, an envelope marked “ballot paper”, and a prepaid return envelope addressed to the returning officer (regulation 15(2)). Decide whether the return envelope will act as the counterfoil; if not, include a separate counterfoil numbered to coincide with the voter’s number on the roll and with fields for office, full name, address and signature (regulation 15(2)-(3)).

• Prepaid postage and instructions: Ensure postage is prepaid and the return envelope bears instructions about where it should be returned if not delivered (regulation 15(4)). Provide clear marking and packing instructions so that misdelivery is minimised.

Counterfoil handling and verification (regulation 15 and regulation 19)

• Counterfoil numbering and reconciliation: Maintain a register mapping consecutive roll numbers to counterfoil numbers. Before opening ballots the returning officer must check counterfoils against the roll and mark the roll where voting papers are in order (regulation 19(1)(a)-(c)). Ensure the returning officer has access to up‑to‑date roll data and that counterfoil numbers are accurately recorded.

Duplicate ballots (regulation 16)

• Duplicate request procedure: Establish a written application form for duplicate ballot requests requiring the applicant to declare they have not voted and to set out the grounds for non‑receipt, loss, destruction or spoiling. Collect any available evidence to support the application (regulation 16(2)). Process duplicates only if the returning officer is satisfied.

Ballot custody and collection (regulation 17)

• Secure ballot boxes: Use locked and sealed ballot boxes for envelopes until the count. For union‑conducted elections, collect envelopes from the private box at the time of close of ballot, in presence of scrutineers (regulation 17(2)). Prepare secure storage for the boxes between receipt and counting and document chain of custody.

Scrutineer procedures (regulation 18)

• Appointment and notice: Candidates should appoint scrutineers by written notice to the returning officer not less than seven days before the close of ballot (regulation 18(1)). The returning officer must give scrutineers sufficient notice of opening and counting times (regulation 18(2)-(3)). Maintain a written log of scrutineer appointments and notices.

• Scrutineer conduct: Train scrutineers on permitted functions , presence during counting, drawing attention to irregularities, and acting under union rules , and on the requirement to comply with lawful returning officer directions or face removal and a $40 penalty (regulation 18(4)-(6)).

Counting and rejection rules (regulation 19)

• Pre‑opening checks: Before opening ballot envelopes the returning officer must compare counterfoils to the roll and mark the roll. Unopened ballot envelopes go into a separate container until all counterfoils are checked (regulation 19(1)(a)-(b)). Only after verification open the ballot paper envelopes and proceed to counting (regulation 19(1)(c)).

• Grounds for rejection: Apply the rejection rules strictly: reject as informal any ballot lacking the returning officer’s initials or facsimile, bearing identifying marks, or not substantially complying with marking instructions (regulation 19(3)). When scrutineers object, the returning officer’s decision must be endorsed on the ballot paper (regulation 19(4)).

Declaration of result and reporting (regulation 20)

• Form of declaration: Where practicable declare results in accordance with union rules; otherwise give written notice to the registered office of the union (regulation 20(1)-(2)). The declaration must include an itemised report of number of ballot papers issued, duplicates issued, ballot papers admitted and rejected, unused ballot papers, number certified by the printer and votes for each candidate (regulation 20(3)(a)-(g)). Reconcile printer certificate numbers with issued and unused ballots.

Record preservation and access (regulation 21)

• Sealing and retention: Place nomination papers, formal and informal ballot papers, counterfoils, late envelopes, the marked roll and unused materials in separate containers, seal, sign and date each container, and retain them in the custody of the union for at least one year (regulation 21). Maintain secure, access‑controlled storage and a log of any access or handling.

Exemption applications (regulation 22)

• Application form and statutory declaration: If applying for exemption from section 57 of the Act, ensure the written application is made by the Secretary or President, state grounds clearly and attach a statutory declaration that the maker is authorised and that the information is true and correct (regulation 22). Use the statutory declaration form compliant with statutory requirements and keep a certified copy.

Appeals and dispute preparedness (regulation 4 and Schedule)

• Appeal form and documentation: If a party intends to appeal a Registrar decision under section 69(12), use Form 1 in the Schedule and set out matters and grounds of appeal with particularity (regulation 4 and Schedule). Retain copies of all documents sealed and retained under regulation 21 as primary evidence for any appeal.

Operational controls and audit trail

• Chain of custody and logs: Maintain written chain of custody logs for ballot boxes, private box collections, printing and delivery receipts, and scrutineer attendance and notices. Record all decisions by the returning officer that exercise discretion under regulation 5.

• Privacy and record protection: Because counterfoils contain identifying information, treat retained materials as personal data and ensure compliance with applicable privacy and recordkeeping laws. Limit access to sealed containers and maintain secure storage.

• Cross‑check with union rules and the Act: Where union rules provide alternative procedures, ensure returning officer and union have agreement about which procedures will be used and document that decisions about practicability or non‑compliance with union rules were made.

This compliance roadmap maps directly to the Regulations’ text and creates a defensible, auditable administration model for union elections. Following these steps reduces procedural irregularities and positions a union and returning officer to meet the documentation requirements that support the declaration of results and any subsequent challenges.
