42Regulations may make provision for transitional matters

#### 42 Regulations may make provision for transitional matters (1) The regulations may make provision for matters of a transitional, saving or application nature arising out of, or relating to, the provisions of this Act or of the Workplace Relations Legislation Amendment (Independent Contractors) Act 2006. (2) Without limiting subsection (1), regulations made for the purpose of that subsection may prescribe modifications of Division 1 of Part 5. (3) Subsection 12(2) (retrospective application of legislative instruments) of the Legislation Act 2003 does not apply to a regulation made for the purposes of subsection (1). (4) Subsection 12(1A) (retrospective commencement of legislative instruments) of the Legislation Act 2003 does not apply to a regulation made for the purposes of subsection (1) that creates, modifies or otherwise affects a provision that makes a person liable to an offence or civil penalty.
