What it does
This Act imposes an additional, specified income tax charge tied to amounts identified by a particular provision in the Taxation Administration Act 1953. Section 3 imposes income tax, but only "to the extent that that tax is payable by an entity in accordance with section 14‑155 in Schedule 1 to the Taxation Administration Act 1953" (s 3). The rate of the tax is not a single fixed percentage set inside this Act; rather it is a compound rate made up of two components. First, it takes the maximum rate specified in the table in Part I of Schedule 7 to the Income Tax Rates Act 1986, and secondly it adds 2 percentage points (s 4). The statute therefore creates a rate that moves with the maximum rate in Schedule 7 of the Income Tax Rates Act 1986 and then imposes a fixed 2 per cent add-on.
The Act also provides a one-step escalation mechanism in the event a particular income year is designated a "temporary budget repair levy year". If that condition holds, the tax rate calculated under s 4 is increased by a further 2 percentage points (s 5(1)-(2)). The definition of "temporary budget repair levy year" is not set out in this Act; it is tied to the meaning given in section 4‑11 of the Income Tax (Transitional Provisions) Act 1997 (s 5(3)).
Commencement is split. Sections 1 and 2 and any matter not otherwise covered by the commencement table began on the day of Royal Assent, recorded as 14 December 2009 (s 2 and the commencement table). Sections 3 and 4 commenced "at the same time as Schedule 1 to the Tax Laws Amendment (2009 Budget Measures No. 2) Act 2009 commences" (s 2 and the commencement table). The Act expressly notes that the commencement table relates only to the provisions of this Act as originally passed and assented to; it will not be expanded to deal with provisions inserted in this Act after assent (s 2, explanatory note in the table). Column 3 of the table is described as additional information that is not part of the Act (s 2(2)).
