What it does
This legislative instrument is a declaration made under subsection 59‑97(3) of the Income Tax Assessment Act 1997 (the Act). It specifies a list of State and Territory grant programs that are to be treated as eligible programs for the purposes of paragraph 59‑97(1)(b) of the Act. The practical effect is that any grant a taxpayer receives under one of the named programs is categorised as non‑assessable non‑exempt income (NANE income) under section 59‑97. NANE income is not included in assessable income, nor is it exempt income that would affect the application of losses or the tax‑free threshold. In substance, the grant is completely tax‑free at the federal level.
The instrument does not create, fund, or administer any of the grant programs. It merely declares that a grant paid under a listed program will attract the NANE treatment. Each program is identified by its official name and the State or Territory that administers it. The table in section 5 itemises 41 programs across four States (New South Wales, Victoria, Queensland, South Australia) and the Australian Capital Territory. Notably, no programs from Western Australia, Tasmania, the Northern Territory, or Norfolk Island are declared. The instrument was originally registered on 24 December 2020 and commenced the following day. It has been amended five times between July 2021 and November 2022, progressively adding new programs as State and Territory governments introduced further COVID‑19 economic recovery grants.
The instrument is a legislative instrument under the Legislation Act 2003 and is subject to disallowance by either House of Parliament. Its authority derives from section 59‑97(3) of the Act, which empowers the Minister (or the Minister’s delegate) to declare a program to be an eligible program. The instrument uses the compendious term “the Act” to refer to the and adopts the definitions from that Act by reference (paragraph 13(1)(b) of the ). No other substantive provisions exist: Part 1 contains only the name, authority, and definitions; Part 2 contains the sole operative provision, section 5, with the table.
