Impounding of Livestock Regulations 2018

The Regulations are tightly scoped and built around a small number of legal-technical concepts. The principal concepts in the text are:

• Infringement penalty, prescribed as a number of penalty units: The Regulations do not create new offences, they specify the prescribed infringement penalty amounts for particular offences already defined in the Impounding of Livestock Act 1994, and they do so by reference to penalty units rather than directly to dollars (regulation 5).

• Division 2 of Part 5A of the Impounding of Livestock Act 1994: The penalties are expressly prescribed for the purposes of that Division; the Regulations therefore operate within and support the infringement-notice framework established by that part of the Act (regulation 5).

• Penalty units and their conversion to monetary amounts: The Regulations rely on the broader statutory architecture for monetary calculation. The explanatory details identify the Sentencing Act 1991 as the source of the penalty unit concept and the Monetary Units Act 2004 as the mechanism for fixing the monetary value of a unit, including Treasurer determinations and publication requirements. The explanatory details supply the value of a unit for the financial years commencing 1 July 2017 and 1 July 2018, and note rounding to the nearest dollar (Explanatory details, Penalty Units).

• Revocation and commencement: The instrument revokes the earlier 2008 Regulations (regulation 4) and has an explicit commencement date of 19 June 2018 (regulation 3). The endnotes record the making and commencing authorities and the sunset provision under the Subordinate Legislation Act 1994, which places a time limit on how long the instrument can remain in force without further action (Endnotes, General information).

• Interpretation and statutory form: The endnotes include references to the Interpretation of Legislation Act 1984 and note style-change authorisations and how headings, notes, punctuation and provision numbers are taken to form part of the Statutory Rule where applicable, which affects how the instrument is read and applied (Endnotes, Interpretation of Legislation Act 1984).

These concepts combine to make the Regulations a device for setting fixed, standardised infringement penalties that are integrated with the existing penalty-unit and subordinate-legislation frameworks. The Regulations specify which sections of the parent Act attract a given number of penalty units, leaving the rest of the infringement-notice mechanics and the substantive definitions of the offences to the Act itself and other legislative instruments cited in the explanatory material.

Two practical corollaries follow from the conceptual design. First, any change to the dollar value of these penalties will typically occur through the statutory process by which the Treasurer fixes the penalty unit value, rather than by amending the Regulations to alter numbers of units (Explanatory details, Penalty Units). Second, the Regulations’ scope is limited to penalty levels; they do not attempt to restate or supplement procedural rules for issuing, serving, challenging or withdrawing infringement notices, which are matters within Division 2 of Part 5A of the parent Act (regulation 5).

The Regulations affect three categories of actors directly, and others indirectly.

1. Persons committing the named infringement offences under the Impounding of Livestock Act 1994: The Regulations specify the monetary consequence, expressed as penalty units, for offences listed at the cited sections of the Act, namely section 25(e), section 25(g), section 25A and section 25B (regulation 5). Any person who is alleged to have committed an infringement offence under those sections and who is dealt with by the Division 2 infringement-notice procedure of the Act will be subject to the prescribed penalty amounts. The Regulations therefore affect the private legal exposure of those persons by standardising the monetary amount that will be prescribed in any infringement notice process under the Act.

2. Enforcement and administrative bodies that exercise the Act’s infringement-notice powers: While the Regulations do not identify a particular enforcement agency, they operate as the pricing schedule for the infringement-notice mechanism in Division 2 of Part 5A of the Act (regulation 5). Any body authorised by the Act to issue infringement notices under that Division will apply these prescribed penalty unit figures when deciding the monetary amount stated on an infringement notice. The Regulations therefore change an administrative variable those bodies must apply when processing infringement notices.

3. Courts, tribunals and lawyers: The Regulations will be relevant to any litigation or administrative review that concerns an infringement notice issued under the Act’s Division 2 procedure, because the notice amount will have been calculated under these Regulations. The amounts and the conversion method into dollars (via the Monetary Units Act 2004 and the Treasurer’s determinations) are therefore elements that counsel, advisers and decision-makers will need to check and rely upon, including checking the correct penalty-unit value for the financial year in which the offence or notice occurs (Explanatory details, Penalty Units).

Indirectly affected parties include persons and businesses in the livestock and agricultural sectors who may be exposed to enforcement activity under the parent Act. The Regulations alter the predictable financial penalty payable on an infringement notice for the listed offences, and thus change the expected compliance cost of the relevant prohibited conduct. The Regulations revoke the prior 2008 Regulations (regulation 4), so any persons or agencies accustomed to the earlier schedule must apply the 2018 schedule from the commencement date (regulation 3).

The Regulations also affect fiscal administrators and budget modelers because the monetary equivalents of the penalty units are determined outside this instrument, by the Monetary Units Act 2004 process, which requires Treasurer determinations and publication before 1 June in the preceding financial year (Explanatory details, Penalty Units). That mechanism means that the actual dollar cost to an offender, and the nominal revenue the State might collect from infringement notices, can shift annually without amendment of the Regulations themselves, by operation of the penalty-unit valuation regime.

Finally, the endnotes state the instrument will sunset 10 years after making, that is, on 19 June 2028, unless further action is taken under the Subordinate Legislation Act 1994 (Endnotes, General information). That sunset date imposes a temporal limit on the Regulations’ effect and therefore matters to anyone planning compliance or enforcement strategies over the medium term.

The Regulations themselves do not create new affirmative duties or give new operational rights; rather they set the monetary amounts, expressed in penalty units, that apply when the infringement-notice mechanism in the Impounding of Livestock Act 1994 is used. The key functional duties and rights therefore derive from the interaction between these Regulations and the parent Act and related statutes cited in the explanatory material.

Duties imposed on alleged infringers: The Regulations set the amount that an alleged infringer must pay if the infringement-notice procedure of Division 2 of Part 5A is followed and the person elects, or is required, to discharge liability by payment of the prescribed penalty. The prescribed penalties are 2 penalty units for offences against section 25(e), 2 penalty units for section 25(g), 2 penalty units for section 25A, and 4 penalty units for section 25B (regulation 5). The duty to pay, and any timeframes, enforcement consequences, ability to contest a notice, or alternatives, remain governed by the parent Act’s Division 2 and other procedural provisions; the Regulations do not restate those processes (regulation 5).

Rights and administrative duties of authorities: Authorities authorised under the parent Act to issue infringement notices must apply these prescribed penalty unit amounts when they issue notices under Division 2 of Part 5A. The Regulations therefore create a mandatory administrative parameter that decision-makers must use when setting the monetary amount on an infringement notice. The Regulations do not, however, define which agency or officer is empowered to make those decisions; that allocation of enforcement responsibility is within the parent Act.

Calculation obligations and administrative duties relating to monetary conversion: The explanatory details specify the calculation method for converting penalty units to dollars by reference to the Monetary Units Act 2004 and the Treasurer’s determinations, and note that amounts may be rounded to the nearest dollar (Explanatory details, Penalty Units). This creates an administrative duty for those issuing or enforcing infringement notices to use the correct penalty-unit value for the relevant financial year and to apply the statutory rounding rule where applicable. The Treasurer’s publication requirement, to be satisfied before 1 June in the preceding financial year, creates a timing obligation on administration and on parties who need the current value.

Revocation and sunset rights: By revoking the 2008 Regulations (regulation 4), the instrument removes the prior schedule and replaces it with this schedule. The instrument also carries an implicit temporal duty on regulators to monitor the sunset date under the Subordinate Legislation Act 1994, being 19 June 2028, after which the Regulations will cease unless further action is taken (Endnotes, General information). That creates a planning obligation for the regulatory authority to renew or replace the schedule within the statutory lifecycle, if continuity is desired.

Limits and boundaries: The Regulations do not confer jurisdictional powers, procedural rules, or definitions of the offences themselves. Those substantive rights and obligations, such as what conduct triggers section 25(e) or section 25B liability, are located in the Impounding of Livestock Act 1994. The Regulations therefore function as a pricing instrument within the legal architecture of the Act and the penalty-unit regime, rather than as a source of standalone duties or rights.

The instrument prescribes the infringement penalties as penalty units, not as immediate monetary amounts, and ties enforcement to the infringement-notice process provided in Division 2 of Part 5A of the Impounding of Livestock Act 1994 (regulation 5). The prescribed penalty-unit amounts are: 2 penalty units for offences against section 25(e), 2 penalty units for offences against section 25(g), 2 penalty units for offences against section 25A, and 4 penalty units for offences against section 25B (regulation 5).

Monetary calculation and rounding: The explanatory details instruct that the monetary amount of a prescribed penalty unit is to be calculated under section 7 of the Monetary Units Act 2004 by multiplying the number of penalty units by the value of a penalty unit for the relevant financial year, and that the result may be rounded to the nearest dollar (Explanatory details, Penalty Units). The explanatory details provide the value of a penalty unit for the financial years commencing 1 July 2017 and 1 July 2018, as $158.57 and $161.19 respectively, which allows immediate conversion to dollars for those years. For example, as at the financial year commencing 1 July 2018, a 2 penalty unit prescribed infringement penalty converts to $322.38 before rounding, and a 4 penalty unit penalty converts to $644.76 before rounding, using the supplied $161.19 unit value (Explanatory details, Penalty Units). The Regulations require the use of whatever penalty-unit value the Treasurer fixes for future years, and that value must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year (Explanatory details, Penalty Units).

Enforcement mechanism and legal effect: The Regulations operate for the purposes of the infringement-notice regime in Division 2 of Part 5A, which implies that offenders dealt with under that Division may be offered or required to respond to an infringement notice carrying the prescribed penalty amount. The Regulations do not set out the procedural steps for issuing, withdrawing, or contesting an infringement notice, nor do they set criminal penalties beyond the infringement framework; those matters remain within the Act’s Division 2 and other relevant parts. Consequently, enforcement action will follow the Act’s prescribed steps, with these Regulations providing the penalty-unit amounts to be used in the infringement notices.

Administrative implications: Enforcement bodies must ensure that the monetary amount on any infringement notice reflects the correct multiplication of the prescribed penalty units by the correct penalty-unit value for the applicable financial year and that the published figure is used, subject to rounding. Because penalty-unit values may change annually under the Monetary Units Act 2004, the dollar value an offender must pay for the same number of penalty units will vary over time without amendment to these Regulations. Enforcement agencies will therefore need procedures to reference the current penalty-unit value at the time of issuing a notice.

Revenue and collection: The Regulations simply prescribe the penalty-unit amounts; they do not allocate where revenue from infringement notices is to be directed, nor do they discuss recovery or enforcement costs. Recovery procedures, late payment consequences, or the relationship between payment and any court process are matters left to the Act and to general enforcement practice. The endnotes and explanatory details do not provide further instruction on collection or disposition.

Sunset and continuity: The Regulations will sunset on 19 June 2028 unless renewed or replaced under the Subordinate Legislation Act 1994 (Endnotes, General information). The sunset creates a point at which the prescribed infringement penalties will lapse in the absence of further legislative action, which affects long-term enforcement planning and any reliance on the current schedule for forecasting compliance costs.

The Regulations are explicitly framed to interact with several other statutes and legal instruments, and their operation depends on those cross-references.

Parent Act operation: The Regulations are made under the authority of section 34 of the Impounding of Livestock Act 1994 (regulation 2). They prescribe infringement penalties for the purposes of Division 2 of Part 5A of that Act (regulation 5). Therefore, substantive offence elements, procedural rights and obligations for issuing, contesting, withdrawing or enforcing an infringement notice are governed by the parent Act; the Regulations supply only the numerical penalty amounts to apply within that statutory framework.

Penalty-unit regime: The monetary conversion mechanism for the prescribed penalties is governed by two pieces of subordinate and primary legislation cited in the explanatory details. The Sentencing Act 1991 is identified as the source of the penalty unit concept, and the Monetary Units Act 2004 is identified as the mechanism for fixing the monetary value of a penalty unit and for requiring publication of the value prior to the relevant financial year (Explanatory details, Penalty Units). The Regulations therefore operate in tandem with the penalty-unit framework; any change in the monetary amount of these penalties will typically come via the Treasurer’s determination under the Monetary Units Act, rather than by amendment of these Regulations.

Subordinate Legislation Act interaction: The endnotes note that these Regulations will sunset 10 years after making under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That interaction imposes a statutory lifecycle on the instrument and requires either legislative action to renew or to replace the schedule before the sunset if continuity is required. That lifecycle is external to the parent Act but directly affects the Regulations’ durability.

Interpretation of Legislation Act implications: The endnotes address how the Interpretation of Legislation Act 1984 affects the form, headings, punctuation and other stylistic elements of statutory rules, and how examples, notes and headings are treated as part of the instrument. These interpretive rules affect how the Regulations and their explanatory material are read and legally construed (Endnotes, Interpretation of Legislation Act 1984). They confirm that headings, notes, and other material included in the Statutory Rule are part of the rule where the ILA allows, which bears on how courts or administrators might interpret the instrument’s provisions and the explanatory items.

Revocation of prior regulations: The instrument revokes the Impounding of Livestock Regulations 2008 (regulation 4). That revocation has the legal effect of replacing the prior penalty schedule with the new one set out in these Regulations; any residual or transitional provisions from the 2008 Regulations are not restated here. Where the parent Act or other laws contain transitional or savings provisions, those provisions would govern the treatment of matters in progress, but the Regulations themselves simply record the revocation.

Administrative and publication obligations: The explanatory details require that the Treasurer fix and publish the penalty-unit value under the Monetary Units Act 2004 before 1 June in the preceding financial year. That requirement links the operation of these Regulations to the public-administration processes under the Monetary Units Act, and creates a timetabled interaction between the monetary conversion mechanism and the Regulations’ application in practice.

Absence of interaction with other enforcement statutes: The Regulations do not purport to modify penalties or enforcement procedures contained in other statutes, nor do they claim to interact with general revenue or recovery laws. They are narrowly tied to the parent Act and to the penalty-unit mechanism identified in the explanatory details. Any interplay with general civil or criminal enforcement processes would therefore be mediated by the parent Act or by general statutory enforcement regimes, not by these Regulations themselves.

The Regulations are the 2018 Statutory Rule (S.R. No. 66/2018) and, as of the version recorded, there are no amendments made to these Regulations by subsequent statutory rules, subordinate instruments or Acts (Table of Amendments). The instrument revokes the earlier Impounding of Livestock Regulations 2008 on commencement (regulation 4). The stated making and commencement dates are recorded in the endnotes: made on 29 May 2018 by the Lieutenant-Governor as the Governor’s deputy, with the advice of the Executive Council, under section 34 of the Impounding of Livestock Act 1994, and coming into operation on 19 June 2018 (Endnotes, General information).

Two time-related points from the explanatory material and endnotes are relevant to amendment and lifecycle considerations. First, the instrument will sunset 10 years after making, that is on 19 June 2028, under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). A sunset requires legislative action if continuity of the infringement-penalty schedule is to be preserved beyond that date. Second, the explanatory details anticipate that the monetary value of penalty units is fixed annually by the Treasurer under the Monetary Units Act 2004, and that those values are published before 1 June in the preceding financial year (Explanatory details, Penalty Units). This annual update mechanism can change the dollar equivalent of the penalties without any amendment to the nominal penalty-unit figures in these Regulations.

The Table of Amendments, as printed in the statutory rule, records that there are no amendments to these Regulations up to the version date. The section headed "Amendments Not in Operation" also records that there were no amendments not in operation at the date of the publication (Table of Amendments; Amendments Not in Operation). The Explanatory details note that the Regulations provide for penalties by reference to the penalty-unit system within the meaning of section 110 of the Sentencing Act 1991 and that the calculation is to be made under section 7 of the Monetary Units Act 2004 (Explanatory details, Penalty Units).

Because the instrument revokes the 2008 Regulations, any differences between the 2008 schedule and the 2018 schedule would only be apparent by comparing the two instruments; the 2018 Regulations do not contain a transitional schedule in the text of this Statutory Rule. Any transitional arrangements would therefore depend on the parent Act’s provisions or on separate instruments, none of which are contained in this Statutory Rule. The absence of recorded amendments indicates that, as at the version date of 19 June 2018, the drafters did not foresee immediate changes to the prescribed penalty-unit numbers beyond relying on the standard annual monetary-unit adjustment.

The statutory rule and its endnotes do not record any judicial decisions, appeals, or tribunal determinations relating to these Regulations. The text does not cite or rely upon any case law, and the Explanatory details and Table of Amendments state that there are no amendments and no amendments not in operation at the date of publication. Accordingly, within the unamended statutory text and its explanatory material as provided, there is no litigation history recorded or referred to.

Because the Regulations operate as a schedule of penalty-unit amounts for the purposes of the infringement-notice regime in Division 2 of Part 5A of the Impounding of Livestock Act 1994, challenges to the use or validity of these penalty amounts would most likely arise in proceedings that test the application of the parent Act’s infringement procedures or challenge whether an infringement notice properly applies the prescription in regulation 5. However, the Regulations themselves do not set procedural rules for contesting notices, nor do they provide a forum for judicial review; those matters are governed by the parent Act and by general administrative law, which are not reproduced in this Statutory Rule.

The absence of recorded litigation in the instrument’s endnotes means there are no reported judicial interpretations of how these particular penalty-unit prescriptions should be applied. Any litigation that post-dates the version provided would not be reflected here. Practitioners relying on these Regulations for litigation or advisory purposes will need to consult the Impounding of Livestock Act 1994 for the infringement-notice process and any procedural protections that might give rise to contestation, and to check case law outside this instrument for developments concerning the operation of infringement notices, penalty-unit calculations, or other enforcement issues.

In short, the Regulator’s text contains no litigation citations and no recorded disputes about the validity or application of the prescribed penalty-unit figures as of the version date. Any litigation history relevant to these Regulations must be sought in court records or in commentary on the parent Act’s infringement-notice scheme, which are outside the text of this Statutory Rule.

This section flags points where the Regulations’ narrow drafting and reliance on external instruments can create traps or unexpected effects for practitioners and affected parties. All points are grounded in the instrument’s text and explanatory material.

1. Penalty expressed in penalty units, not dollars, so value changes without amendment: The Regulations prescribe penalties as numbers of penalty units (regulation 5). The dollar equivalent depends on the Treasurer’s annual determination under the Monetary Units Act 2004 and must be published before 1 June in the preceding financial year (Explanatory details, Penalty Units). This means the dollar cost of the same infringement-unit figure can change annually without any amendment to the Regulations. Practitioners must check the current penalty-unit value at the time of the alleged offence or at the time an infringement notice is issued.

2. Rounding may alter the payable amount by a small margin: The Explanatory details allow amounts to be rounded to the nearest dollar (Explanatory details, Penalty Units). Rounding can produce a minor discrepancy between the raw multiplication and the published payable amount. Administrators and payers should apply the statutory rounding rule when calculating actual payable amounts.

3. The Regulations do not repeat or restate the infringement-notice procedures: The prescribed penalty amounts operate "for the purposes of Division 2 of Part 5A of the Impounding of Livestock Act 1994" (regulation 5). The Regulations do not detail who may issue a notice, time limits, appeal rights, or consequences of non-payment; those are in the parent Act. Assuming procedural features or remedies from the Regulations alone risks error. Advisers must work with the parent Act to advise on rights, time limits and remedies.

4. Revocation of the 2008 Regulations: The 2008 Regulations are revoked on commencement (regulation 4). If past conduct spans the commencement date or if enforcement actions were started under the 2008 schedule, transitional or savings provisions in the parent Act or other instruments may be relevant, but this Statutory Rule contains no transition clauses. Parties must check whether ongoing matters are governed by the old or the new schedule and review the parent Act for transitional rules.

5. Sunset date requires forward planning: The instrument will sunset on 19 June 2028 (Endnotes, General information). Without legislative action before that date, the prescribed penalty schedule will lapse, creating uncertainty for enforcement agencies and for subjects of enforcement. Agencies should plan to review or renew the schedule well before the sunset date.

6. No guidance on allocation or use of collected funds: The Regulations prescribe the penalty-unit amounts but do not allocate revenue or discuss collection or enforcement costs. Assumptions about revenue treatment or offsets against administrative costs are not supported by the Regulations themselves.

7. Limited public guidance in the instrument: Aside from the prescribed penalty-unit numbers and the monetary unit values for two specific financial years, the instrument provides little operational guidance. For example, it does not specify how to handle situations where multiple offences or multiple notices are issued, nor does it address aggregation of penalties. Those matters are likely within the parent Act or general enforcement practice, not the Regulations.

8. Potential for mismatch in timing between offence date and published penalty-unit value: Because the Treasurer must publish a penalty-unit value before 1 June in the preceding financial year, but offences and notices can occur at any time, practitioners must verify which financial-year figure applies to the calculation. The text does not specify whether the relevant value is the value at the time of the offence, the time of the notice, or the time of payment; resolving that question requires reference to the Monetary Units Act 2004 or to the parent Act where it addresses such timing issues.

9. No explicit statement of enforcement body or issuing authority: While the Regulations apply to Division 2 of Part 5A, they do not name the specific enforcement agency or officer responsible for issuing infringement notices. Practitioners must consult the parent Act to identify enforcement responsibility and delegated powers.

In sum, the main “gotchas” flow from the Regulations’ minimalist design: they set unit-based penalty figures and rely on other statutes and the parent Act for the rest of the enforcement architecture. Users must therefore consult the parent Act and the Monetary Units Act 2004 to avoid timing and calculation mistakes, and to understand procedural rights and obligations.

Compliance with the effect of these Regulations requires attention to three linked legal instruments: the Impounding of Livestock Act 1994 (the parent Act), the Monetary Units Act 2004 (for the monetary conversion of penalty units), and the Sentencing Act 1991 (for the penalty unit concept). The Regulations themselves prescribe the number of penalty units that apply to specified infringement offences under the parent Act, and compliance steps flow from that specification (regulation 5; Explanatory details, Penalty Units).

Practical steps for an individual or business potentially affected by the listed sections:

1. Identify whether the conduct is captured by the specified sections of the parent Act: The Regulations apply to offences against section 25(e), section 25(g), section 25A and section 25B of the Impounding of Livestock Act 1994 (regulation 5). To determine whether an incident attracts a prescribed infringement penalty, consult the parent Act to ascertain the conduct elements, defences, and relevant section definitions. The Regulations do not define the substantive offences.

2. If an infringement notice is received, check the legal basis: An infringement notice issued under Division 2 of Part 5A should reference the relevant section of the parent Act and state the prescribed number of penalty units. Confirm the notice is issued under the correct statutory provision and that it cites the correct prescribed penalty-unit figure as set out in regulation 5.

3. Convert penalty units to the correct dollar amount for the applicable financial year: Use the penalty-unit value fixed under the Monetary Units Act 2004 for the relevant financial year, which is published by the Treasurer before 1 June in the preceding financial year, and multiply that value by the number of prescribed penalty units (Explanatory details, Penalty Units). Apply statutory rounding to the nearest dollar where appropriate. For reference, the explanatory material supplies the unit values of $158.57 for the financial year commencing 1 July 2017 and $161.19 for the financial year commencing 1 July 2018 (Explanatory details, Penalty Units).

4. Determine available responses under the parent Act’s infringement scheme: The Regulations set the penalty figure; the options for immediate payment, seeking review, electing to have the matter heard in court, or other statutory alternatives are governed by Division 2 of Part 5A of the Impounding of Livestock Act 1994. Check the parent Act for time limits, dispute mechanisms, and consequences of non-payment.

5. Keep records and timelines: Document the date of the alleged offence, the date of service of any infringement notice, the financial-year penalty-unit value used, the conversion to dollars, and any payment, election, or challenge communications. Because the monetary value may differ depending on the penalty-unit determination in force at the relevant time, accurate records will assist in any dispute.

6. Check for transitional or revocation effects if the matter spans the 2018 commencement: For incidents occurring before and after 19 June 2018, determine whether the prior 2008 Regulations applied at the relevant time (regulation 4). The Regulations do not include transitional clauses, so check the parent Act for guidance on how to treat matters that bridge the revocation date.

7. For enforcement agencies and administrators, adopt administrative procedures to ensure correct application of the schedule: Authorities issuing infringement notices should maintain an up-to-date internal reference to the current penalty-unit value as published by the Treasurer and apply the statutory rounding rule in converting prescribed units to payable amounts. Administrative forms and templates for infringement notices must reflect the correct number of penalty units, the relevant section citation, and the correct dollar figure.

8. Monitor the sunset date and legislative changes: The Regulations will sunset on 19 June 2028 unless renewed or replaced under the Subordinate Legislation Act 1994 (Endnotes, General information). Compliance strategies and enforcement policies should anticipate the need for legislative renewal or replacement to avoid a lapse in authorised penalty schedules.

9. Seek legal advice when in doubt: Because the Regulations do not reproduce procedural or substantive rules from the parent Act, when there is uncertainty about rights, time limits, or defences, consult the Impounding of Livestock Act 1994 and, if necessary, obtain legal advice to determine the appropriate response within the infringement-notice framework.

Following these steps will align a person’s or agency’s practical response with the Regulations’ limited function as a prescribed penalty-unit schedule and with the related statutory processes that determine monetary equivalents and procedural rights.
