#### 41 Delegation by Secretary
(1) Subject to subsection (2), the Secretary may, by signed instrument, delegate any or all of the Secretary’s powers under this Act (except the power under subsection 42A(5)) to:
(a) an SES employee, or acting SES employee, in the Department; or
(b) an APS employee who holds or performs the duties of an Executive Level 1 or 2 position, or an equivalent position, in the Department.
(2) The Secretary may delegate the Secretary’s powers and functions under section 20A only to an SES employee, or an acting SES employee, in the Department.
