What it does
This regulation prescribes charges for matters connected with the administration of the Imported Food Control Act 1992. The charges are imposed as taxes, specifically as duties of customs within the meaning of section 55 of the Constitution. The instrument is made under the Imported Food Charges (Imposition,Customs) Act 2015 and sets out fixed dollar amounts for four categories of imported food matters, indexed annually by CPI. It also designates the persons liable to pay and provides exemptions where equivalent biosecurity charges have already been paid.
Mechanically, the regulation provides a table in subsection 6(1) with four items. Item 1 imposes a flat $194 fee for an application to enter into a compliance agreement. Item 2 imposes a charge of $3,316 for the administration and ongoing management of two or more relevant arrangements or agreements covering a person in a financial year, provided at least one is a compliance agreement and at least two covered the person immediately before the financial year started. Item 3 imposes a charge of $2,857 for the first compliance agreement covering a person in a financial year where the person is not also covered by an approved arrangement; if the compliance agreement comes into force on or after 1 January, the charge is 50% of that amount. Item 4 imposes a set of graduated charges for the administration of one or more relevant arrangements or agreements that involve at least one compliance agreement but fall outside items 2 and 3, with amounts ranging from $229 to $2,744 depending on whether the first arrangement is a Class 19 Arrangement and whether further arrangements commence before or after 1 January in the financial year.
The regulation also includes indexation of charges on each 1 July from 2024, using the All Groups Consumer Price Index for the weighted average of eight capital cities. However, a transitional provision in section 9 provides that indexation does not apply to items 2, 3 and 4 on the indexation day of 1 July 2025. Exemptions from charges are available where the person has already paid equivalent biosecurity charges under the Biosecurity Charges Imposition (Customs) Regulation 2016 or the Biosecurity Charges Imposition (General) Regulation 2016.
