Imperial Acts Adopting Act 1844

The central concept of the Imperial Acts Adopting Act 1844 is the selective reception of imperial legislation into the law of a colonial jurisdiction. At the time of enactment, Western Australia was a Crown colony without a fully independent legislature, and English law applied generally as received through common law principles (such as the date of settlement reception). This Act provides a specific statutory mechanism to ensure that particular UK Acts of Parliament, some of which may not have been considered part of the received common law or were in the nature of statutory modifications to English law, would have force in the colony. The concept is not one of wholesale adoption of English law; rather, it is a targeted transplantation of discrete statutory provisions. The Act operates by force of its own enactment: once the Governor and Legislative Council passed it, the adopted Acts became WA law without requiring separate colonial enactments of their substantive content. This legislative device was common in 19th century Australian colonies to fill gaps in local statute books where the imperial Parliament had legislated for England but not expressly extended the operation to the colonies. Section 2 introduces the concept of institutional substitution: the Civil Court (which later evolved into the Supreme Court of Western Australia) stands in for the Court of Chancery, and the Advocate-General (an office that existed in early WA but was later superseded by the Attorney-General) stands in for the English Attorney-General. This ensures the adopted Acts can be administered by local institutions. Another concept is that the adoption is subject to the “circumstances of this Colony” - a savings clause that allows local modification in application, though the Act does not specify the precise effect of that qualification. It may operate to render provisions inapplicable if the colonial context (e.g., absence of certain office holders or infrastructure) makes their operation impossible. A further concept is that each adopted Act is carried forward with its own internal provisions intact, including any penalty or enforcement mechanisms, subject to the local jurisdictional substitutions. The Act itself does not enact substantive rules; it is purely a conduit. The concept of adoption also raises questions about repeal and amendment. The note system appended to the official compilation shows that most adopted Acts have been expressly repealed by later WA Acts. However, the Act itself remains on the statute book as a framework; it is not repealed. The ongoing legal effect is that for the four surviving adopted Acts, they continue in force as if they were WA legislation, but their text must be located in the reproduced compilation rather than in the original UK statute books. The Act also illustrates a legislative technique that is now obsolete: modern practice is to enact domestic legislation directly, not to adopt imperial Acts by reference. Nonetheless, the concept of reception of English law has been replaced by the codification and consolidation efforts of the 20th and 21st centuries. The Act’s existence serves as a reminder that some areas of WA property and commercial law still have roots in early Victorian imperial statutes.

The Imperial Acts Adopting Act 1844, by its terms, was addressed to the administration of justice in the Colony of Western Australia. The primary persons affected at the time of enactment were litigants, courts, law officers, and practitioners dealing with the specific matters covered by the adopted Acts - affirmation in lieu of oath, escheat, forfeiture of trust property, abolition of hanging in chains, gaming and usurious securities, capital punishment for letter stealing and sacrilege, bills of exchange, execution of murderers, evidence of previous convictions, right of counsel for felony defendants, mortgage conveyances, recovery of tenements, oaths, custody of infants, debt recovery from real estates, and factors’ advances. In practice today, the Act affects a much narrower group because only four adopted Acts remain in force. Those are the Bills of Exchange (Day for Payment) Act 1836, the Debts Recovery Act 1830, the Debts Recovery Act 1839, and the Factors Act 1842. Consequently, the present-day audience includes: commercial lawyers dealing with bills of exchange presentment and dishonour (the Bills of Exchange Act 1836 specifies the day on which a bill must be presented for payment to an acceptor supra protest or referee in case of need); property lawyers and insolvency practitioners involved in the recovery of debts out of real estate under the Debts Recovery Acts (which provide mechanisms for creditors to reach real property of deceased debtors); and commercial lawyers dealing with factors and mercantile agents under the Factors Act 1842 (which protects bona fide purchasers from agents entrusted with goods). The Act also affects the Civil Court (now the Supreme Court of Western Australia) which must exercise any powers conferred on the Court of Chancery by the surviving adopted Acts. The Advocate-General role has been subsumed by the Attorney-General, but section 2 remains on the statute book. The Act does not impose direct obligations on ordinary citizens; it operates through the adopted substantive Acts. For example, the Factors Act 1842 may affect the rights of buyers and sellers of goods in the ordinary course of business where a factor or agent sells goods without full authority. Similarly, the Debts Recovery Acts may affect executors, administrators, and creditors of deceased estates. The Oaths and Affirmations Acts adopted have been repealed, so Quakers, Moravians, and others seeking to affirm now rely on modern WA legislation (the Oaths, Affidavits and Statutory Declarations Act 2005). The criminal law adopted Acts have been repealed and replaced by the Criminal Code and sentencing legislation. The custody of infants Act has been replaced by the Family Court Act and Guardianship of Infants Act 1926 (which itself may now be superseded). In effect, the Act’s practical reach is confined to niche areas of commercial and property law. Legal professionals, particularly those in the Supreme Court’s probate and commercial lists, and those advising on historical property titles, may need to consult the reproduced imperial Acts. The Act also has symbolic effect for legal historians and those researching the reception of English law in Western Australia.

The Imperial Acts Adopting Act 1844 does not itself create duties or rights; those arise from the substantive provisions of the adopted Acts that remain in force. However, because the Act is the vehicle that gives those Acts legal force in Western Australia, it is the source of their authority. The key duties and rights that currently flow from the Act derive from the four surviving adopted Acts. Under the Bills of Exchange (Day for Payment) Act 1836 (6 & 7 Will. IV c. 58), a duty is imposed on holders of bills of exchange that have been dishonoured to present them for payment to the acceptor supra protest for honour, or to the referees or referee in case of need, on the day required by law. The Act declares what that day is, clarifying the timing obligation. The right of the holder to recover from the parties liable on the bill may depend on compliance. Under the Debts Recovery Act 1830 (11 Geo. IV & 1 Will. IV c. 47) and the Debts Recovery Act 1839 (2 & 3 Vict. c. 60), rights are given to creditors to enforce payment of debts out of the real estate of deceased debtors. These Acts create a duty on executors and administrators to pay debts out of real property if personal estate is insufficient, and they provide a mechanism for creditors to compel sale or recovery of land for debt. The earlier Act facilitates payment of debts out of real estates; the later Act extends and explains its provisions. The Factors Act 1842 (5 & 6 Vict. c. 39) confers important rights on persons who deal with agents entrusted with goods or documents of title. It provides that where an agent is entrusted with goods or documents of title to goods, any sale, pledge, or other disposition made by the agent in the ordinary course of business is valid in favour of a bona fide purchaser for value without notice. This creates a right in the purchaser to retain the goods free of the principal’s claims. The corresponding duty on the principal is to bear the risk of the agent’s misconduct. The Act also gives rights to persons advancing money on the security of goods or documents of title entrusted to an agent. The adopting Act itself imposes only a procedural duty: the Civil Court and Advocate-General must perform the functions that the adopted Acts assign to the Court of Chancery and Attorney-General respectively. This is a duty on public institutions, not on private parties. There is no additional reporting, registration, or filing requirement created by section 1 or 2. The adoption is automatic. The Act also contains no sunset clause or automatic repeal of the adopted Acts; they remain until explicitly repealed by WA legislation. The rights and duties created by the surviving adopted Acts are therefore indefinite. The Act’s preamble recites that it is expedient to adopt these Acts; that is a statement of legislative intent, not a source of rights. The practical significance of these duties and rights is limited by the infrequency of litigation relying on 19th century imperial Acts. However, they remain enforceable and could be invoked in appropriate cases. The Bills of Exchange Act 1836, for example, might affect a party’s rights if a question arises about presentment after dishonour. The Factors Act 1842 could be relevant in disputes over title to goods sold by a mercantile agent.

The Imperial Acts Adopting Act 1844 does not prescribe any penalties itself. Section 1 adopts the “clause, provision, and enactment” of each recited Act, which includes any penalty, forfeiture, or enforcement mechanism contained in those Acts. For the four surviving adopted Acts, the penalty provisions are derived from UK Acts of the 1830s and 1840s. The Bills of Exchange (Day for Payment) Act 1836 is a declaratory Act: it does not impose a penalty but states the law on the day for presentment. Non-compliance may affect the holder’s right to recover (a civil consequence, not a criminal penalty). The Debts Recovery Act 1830 and 1839 are procedural: they provide for enforcement through court orders for sale of real estate, appointment of receivers, and other equitable remedies. The penalty for a personal representative who fails to pay debts in due course is potential personal liability, though this arises from the general law of administration rather than a specific penal clause. The Factors Act 1842 protects bona fide purchasers; the penalty for a factor acting without authority is civil liability in conversion or breach of trust, but the Act itself does not create a criminal offence. The adopted Acts that were repealed included several that carried criminal penalties. For example, the Act abolishing capital punishment for letter stealing and sacrilege (5 & 6 Will. IV c. 81) and the Act amending it (6 & 7 Will. IV c. 4) were substantive criminal law reforms that substituted lesser penalties. These have been repealed by the Sentencing (Consequential Provisions) Act 1995. The Act abolishing hanging in chains (4 & 5 Will. IV c. 26) was similarly repealed. The Act relating to execution and prison discipline for murder (6 & 7 Will. IV c. 30) was repealed by the Criminal Law Consolidation Ordinance 1865. The Gaming, Usurious Securities Act (5 & 6 Will. IV c. 41) rendered securities void in certain cases; its penalty was civil invalidity, and it was repealed in 1985. Enforcement of any surviving provisions is through the ordinary civil jurisdiction of the Supreme Court of Western Australia (as the successor to the Civil Court). Section 2 ensures that the Civil Court can exercise Chancery powers. There is no criminal enforcement under the Act itself. The Act does not create any regulatory body, inspector, or administrative penalty. The only enforcement mechanism is litigation by private parties or, for the Debts Recovery Acts, by creditors against estates. The Oaths Acts (Quakers and Moravians) had provisions that made false affirmations punishable as perjury, but those Acts have been repealed. The Act regarding evidence of previous convictions (6 & 7 Will. IV c. 111) regulated when juries could be informed of prior convictions; its repeal by the Criminal Code Act 1902 means no current penalty flows. In summary, the penalty and enforcement landscape under the Act is minimal. The surviving adopted Acts are mostly concerned with commercial and property rights, where the sanction is civil: loss of rights, invalidity of transactions, or court-ordered remedies. The Act does not impose any monetary fines, imprisonment, or administrative sanctions. Practitioners should be aware that the four surviving Acts are still enforceable in court, and failure to comply with their requirements (e.g., improper presentment of a bill of exchange) could be fatal to a claim.

The Imperial Acts Adopting Act 1844 interacts with other laws primarily through the principle that later WA statutes impliedly or expressly repeal the adopted Acts. The compilation table and notes appended to the Act document the interaction: the majority of the adopted Acts have been expressly repealed by subsequent WA legislation. For example, the Oaths Acts were repealed by the Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005; the Escheat Act by the Statutes (Repeals) Act 2016; the capital punishment abolition Acts by the Sentencing (Consequential Provisions) Act 1995; the gaming securities Act by the Acts Amendment (Gaming and Related Provisions) Act 1985; the criminal evidence and defence Acts by the Criminal Code Act 1902; the mortgage conveyance Act by the Trustee Ordinance 1854; the Tenements Recovery Act by the Courts Legislation Amendment and Repeal Act 2004; the Custody of Infants Act by the Guardianship of Infants Act 1926. These repeals are territorial: they remove the adopted Act from WA law. The four surviving adopted Acts have not been repealed, but they may interact with later WA legislation that covers similar subject matter. The Bills of Exchange (Day for Payment) Act 1836 coexists with the Bills of Exchange Act 1909 (Cth), which is a Commonwealth law covering cheques and bills of exchange. However, the 1836 Act addresses a narrow point (presentment after dishonour for honour) that may not be fully covered by the Commonwealth Act. To the extent of any inconsistency, the Commonwealth Act would prevail under section 109 of the Constitution if it is a valid law of the Commonwealth, but the 1836 Act operates as WA law on a matter not exhaustively covered. The Debts Recovery Acts 1830 and 1839 interact with the Administration and Probate Act 1919 (WA) and the Trustees Act 1962 (WA). These modern Acts provide comprehensive rules for the administration of deceased estates, including the payment of debts out of real estate. The surviving imperial Acts may be considered as supplementary or, in some respects, superseded by the later codification. However, they remain on the statute book and could potentially be invoked if the modern Acts do not cover a particular point. The Factors Act 1842 interacts with the Sale of Goods Act 1895 (WA) (based on the UK Sale of Goods Act 1893) and the Personal Property Securities Act 2009 (Cth) (PPSA). The PPSA, which commenced in 2012, reformed the law of security interests in personal property, including goods. The Factors Act 1842 provides protection for buyers who acquire goods from a mercantile agent in the ordinary course of business. The PPSA contains similar protections and may have displaced the Factors Act to some extent. However, the Factors Act 1842 remains in force and could apply to transactions not covered by the PPSA or where the Commonwealth Act does not apply (e.g., certain overseas transactions). The Act also interacts with the common law. The adopted Acts are statutory modifications of the common law. For example, the Factors Act 1842 limits the common law principle that a person cannot give better title than they have (nemo dat quod non habet) by allowing a factor to pass good title to a bona fide purchaser. The adopting Act itself is a law of WA, so it sits within the hierarchy of laws as an Act of the local Parliament (albeit from 1844). The Statute Law Revision Act 1970 inserted the short title but did not otherwise affect the operation. The Statutes (Repeals) Act 2014 repealed certain provisions of the adopting Act? No, the table shows that the 2014 Act repealed s.14(1)(c) and (d) - but that refers to a separate Act, not a repeal of the Imperial Acts Adopting Act itself; those repeals were of other adopted Acts. The Act itself has not been repealed.

The Imperial Acts Adopting Act 1844 has a sparse amendment history. The Act was originally enacted as 7 Vict., No. 13, receiving assent on 30 May 1844. The only direct amendment to the Act itself is the insertion of section 5 (the short title) by the Statute Law Revision Act 1970 (No. 10 of 1970), which commenced on 29 April 1970. Section 5 now provides that the Act may be cited as the Imperial Acts Adopting Act 1844. Before 1970, the Act likely had no short title; it would have been referred to by its regnal year and chapter number. The amendment history of the Act is therefore minimal. The more significant amendment history concerns the list of adopted Acts. Since 1844, various WA statutes have repealed individual adopted Acts. The compilation table notes these repeals across multiple decades: the Trustee Ordinance 1854 (repealed the mortgage conveyance Act), the Criminal Law Consolidation Ordinance 1865 (repealed one Act), the Criminal Code Act 1902 (repealed two Acts), the Prisons Act 1903 (purported to repeal one, though it had already been repealed), the Guardianship of Infants Act 1926 (repealed one), the Acts Amendment (Gaming and Related Provisions) Act 1985 (repealed one), the Sentencing (Consequential Provisions) Act 1995 (repealed three), the Courts Legislation Amendment and Repeal Act 2004 (repealed one), the Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005 (repealed three), the Statutes (Repeals) Act 2014 (repealed two: s.14(1)(c) and (d) - likely the Quakers and Moravians Act 1833 and the Escheat and forfeiture Act? Actually from the notes: note 2 says the Quakers and Moravians Act 1833 was repealed by the Oaths, etc. Act 2005; note 3 says the Escheat Act was repealed by Statutes (Repeals) Act 2016. So the 2014 repeal is of something else - possibly a different adopted Act. The table shows 2014 Act s.14(1)(c) and (d) - but the notes do not identify what those paragraphs repealed. It may be that the 2014 Act repealed two adopted Acts that were not identified in the notes. However, the notes only list specific repeals for each adopted Act; the 2014 repeal is mentioned in the compilation table but without a note linking it to a specific adopted Act. This omission suggests careful cross-checking is required. In any case, the effect is that today, only four adopted Acts remain. The Act itself has not been repealed or amended in substance, only the short title was added in 1970. The Act is still a current law of Western Australia. The Western Australian Parliamentary Counsel’s Office maintains a compilation that includes the four surviving imperial Acts in a separate document. The compilation of the Act itself is up to date as at the date of the last amendment (1970). No further amendments are anticipated. The Act could be repealed by a future statutes repeal Act as part of ongoing law reform efforts to remove obsolete legislation. The Law Reform Commission of Western Australia has noted the existence of such old Acts.

The Imperial Acts Adopting Act 1844 has generated no reported litigation directly concerning its own interpretation. The Act is a machinery statute, and any litigation that arose from the adopted Acts would likely have been cited under the name of the adopted Act rather than the adopting Act. For example, cases involving the Factors Act 1842 in Western Australia would be decided under that Act, not the Imperial Acts Adopting Act. Similarly, disputes about bills of exchange presentment would rely on the Bills of Exchange (Day for Payment) Act 1836. Because the Act itself does not create substantive rights, there is no reported case law that turns on the meaning of section 1, 2, 3, or 4. The most likely area for litigation involving the Act would be a dispute about whether a particular UK Act was validly adopted by the 1844 Act, or whether the “circumstances of this Colony” qualification rendered an adopted Act inapplicable. No such case is reported in the public record. Given the age of the Act and the fact that most adopted Acts have been repealed, the potential for future litigation is low. However, the four surviving adopted Acts could be litigated. For instance, a dispute over the validity of a sale by a factor might turn on the Factors Act 1842. If a party argued that the Factors Act 1842 does not apply in WA because it was not properly adopted, the Imperial Acts Adopting Act 1844 would be directly in issue. That argument is unlikely to succeed given the Act’s plain language and long acceptance. The Act has been cited in passing in some historical legal articles, but not in contemporary case law. The notes in the compiled Act indicate that two of the adopted Acts have been reproduced as at 26 October 1999 in a document called “Imperial Acts Adopted”. This suggests that the Parliamentary Counsel considers them current. There are no known cases where the applicability of the 1844 Act was challenged. The Act’s litigation history is essentially a null set. Practitioners should not expect to find any authoritative judicial interpretation of the Act. If a question arises about the operation of the Act, it would be resolved by ordinary principles of statutory interpretation: the text is clear, the purpose is evident, and the context (including the preamble) supports a broad adoption subject to local circumstances. The lack of litigation is itself informative: the Act has operated smoothly for 180 years without controversy. That is not to say it is immune to challenge, but the probability is low. Should a case arise, courts would likely treat the Act as a straightforward piece of reception legislation and give effect to its terms without deviation.

Several features of the Imperial Acts Adopting Act 1844 could catch out the unwary practitioner. First, the Act remains in force despite its age and the repeal of most of its adopted Acts. Many practitioners assume that imperial Acts of the 1840s have no modern application, but four adopted Acts survive: the Bills of Exchange (Day for Payment) Act 1836, the Debts Recovery Act 1830, the Debts Recovery Act 1839, and the Factors Act 1842. Relying on the assumption that all imperial Acts are obsolete could lead to a missed argument or a procedural error. Second, the text of these four surviving Acts is not found in the official WA legislation database as separate stand-alone Acts; they are reproduced in a compilations document called “Imperial Acts Adopted” maintained by the Parliamentary Counsel’s Office. A lawyer searching for “Factors Act 1842” on the WA legislation website may not find it directly; they need to locate the “Imperial Acts Adopted” document. That document is not a published Act but a compilation of the imperial Acts as they apply in WA. Third, the Act’s section 2 substitution of “Civil Court” for “Court of Chancery” may cause confusion today. The Civil Court of 1844 was the predecessor of the Supreme Court. The Supreme Court now has all the jurisdiction of the former Court of Chancery, but a practitioner might overlook that the adopted Acts refer to the Court of Chancery’s powers and need to confirm that the Supreme Court holds those powers. Fourth, the phrase “so far as they can be applied respectively to the circumstances of this Colony” in section 1 is a qualification that has never been judicially defined. It could be argued that a provision of an adopted Act is inapplicable because of local conditions (e.g., absence of certain public officials). This provides a potential escape clause, but its scope is uncertain. Fifth, the Act’s preamble lists the adopted Acts by their short titles and regnal years. Some of those titles are abbreviated and may not match modern citation forms. For example, the Factors Act 1842 is cited as “5 & 6 Vict. c. 39” in the preamble. A practitioner relying on that Act must ensure they have the correct imperial version, as the UK text may have been amended before 1844 or after. The adoption is of the Act as it stood at the time of the imperial enactment, not as subsequently amended by the UK Parliament. Sixth, the adoption is of the entire Act, but subsequent WA repeals may have removed only parts. The notes show that for some adopted Acts, the repeal was of the Act “so far as it was a part of the law of WA”. For the surviving Acts, no such partial repeal has occurred, but there could be implicit repeal by later inconsistent WA legislation. For instance, the PPSA may have impliedly repealed parts of the Factors Act 1842. Whether the old Act survives in whole or in part is a question of statutory construction. Seventh, the short title of the adopting Act (Imperial Acts Adopting Act 1844) might be confused with the “Imperial Acts Adopted” document. They are different: the Act is the machinery; the document is the compiled text. Eighth, the Act does not have an expiry or sunset date. It will continue indefinitely until explicitly repealed. Ninth, the Act’s compilation table indicates that section 5 was inserted in 1970; before that, the Act may have been cited without a short title. Old references to “7 Vict. No. 13” are still valid. Tenth, the Act does not provide for the adoption of any later imperial Acts; it is closed. If a practitioner finds an imperial Act that is not recited, it cannot be relied upon under this Act, even if it relates to the same subject matter.

Compliance with the Imperial Acts Adopting Act 1844 is not a matter of filing a return or obtaining a permit. The Act itself imposes no ongoing obligations on private persons. Compliance means ensuring that any action taken under the four surviving adopted Acts conforms to their requirements. For the Bills of Exchange (Day for Payment) Act 1836, if a bill of exchange has been dishonoured and a party wishes to present it for payment to an acceptor supra protest or referee in case of need, they must do so on the day required by law. That day is determined by the Act; practitioners should locate the precise text of the 1836 Act in the “Imperial Acts Adopted” compilation and follow the presentment rules. Failure to comply could affect the holder’s right to recourse against prior parties. For the Debts Recovery Acts 1830 and 1839, a creditor seeking to enforce a debt against the real estate of a deceased debtor must use the procedure provided in those Acts. This may involve applying to the Supreme Court for an order for sale or for the appointment of a receiver. However, because these Acts are old, the modern practice may be governed by the Administration and Probate Act 1919 or the Supreme Court Rules. The safe approach is to check whether the modern WA legislation has superseded the imperial Acts. If the modern Acts provide a complete code, then compliance with the modern Act is sufficient. If the imperial Acts add a remedy not available under modern law, a creditor may elect to proceed under the imperial Act. In that case, they must follow the specific steps: e.g., for the Debts Recovery Act 1830, the creditor may need to file a bill or petition in equity, or take other steps as outlined in the Act. The Act also gives powers to the Court of Chancery; those powers are now exercised by the Supreme Court. Practitioners should check that any orders sought are within the Supreme Court’s equitable jurisdiction. For the Factors Act 1842, a person who buys goods from a mercantile agent in good faith and without notice of the agent’s lack of authority will be protected. Compliance for the buyer is simply to act in the ordinary course of business and pay value. For the principal who entrusts goods to a factor, the duty is to ensure that the agent does not have apparent authority that could mislead third parties. The principal can protect themselves by clear instructions and by not providing documents of title that give the appearance of authority. For all four surviving Acts, the first step in compliance is to locate the correct text. The Parliamentary Counsel’s Office has reproduced the Acts as at 26 October 1999. A practitioner should download that compilation and read the exact wording, because the UK versions may have been altered by subsequent UK repeals that do not apply in WA. The adoption is of the Acts as enacted, but the WA compilation may incorporate minor corrections. There is no registration or notification requirement under the adopting Act. There is no annual return, no fee, no licence. The only “compliance” is to be aware that these Acts exist and to apply them correctly when they are relevant. For the many adopted Acts that have been repealed, compliance is irrelevant; they are no longer law. However, a practitioner should verify that a particular adopted Act has not been repealed before relying on it. The compilation table and notes in the official version of the Imperial Acts Adopting Act 1844 are the best source. If an adopted Act does not appear in the repealed list, it may still be in force. For the four surviving Acts, the notes confirm they have been reproduced, indicating they are considered current. In summary, compliance with the Imperial Acts Adopting Act 1844 is passive: it requires knowledge of the adopted Acts that remain, and adherence to their substantive rules when transacting in bills of exchange, factors, or deceased estates.
