Imperial Acts Adopting Act 1836

The statute rests on three discrete legal concepts visible on its face.

1. Adoption by reference. The statute adopts specified Imperial Acts “and every clause, provision and enactment therein respectively contained.” That is textual incorporation by statutory reference: rather than re‑enacting full texts within the local statute book, the Legislature directed the Colonial administration and courts to treat those Imperial Acts as part of the local law, subject to the statutory qualification “so far as they can be applied to the circumstances of the said Colony.”

2. Territorial or contextual limitation. The phrase “so far as they can be applied to the circumstances of the said Colony” introduces a concept of limited applicability. The Act does not make the adopted Acts effective in identical form regardless of local circumstances; it imposes a factual and legal filter. That filter allocates to local decision‑makers (courts, administrators and possibly the Legislature) the task of determining whether and to what extent a particular Imperial provision is adaptable to Western Australian circumstances.

3. Residual and historical continuity. The Act functions as an instrument of legal continuity, preserving or importing then‑contemporary Imperial law into the Colony’s system. The preamble lists measures dealing with estate administration, property, trustees, infants and persons of unsound mind, certain criminal offences (forgery, coin offences, burglary historically), commercial procedural matters (protesting bills of exchange), prescription and limitation rules, and civil procedure. The compilation notes reveal that this was a one‑time, historically contextual adoption; later local enactments either reproduced, amended or repealed those provisions (for example the Trustee Ordinance 1854 or the Criminal Code Act 1902). The Act therefore embodies a legal mechanism for establishing a starting body of law in a colony by adopting a specific set of Imperial statutes.

Ancillary concepts in the notes and table include:

• Reproduction and recordation: certain adopted Imperial Acts “have been reproduced” as part of a document entitled “Imperial Acts Adopted” (reproduced as at 26 October 1999), indicating that copies of the adopted texts have been preserved in the statutory record.
• Partial adoption or partial repeal: the notes repeatedly say “so far as it was a part of the law of WA” certain sections were subsequently repealed, signalling that adoption could be partial or that subsequent local statute law selectively displaced adopted provisions.
• Subsequent statutory modification: the compilation table records later Western Australian enactments (for example Criminal Code Act 1902 s. 3 & 3rd Schedule; Statute Law Revision Act 1970 s. 3; Statutes (Repeals) Act 2014 s. 14(1)(a) and (b)) which respectively amended or removed some adoption consequences or altered the scope of the original adoptions.

Taken together, these concepts frame the statute as an historical importation mechanism rather than a contemporary code of rights or duties; its interpretive questions are therefore about whether a particular imported clause remains in force and how readily it can be applied to local fact patterns, given later local legislation.

The Act primarily affects those who administer justice and those whose legal rights and obligations derive from the Imperial Acts listed in the preamble, but the statute’s effect differs by role because the statute itself performs an adoption function rather than setting out direct obligations.

• Courts and judges. The courts of the Colony (and in modern terms, courts of Western Australia) are addressees of the instruction to apply the adopted Imperial Acts “in the Administration of Justice.” Those courts therefore decide whether and how an imported Imperial provision is “applicable to the circumstances of the said Colony.” The Act places on judicial officers an interpretive task: to treat the recited Imperial Acts as part of local law where appropriate.

• Legal practitioners. Solicitors, barristers, conveyancers and other legal advisers must take account of the adopted Imperial Acts when advising on issues of trusts, succession, conveyancing, limitation, bills of exchange, and other subjects listed in the preamble , but only to the extent those adopted Acts remain in force and have not been displaced by later Western Australian statutes. The compilation notes flag many areas where later local statutes have replaced or repealed adopted Imperial provisions. Practitioners need to check the notes and local repeals before relying on an adopted Imperial provision.

• Litigants in affected subject areas. Persons involved in disputes over estates, trusteeship, infants’ property, limitation and prescription of claims, bills of exchange protests, certain historical criminal matters (for example forgery as listed), or procedural matters might be affected if the relevant adopted Imperial provision remains applicable. The Act does not itself create new penalties or duties; it imports those that were part of the cited Imperial Acts.

• Public officials and administrators. Officials responsible for probate and administration of estates, registry officers, or officers in customs and excise (historically tied to the oaths and declarations Act that was adopted) were affected historically. The notes identify that the Customs and Excise declarations provision (the Excise Declarations Act 1831) was subsequently repealed by a local Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005. That demonstrates administrative routines created by the adopted Acts can be displaced by later local legislation.

• Law‑makers and drafters. Parliamentary drafters and government legal counsel are affected because the adopted Imperial Acts form a base layer of law; any local reform or consolidation exercises must take account of which Imperial provisions remain in effect and which have been repealed or replaced. The compilation table makes explicit that the Imperial Acts Adopting Act itself has been the subject of later statutory housekeeping (for example No. 10 of 1970 inserted a short title paragraph).

• Subjects of criminal law historically. Several recited Imperial Acts concerned criminal offences (forgery, coin offences, burglary). The notes show many of those criminal provisions were later repealed or consolidated by Western Australian criminal law enactments (for example Criminal Law Consolidation Ordinance 1865 and later Criminal Code Act 1902). The continuing relevancy for modern defendants or prosecutors therefore depends on whether the local legislature preserved or replaced those offences.

Who does not gain new statutory privileges directly from the Act? The Act itself confers no novel rights or remedies beyond importing what the adopted Imperial Acts provided, and it does not purport to alter private contract, ownership or commercial freedom separate from whatever was contained in the adopted statutes. Any practical effect on businesses, creditors, or property owners flows from whether an adopted Imperial provision creates a binding local rule that remains operative after subsequent local legislation.

The Imperial Acts Adopting Act 1836 contains only two operative legal commands on its face, and therefore its “duties and rights” are mostly derivative.

1. Adoption directive. The principal duty placed by the Act is a directional duty on the administrators of justice to apply the adopted Imperial Acts: “the said recited Acts of Parliament ... shall be ... adopted, and directed to be applied, in the Administration of Justice.” This is a categorical expression that compels courts and judicial officers to treat those recited Acts as law, but subject to the textual qualifier “so far as they can be applied to the circumstances of the said Colony.” The duty is therefore conditional rather than absolute. The Act itself does not describe the mechanism of application (for example, whether administrative executive action is required) but it legally establishes the adopted texts as part of the corpus of local law for judicial application.

2. Citation or short title. The short‑title paragraph allows the Act to be cited as the Imperial Acts Adopting Act 1836. That subparagraph was inserted by No. 10 of 1970 s. 3, and it is a facilitative provision so that the statute can be referred to in subsequent local law and practice.

Rights and duties that matter in practice are those created or preserved by the adopted Imperial Acts themselves. For example, the preamble lists an Executors Act, a Debts Recovery Act, Acts about trustee powers and conveyances, Acts concerning infants’ property and persons of unsound mind, and Acts dealing with prescription and limitation. The Act therefore operates to import whatever rights and duties those Imperial Acts conferred, “and every clause, provision and enactment therein respectively contained,” subject to local applicability. The compilation notes indicate the historical operation of those rights and duties has often been modified: some adopted provisions were later repealed or replaced by Western Australian statutes (for example the Trustee Ordinance 1854 repealed parts of an adopted act; Criminal Law Consolidation Ordinance 1865 repealed many of the forgery and coin provisions; the Administration Act 1903 repealed certain real property asset provisions). Those notes are the textual record of subsequent local legislative decisions about which adopted rights and duties continue to operate.

The Act itself does not create an enforcement apparatus. The enforcement of any obligations or exercise of any rights imported by the adopted Imperial Acts is therefore a function of the ordinary courts and administrative mechanisms, and of any enforcement machinery that existed in the adopted statutes. The Imperial Acts Adopting Act does not add penalties or new enforcement mechanisms beyond incorporation of the adopted Acts’ provisions.

An important interpretive consequence is that the imported provisions are subject both to the local qualifier of applicability and to later local statutes. Practitioners must therefore identify (a) whether the specific adopted clause was in the list, (b) whether it remains a part of Western Australian law “so far as” capable of application, and (c) whether it has been superseded or repealed by later local legislation identified in the compilation notes.

The Imperial Acts Adopting Act 1836 does not itself create new offences, penalties, or a separate enforcement regime. Penalties that arise as a consequence of the adoption are those contained within the adopted Imperial Acts. The Act’s text simply instructs the administration of justice to apply the adopted Acts “and every clause, provision and enactment therein respectively contained,” which includes any penal provisions originally contained in the Imperial Acts, subject to local adaptability.

The compilation notes record that several adopted Imperial provisions that originally created criminal offences were later repealed or consolidated into local criminal statutes. For example:

• The Act adopting forgery provisions (11 Geo. IV & 1 Will. IV c. 66) was largely repealed by the Criminal Law Consolidation Ordinance 1865 (29 Vict. No. 5) s. 5, and the balance was repealed by the Criminal Code Act 1902 (1 & 2 Edw. VII No. 14) s. 3. The notes make explicit which adopted provisions remained part of WA law and which were later removed.
• Adopted Acts dealing with offences relating to coin and other criminal matters were similarly repealed by the Criminal Law Consolidation Ordinance 1865 in 1865.

The immediate practical effect is that a practitioner cannot assume the penal provisions recited in the preamble continue to be operative. The appropriate enforcement provisions are those that currently form part of Western Australian law, which may be the original adopted Imperial provision where no local repeal or replacement has occurred, or a subsequent local statute where Parliament has expressly repealed or replaced the adopted provision.

The Act delegates the determination of applicability to courts and administrators. That delegation implicates enforcement only insofar as courts will have to decide, when a contested provision is invoked, whether the imported Imperial enactment applies to the factual circumstances and whether it has been displaced by later local law. The statute contains no specified enforcement timetable, transitional arrangements or savings clauses beyond the adoption language, so procedural and evidential questions about invocation of an adopted Imperial provision will be resolved through standard judicial process and statutory interpretation principles as applied by courts.

Finally, the compilation table and notes record later legislative amendments to the adoption and to the status of adopted Acts themselves. For instance, statutory housekeeping via the Statute Law Revision Act 1970 (s. 3) and the Statutes (Repeals) Act 2014 (s. 14(1)(a) and (b)) altered the schedule of what remains relevant. Those later Acts affect enforcement only by changing which imported provisions remain available to be pleaded or enforced.

The text and the accompanying compilation notes show the Imperial Acts Adopting Act 1836 was designed to operate in conjunction with local law and to be subject to subsequent legislative modification. The statute’s interaction with other laws appears in several concrete ways.

1. Subject to local applicability. The key interactional clause is the qualifier “so far as they can be applied to the circumstances of the said Colony.” That clause expressly requires courts and administrators to apply the adopted Imperial Acts only insofar as they can meaningfully operate locally. That creates a point of interface between imported Imperial text and local circumstance, where local law and local facts mediate the effect of an imported provision.

2. Repeal and replacement by local statutes. The compilation notes list multiple Western Australian enactments that later repealed, consolidated, or replaced parts of the adopted Imperial Acts. Examples recorded in the notes include:

   • Trustee Ordinance 1854 repealing the part of an adopted Act related to conveyances, transfers and trustees (11 Geo. IV & 1 Will. IV c. 60).
   • Criminal Law Consolidation Ordinance 1865 repealing many parts of adopted criminal provisions (for example as to forgery and coin offences).
   • Criminal Code Act 1902 repealing remainder criminal provisions (1 & 2 Edw. VII No. 14).
   • Administration Act 1903 repealing parts related to freehold and copyhold estates being assets for debts.
   • Real Property Limitation Act 1878 and Limitation Act 1935 modifying and replacing adopted limitation and real property limitation provisions.
   • Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005 repealing the Excise Declarations Act 1831 as it applied.

These entries show that the adopted Imperial Acts have been integrated, superseded or excised by local legislative action over time. The Imperial Acts Adopting Act therefore functions as a foundational statute that subsequent local laws may alter.

3. Citation and statutory housekeeping. The compilation table shows the Imperial Acts Adopting Act itself has been the subject of later statutory housekeeping: No. 10 of 1970 inserted a short title, and Statutes (Repeals) Act 2014 made targeted repeals recorded in the table. Therefore later local statutes explicitly interact with the framework by modifying how the adoption is recorded and referenced.

4. Partial adoption and historical legacy. The notes often say “so far as it was a part of the law of WA,” indicating that the interaction with other laws may be partial , an adopted Imperial provision may have been only partially applicable at adoption, or later partially repealed. This creates an interactional layering: some Imperial provisions were fully absorbed into local law and preserved; others were absorbed then later replaced; some may have been never practically applied because local circumstances rendered them inapplicable.

5. Reproduction as a reference. Several adopted Imperial Acts “have been reproduced as at 26 October 1999 as part of the document entitled ‘Imperial Acts Adopted’.” That means the statutory record contains reproduced copies of some of the adopted texts, which interact with the statute book as reference material when determining current law. Practitioners should consult those reproductions and the compilation notes to map the interaction between the original Imperial text and current Western Australian law.

In sum, the Act interacts with other laws predominantly through the mechanism of assimilation and subsequent local legislative modification. Its legal force is interdependent with later local statutes that either maintain, modify, reproduce or repeal individual adopted Imperial provisions.

The compilation table and notes supplied in the source document record a modest set of discrete interventions after the Act’s original enactment in 1836. The key chronological points in the amendment and repeal history, as given in the source, are:

• Original enactment: Imperial Acts Adopting Act 1836, cited in the compilation table as 6 Will. IV, No. 4, with assent and commencement on 11 April 1836.

• Criminal Code Act 1902 (1 & 2 Edw. VII, No. 14): Recorded in the compilation table as affecting this Act by s. 3 and the 3rd Schedule, with assent on 19 February 1902 and commencement 1 May 1902. The compilation notes also indicate that parts of some adopted Imperial Acts (for example sections of the forgery Act) were repealed by the Criminal Law Consolidation Ordinance 1865 and then the balance repealed by the Criminal Code Act 1902.

• Statute Law Revision Act 1970 (No. 10 of 1970) s. 3: This Act inserted the short title paragraph into the Imperial Acts Adopting Act, providing that the Act may be cited as the Imperial Acts Adopting Act 1836. The compilation table records its assent and commencement on 29 April 1970. The short‑title paragraph is specifically noted in the source.

• Statutes (Repeals) Act 2014 (No. 32 of 2014) s. 14(1)(a) and (b): The compilation table records that some later repeals were effected in 2014, with assent on 3 December 2014 and commencement 4 December 2014 (see s. 2(b) of that Act). The compilation table marks certain previously adopted Acts as repealed by that 2014 statute (see the bracketed notes indicating repeals).

• Historical local repeals or replacements: The compilation notes list a number of earlier Western Australian statutes that repealed or replaced parts of the adopted Imperial Acts:

  • Administration Act 1903 (No. 13 of 1903), assent 31 December 1903; the notes say an adopted provision (3 & 4 Will. IV c. 104) was repealed by the Administration Act 1903.
  • Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005 (No. 24 of 2005) s. 4 repealed the adopted Excise Declarations Act 1831 so far as it formed part of WA law.

The companion footnotes also record that certain adopted Acts have been reproduced as part of a consolidated document (reproduced as at 26 October 1999) for the purposes of reference.

The amendment history therefore is not a single continuous sequence of textual amendments to the Imperial Acts Adopting Act itself, but rather a sequence of local legislative acts which either (a) modified the status of specific adopted Imperial Acts, (b) repealed parts of them, or (c) inserted ancillary provisions such as a short title into the adopting Act. Practitioners must consult the compilation table and notes to identify which adopted provisions remain, which have been repealed, and the dates of those statutory changes.

The source material supplied contains no reported cases, judicial decisions, or litigation history referencing the Imperial Acts Adopting Act 1836. The printed text, preamble, operative adoption clause, compilation table and notes do not cite any judicial determinations or list any appeals or authorities that have interpreted the Act. Footnotes and the compilation table instead track statutory amendments, repeals and reproductions; they do not record judicial treatment.

Consequently, the statement that follows is strictly sourced: there is no litigation history recorded in the provided statutory text or notes. Where a practitioner requires authoritative judicial interpretation, the present source does not supply it. Users should therefore treat the Act as an enabling legislative instrument whose interpretive questions (for example, what it means for an Imperial clause to be “applied to the circumstances of the said Colony”) will be resolved by courts but for which this document contains no case law references.

In practice, given the age of the adoption (1836) and the number of subsequent local legislative repeals and consolidations listed in the compilation notes, any litigation invoking a particular adopted Imperial provision would need to establish:

• that the provision in question was indeed among those recited and adopted;
• that it has not been repealed or superseded by later Western Australian statute law (as indicated in the notes); and
• that it is applicable to the local factual circumstances as per the “so far as they can be applied” qualifier.

Because there are no cases recorded in the provided source, readers should consult commercial law reports, jurisprudential databases or other primary sources if they require judicial interpretation of specific adopted provisions. The supplied statute and notes do not themselves provide that litigation record.

The source‑documented text contains several pitfalls for practitioners relying on the Imperial Acts Adopting Act 1836 as a primary source of law. The following are concrete, source‑grounded issues to watch for.

1. “So far as they can be applied” is open‑ended. The Act adopts the recited Imperial Acts “so far as they can be applied to the circumstances of the said Colony.” That qualification creates an ambiguity: the statute does not define how to determine applicability, who makes that determination in all situations, or whether legislative intent is required to adapt substantive provisions. The practical consequence is that a party invoking an adopted Imperial provision must be prepared to justify its applicability to local facts and legal structures; the Act gives no automatic blanket import.

2. Many adopted provisions have been repealed or replaced locally. The compilation notes explicitly record that numerous adopted Imperial Acts, or substantial parts of them, were later repealed or replaced by Western Australian statutes (for example Trustee Ordinance 1854; Criminal Law Consolidation Ordinance 1865; Criminal Code Act 1902; Real Property Limitation Act 1878; Limitation Act 1935; Administration Act 1903; Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005). A practitioner who reads only the preamble may incorrectly assume a provision remains in force when it has in fact been displaced. The notes repeatedly qualify the status of particular adopted Acts with “so far as it was a part of the law of WA,” emphasising selective survival.

3. The Act is an adoption vehicle, not a modernising text. The statute does not translate or update older Imperial formulations to modern language or policy. Relying parties must check whether the substance of an adopted Imperial Act conforms with later local policy changes effected by Western Australian legislation.

4. Reproduction dates and reliance. The notes record that certain adopted Imperial Acts “have been reproduced as at 26 October 1999 as part of the document entitled ‘Imperial Acts Adopted’.” That reproduced text may be helpful as a historical source, but reproduction alone does not guarantee current legal effect. Reproduction dates should be checked against the compilation table and the recorded repeals.

5. Short title insertion does not change substance. No. 10 of 1970 s. 3 inserted a short title for convenience. That amendment affects citation only; it does not expand or contract the substantive adoption mechanism. Readers should not infer substantive change from the new short title.

6. Footnotes indicating partial repeal create interpretive complexity. Several footnotes remark on partial repeals (for example “All but s 21 was repealed...”; “so far as it was a part of the law of WA, was subsequently repealed...”). Those formulations indicate that some adopted Acts were only partly in force at different times, which complicates searches for a live provision. One must track which sections survived and whether any surviving sections remain in force today.

7. The Act contains no savings, transitional or procedural specifics. Because it simply adopts Imperial Acts, it does not provide transitional arrangements or savings for rights accrued under the adopted Acts, nor does it outline how conflicts with later Western Australian statutes are to be resolved beyond the ordinary rules of statutory interpretation and repeal. That absence can be consequential in litigation where historical rights, obligations or defences are claimed under an imported text.

8. The Act’s historical framing. The preamble lists Acts passed in the reign of King William the Fourth, and the compilation notes observe that those Acts are cited in United Kingdom Statutes as chapters of 11 George IV and 1 William IV. Users should not assume that the titles or chapter citations used in modern references correspond neatly to current statute citations without checking the reproductions and the compilation table.

In short, a reliance strategy that begins with the preamble without consulting the compilation notes, reproduction materials and later local statutes risks error. The practical “gotcha” is failure to verify whether a particular adopted Imperial provision remains operative after the local legislative history recited in the notes is applied.

The Imperial Acts Adopting Act 1836 imposes no new compliance regime beyond the imported obligations in the adopted Imperial Acts. Compliance therefore requires a three‑step approach grounded in the statute and accompanying notes.

1. Identify the specific adopted provision. Start with the preamble’s list of recited Imperial Acts. The preamble names each Act by its long title (for example An Act for making better Provision for the disposal of the undisposed of Residues of the Effects of Testators; An Act for the Limitation of Actions and Suits relating to Real Property, and for simplifying the Remedies for trying the Right thereof; the Prescription Act 1832; the Bills of Exchange non‑payment Act, etc.). Confirm that the provision you intend to rely on is indeed within one of those recited Acts.

2. Check the compilation notes and identified repeals. The compilation notes accompanying the Act record whether particular adopted Imperial Acts were reproduced, amended or repealed by later Western Australian enactments. For example, the notes show:

   • The Trustee Ordinance 1854 repealed the adopted trustee/conveyance Act insofar as relevant.
   • The Criminal Law Consolidation Ordinance 1865 and the Criminal Code Act 1902 repealed adopted forgery and coin offence provisions.
   • The Excise Declarations Act 1831 was subsequently repealed by an Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005.
   • Limitation and real property limitation provisions were amended by the Real Property Limitation Act 1878 and later repealed by Limitation Act 1935.

Complying therefore mandates a direct check of the footnotes and the compilation table entries. If the provision has been repealed or replaced as indicated in the notes, compliance requires adherence to the modern Western Australian statute rather than the original adopted Imperial provision.

3. Determine applicability under the “so far as” qualification. Even where an adopted provision has not been statutorily repealed, the Act conditions its application on local circumstances. To comply, an advising lawyer or official must assess whether the imported rule can be applied to contemporary Western Australian legal and factual circumstances. That assessment may involve legal argument in court if applicability is contested. Practically, document why the provision is “applicable” in the case of reliance, referencing the text of the adopted Imperial provision and the local facts which make it adaptable.

4. Use reproduced authoritative texts where available. The notes indicate certain adopted Acts “have been reproduced as at 26 October 1999” in the document titled “Imperial Acts Adopted.” When advising or litigating, consult those reproductions together with the compilation notes to ensure textual accuracy of the adopted enactment being relied upon.

5. Where the adopted provision has been superseded, comply with the successor statute. If the compilation notes show the adopted Imperial provision was repealed and replaced by a Western Australian Act (for example Administration Act 1903 for certain estate matters, Limitation Act 1935 for limitation rules, Criminal Code Act 1902 for criminal offences), compliance must follow the modern Western Australian statute. The compilation table identifies precise instruments and sections responsible for these changes; use those references when identifying the controlling law.

6. Cite the short title correctly for procedural drafting. The Act’s short title paragraph (inserted by No. 10 of 1970 s. 3) permits citation as the Imperial Acts Adopting Act 1836. Use that short title where appropriate in pleadings, statutory cross‑references or legislative history materials.

7. Maintain an audit trail. Because the Act’s operative effect is contingent on later local repeals and applicability assessments, advise clients and administrative officers to document the research establishing that the adopted provision remains in force and applicable. Note the dates and sections of any later repeal or replacement Acts found in the compilation notes.

In practice, compliance is investigative and contextual. It requires confirming (a) that the particular Imperial provision was adopted, (b) whether it survives or has been repealed/replaced by local statute as recorded in the compilation notes, and (c) whether the provision can genuinely be applied to the present facts under the statutory qualifier. The compilation notes and table supplied with the Act in the source are the immediate documents to consult; where those notes indicate replacement, apply the successor Western Australian statute.
