Illegal Logging Prohibition Rules 2024

The Rules assemble a set of operational concepts that determine when and how the Act’s prohibitions apply. Those key concepts, and their legal mechanisms in the instrument, are as follows.

Regulated timber product (s 5). The Rules adopt a tariff‑based identification approach: timber products are prescribed by reference to specific headings or subheadings in Schedule 3 to the Customs Tariff Act 1995. The Rules list 47 items , ranging from wood in the rough (4403) and sawn wood (4407-4409) through particle board and fibreboard (4410-4411), plywood and laminated wood (4412), a broad set of wood pulps (4701-4705), a wide range of paper and paperboard classes (4801-4823), paper products and stationery (4810-4821), and wooden furniture and prefabricated wooden buildings (9401-9403, 9406) (s 5). Identifying whether a product falls within those tariff lines will therefore depend on correct tariff classification.

Recycled material exemption (s 6). The Rules prescribe that a regulated timber product is exempt for the purposes of certain Act paragraphs if the product is recycled material, entirely made from recycled material, or all timber (and products derived from timber) included in the product are recycled material (s 6(1)(a)). The instrument defines recycled material by reference to prior use: the timber or product must previously have been, or been part of, another thing and must have ceased to be that other thing at a time when that other thing was no longer used for its intended purpose (s 6(2)). Importantly, by‑products of manufacturing processes are explicitly excluded from being recycled material (s 6(3)); an example given is off‑cuts used to make particle board or MDF.

Low‑value consignment exemption (s 6(1)(b)). For imports, regulated timber products that are part of a consignment whose total customs value of regulated timber products on import does not exceed A$1,000 are prescribed as exempt for specified paragraphs of the Act (s 6(1)(b)). Customs value is defined according to Division 2 Part VIII of the Customs Act 1901 (definitions at s 4).

Certified product and certified raw logs (ss 8(4), 11(3)). The Rules set out concrete facts that make a product or raw logs certified: the importer/processor must obtain a copy of a record from an FSC or PEFC database showing the product/raw logs fall within the supplier’s certification scope under a forest certification standard, verify the database record details about the supplier, and obtain a supplier sales/delivery document containing a certification claim consistent with the certification (s 8(4)(a)-(c); s 11(3)(a)-(c)). The Rules define “forest certification standard” by reference to FSC Principles and Criteria and PEFC standards (s 4, definitions).

Due diligence system information (ss 7, 10). For both importers and processors, the Rules prescribe the minimum contact and business identity information that must be held in the due diligence system, including responsible officer details when the entity is not an individual, and ABN/ACN where the activity is in connection with a business (s 7; s 10).

Risk identification, assessment and mitigation (ss 8(5)-(9); 11(4)-(8)). The Rules distinguish between certified and non‑certified goods in the required risk assessment inputs and set a common obligation that identification and assessment must be to a reasonable standard (s 8(7); s 11(6)). For certified goods the assessment must consider the information gathered plus the extent of illegal logging in general involving known entities in the supply chain and any other relevant information (s 8(5); s 11(4)). For non‑certified goods, the assessment must consider a longer list of matters including country‑specific guidelines, conservation status (including CITES Appendices), armed conflict, corruption and forest governance in the harvest area (s 8(6); s 11(5)). If risks above low are identified, a risk mitigation process reasonable and proportionate to the identified risk must be conducted and recorded; post‑mitigation reassessment and a written record are required (s 8(8)-(9); s 11(7)-(8)). The mitigation steps may include obtaining further information and scientific methods of timber identification (s 8(9)(a)-(b); s 11(8)(a)-(b)).

Record‑keeping (ss 8(11), 11(10)). The Rules require five‑year retention, from the day of importation or processing, of the information obtained, database certification records and sales/delivery documents, and the risk assessment and mitigation records.

Repeat transaction exception (ss 8(10), 11(9)). A repeat importer or processor can avoid repeating the full set of assessment steps for a new product or batch if an earlier product or logs of the same type were imported/processed within the prior 12 months, the applicable assessments and information gathering were performed, the products/logs are both certified or both non‑certified as applicable, the current product/logs have the same basic information as the earlier load, and the importer/processor documents consideration of whether significant changes have occurred since the earlier compliance (and records that no significant change occurred if satisfied) (ss 8(10)(a)-(e); 11(9)(a)-(e)). This creates an administrative pathway to reduce duplication, conditional on recordable stability across a 12‑month window.

Exempt processing circumstance (s 9). For processing, the Rules prescribe one circumstance where the processing due diligence exemption in subsection 17(5) of the Act applies: when the person who processed the raw log is the person who harvested it (s 9).

These concepts turn the Act’s high‑level duty to avoid importing or processing illegally logged timber into a defined series of information collection, assessment and record‑keeping tasks tied to specific documentary inputs, certification database checks and proportional mitigation measures.

The Rules allocate compliance obligations primarily to two operational groups: importers of regulated timber products and processors of raw logs. Each group has distinct but parallel sets of duties.

Importers. Any person importing a regulated timber product classified under one of the Customs Tariff headings in the s 5 table will need to determine whether the Rules apply to the goods and, if so, perform the prescribed due diligence before importation (see s 5 for the tariff list and Part 2, especially s 8). The importer must collect detailed product and supplier information (s 8(3)), set up and maintain a due diligence system that includes the prescribed contact and business fields (s 7), conduct risk identification and assessment for certified or non‑certified timber products (ss 8(5)-(6)), undertake mitigation where risks above low are identified (s 8(8)), and keep records for five years after import (s 8(11)). The Rules explicitly address businesses by requiring ABN/ACN and principal business activity when the importation is in connection with a business (s 7(c)).

Processors of raw logs. A person who processes raw logs in Australia is subject to the parallel processing requirements in Part 3 (s 11). Before processing, the processor must obtain species, provenance, supplier and quantity details and sales/delivery documents (s 11(2)), determine whether the logs are certified by checking FSC/PEFC database records and supplier certification claims (s 11(3)), perform risk identification and assessment (ss 11(4)-(5)), carry out proportionate mitigation for non‑low risks (s 11(7)), and retain records for five years from processing (s 11(10)). If the processor harvested the raw log personally, the prescribed exempt circumstance applies and the particular processing‑duty exemption in subsection 17(5) of the Act is met (s 9).

Suppliers and overseas exporters. While the Rules do not directly regulate suppliers outside Australia, they force importers and processors to extract and verify supplier information. The importer/processor must obtain supplier name, address, trading name and business registration number where applicable (s 8(3)(d); s 11(2)(c)), and verify certification claims against FSC/PEFC databases (s 8(4)(a)-(b); s 11(3)(a)-(b)). Consequently, suppliers and overseas actors will face commercial pressure to provide verifiable certification documents and sales/delivery paperwork if they want to access the Australian market.

Businesses across supply chains. The Rules’ coverage of a broad range of timber‑derived products , including many paper and paperboard tariff lines (items 19-39, s 5) and furniture (items 40-46, s 5) , means that not only primary timber merchants and sawmills, but also downstream manufacturers, furniture importers, paper importers and stationery suppliers may be brought within scope. Firms that import mixed consignments must be able to compute the customs value of regulated timber products in the consignment to determine whether the low‑value exemption applies (s 6(1)(b); definition of customs value at s 4).

Who bears compliance costs. The Rules place the primary compliance burden on importers and processors. Those actors must establish due diligence systems (prescribed fields in ss 7 and 10), undertake documentary checks and database verifications (ss 8(4), 11(3)), perform substantive risk assessments to a “reasonable standard” (ss 8(7), 11(6)), and procure mitigation measures where necessary (ss 8(8), 11(7)). Where scientific timber identification is used as a mitigation step, importers/processors will bear the cost and logistical burden of testing (ss 8(9)(b), 11(8)(b)). Suppliers may bear indirect costs in producing verifiable documentation and participating in audits or certification.

Governmental role. The Minister made the Rules under the authority of the Act (s 3). The instrument itself does not list enforcement penalties; instead it signals that non‑compliance triggers the Act’s offence and civil penalty provisions (notes referencing ss 12 and 17 of the Act in ss 8 and 11). Administrative decisions , for example whether a certification record matches a supplier’s claim , are therefore matters importers and processors must make or verify and preserve in their files for regulatory review.

Small consignments and recycled material exemptions reduce the scope for small traders and businesses dealing in genuinely recycled goods, but the Rules still implicate many commercial actors in the timber value chain. Determination of tariff classification, customs value calculation, and verification of certification records will be operationally necessary for affected firms.

This section summarises the concrete duties created by the Rules, the limited rights or procedural pathways the Rules provide, and the thresholds or conditions that alter those duties. All references are to provisions in the Rules.

Primary duties for importers (Part 2, s 8)

• Set up and maintain a due diligence system with prescribed information: importer’s name, street and postal addresses, telephone and email; if not an individual, name and contact details of the individual responsible for maintaining the system; and if importing in connection with a business, principal business activity and ABN/ACN (s 7(a)-(c)).
• Before import, obtain as much of the following information as is reasonably practicable: product description including type and trade name and common and scientific species name; country and area of harvest; country of processing (if applicable); supplier name/address/trading name/registration number; quantity; and the sales or delivery document for the purchase (s 8(3)(a)-(f)).
• If the product is certified, obtain a copy of the relevant record from an FSC or PEFC database showing the regulated timber product and species are within the scope of the supplier’s certification, verify the record details, and obtain a sales/delivery document with a certification claim consistent with that record (s 8(4)(a)-(c)).
• Conduct a risk identification and assessment for certified and non‑certified products before importing. The inputs differ: certified products require consideration of the information gathered and the extent of illegal logging involving known supply chain entities (s 8(5)); non‑certified products require consideration of a longer list including country‑specific guidelines, conservation status (including CITES), armed conflict, corruption and the governance arrangements for forest management in the harvest area (s 8(6)).
• Ensure identification and assessment are “to a reasonable standard” (s 8(7)).
• If a risk that is not low is identified, conduct a reasonable and proportionate risk mitigation process, reassess risk following that process, and make a written record of the mitigation including residual risk and any further information obtained (s 8(8)(a)-(d)). The mitigation process may include obtaining further information and scientific timber identification methods (s 8(9)(a)-(b)).
• Keep the records specified in s 8(11) for five years from the date of import: information obtained under s 8(3), certification record and sales/delivery document under s 8(4), and risk assessment or mitigation records under s 8(5)(d), s 8(6)(d), s 8(8)(d) or s 8(10)(e).

Primary duties for processors (Part 3, s 11)

• Maintain a due diligence system containing prescribed information about the person doing the processing: name, addresses, telephone and email; responsible individual details if not an individual; and business activity and ABN/ACN when processing in connection with a business (s 10(a)-(c)).
• Before processing raw logs, obtain as much as is reasonably practicable: species common and scientific name, State/Territory and area of harvest, supplier name/address/trading name/ABN/ACN, quantity, and the sales/delivery document (s 11(2)(a)-(e)).
• For certified raw logs, obtain a copy of the FSC/PEFC database record showing the logs fall within supplier certification, verify record details, and obtain a supplier sales/delivery document with a certification claim consistent with that record (s 11(3)(a)-(c)).
• Identify and assess risk of illegal logging to a reasonable standard, according to differing inputs for certified (s 11(4)) and non‑certified (s 11(5)) raw logs.
• If risk above low is identified, perform mitigation proportionate to the risk, reassess, and record the mitigation and residual risk (s 11(7)-(8)).
• Record retention for five years after processing of the documents specified (s 11(10)).

Rights, exemptions and procedural pathways

• Recycled material exemption for import. If a regulated timber product is recycled material (as defined in s 6(2)) or entirely made from recycled material, it is prescribed as exempt for specified Act paragraphs (s 6(1)(a)-(b)). But by‑products are excluded (s 6(3)).
• Low‑value consignment exemption. Regulated timber products in a consignment whose total customs value of regulated timber products does not exceed A$1,000 are prescribed as exempt in certain Act contexts (s 6(1)(b)).
• Certified‑product pathway. A product or raw logs treated as “certified” under s 8(4) or s 11(3) triggers a slightly narrower list of assessment inputs but still requires an assessment and mitigation where relevant (s 8(5); s 11(4)).
• Repeat transaction exception. Importers and processors that have imported/processed a similar product/wood within the previous 12 months and complied with due diligence may rely on that earlier compliance and need only confirm unchanged information and document consideration of any significant change since the earlier transaction (s 8(10); s 11(9)).
• Exempt processing circumstance. Processing is prescribed as exempt under subsection 17(5) of the Act where the processor is the person who harvested the raw log (s 9).

Specified legal effect of non‑compliance

• The Rules make explicit reference to the Act’s offence and civil penalty provisions (notes referencing s 12 for importers in s 8 and s 17 for processors in s 11). The Rules themselves do not specify penalty sums or enforcement modalities, but they make clear compliance with the prescribed due diligence requirements is relevant to whether an importer or processor has contravened the Act.

The duties are therefore prescriptive, documentary and process‑oriented. They require factual verification steps (database and supplier verification), a qualitative risk assessment to a “reasonable standard”, proportional mitigation where risk is identified, and five‑year record retention. The Rules provide limited procedural relief through exemptions and repeat‑transaction relief, and they link to external guidance instruments (country and State/Territory guidelines) for certain risk assessments.

The Rules do not create or quantify penalties within their own text. Instead the instrument repeatedly cross‑references offences and civil penalty provisions in the principal statute, the Illegal Logging Prohibition Act 2012, thereby tying the Rules’ compliance obligations to the Act’s enforcement architecture.

Direct references to enforcement. The import due diligence section notes that “Section 12 of the Act contains offences and a civil penalty for a person who imports a regulated timber product and who does not comply with one or more due diligence requirements for importing the regulated timber product” (note to s 8). The processing due diligence section contains a parallel note that “Section 17 of the Act contains offences and a civil penalty for a person who processes a raw log and who does not comply with one or more due diligence requirements for processing the raw log” (note to s 11). Those notes anchor enforcement and sanctions to the Act rather than to the Rules.

Evidence and enforcement mechanics. Because the Rules prescribe what information must be obtained, what databases or certification records must be checked, and what written records of assessment and mitigation must be kept (ss 7-11), they create an evidentiary trail that regulators can inspect in the course of enforcement under the Act. The five‑year retention obligation (s 8(11); s 11(10)) ensures that documentation will be available to support prosecutions, civil penalty claims or administrative sanctions under the Act. The Rules therefore function as compliance‑audit guidance, by describing the documentation an enforcement agency can expect importers and processors to hold.

No new investigatory powers in the Rules. The instrument does not itself set out investigatory or enforcement powers , for example, powers to inspect premises, detain goods, or compel documents , nor does it provide administrative penalty mechanisms. Those powers and remedies, where available, are contained in the Act and other Commonwealth laws. The Rules’ approach is to operationalise the Act’s substantive requisite conduct rather than to prescribe enforcement modalities.

Uncertainty and discretion in enforcement. The Rules require assessments to be made “to a reasonable standard” (s 8(7); s 11(6)). The instrument does not define “reasonable standard” or set objective metrics, thus creating a compliance standard that will be interpreted in enforcement proceedings. Whether a regulator finds an assessment satisfies that standard will depend on the totality of the information an importer/processor collected and the risk mitigation steps taken and documented. The Rules also allow importers/processors to determine whether there has been a “significant change in circumstances” when relying on a prior compliant transaction (ss 8(10)(e)(i)-(ii); 11(9)(e)(i)-(ii)). Those determinations are fact‑sensitive and could be a subject of enforcement challenge.

Use of certification and databases as mitigation of enforcement risk. The Rules formalise reliance on FSC and PEFC database records and supplier certification claims (ss 8(4), 11(3)). Properly documented certification records and verifications are therefore a de facto compliance defence under the Rules’ framework. The regulator’s assessment will still examine whether the importer/processor verified and considered the record’s validity and reliability (ss 8(5)(b)(iii), 8(5)(c); 11(4)(b)(iii), 11(4)(c)), and whether the risk identification, assessment and mitigation were reasonable.

Consequences of non‑documented mitigation. Because the Rules require written records of risk identification, assessment and mitigation (ss 8(5)(d), 8(6)(d), 8(8)(d); 11(4)(d), 11(5)(d), 11(7)(d)), an absence of documentation is itself a compliance gap. Enforcement under the Act is likely to treat lack of required documentation as evidence of non‑compliance with due diligence requirements.

Administrative burden as compliance lever. By prescribing specific items of information and documentary steps, the Rules create a discrete set of administrative tasks that regulators can audit. Compliance therefore entails both substantive risk work (assessments and mitigation) and administrative record management (data capture and retention), and enforcement can rely on failures in either domain.

In summary, the Rules do not themselves impose fines or seizure powers but translate the Act’s statutory duties into defined documentary and process obligations. Enforcement and penalties flow from the Act; the Rules determine what an enforcement agency will expect to find in a compliant actor’s files and processes.

The Rules are expressly framed as subordinate legislation made under the Illegal Logging Prohibition Act 2012 and rely on, and cross‑refer to, provisions and statutory constructs from other Commonwealth statutes and international agreements. The instrument integrates with those other legal instruments in the following concrete ways.

Parent Act (Illegal Logging Prohibition Act 2012). The Rules are made under the authority of the Act (s 3) and operationalise the Act’s due diligence obligations by prescribing specific information and steps for importers and processors (Parts 2 and 3). The Rules repeatedly note that breaches of their prescribed due diligence requirements will engage the Act’s offence and civil penalty provisions (notes to ss 8 and 11 referencing ss 12 and 17 of the Act respectively). In effect, the Rules specify what compliance with the Act looks like in practice.

Customs and tariff law. The Rules identify regulated timber products by reference to headings and subheadings of Schedule 3 to the Customs Tariff Act 1995 (s 5). The exemption for low‑value consignments depends on the “customs value of the goods worked out or determined in accordance with Division 2 of Part VIII of the Customs Act 1901” (definition of customs value in s 4). Importers will therefore need to apply customs valuation rules under the Customs Act 1901 and determine correct tariff classifications under the Customs Tariff Act 1995 to establish whether goods are caught and whether a consignment qualifies for the low‑value exemption.

Taxation and corporations law definitions. Definitions of ABN and ACN in the Rules are adopted from the A New Tax System (Australian Business Number) Act 1999 and the Corporations Act 2001 respectively (s 4). The presence of ABN/ACN fields in the prescribed due diligence system (ss 7(c), 10(c), s 11(2)(c)) creates points of intersection with business registration frameworks.

International conventions and forest certification standards. The Rules reference CITES (the Washington Convention) and require importers/processors to consider conservation status and CITES listings for non‑certified goods (s 8(6)(b)(v); s 11(5)(b)(v)). The Rules also rely on third‑party certification systems by referencing forest certification standards, specifically FSC and PEFC standards, and the use of database records maintained by those organisations to substantiate certification claims (s 4 definitions; s 8(4); s 11(3)). The Rules therefore create a compliance pathway that intersects with private international standard‑setting organisations and international wildlife trade obligations.

State and country guidelines. The instrument incorporates external guidance instruments by name and requires importers and processors to consider country‑specific guidelines for non‑certified imports (s 8(6)(b)(ii)) and State specific guidelines for non‑certified raw logs (s 11(5)(b)(ii)). The Rules list specific country and State/Territory guidelines and state that those guidelines, as in force from time to time, should be considered. This creates a cross‑reference to non‑statutory or co‑endorsed guidance developed between the Commonwealth and jurisdictions or foreign governments (s 4, tables under definitions).

Evidence and documentary regimes. The Rules require importers/processors to obtain sales or delivery documents and to maintain copies of certification records from FSC/PEFC databases (ss 8(3)(f), 8(4)(a)-(c); s 11(2)(e), 11(3)(a)-(c)). That creates interactions with trade documentation regimes, commercial contracts, and evidence rules relevant to enforcement under both the Act and potentially other laws (for example, customs declarations, contract law disputes arising from supplier misrepresentations, or statutory obligations to retain business records).

No express conflict‑resolution clauses. The Rules do not expressly displace or amend other Commonwealth legislation. They rely on and reference definitions and mechanisms in other statutes. Where a regulated timber product is also subject to other regulatory regimes (for example, biosecurity import conditions, chemical or sanitary standards, or customs controls), importers will need to satisfy those regimes as well; the Rules do not remove or change those other obligations.

Practical consequence. Operational compliance will often require businesses to coordinate data and documentary flows required by customs administration, private certification schemes, commercial suppliers, and national environmental obligations. The Rules tie together these distinct legal and private regimes by naming specific documentary inputs (database records, sales/delivery documents, certification claims) and by explicitly naming external guidance instruments to be considered in risk assessments.

Overall, the Rules are designed to sit within an ecosystem of Commonwealth statutory rules (customs, corporations, taxation), international conventions (CITES), private certification standards (FSC/PEFC), and jurisdictional guidance documents. Compliance therefore requires attention to multiple legal and quasi‑legal sources.

The instrument as provided contains the original making information and an explicit commencement table; it does not record any subsequent amendments within the text supplied.

Key points from the instrument’s own amendment and commencement material:

• Date made and signature. The Rules were signed by the Minister for Agriculture, Fisheries and Forestry, Julie Collins, dated 19 December 2024 (front matter).
• Commencement. The commencement table in s 2 states that “the whole of this instrument” commences “At the same time as the Illegal Logging Prohibition Amendment (Strengthening Measures to Prevent Illegal Timber Trade) Act 2024 commences” and provides the commencement date/ detail column entry of 3 March 2025 (s 2(1) and the commencement table). The instrument therefore ties its operation to the commencement of an Amendment Act and identifies a specific commencement date for that concurrent commencement.
• Authority. The Rules are made under the Illegal Logging Prohibition Act 2012 (s 3). That implies that any subsequent amendment to the Act could change the powers under which such Rules are made, and future amendments to the Rules themselves would be undertaken under the Act’s delegated‑legislation procedures.
• Non‑amendment note. The commencement table carries an express note that the table “relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument” (s 2(2)). That is a standard presentation note indicating the table records original commencement arrangements only.

No further amendment record. The instrument does not contain a schedule of prior amendments or a list of changes from earlier Rules. The text provided appears to be the 2024 instrument as made. There are no internal amending provisions or historic versions attached to the document provided.

Guidance materials and external documents. The Rules refer to country and State specific guidelines “as in force from time to time” and to international standards maintained by FSC and PEFC. These external instruments will likely be updated independently of the Rules; the Rules give effect to those changes by reference rather than by reproducing their text (definition of “country specific guideline” and the tables in s 4; definition of forest certification standard in s 4). Any updates to those external guidelines or standards will therefore affect what an importer/processor must “consider” under the Rules without need to amend the Rules.

In short, the instrument itself is newly made in December 2024, set to commence with an Amendment Act on 3 March 2025, and does not include a history of prior amendments in the provided text. Ongoing interaction with changing external standards and guidance is anticipated by the Rules’ textual reliance on materials “in force from time to time.”

The Rules as provided contain no record of judicial or administrative litigation. The instrument does not cite, summarise or reference any case law, and it contains no annotations reporting judicial interpretation. Therefore, based solely on the text supplied, there is no litigation history to report.

Potential litigation touchpoints implied by the Rules. While no cases are named or recorded in the text, the Rules create a number of legal questions and compliance determinations that are naturally susceptible to dispute and hence potential litigation under the Act. Those potential contentious issues, which would be relevant in enforcement or judicial review contexts, include:

• What constitutes a “reasonable standard” for identification and assessment. The Rules require that risk identification and assessment be “to a reasonable standard” (s 8(7); s 11(6)). That phrase is undefined in the instrument and invites fact‑based evaluation. Disagreement over whether an assessment met that standard could lead to litigation under the Act’s offences or civil penalty regime.
• The sufficiency of certification verification. The Rules permit reliance on FSC/PEFC database records and require verification that the database details about the supplier are “true and correct” (s 8(4)(a)-(b); s 11(3)(a)-(b)). If a supplier misrepresents certification or a database record is inaccurate, disputes may arise about whether the importer/processor took reasonable steps to verify the record.
• Interpretation of recycled material and the exclusion for by‑products. The Rules define recycled material by prior use but explicitly exclude manufacturing by‑products (s 6(2)-(3)). A contested transaction over whether material qualifies as recycled could generate legal disagreement, particularly in cases where manufacturing streams are complex.
• The meaning of “significant change in circumstances” in the repeat transaction exception. The repeat‑transaction pathway requires the importer/processor to consider whether a significant change in circumstances has increased risk since the earlier compliant transaction (s 8(10)(e); s 11(9)(e)). Parties and regulators could disagree about what counts as a significant change.
• Tariff classification and customs valuation disputes. Because the regulated goods are identified by Customs Tariff Act headings (s 5) and the low‑value exemption turns on customs value calculated under the Customs Act (s 4), disagreements with customs authorities over classification or valuation could affect whether goods fall within the Rules’ scope or qualify for the exemption.

Matters of administrative law. Enforcement decisions under the Act (e.g. decisions to prosecute or impose civil penalties) could give rise to judicial review applications if decision‑making processes (procedural fairness, reasoned decisions) are challenged. The Rules themselves do not create administrative appeal rights; any review would be under general administrative law or the appeal/ review provisions of the Act or other relevant statutes.

Because the Rules are newly made in the form provided, there is no reported case law directly interpreting their terms in the text supplied. Practitioners should therefore treat the Rules as an operational compliance standard that will, in time, be clarified by regulatory practice and potentially by litigation under the Act.

The Rules contain numerous specific drafting and operational features that are potential compliance traps for importers and processors. These are practical pitfalls where a failure to appreciate a narrow textual point can create litigation or enforcement exposure under the Act. The following items are concrete “gotchas” grounded in the Rules’ text.

Recycled material exclusion is narrow (s 6(2)-(3)). The definition of recycled material requires prior use as “another thing” and cessation or removal from that thing when it was no longer used for its intended purpose (s 6(2)). Critically, the Rules explicitly exclude manufacturing by‑products from the recycled definition (s 6(3)). The example provided , off‑cuts from sawn timber used to make particle board or medium density fibreboard , shows that common industrial secondary uses do not qualify. Suppliers and importers treating off‑cuts or by‑products as exempt recycled material risk misclassification.

Low‑value consignment threshold applies to “regulated timber products” within the consignment (s 6(1)(b)). The exemption hinges on the total customs value of the regulated timber products in the consignment, not the total consignment value. If a consignment contains mixed goods only part of which are regulated timber products, importers must segregate and value the regulated elements. Miscalculation of customs value under the Customs Act can therefore cause inadvertent non‑coverage by the exemption.

Tariff classification complexity (s 5). The Rules adopt a tariff‑line approach listing 47 items drawn from the Customs Tariff Act 1995. Correctly classifying a product under the customs tariff is a technical exercise and often contentious. An imported composite good or partially timber product may require careful tariff analysis to determine whether it is covered by the listed headings. Errors in classification risk retrospective exposure.

Certified product reliance requires database verification and consistent supplier documents (ss 8(4), 11(3)). The “certified” pathway demands both a copy of a record from an FSC/PEFC database and verification that the record’s supplier details are accurate, plus a sales/delivery document containing a matching certification claim (ss 8(4)(a)-(c); 11(3)(a)-(c)). Relying on a supplier’s emailed claim alone is insufficient under the Rules; exporters or brokers may need to provide database extracts that can be matched to supplier paperwork. Importers must exercise due diligence to ensure database records and supplier documents align.

“Reasonable standard” is undefined (ss 8(7), 11(6)). The Rules require risk identification and assessment to be to a reasonable standard, but give no objective metric. That leaves ambiguity about what sorts of enquiries, checks, or levels of documentation satisfy the standard in high‑risk contexts. In practice, this will be resolved by regulatory guidance or enforcement decisions, but until then importers/processors face uncertainty about sufficiency.

Mitigation may require scientific timber identification (ss 8(9)(b), 11(8)(b)). Scientific identification can be expensive, time‑consuming, and technically specialised. Where a risk is not low, importers/processors may need to budget for laboratory or expert analysis to identify species and provenance. Availability of appropriate laboratories and chain‑of‑custody for samples can be operational constraints.

Repeat transaction relief requires documentation and review (ss 8(10), 11(9)). The exemption for repeat imports/processing avoids duplicative assessment only where the prior transaction’s information is the same and where the importer/processor has considered and recorded whether there has been a significant change in circumstances. The need to document the “no significant change” state is a formal obligation; absent that record the importer/processor cannot rely on the exception.

Supplier name and business registration details required (ss 8(3)(d), 11(2)(c)). The Rules demand supplier commercial identifiers, and for processors the supplier’s ABN/ACN “if any” (s 11(2)(c)). Where suppliers are informal, small or remote entities that do not provide formal registration numbers, importers may find it difficult to satisfy the Rule’s prescriptive documentary checklist.

Country and State guidelines must be considered (ss 8(6)(b)(ii), 11(5)(b)(ii)). The non‑certified risk assessment requires explicit consideration of country‑specific guidelines (for imports) or State‑specific guidelines (for raw logs) “as in force from time to time” (s 4 tables and ss 8(6)(b)(ii), 11(5)(b)(ii)). These guidelines are external documents and may be updated independently; failure to consult the correct, current guideline could be a compliance gap.

Exempt processing circumstance is narrowly drafted (s 9). The Rules prescribe a single exempt circumstance for processing: where the processor is the person who harvested the raw log (s 9). This is a narrow factual condition , processors who source logs from third parties, even small local harvesters, must still apply full processing due diligence.

Record retention is five years from import or processing date (ss 8(11), 11(10)). Practitioners must ensure data retention systems preserve records for exactly five years and allow easy retrieval for enforcement audits. Electronic archiving and chain‑of‑custody logs must match the statutory retention trigger day.

Overlap with customs obligations and other regulators. The Rules’ reliance on customs classifications and valuations creates exposure to customs audits. An importer may be compliant with these Rules yet be non‑compliant with separate biosecurity, quarantine or product safety laws; compliance programmes must therefore integrate multiple regulatory checklists.

Commercial contract risk. The Rules require sales/delivery documents to include certification claims consistent with database records (ss 8(4)(c), 11(3)(c)). That can generate contractual disputes with suppliers if supplier statements prove false or inconsistent; contracts should therefore include representations and warranties tailored to these documentary obligations.

In short, the principal practical traps are (1) narrow definitions and explicit exclusions (e.g. by‑products), (2) documentary and database verification requirements that are prescriptive and require supplier cooperation, (3) undefined standards (reasonable standard, significant change) that create legal uncertainty, (4) potential cost and capacity burdens from scientific testing, and (5) difficulties in tariff classification and customs valuation that determine coverage. Each of these is grounded in the Rules’ specific text.

Below is a practical, source‑grounded compliance checklist structured for importers and processors that mirrors the Rules’ requirements. Each step cites the relevant Rule provision and explains the concrete actions to implement a defensible due diligence program.

A. Preliminary triage: determine coverage (s 5; s 6)

1. Tariff classification. Before any further steps, classify the goods against the Customs Tariff Act 1995 headings listed in s 5. If the goods fall under one of the listed headings/subheadings (items 1-47 in s 5), proceed to the next steps. If classification is uncertain, obtain a binding tariff classification decision from customs or formal tariff advice to avoid retrospective coverage disputes.

2. Check recycled material exemption (s 6(1)-(3)). Determine whether the goods are recycled material under s 6(2). If the goods are by‑products of manufacturing (e.g. off‑cuts used to make particle board), the exclusion in s 6(3) applies and the exemption will not be available. Document the factual basis for any recycled‑material claim (how the goods were previously used, when they ceased to be the other thing, and evidence that the previous item was no longer used for its intended purpose).

3. Evaluate low‑value consignment exemption (s 6(1)(b); s 4, customs value). Calculate the customs value of the regulated timber products in the consignment using Division 2 of Part VIII of the Customs Act 1901. If the total customs value of the regulated timber products in the consignment does not exceed A$1,000, the exemption applies to the relevant Act paragraphs. Preserve the valuation calculations and supporting invoices.

B. Set up the due diligence system and administrative fields (ss 7 and 10)

4. Due diligence system minimum fields. Implement an internal due diligence system or module containing at minimum the prescribed fields:

• For importers: importer’s full name, street address, postal address, telephone, email; if the importer is not an individual, name/position/contact details of the individual responsible for maintaining the system; and if importing in connection with a business, principal business activity and ABN/ACN (s 7(a)-(c)).

• For processors: name, street and postal address, telephone, email; if not an individual, name/position/contact details of the person responsible; and if processing in connection with a business, principal business activity and ABN/ACN (s 10(a)-(c)).

Log system changes and date stamps for auditability.

C. Information gathering before importation or processing (ss 8(3), 11(2))

5. Collect core documents and data. For each shipment or batch, obtain and record as much as reasonably practicable of the following before import/processing:

• Product description: type, trade name, common and scientific species name (s 8(3)(a); s 11(2)(a)).
• Origin: country and area of harvest; for processors, State or Territory and harvest area (s 8(3)(b); s 11(2)(b)).
• Processing origin: if applicable, country where product was processed or manufactured (s 8(3)(c)).
• Supplier details: name, address, trading name and business registration number if any, and for processors supplier ABN/ACN if any (s 8(3)(d); s 11(2)(c)).
• Quantity metrics: volume, weight or unit count (s 8(3)(e); s 11(2)(d)).
• Sales or delivery documents showing the sale and any supplier claims (s 8(3)(f); s 11(2)(e)).

6. Evidence handling. Ensure copies of all supplier documents are preserved in the due diligence system and indexed by consignment/lot. Capture digital metadata (received date, sender, file hash) and maintain original commercial documents where required.

D. Certification verification steps (ss 8(4), 11(3))

7. For claimed “certified” goods: obtain an extract of the supplier’s certification record from the Forest Stewardship Council or PEFC database showing that the regulated timber product and, if applicable, species fall within the supplier’s certification scope (s 8(4)(a); s 11(3)(a)). Do not rely solely on a supplier’s oral or email statement.

8. Verify the database details. Cross‑check the database record against the supplier details in the sales/delivery document (supplier name, contact details, scope of certification) and verify the record’s currency (s 8(4)(b); s 11(3)(b)). Document the verification steps and record the database extract copy.

9. Ensure the sales/delivery document contains a certification claim consistent with the database record (s 8(4)(c); s 11(3)(c)). Retain that sales/delivery document and the database record copy for five years.

E. Risk identification and assessment (ss 8(5)-(7), 11(4)-(6))

10. Perform a pre‑import/pre‑processing risk assessment. Use separate assessment templates for certified and non‑certified goods that capture the explicit list of matters in the Rules:

• For certified goods: include the information obtained under step 5, the extent of illegal logging in general involving entities known in the supply chain, and any other information known that may indicate illegal logging (s 8(5); s 11(4)). Record evaluation of the source, validity and reliability of each matter (s 8(5)(c); s 11(4)(c)).

• For non‑certified goods: include the information obtained under step 5, country‑specific guidelines (imports) or State guidelines (processors) where applicable, extent of illegal logging for known entities, species/genus‑level illegal logging prevalence, conservation status including CITES listings, extent of illegal logging in the harvest area, armed conflict, corruption, forest governance arrangements, and any other relevant information (s 8(6)(b)(i)-(x); s 11(5)(b)(i)-(vii)). Record assessments of source validity and reliability (s 8(6)(c); s 11(5)(c)).

11. Apply the “reasonable standard”. Structure the assessment to show what enquiries were made, what sources were consulted (databases, country or State guidelines, supplier documents), and why the outcome meets a reasonable‑standard determination (s 8(7); s 11(6)). Save a dated written record of the risk identification and assessment (s 8(5)(d); s 8(6)(d); s 11(4)(d); s 11(5)(d)).

F. Risk mitigation and reassessment (ss 8(8)-(9), 11(7)-(8))

12. If the assessment identifies any risk that is not low, commence a mitigation process before import/processing that is reasonable and proportionate to the identified risk (s 8(8)(a)-(b); s 11(7)(a)-(b)). Design the mitigation steps in escalating order: obtain further documentation from the supplier, request chain‑of‑custody evidence upstream, obtain additional geographic provenance data, or seek third‑party verification.

13. Use scientific timber identification if necessary. Where provenance or species is disputed or unclear, consider scientific methods to identify species and the likely harvest area, recognising cost and lead times (s 8(9)(b); s 11(8)(b)). Keep provenance chain records for samples and lab reports.

14. Post‑mitigation reassessment and record (s 8(8)(c)-(d); s 11(7)(c)-(d)). After mitigation, reassess the residual risk and make a written record of the mitigation process, residual risk level, and any further information obtained. Retain these records for five years.

G. Repeat transaction pathway (ss 8(10), 11(9))

15. If the importer/processor imported/processed an earlier, similar product/log in the previous 12 months and complied with the full due diligence then, and the current and earlier product/logs are both certified or both non‑certified and have the same information in the ss 8(3)(a)-(d) or s 11(2)(a)-(c) fields, the importer/processor may rely on that earlier compliance but must still:

• Consider whether there has been a significant change in circumstances since the earlier compliant transaction (s 8(10)(e)(i); s 11(9)(e)(i)).
• If satisfied no significant change has occurred, make a written record to that effect (s 8(10)(e)(ii); s 11(9)(e)(ii)).
• Maintain the same retention schedule for the earlier and current records.

H. Record retention and audit readiness (ss 8(11), 11(10))

16. Retain all specified records for five years from the day of importation or processing (s 8(11); s 11(10)). That includes the information gathered under ss 8(3) or 11(2), copies of FSC/PEFC database records and supplier sales/delivery documents where certification was relied upon, and written risk assessment and mitigation records. Design archive procedures to permit prompt retrieval and export of records for audits or enforcement inquiries.

I. Contractual and supplier management

17. Update procurement contracts and supplier onboarding templates to require the supplier to provide:

• Certification records or database proof extract (FSC/PEFC) and consistent certification claims in sales/delivery documents (ss 8(4)(a)-(c); 11(3)(a)-(c)).
• Accurate supplier commercial identification details (s 8(3)(d); s 11(2)(c)).
• Representations and warranties regarding origin, species, and the absence of illegal logging or fraudulent documentation; indemnities against supplier misrepresentations are commercially prudent.

18. Maintain a supplier register indexed by certification status, last assessment date, and risk rating. Where suppliers are in high‑risk jurisdictions, increase verification frequency and document escalation measures.

J. Integrate with customs and other compliance regimes

19. Ensure customs valuation and tariff classification workflows feed into the legal triage in step A, particularly where consignments are mixed or borderline under s 5. Maintain customs decisions and valuation calculations as part of the five‑year file.

20. Coordinate due diligence with other regulatory obligations (quarantine, import permits, biosecurity). The Rules do not displace these other regimes.

K. Senior oversight and training

21. Nominate and document the responsible officer required by ss 7(b) or 10(b) where the legal entity is not an individual. Ensure that person’s contact details are in the due diligence system and that they sign off on high‑risk assessments and mitigation decisions.

22. Train commercial, procurement and customs teams on the Rules’ documentary and assessment requirements. Provide procedural templates for assessments, mitigation, and “no significant change” memos.

L. Practical resource planning

23. Budget for potential scientific testing and third‑party checks for high‑risk species or origins (s 8(9)(b); s 11(8)(b)). Identify accredited timber‑ID laboratories or forensic providers in advance.

24. Plan for the administrative load of five‑year retention and for responding to audits. Where volumes are high, automate document capture and record indexing.

By mapping each operational step to the specific sections of the Rules and embedding evidentiary trails and supplier contractual protections, importers and processors can structure a defensible, auditable compliance programme that addresses the Rules’ prescriptive documentary, verification, assessment and mitigation requirements.
