#### 5A Delegation of functions of next of kin 5A Delegation of functions of next of kin > > (1) A next of kin of a deceased person may from time to time, by instrument in writing, authorise a person to exercise his or her functions under this Act as a next of kin of the deceased person. > > > (2) In such a case, the person so authorised— > > > > > (a) may exercise the functions of a next of kin of the deceased person under this Act (other than the function conferred by subsection (1)), in the place of the person who authorised him or her, and > > > > > (b) is taken, for the purposes of this Act, to be a next of kin of the deceased person, and > > > > > (c) for the purposes of the definition of senior available next of kin in section 4 (1), is taken to be a next of kin of the same order as the person who authorised him or her to exercise the functions of a next of kin. > > **s 5A:** Ins 2003 No 18, Sch 2 \[9\].
