HOUSING REGULATIONS 1983

This instrument relies on a set of discrete, recurring concepts and cross-references. For practical application, these are the principal notions to track and the operational consequences they carry.

• Social housing scheme and scheme for approved persons (reg 3B; reg 3C). The Regulations identify two prescribed schemes under the Act. The social housing scheme (Part 2) covers letting by the Chief Executive Officer (Housing) and facilitation of housing by community housing providers (reg 3C). Part 3 sets up a separate scheme for “approved persons and their employees” and contains acquisition, sale and letting powers for that cohort (regs 6-11). The schemes are distinct in purpose and subject to differing entry rules and approvals (for example, Ministerial approval appears for some approvals in Part 3, reg 7(1)(b)).

• Eligible person (appears throughout; not defined in these Regulations). The Regulations repeatedly use the term eligible person (for example, reg 4(1) and reg 3C), but the text of the Regulations does not provide a definition. The disqualifying-offence definition in reg 3A specifically references section 5 of the Act for the definition “disqualifying offence”; that cross-reference indicates that broader eligibility criteria are set in the Act rather than the Regulations. Practitioners must therefore consult the Housing Act 1982 for the primary definitions that determine who is eligible for social housing.

• Disqualifying offence (reg 3A; Schedule 1). The Regulations expand the Act’s definition of disqualifying offence by listing classes of offences: indictable offences under the Criminal Code and the Misuse of Drugs Act 1990 (Part A, Sch 1), specified firearms and weapons offences (Parts B and C), a catalog of summary offences (Part D), a domestic and family violence offence (Part E), and Commonwealth offences punishable by imprisonment for two years or more (Part F). The regulation also includes foreign offences equivalent to those listed and any offence that resulted in a sentence of imprisonment, whether suspended or not (reg 3A(1)(b)-(c)). This places conviction history, including foreign convictions and sentences of imprisonment, within the statutory eligibility calculus.

• Concurrent lease (reg 5A(1)(b); reg 5C). A concurrent lease is a lease granted by the Chief Executive Officer (Housing) to a community housing provider over premises that are, or were, let under Division 2. On commencement of a concurrent lease, rent payable by a tenant after commencement becomes payable to the community housing provider (reg 5C(2)(a)), rent arrears remain with the Chief Executive Officer unless otherwise agreed (reg 5C(2)(b)), and the premises cease to be public housing premises (reg 5C(2)(c)). The concurrent lease is therefore a structural device for transferring operational responsibility for tenancies while preserving some existing arrears position for the Territory unless parties agree otherwise.

• Community housing provider arrangements (reg 5A-5B). The Chief Executive Officer (Housing) or the Territory may grant a lease of vacant premises, grant concurrent leases, or enter into agreements for funding, asset transfer or other assistance to facilitate housing provision by community housing providers (reg 5A(1)(a)-(c)). Such leases or agreements may contain any conditions the CEO or the Territory considers appropriate (reg 5A(2)). When premises are the subject of these arrangements, the provider must let them at the rent determined under section 23 of the Act (subject to any rebate obligations in the lease or agreement) and on terms that comply with these Regulations and the Residential Tenancies Act 1999 (reg 5B(2)(a)-(b); reg 5B(3)).

• Information sharing and privacy (reg 5C(3)-(5)). When a concurrent lease is granted, the Chief Executive Officer (Housing) must not provide personal or health information about a tenant to a community housing provider unless satisfied the provider has appropriate procedures to protect that information from misuse, loss, and unauthorised access, modification or disclosure (reg 5C(3)). The regulation draws definitions of personal and health information from the Information Act 2002 (reg 5C(5)). Importantly, the Regulation states the consent of a tenant is not required for the CEO to enter a concurrent lease or to provide such information once the CEO is satisfied as to the provider’s procedures (reg 5C(4)).

• Rent and rebate mechanics (regs 4(2)(a), 5, 5B(2)(a)-(3), 8, 9). Rents for dwellings let under Division 2 and those let by community housing providers under Division 3 are to be determined under section 23 of the Housing Act (reg 4(2)(a); reg 5B(2)(a); reg 8). The CEO may award rent rebates in whole or in part at its discretion and for such period as it thinks fit (reg 5). A community housing provider must grant a rebate in accordance with the lease or agreement where the lease requires one (reg 5B(3)). Sale prices in Part 3 are subject to section 35 of the Act and are generally to be the market value (reg 9).

• Administrative enforcement via infringement notices (Part 5). The Regulations make some breaches subject to infringement notices (reg 14). Schedule 2 lists the specific Act provisions that are infringement offences (s 28D(5) and s 28E(4) of the Act) and prescribes amounts in penalty units (Schedule 2). Public housing safety officers can give infringement notices (reg 15), which must contain specific information and outline the person’s options including expiation by payment within 28 days or election for court proceedings under the Fines and Penalties (Recovery) Act 2001 (reg 16(1)-(2)). A prescribed amount is the monetary value of the penalty units specified (reg 14(2)).

• Procedural safeguards and ministerial approval points. The CEO’s discretion in some areas is constrained by procedural requirements or ministerial consent. For example, the CEO must be satisfied the person will use the dwelling as a home (reg 4(4)). The CEO may temporarily let a dwelling for not more than six months to a non-eligible person displaced by legal process with the Minister’s written consent (reg 4(5)). Acting as agent for an approved person in Part 3 requires Ministerial approval and the person’s consent and expense (reg 10).

These concepts are interdependent. For example, a concurrent lease will shift rent receipts and obligations but leaves rent arrears treatment to agreement, and it raises immediate privacy compliance steps because personal and health information may be shared without tenant consent when procedural safeguards for the provider are satisfied. Similarly, the administrative penalty machinery utilises the Fines and Penalties (Recovery) Act 2001 for enforcement, so infringement notices issued under these Regulations carry the broader enforcement consequences available under that Act.

The Regulations distribute rights, obligations and discretionary powers across several groups. The principal actors, as expressed in the text, are the Chief Executive Officer (Housing), the Minister, eligible persons and others seeking social housing, community housing providers, approved persons and their employees (under Part 3), tenants, public housing safety officers, and enforcement agencies. Each group faces specific rules and practical consequences under the Regulations.

• Chief Executive Officer (Housing). The CEO is the central decision-maker. The CEO has power to let dwellings to eligible persons (reg 4(1)), to determine rents (via s 23 of the Act , reg 4(2)(a)), to grant rent rebates (reg 5), to grant leases, concurrent leases or other agreements to community housing providers (reg 5A(1)), and to grant dwellings to approved persons or their employees (reg 7(1)). The CEO also has agent powers to assist approved persons to obtain housing for employees (reg 10), and an administrative power to withdraw an infringement notice within 28 days (reg 18). The CEO must satisfy certain conditions before letting (for example, that the intended use is residential, reg 4(4)), and must be satisfied about a provider’s information-protection procedures before sharing personal or health information under a concurrent lease (reg 5C(3)).

• Minister. The Minister has gatekeeping roles in several places. Ministerial written consent is required for temporary lets to displaced non-eligible persons for up to six months (reg 4(5)). In Part 3, approval by the Minister follows recommendation from the CEO for entities to be treated as approved persons (reg 6), and the Minister’s approval is required for certain sale/let terms when commercial/industrial/defence-related entities are the counterparty (reg 7(1)(b)). The CEO must obtain the Minister’s approval in order to acquire, let or sell dwellings to certain kinds of private employers (reg 7(1)(b)). The Minister must also approve assistance to charitable bodies that involves acquisition, letting, sale or agency assistance (reg 11).

• Eligible persons, tenants and displaced persons. Eligible persons are the class to whom the CEO may let dwellings under the social housing scheme (reg 4(1); reg 3C). The Regulations allow the CEO to give preference to eligible persons occupying insanitary or overcrowded dwellings, living in unsatisfactory housing conditions or who are homeless (reg 4(3)). Displaced non-eligible persons can be let premises for up to six months with Ministerial consent (reg 4(5)). Tenants of premises subject to a concurrent lease will, from the lease’s commencement, pay rent to the community housing provider and cease to occupy public housing premises (reg 5C(2)(a), (c)).

• Community housing providers. The Regulations explicitly contemplate arrangements to facilitate community housing providers (reg 5A). Providers can receive leases or concurrent leases, and the CEO or the Territory may enter agreements with them relating to funding, asset transfer or other assistance (reg 5A(1)(a)-(c)). Providers must let premises at the rent determined under section 23 of the Act and in accordance with the Residential Tenancies Act 1999, except where an agreement requires rebates, in which case the provider must comply with the agreement (reg 5B(2)-(3)). When a concurrent lease commences, providers become the recipient of post-commencement rents (reg 5C(2)(a)). They also must have credible procedures to protect personal and health information before the CEO may provide such information (reg 5C(3)).

• Approved persons and their employees (Part 3). Approved persons include the Territory and the Commonwealth, statutory authorities, permitted classes of private employers engaged in commercial/industrial or defence-significant activities who have Ministerial approval, certain bodies taken to be registered under the Corporations Act 2001, and bodies approved by the Minister as organisations promoting community services (reg 6). The CEO may acquire, let and sell dwellings to such approved persons or their employees, subject to agreed terms and Ministerial approval where required (reg 7). Rents for dwellings let to Commonwealth/public authorities or their employees must be at the rate determined under s 23 (reg 8). Sales are to be at market value, subject to s 35 of the Act (reg 9).

• Public housing safety officers. These officers are empowered to issue infringement notices when they reasonably believe a person has committed an infringement notice offence (reg 15). They must follow prescribed notice contents (reg 16) and issue seizure receipts in the specific form required by reg 13 when seizing items under section 28G(5) of the Act (reg 13).

• Enforcement agencies and the Fines and Penalties (Recovery) Act apparatus. Infringement notices identify an enforcement agency to whom the prescribed amount is payable (reg 16(1)(f)); enforcement follows the Fines and Penalties (Recovery) Act 2001. The Regulations make clear that enforcement consequences available under that Act (suspension of licences, seizure of property, wage deductions, registration of statutory charges, community work orders and imprisonment for breach of community work orders) may follow from non-payment or non-response to an infringement notice (reg 16(2)(c)).

• Private persons building on their own land. The CEO may contract with a private landholder to build a dwelling on that land under agreed terms (reg 12).

• Charitable bodies. The CEO may acquire a building to let or sell to certain charitable bodies, or assist as agent in obtaining a building for use other than as a residence, with Ministerial approval and subject to terms approved after consultation with the CEO (reg 11).

• Persons who have committed disqualifying offences. The disqualifying offence list (reg 3A and Schedule 1) affects applicants and tenants because convictions within the scope of that list are relevant to the statutory concept of disqualification in the Act.

Operationally, these groups are affected differently: the CEO bears most of the administrative operational burden and discretion; community housing providers must meet procedural and tenancy law obligations; tenants face transfers of rent recipients and potential data sharing without consent where the CEO is satisfied the provider’s procedures are adequate; public housing safety officers carry enforcement and seizure procedural obligations; and approved persons obtain market-value sales or commercial letting options with Ministerial consent in some cases. Each of those shifts requires documentation, procedural checks and in some cases ministerial approvals to be in place before action.

The Regulations allocate both discretionary powers and mandatory duties. Below are the principal rights and obligations, with precise references to the regulatory text where appropriate.

Chief Executive Officer (Housing) , duties and constrained discretions

• Power to let dwellings: The CEO may let a dwelling to an eligible person (reg 4(1)). This is permissive wording (may), but the letting, when made, must comply with regulation 5 (rent rebates), the rent determined under s 23 of the Act and any conditions the CEO thinks fit (reg 4(2)(a)-(b)).
• Use as a home: The CEO must not let a dwelling unless satisfied the person intends to use it as a home for them or their dependants and no other purpose (reg 4(4)). That is a mandatory precondition to letting.
• Preference: The CEO may give preference to an eligible person occupying insanitary or overcrowded dwellings, living under unsatisfactory housing conditions, or homeless (reg 4(3)). This establishes a triage-type discretionary priority but does not prescribe precise priority weights.
• Temporary letting to displaced non-eligible persons: With written Ministerial consent the CEO may let a dwelling for up to six months to a displaced non-eligible person who meets the same preference criteria as eligible persons, subject to the same requirement to be used as a home (reg 4(5)). This power is time-limited and requires Ministerial consent.
• Rent rebates: The CEO may, in its discretion, grant a rent rebate in whole or in part and for such period as it thinks fit (reg 5). This is a broad discretionary relief power for affordability or policy reasons.
• Agreements and leases with community housing providers: The CEO or the Territory may grant leases (including concurrent leases), and enter into agreements relating to funding, transfer of assets or other assistance, with conditions as considered appropriate (reg 5A(1)-(2)). While broad, these powers are framed to “facilitate the provision of housing”.
• Information protection precondition: When providing tenant personal or health information to a community housing provider as part of a concurrent lease, the CEO must be satisfied the provider has procedures to protect the information from misuse, loss and unauthorised access, modification or disclosure (reg 5C(3)). Consent of the tenant is not required for the CEO to enter into a concurrent lease or to provide information once the CEO is satisfied (reg 5C(4)).
• Agent powers: The CEO may act as agent, with Ministerial approval and with the consent and expense of the approved person, in arranging construction or purchase of housing for an approved person’s employees, including conducting negotiations and entering into contracts on behalf of that person (reg 10).
• Infringement notice withdrawal: The CEO may withdraw an infringement notice by written notice within 28 days after it is given and before payment (reg 18).

Community housing providers , duties and rights

• Lease and letting obligations: When premises are subject to a lease, concurrent lease or agreement with the CEO, providers must let the premises at the rent determined under s 23 of the Act (subject to any rebate obligation in the lease), and on terms that comply with these Regulations and the Residential Tenancies Act 1999 (reg 5B(2)(a)-(b); reg 5B(3)).
• Rebate compliance: If the lease or agreement requires the provider to grant a rebate of all or part of the rent, the provider must do so in accordance with that lease/agreement (reg 5B(3)).
• Recipient of rent upon concurrent lease commencement: Providers become the recipients of rent payable after the commencement of a concurrent lease (reg 5C(2)(a)). They do not, by default, become entitled to rent arrears that accrued before the commencement unless a contrary agreement exists (reg 5C(2)(b)).
• Information-protection requirement: Providers must have procedures to protect tenant personal and health information from misuse, loss and unauthorised access, modification and disclosure if they are to receive such information from the CEO (reg 5C(3)).

Tenants and persons facing infringement notices , rights

• Expiation: A person served with an infringement notice may expiate the offence by paying the prescribed amount to the specified enforcement agency within 28 days after the notice is given (reg 16(2)(a)).
• Election for court: A person may elect under section 21 of the Fines and Penalties (Recovery) Act 2001 to have the matter dealt with by a court instead of under that Act by completing a statement of election and giving it to the specified enforcement agency (reg 16(2)(b)). The infringement notice must include an appropriate form for making the statement of election (reg 16(3)).
• Information and notice content: Every infringement notice must contain specific identifying information, date/time/place of the offence, description, prescribed amount and specified enforcement agency among other information (reg 16(1)). These are minimum procedural protections for natural justice and notice.

Public housing safety officers , duties

• Issuance of infringement notices: A public housing safety officer may give an infringement notice when the officer reasonably believes a person has committed an infringement offence (reg 15).
• Seizure receipts: When a public housing safety officer seizes an item under s 28G(5) of the Act, they must issue a receipt containing the specified information (description, date and time of seizure, statement about three-month collection window, pickup location, name and signature of issuing officer) (reg 13).

CEO and provider interaction , duties regarding arrears and public-housing status

• Arrears: On commencement of a concurrent lease, pre-commencement arrears do not automatically transfer to the community housing provider unless otherwise agreed (reg 5C(2)(b)).
• Change of status: Premises subject to a concurrent lease cease to be public housing premises (reg 5C(2)(c)).

Other statutory interactions and duties

• Compliance with the Residential Tenancies Act 1999: Lettings by both the CEO and community housing providers are explicitly required to be in accordance with the Residential Tenancies Act 1999 (reg 4(2)(b); reg 5B(2)(b)).
• Definitions of personal and health information: The Regulations adopt the Information Act 2002’s definitions for personal and health information when prescribing information-protection duties (reg 5C(5)).

Penalties and enforcement particulars

• Infringement notice scheme: The Regulations set out the mechanics for infringement notices and the prescribed amounts calculated as the monetary value of the penalty units specified in Schedule 2 (reg 14(1)-(2); Schedule 2). The scheme does not preclude prosecution where no notice has been given and does not require that an infringement notice be given in lieu of prosecution (reg 19(2)(a)-(b)).

Collectively, these duties and rights form the operational backbone of the Territory’s approach to managing public housing stock, partnering with community housing providers, and administratively enforcing certain breaches. Several duties are conditional on Ministerial approval or satisfaction of procedural safeguards; others are discretionary to the CEO. Parties operating under these Regulations must track those conditions carefully when exercising powers or meeting obligations.

The Regulations embed an administrative enforcement track via infringement notices, define which Act provisions give rise to infringement offences, and prescribe the monetary amounts and procedural requirements for issuing and handling notices. They also point the reader to the enforcement tools available under the Fines and Penalties (Recovery) Act 2001.

Infringement notice offences and prescribed amounts

• An infringement notice offence is an offence against a provision specified in Schedule 2 (reg 14(1)). Schedule 2 identifies two specific provisions of the Housing Act 1982 as infringement offences: section 28D(5) and section 28E(4) of the Act, each with a prescribed amount of 0.5 penalty units (Schedule 2). The prescribed amount for an infringement notice offence is defined as the monetary value of the number of penalty units specified for the offence in Schedule 2 (reg 14(2)). Practitioners must therefore calculate the monetary sum by reference to the current value of a penalty unit.

Issuance of infringement notices

• Who may issue: A public housing safety officer may give an infringement notice where the officer reasonably believes a person has committed an infringement notice offence (reg 15). The combined effect is that public housing safety officers are the authorised administrative enforcers under this instrument for the offences listed in Schedule 2.
• Content requirements: An infringement notice must specify the person’s name and address if known, the date the notice is given, the date/time/place of the alleged offence, a description of the offence, the prescribed amount payable, and the enforcement agency (as defined in the Fines and Penalties (Recovery) Act 2001) to whom payment is to be made (reg 16(1)(a)-(f)). The notice must also include statements advising the person of their options: expiate by paying within 28 days, elect to have the matter dealt with by a court under the Fines and Penalties (Recovery) Act 2001, and the possible enforcement actions that follow if the person does nothing (reg 16(2)(a)-(c)). The notice must also include a form for making the election under section 21 of the Fines and Penalties (Recovery) Act 2001 (reg 16(3)).

Enforcement consequences via the Fines and Penalties (Recovery) Act 2001

• The Regulations do not themselves list enforcement powers beyond administrative expiation. Instead, reg 16(2)(c) explicitly warns that enforcement action may be taken under the Fines and Penalties (Recovery) Act 2001 if the person does nothing in response. The examples given are suspension of a driver’s licence, seizure of personal property, deduction from wages or salary, registering a statutory charge on land, making a community work order, and imprisonment if the person breaches such an order (reg 16(2)(c)(i)-(v)). These are statutory enforcement mechanisms outside the Housing Regulations themselves but are triggered by non-payment of prescribed amounts.

Payment and withdrawal mechanics

• Payment by cheque is conditional on clearance: a cheque tendered in payment of the prescribed amount is not taken to have been paid unless the cheque is cleared on first presentation (reg 17). This prevents premature discharge of liability based on an uncleared instrument.
• Withdrawal: The CEO may withdraw an infringement notice by written notice given to the person, but such withdrawal must be within 28 days after the infringement notice was given and before payment of the prescribed amount (reg 18(1)-(2)). This creates a limited administrative reprieve window and requires written communication.

Interaction with court proceedings and prosecutions

• The Part does not preclude the commencement or continuation of proceedings for an offence for which an infringement notice has been given unless the offence is expiated (reg 19(1)). The Part does not require an infringement notice to be given and does not prevent prosecution where no notice has been given (reg 19(2)(a)-(b)). It also allows more than one infringement notice for the same offence to be given to a person (reg 19(2)(c)), and enables expiation under any of multiple notices (reg 19(3)). These provisions preserve prosecutorial discretion and ensure the administrative notice scheme is not an exclusive enforcement path.

Seizure receipts and evidentiary consequences

• When an item is seized under section 28G(5) of the Act, the public housing safety officer must issue a receipt containing specific information, including that the seized item can be collected within three months if not retained as evidence (reg 13(a)-(e)). This creates a statutory minimum for recordkeeping and notice to the owner about retrieval rights. The three-month collection window is a precise time limit required to be stated on the receipt.

Scope and scale of sanctions

• The monetary amounts in Schedule 2 are small (0.5 penalty units for each listed Act provision), but the enforcement machinery enabled by the Fines and Penalties (Recovery) Act can have significant collateral effects (licence suspension, seizure, wage deduction, land charge registration, community work orders, imprisonment for breaching those orders), as the infringement notice informs the recipient (reg 16(2)(c)). Practitioners must therefore not equate a small pecuniary expiation amount with an absence of consequential enforcement risk where the enforceable apparatus is engaged by non-payment.

Administrative due process

• The notice requirements and the option to elect court proceedings (reg 16(2)(b)-(3)) provide a procedural path to contest a notice rather than purely administrative repayment. The CEO’s power to withdraw notices (reg 18) and the multiple-notice provisions (reg 19(3)) also affect strategic enforcement decisions.

In short, the Regulations create a two-tier enforcement environment: relatively low pecuniary infringement amounts set out in Schedule 2 with detailed procedural notice obligations, coupled with the full enforcement apparatus of the Fines and Penalties (Recovery) Act for non-payment or non-response. Seizure operations are procedurally constrained by the receipt requirements in reg 13. All of these mechanisms are designed to be administered by public housing safety officers and overseen administratively by the CEO.

The Regulations are tightly interwoven with the parent Housing Act 1982 and several other statutes. The text explicitly cross-references other statutes for definitions, procedural frameworks, and substantive limits. Practitioners must therefore treat these Regulations as part of a broader legal network.

Primary statutory anchors

• Housing Act 1982. The Regulations are made under and to give content to provisions of the Housing Act 1982. Key references to the Act present in the Regulations include:

  • The definition of disqualifying offence is integrated with section 5 of the Act (reg 3A references “for the definition disqualifying offence in section 5 of the Act”).
  • Rents for dwellings are to be determined under section 23 of the Act (reg 4(2)(a); reg 5B(2)(a); reg 8).
  • The infringement notice offences specified in Schedule 2 are provisions of the Act (s 28D(5) and s 28E(4)) and are actionable under the Regulations (reg 14; Schedule 2).
  • The form and content of receipts for seized items are specified for items seized under section 28G(5) (reg 13).
  • Other operationally material sections such as s 22 (to which reg 3B refers the prescribed housing schemes) and s 35 (subjecting sale prices in reg 9) are invoked.

• Residential Tenancies Act 1999. Lettings by the CEO and by community housing providers must be in accordance with the Residential Tenancies Act 1999 (reg 4(2)(b); reg 5B(2)(b)). This places tenancy law obligations and tenant protections in that Act alongside the CEO’s and providers’ obligations.

• Information Act 2002. The Regulations adopt the Information Act’s definitions of personal and health information when prescribing information-protection requirements for concurrent leases (reg 5C(5)). Reg 5C(3) requires the CEO to be satisfied a provider has procedures to protect that information. The Regulations also provide that tenant consent is not required where the CEO is satisfied (reg 5C(4)). This interaction creates a compliance interface with the Information Act’s standards and any applicable privacy and information-security obligations.

• Fines and Penalties (Recovery) Act 2001. The infringement-notice scheme leans on the Fines and Penalties (Recovery) Act for enforcement and procedural elections. Reg 16(1)(f) requires an infringement notice to identify the enforcement agency as defined in that Act; reg 16(2)(b) provides the statutory right to elect court proceedings under section 21 of that Act; and reg 16(2)(c) lists the enforcement actions available under that Act. This means enforcement steps and collateral sanctions are administered under, and subject to the rules of, the Fines and Penalties (Recovery) Act.

• Corporations Act 2001. Regulation 6(d) includes as an approved person a body taken to be registered in the Territory under section 119A of the Corporations Act 2001, thereby importing a federal corporate-registration construct into the relevant local approvals process.

• Criminal Code, Misuse of Drugs Act 1990, Firearms Act 1997, Weapons Control Act 2001, Summary Offences Act 1923, Domestic and Family Violence Act 2007. Schedule 1 expands disqualifying offences by reference to offences under those laws (Sch 1 Parts A-E). It also includes Commonwealth offences with penalties of two years or more (Sch 1 Part F). Foreign offences that would be equivalent to those listed are also included by reg 3A(1)(b), and any offence leading to a sentence of imprisonment is captured by reg 3A(1)(c).

Areas where operational friction arises

• Privacy vs operational transfer of tenancies. Reg 5C permits the CEO to disclose tenant personal and health information to a community housing provider without tenant consent once the CEO is satisfied about the provider’s procedures. This creates potential operational tension with the Information Act and privacy expectations because the consent requirement is removed but replaced with a procedural satisfaction test. Practitioners must reconcile the CEO’s statutory satisfaction duty with obligations under information law and any contractual data-protection requirements.

• Rent determination and tenancy law overlap. Rents are to be determined under s 23 of the Housing Act (for CEO and provider lettings) but lettings must also comply with the Residential Tenancies Act 1999 (reg 4(2)(a)-(b); reg 5B(2)(a)-(b)). The interplay requires administrators to ensure both statutory rent-setting rules and tenancy-law procedural protections are satisfied in lease terms, notices and dispute handling.

• Enforcement baton passing. The administrative pecuniary amount in Schedule 2 is modest, but enforcement follows the Fines and Penalties (Recovery) Act, which enables non-payment consequences that extend beyond the housing context. Users must be aware of cross-act enforcement consequences including licence suspensions and statutory charges on land, which can affect tenant and owner property rights beyond tenancy issues (reg 16(2)(c)).

• Treatment of arrears on concurrent leases. Reg 5C(2)(b) provides that arrears payable before the commencement of a concurrent lease do not automatically transfer to the community housing provider unless otherwise agreed. This requires explicit contractual allocation of arrears in any concurrent lease and clarity about debt-recovery responsibilities between the CEO and provider.

• Ministerial consent points. The Regulations incorporate ministerial control over certain discretionary acts (temporary lettings to displaced non-eligible persons , reg 4(5); approvals for certain approved persons in Part 3 , regs 6, 7; assistance to charitable bodies , reg 11; agent powers under reg 10). In practice, this creates points where administrative action is conditional on political or executive approval, which may affect timelines and predictable delivery.

In sum, the Regulations do not operate in isolation: they rely on and must be applied with reference to the Housing Act 1982 for definitions and rent-setting; the Residential Tenancies Act for tenancy law; the Information Act for data definitions and likely privacy obligations; the Fines and Penalties (Recovery) Act for enforcement mechanics; and a range of criminal and regulatory statutes for disqualifying offence definitions. Compliance and dispute-resolution activity therefore requires cross-act coherence and explicit attention to where duties and powers overlap.

The reprint includes an amendment chronology and notes summarising the legislative changes to the Housing Regulations 1983 from their inception in 1983 through to the most recent amendments recorded in April 2024. The following points describe the amendment history as presented in the endnotes and the List of Amendments.

• Initial making and commencement. The Housing Regulations were made as SL No. 10, 1983; they were notified on 25 March 1983 and commenced on 15 April 1983 (Endnotes, List of Legislation).

• Early amendments. A first recorded amendment occurred by SL No. 36 of 1985, notified 11 December 1985 and commencing 15 January 1986, under the Housing Amendment Act 1984 (Endnotes). That amendment inserted reg 13 (receipt content for seizure) (List of amendments: r 13 ins No. 36, 1985, r 3).

• 1998 and early 2000s amendments. Amendments in 1998 (SL No. 21, 1998) changed r 3 and r 12, and other textual updates were made in the late 1990s (List of amendments: r 3 amd No. 21, 1998, r 2; r 12 amd No. 21, 1998, r 2). The Corporations Reform (Consequential Amendments NT) Act 2001 (Act No. 17, 2001) made consequential amendments relating to corporate registration references (Endnotes: Act No. 17, 2001; List of amendments: r 6 amd Act No. 17, 2001, s 22).

• Statute Law Revision and subsequent amendments. The Statute Law Revision Act 2005 and other miscellaneous changes effected non-policy alterations (Endnotes). The reprint lists numerous statutory instruments and Acts that have amended the Regulations, including the Local Court (Related Amendments) Act 2016, Local Court (Repeals and Related Amendments) Act 2016, and Justice Legislation Amendment (Drug Offences) Act 2016 (Endnotes).

• 2012 structural additions. Housing Amendment Regulations (SL No. 11, 2012) were notified 28 March 2012 and commenced the same day (Endnotes). The 2012 amendments inserted Part 5 (Infringement notice offences) and Schedules 1 and 2 (List of amendments: pt 5 hdg ins No. 11, 2012, r 4; rr 14-19 ins No. 11, 2012, r 4; sch 1 ins No. 11, 2012, r 5; sch 2 ins No. 11, 2012, r 5). They also introduced reg 3A (disqualifying offence) and related changes (List of amendments: r 3A ins No. 11, 2012, r 3). Several headings were amended as part of that 2012 package (List of amendments: pt 1 hdg amd No. 11, 2012, r 6; pt 2 hdg amd No. 11, 2012, r 6; etc.).

• Criminal Code Amendment (Property Offences) Act 2022. This Act (Act No. 24, 2022) made amendments that affected references in Schedule 1 (Endnotes). The reprint notes that Schedule 1 was amended by Act No. 24, 2022, s 35; and specifically item 3 in Part A of Schedule 1 concerns an offence as in force immediately before the commencement of a provision of that Criminal Code amendment (Sch 1 Part A item 3). The Criminal Code Amendment commenced 30 April 2023 (Endnotes).

• 2016 enactments related to courts. The Local Court (Related Amendments) Act 2016 and the Local Court (Repeals and Related Amendments) Act 2016 (Acts Nos 8 and 9 of 2016) are recorded in the endnotes and affected certain references in the Regulations (Endnotes; List of amendments: sch 1 amd Act No. 9, 2016, s 160; Act No. 8, 2016, s 42; Act No. 17, 2016, s 46).

• 2024 amendments. Most notably, the Housing and Related Legislation Amendment Act 2024 (Act No. 3, 2024) received assent on 14 March 2024 and commenced on 5 April 2024 (Endnotes). The Housing Amendment Regulations 2024 (SL No. 3, 2024) were made on 27 March 2024 and also commenced on 5 April 2024 (Endnotes). The List of Amendments shows that the 2024 changes inserted Division headings in Part 2, added reg 3B prescribing housing schemes, added reg 3C describing the social housing scheme, and inserted Division 3 provisions (rr 5A-5C) dealing with agreements with and leases granted to community housing providers (List of amendments: r 3B ins No. 3, 2024, r 4; r 3C ins No. 3, 2024, r 5; rr 5A - 5C ins No. 3, 2024, r 7). The 2024 amendments also modified earlier provisions of reg 4 and others to align with the new division structure (List of amendments: r 4 amd No. 21, 1998, r 2; No. 11, 2012, r 6; No. 3, 2024, r 6).

• Nature of changes. The amendment history shows a trajectory from the original 1983 regulations that focused on core CEO powers and tenancy processes, through a 2012 addition of an infringement notice machinery and disqualifying-offence provisions, to a 2024 structural refocus to formalise relationships with community housing providers and to split the social housing scheme into clearer operational divisions. The reprint’s List of Amendments documents which regulations were inserted, amended or renumbered and cites the instruments and parliamentary Acts responsible.

For practitioners, the key points from the amendment history are:

• The provisions concerning community housing providers and concurrent leases are recent insertions (2024) and therefore likely to be the focus of current policy implementation and administrative guidance.
• The infringement notice machinery and the expanded disqualifying-offence list were introduced in 2012 and have been in force since then, with later technical amendments.
• Relevant cross-act amendments (for example to the Criminal Code) have been reflected in Schedule 1 where they affect disqualifying-offence references.

The reprint’s endnotes provide the statutory sources and dates of commencement for each amendment; every practitioner should confirm the current text against the official Government Gazette or the Consolidated Legal Database to ensure they are working with the operative version.

The Regulations as reprinted do not include any case law or reported litigation history. The instrument itself is a statutory reprint and the endnotes and List of Amendments record amendments and commencement dates, but they do not record judicial determinations or interpretive authorities that have applied the Regulations.

What this reprint shows

• The reprint contains no entries in its endnotes or elsewhere listing cases or judicial decisions that have interpreted these Regulations. The List of Amendments and Endnotes are confined to legislative instruments and Acts that have amended the text over time (Endnotes), and there is no section titled “Cases” or “Authorities” that provides a litigation history.

What users seeking litigation history should do

• Search jurisdictional databases. To locate judicial decisions that have considered the Housing Regulations 1983 or their interaction with the Housing Act 1982 or other statutes (for example, cases dealing with concurrent leases, data sharing, or infringement notices), practitioners must search Northern Territory decisions reported in official law reports, local court lists, and online legal databases for mentions of the Housing Act 1982 or the Housing Regulations 1983.
• Search for administrative review and tribunal decisions. Some disputes under tenancy law and administrative decisions about allocations, disqualifications, or privacy could be the subject of tribunal or administrative review decisions. Relevant bodies may include local tribunals or administrative review panels that handle tenancy or public-housing disputes.
• Cross-reference related statutes. Because the Regulations interact with the Residential Tenancies Act 1999, the Fines and Penalties (Recovery) Act 2001 and the Information Act 2002, litigation may arise under those Acts and touch on the operation of the Regulations. Searches should therefore include case law under those statutes where the facts involve public housing operations or enforcement actions.
• Consider magistrates’ and local court decisions. The practical enforcement issues (seizures, infringement notices) may be litigated in lower courts; search criminal and civil registries for matters involving s 28D, s 28E or s 28G of the Housing Act 1982 or the equivalent provisions cited in the Regulations.

Limitations of this reprint for litigation research

• No substitute for a case-law database. The reprint is not a comprehensive litigation resource. It reflects statutory text and amendment history only. It does not summarise or cite judicial pronouncements, interpretations, or appeals that might clarify ambiguous provisions in the Regulations or illuminate how tribunals treat issues such as the CEO’s satisfaction regarding privacy procedures, the scope of “intends to use as a home” in reg 4(4), or the operation of concurrent leases in practice (reg 5C).
• Need for cross-referencing. Judicial interpretation may occur in decisions referring to the parent Housing Act 1982 rather than the Regulations. Locating authoritative judicial guidance therefore requires broad searches across statutes and courts.

In short, the reprinted Regulations show legislative content and amendment pathways but do not provide litigation history. Practitioners requiring judicial interpretation must consult legal databases and tribunal/court records to assemble a relevant body of case law.

The Regulations include several specific drafting points, procedural conditions and cross-act interactions that create practical pitfalls and compliance traps unless actively managed. Below are the principal “gotchas” drawn from the text, with precise references.

1. “Eligible person” is not defined in these Regulations

• The Regulations repeatedly use “eligible person” (for example reg 4(1), reg 3C) but do not define it. The definition and eligibility tests reside in the Housing Act 1982. Practitioners who rely on the Regulations without cross-referencing the Act risk misapplying eligibility criteria.

2. Disqualifying offence is broad and includes foreign convictions and any sentence of imprisonment

• Regulation 3A(1)(b) treats offences under foreign laws that would be equivalent to specified offences as disqualifying. Regulation 3A(1)(c) includes “any other offence … for which the offender was sentenced to a term of imprisonment ... whether or not the imprisonment was suspended in whole or in part.” Schedule 1 lists an extensive range of offences across criminal, firearms, weapons and summary-offences statutes. The practical consequence is that even suspended sentences and foreign convictions may disqualify applicants or tenants. Administrators must establish reliable processes for checking and assessing overseas convictions and sentences and for recording and assessing suspended sentences.

3. Tenant consent not required for data sharing on concurrent leases

• Reg 5C(3)-(4) requires the CEO to be satisfied a provider has procedures to protect personal and health information before the CEO provides such information, but reg 5C(4) expressly states tenant consent is not required for the CEO to enter a concurrent lease or to provide the tenant’s personal or health information if the CEO is satisfied as to procedures. This is a functional “no-consent-forwarding” rule: privacy compliance therefore rests on the CEO’s satisfaction decision, which should be documented and defensible. That places compliance risk on the CEO and the provider to demonstrate adequacy of procedures under the Information Act 2002 definitions (reg 5C(5)).

4. Concurrent lease transfers post-commencement rent but not necessarily arrears

• On commencement of a concurrent lease, rent payable after commencement becomes payable to the provider (reg 5C(2)(a)) but rent arrears before commencement remain payable to the Chief Executive Officer unless otherwise agreed (reg 5C(2)(b)). In practice this requires explicit contractual treatment of arrears in any concurrent lease to avoid disputes and unclear debt allocation between the Territory and the community housing provider.

5. Premises cease to be public housing on concurrent lease commencement

• Reg 5C(2)(c) states that premises cease to be public housing premises on commencement. That change of status has legal and policy consequences (eligibility rules, reporting, funding and public perceptions). Parties should be aware that concurrent leases produce a statutory effect on classification and status, not merely an operational change.

6. CEO discretion on rebates is wide

• Reg 5 allows the CEO to grant rent rebates of the whole or any portion and for such period as it thinks fit. The discretion is broad and unqualified. Clear policy criteria and recordkeeping are necessary to avoid inconsistent decision-making and to demonstrate rational exercise of discretion.

7. The infringement notice amounts are small but enforcement consequences can be large

• Schedule 2 prescribes 0.5 penalty units for each listed housing Act provision (s 28D(5) and s 28E(4)), but reg 16(2)(c) warns that failure to expiate can result in enforcement under the Fines and Penalties (Recovery) Act 2001, including licence suspension, seizure, wage deductions, land charges, community work orders and imprisonment for breach. The small pecuniary figure can therefore precipitate large collateral consequences if unattended , a practical mismatch between the immediate expiation sum and enforcement reach.

8. Technical notice requirements are strict

• An infringement notice must contain specified information (reg 16(1)) and include a form for election to go to court (reg 16(3)). Failure to include required elements could be a procedural ground to challenge a notice. Additionally, cheque payments are ineffective until cleared on first presentation (reg 17), offering a narrow timing trap.

9. CEO may give temporary tenancy to displaced non-eligible persons but only with Ministerial consent and for a limited time

• Reg 4(5) permits a letting for not more than six months to a non-eligible person displaced by process of law, with Ministerial written consent. This is a narrow exception with a strict time limit and the requirement for Ministerial consent, producing administrative dependencies and potential delays.

10. Ministerial approvals are frequent in Part 3 approvals and agency assistance

• Part 3 repeatedly triggers Ministerial approval obligations (reg 6 for approved persons, reg 7(1)(b) for letting/sale terms to some categories, reg 10 where CEO acts as agent requires Minister approval). This can create bottlenecks or political considerations in operational delivery.

11. The link to other laws means concurrent compliance tasks

• Practical compliance needs to reconcile the Housing Regulations with the Residential Tenancies Act 1999 (tenancy rights and dispute resolution), the Information Act 2002 (definitions of personal and health information and likely privacy obligations), and the Fines and Penalties (Recovery) Act 2001 (enforcement tools). Failure to adopt a cross-act compliance framework risks inconsistent or unlawful action.

12. The Regulations preserve prosecutorial discretion

• Reg 19 confirms that the infringement-notice scheme does not preclude criminal prosecution and does not require an infringement notice to be used instead of prosecution. Parties should be aware that administrative expiation is optional and may be supplemented by prosecution.

13. The definition of approved person in Part 3 contains several categories with different approval routes

• Reg 6 includes (a) Territory or Commonwealth; (b) statutory authorities; (c) private/commercial entities approved by the Minister after CEO recommendation; (d) bodies treated as registered under Corporations Act s 119A; and (e) bodies approved by the Minister that provide community-benefit services. Each category follows different approval mechanics and therefore different evidence standards and policy considerations apply when assessing applicants.

14. Seized-item collection deadline is short and must be recorded on the receipt

• Reg 13 requires the seizure receipt to include a statement that the seized item can be collected within 3 months of the date of seizure if not retained as evidence. Failure to state or track this three-month window could create disputes over property rights or constructive abandonment.

To mitigate these risks, administrators, providers and advisers must coordinate policy, procurement, privacy and debt-recovery practices, maintain documented decision-making trails (especially for CEO satisfactions and rebates), make Ministerial approval procedures efficient and auditable, and ensure infringement-notice processes and seizure operations follow the Regulations’ prescribed content and timing rules.

Compliance under these Regulations requires an operational framework that integrates statutory preconditions, Ministerial approvals, tenancy law conformity, information-security checks and administrative enforcement procedures. Below is a practical checklist for the principal actors,Chief Executive Officer (Housing), community housing providers, public housing safety officers, approved persons and private persons contracting for building, followed by recommended documentary and process controls tied to specific regulatory provisions.

Checklist for the Chief Executive Officer (Housing)

• Eligibility checks: Cross-reference the Housing Act 1982 definitions (including disqualifying-offence criteria in reg 3A and Sch 1) before letting. Implement a verified records process for convictions, including foreign convictions and suspended sentences (reg 3A(1)(b)-(c); Sch 1).
• Pre-let satisfaction: Document the factual basis for satisfaction that the proposed tenant intends to use the dwelling as a home (reg 4(4)). Keep signed declarations, supporting evidence of residency intent and assessment notes.
• Preference determinations: Maintain transparent criteria and records for awarding preference to persons in insanitary, overcrowded or homeless circumstances (reg 4(3)). Use standardised assessment forms and priority matrices to ensure consistency.
• Ministerial consents: Establish an internal workflow to obtain and record Ministerial written consent for temporary lets of displaced non-eligible persons (reg 4(5)) and other Ministerial approvals in Part 3 (regs 6-11). Track timelines and document approvals in a central register.
• Rebates: Adopt a rebate policy framework to guide discretionary decisions under reg 5. Record the reasons for rebates, their scope and duration. Ensure budgetary authority and financial tracking for rebate decisions.
• Agreements with community housing providers: Use standard-form agreements for leases, concurrent leases and funding/asset-transfer arrangements with conditions and model clauses addressing arrears allocation, rent determination under s 23, compliance with the Residential Tenancies Act 1999, and data-protection obligations (reg 5A(1)-(2); reg 5B(2)-(3); reg 5C(2)(b)).
• Data-sharing satisfactions: Implement an assessment checklist for provider procedures before sharing personal or health information. The checklist should evidence checks on encryption, access control, staff vetting, retention and destruction policies and incident response plans (reg 5C(3)-(5)). Record the satisfaction decision in writing and attach provider evidence.
• Concurrent leases: For concurrent leases, ensure explicit contractual allocation for pre-commencement arrears if necessary (reg 5C(2)(b)). Document transfer of rent receipts and ensure that tenants are notified of the change in recipient rent payments and the change of status from public housing premises (reg 5C(2)(a),(c)).
• Agent engagements: For acting as agent under reg 10, obtain written Ministerial approval, the approved person’s consent and confirmation of expense arrangements. Keep procurement and contract authorisation records.
• Seizure receipts: Ensure public housing safety officers issue receipts with the information required by reg 13 at the time of any seizure under s 28G(5); retain copies centrally for audit.

Checklist for community housing providers

• Rent and tenancy terms: Ensure lettings comply with the rent determined under s 23 of the Housing Act and with the Residential Tenancies Act 1999 (reg 5B(2)(a)-(b)). Implement tenancy agreements and standardised notices compliant with the Residential Tenancies Act.
• Rebate obligations: If the lease or agreement requires a rebate, implement billing and accounting processes to grant rebates exactly as specified (reg 5B(3)). Maintain reconciliation procedures with the CEO for budgetary tracking.
• Data-protection procedures: Have documented procedures to protect personal and health information from misuse, loss, unauthorised access, modification and disclosure. Provide evidence to the CEO to satisfy the reg 5C(3) requirement before receiving tenant information. Keep information-security certifications, policy documents and logs of access incidents.
• Arrears and billing transition: Agree in writing with the CEO on arrears treatment in concurrent leases (reg 5C(2)(b)) and maintain clear processes for collecting post-commencement rent now receivable by the provider (reg 5C(2)(a)). Ensure transfer of tenant account records is secure and documented.
• Reporting and compliance: Record the change of premises’ status to non-public housing when a concurrent lease commences (reg 5C(2)(c)) and update registries and funding reports accordingly.

Checklist for public housing safety officers (infringement notices and seizures)

• Infringement notices: Issue notices only where the officer reasonably believes an infringement offence has occurred (reg 15). Use a standard notice template that includes all required content under reg 16(1) and the election form under reg 16(3).
• Timing and payment handling: Ensure the notice specifies the 28-day expiation window (reg 16(2)(a)). If accepting cheques, process them such that they clear on first presentation before treating the amount as paid (reg 17).
• Withdrawal process: If a notice is to be withdrawn, ensure written withdrawal is issued within 28 days of the original notice and before payment (reg 18).
• Seizure receipts: Issue seizure receipts with all required details (description, date/time, three-month collection statement, collection address, name and signature of officer) when exercising powers under s 28G(5) of the Act (reg 13). Keep duplicate copies and log serial numbers, custody chains and evidence retention decisions.

Checklist for approved persons and employers (Part 3)

• Ministerial approval processes: If seeking approved-person status under reg 6(c), secure the Minister’s approval after a CEO recommendation. Prepare evidence of commercial/industrial/defence-significant activities and the necessary corporate or organisational documents.
• Agency arrangements: Where the CEO may act as agent under reg 10, ensure clear written instructions, agreements on expense recovery and Ministerial approvals are in place before work commences.
• Market-value sales: If purchasing dwellings under reg 7 or reg 9, ensure valuations are obtained to comply with the market-value requirement subject to s 35 of the Act.

Documentary and record-keeping controls

• Central register of Ministerial consents and CEO satisfactions. Maintain a secure central register that logs Ministerial consents, CEO satisfactions (especially those authorising disclosure of personal/health information), concurrent leases and rebate decisions, with timestamps, rationale and supporting documents.
• Standard form clauses. Use model lease clauses that incorporate s 23 rent references, rebate mechanics, arrears allocation, data-sharing provisions and compliance with the Residential Tenancies Act 1999 to avoid bespoke drafting pitfalls.
• Privacy and information-security audits. Conduct periodic audits of community housing providers’ information-protection procedures and retain audit reports to support the CEO’s satisfaction under reg 5C(3).
• Enforcement log and notice templates. Keep templates for infringement notices that meet reg 16 content requirements and a log of notices issued, withdrawn (reg 18), and expiations received, including bank/cheque clearance evidence.
• Arrears ledger and transfer protocol. For concurrent leases, have a detailed ledger that distinguishes pre-commencement arrears from post-commencement liabilities and a written protocol for resolving arrears allocation disputes (reg 5C(2)(b)).

Operational risk controls and training

• Training for safety officers. Train public housing safety officers on the reasonable-belief standard for issuing notices (reg 15), precise content and timing requirements (reg 16), cheque-processing rules (reg 17) and withdrawal procedures (reg 18).
• Legal and procurement sign-offs. Require legal sign-off on concurrent leases, data-sharing agreements and rebate policies. Require procurement and budget sign-off when the CEO acts as agent (reg 10) or when entering building contracts with private landholders (reg 12).
• Tenant communications. When a concurrent lease is to commence, furnish tenants with advance written notice explaining the change in rent recipient, the change of premises’ status, and how personal information will be handled, even though the CEO is not required to obtain tenant consent to share information once satisfied (reg 5C(4)). Clear communication reduces disputes and reputational risk.

Monitoring and review

• Periodic reviews of rebate decisions and concurrent-lease outcomes to assess fiscal impacts and tenant outcomes.
• Regular reconciliation between CEO and provider records for rent receipts and arrears.
• Annual privacy compliance reviews to align provider procedures with current standards and to refresh CEO satisfaction evidence.

By following the checklists, documenting decisions, using model forms, and aligning processes with the cross-referenced statutes (Housing Act 1982 s 23, the Residential Tenancies Act 1999, the Information Act 2002, and the Fines and Penalties (Recovery) Act 2001), agencies and providers can reduce the risk of procedural error and legal challenge. The Regulations’ repeated reliance on CEO satisfaction and Ministerial approvals means those administrative steps should be explicit, auditable and accompanied by consistent policy criteria and recordkeeping.
