Horticultural Produce Commission Act 1988 (Western Australia)

The Agricultural Produce Commission Act 1988 establishes a statutory framework for producer-driven bodies to provide services for particular kinds of agricultural produce in Western Australia. Mechanically the Act does the following.

Creates the Agricultural Produce Commission (the Commission) as a body corporate (s 4). The Commission consists of 3 or 4 Minister-appointed members with published selection criteria and advertised vacancies (s 5). The Schedule sets terms, meetings, disclosure obligations and procedural rules for the Commission.
Authorises the Commission to establish, allocate responsibility to, appoint members of, supervise, wind up and dissolve producers’ committees that have responsibility for specified agricultural produce across the State or in part of the State (s 6; ss 10-11; ss 11A-11D; ss 14A-15A).
Grants producers, or bodies representing them, the procedural route to request polls to establish a producers’ committee (s 10) or to allocate additional produce to an existing committee (s 11A), subject to prescribed notice, deposit and polling requirements (ss 10(1A)-(5); 11A(3)-(5); 11B(4)).
Permits producers’ committees, subject to Commission direction, to provide a defined menu of services (including promotion, pest and disease control, research, education, market development, inspection and accreditation schemes, insurance and compensation schemes) and to arrange for those services to be provided by others (s 12).
Enables the Commission, with Minister approval and on advice from a producers’ committee, to impose charges for services and to determine their amount (s 14), and prescribes that moneys collected are to be credited to an agency special purpose account (the Agricultural Produce Commission Account) established under the Financial Management Act 2006 (s 7).

(3) If the procedure for establishing a growers’ committee under the Horticultural Produce Commission Act 1988 has been initiated but has not been completed before the commencement of this Act, that procedure may continue to be followed and be completed after the commencement of this Act as if this Act had not come into operation but if a committee is established under that procedure it is established as a producers’ committee with a name containing “Producers’” instead of “Growers’”.

5 The State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 Pt. 5, the State Administrative Tribunal Act 2004 s. 167 and 169, and the State Administrative Tribunal Regulations 2004 r. 28 and 42 deal with certain transitional issues some of which may be relevant for this Act.

The Act organises around a small set of statutory concepts whose meaning and interplay determine outcomes.

Commission and producers’ committees. The Commission is the central statutory actor (s 4). Producers’ committees are bodies established or allocated responsibility by the Commission to provide services for defined agricultural produce (s 3; ss 6 and 11). The Commission may establish committees for an entire industry in the whole State or part of the State (s 6(2); s 11(1)(a)(ii)).
Agricultural industry, agricultural produce, and producer. Defined terms are in s 3 and, for the special case of pest/disease control, s 19A expands the meaning of producer to include any quantity producers when a Ministerial Gazette declaration applies (s 19A(1)-(2)). The Act distinguishes agricultural industry (which includes horticultural industry and other prescribed industries, excluding livestock on pastoral leases) and agricultural produce (s 3(1)).
Services and charges. Producers’ committees may provide a listed set of services prescribed for the particular produce (s 12(1)(a)-(m)), including advertising, pest control, research, education, market expansion, inspection, grading systems, accreditation, voluntary insurance and compensation schemes (s 12). The Commission may, on request and advice of a producers’ committee and with Minister approval, impose charges for these services (s 14(1)). The Act requires charges to be determined having regard to cost and other relevant factors (s 14(2)), and allows regulations to set payment and collection mechanisms and grounds for waiver or refund (s 14(3)-(5); s 25(2)(ea)).
Polls and producer consent. Establishment, allocation of responsibility, and dissolution (in many cases) require a poll of affected producers (ss 10(1), 11B(1), 14A(1), 15(1)). The Act mandates public notice, invitation for submissions and publication requirements before polls (s 10(1B), (2)). However, the Commission retains discretion not to proceed if it considers the formation would materially detriment a producer financially (s 10(3)) and may refuse even where a poll is in favour if it considers establishment undesirable or impracticable (s 10(8); s 11C(2); s 11(1a)(b)).
Financial architecture and accountability. Funds of the Commission come from charges and assets of dissolved committees and are held in an agency special purpose account under the Financial Management Act 2006 (ss 7(1)-(3); s 20). The Commission and committees are subject to FMA and Auditor General Act rules (s 20(1)) and the Commission must maintain proper books (s 18(4)). The Treasurer may advance funds if Commissioner funds are insufficient and later recoup (s 8(2)-(3)).
Compliance and enforcement. The Act provides statutory authorised officer powers (Part 3A, ss 19B-19D) to require information and records, with a $1,000 fine for non-compliance (s 19E), and proscribes giving false or misleading information (s 19G, $1,000). Self-incrimination is constrained by a non-admissibility rule for compelled information (s 19F). Regulations may prescribe additional penalties up to $2,000 (s 25(2)(f)).
Ministerial oversight. The Minister may (i) appoint Commission members and the chair (s 5); (ii) give written directions to the Commission binding on it, which must be disclosed in the Commission’s annual report (s 6A); and (iii) access Commission information for parliamentary or public business purposes (s 6B). The Commission must comply with such access requests (s 6B(3)).

Mechanically these concepts are interlocked: producers initiate via requests and deposits (s 10), the Commission conducts notices and polls (ss 10(1B), 16), determines constitution and can appoint non-producers under conditions (s 11E), committees deliver services financed by charges (s 14), and authorised officers supervise compliance and collect records (Part 3A). The Act thereby creates a producer-service delivery model mediated by statutory administrative decision points, funding instruments and compliance tools.

The Act identifies and directly affects several discrete groups; the consequences for each follow deterministically from the statutory text.

Producers of agricultural produce. Producers are the primary intended beneficiaries and payers. Producers can initiate requests to form committees (s 10(1)), vote in polls on establishment, allocation, dissolution and service proposals (ss 10(7); 11C(1); 14A(1); 15(1); s 12(3) requires polls for new services), and are liable to pay charges imposed under s 14. Producers may be required by notice to provide prescribed statistical information to the Commission (s 13(1)) and may be directed by authorised officers to supply information and records (s 19D). Under s 19A a Ministerial declaration can temporarily expand the definition of producer to include those producing any quantity.
Applicant bodies or groups representing producers. Such bodies may request polls and must deposit costs for polls and initial establishment costs (s 10(1), (5)). They carry joint and several liability where the Commission performs functions for voluntary groups under s 19(2).
Producers’ committees and their members. Committees can provide the specified services (s 12). They hold funds which must be credited to the Agricultural Produce Commission Account (s 18(1)). Committees and members must maintain accounts and may be dissolved or have responsibility removed by the Commission (ss 14B; 15; 15A). Members may include non-producers appointed under s 11E; such appointees may participate in discussion but cannot vote (s 11E(3)).
The Commission, its members and staff. The Commission makes establishment, allocation, appointment, dissolution and charging decisions (s 6). Members are Minister-appointed, subject to disclosure and vacation rules in the Schedule. The Commission may employ staff with Minister approval (s 9) and designate authorised officers (s 19B). The Commission is not an agent of the Crown (s 4(3)), although Schedule s 24 provides protection from personal liability for acts done in good faith.
The Minister. The Minister appoints Commission members (s 5), approves charges (s 14(1)), may direct the Commission in writing (s 6A) and may access Commission information (s 6B). Directions must be published in the Commission’s annual report (s 6A(2)).
Third parties involved in service delivery. The Act permits committees to contract or arrange services to be delivered by other persons or organisations, and to accept grants or financial aid (s 12(1)(m); (k)). Persons engaged by the Commission to assist in fruit fly control may enter orchards under authorisation and notice requirements (s 12A).
Public financial regulators and auditors. The Commission and producers’ committees fall under the Financial Management Act 2006 and Auditor General Act 2006 for financial administration and audit (s 20(1)). The Treasurer may advance or recoup funds (s 8).

Who pays. Producers bear direct financial costs: deposits to initiate polls and establishment (s 10(5); s 11B(4)), ongoing charges for services (s 14(1)), and potentially joint and several liability where the Commission provides services to voluntary groups (s 19). The Treasurer may underwrite temporary cash shortfalls (s 8), but recoupment is expected when funds are available (s 8(3)). The Commission may recover poll costs from committee funds where deposits do not cover total costs (s 16B).

Who decides. Producers decide by poll; the Commission decides whether to proceed, how to constitute committees, and charges; the Minister decides on membership appointments, approves charges and issues directions to the Commission (ss 5, 6, 6A, 14). The State Administrative Tribunal has review jurisdiction over inclusion or omission from producer lists (s 16(2)).

Practical effect on private choice and markets. The Act enables producer collective organisation to supply services that otherwise might be provided by private contractors or government agencies (s 12). Charges and compulsory schemes (where applicable through committee services and authorised schemes such as inspection and accreditation) alter cost structures and compliance obligations for producers. The Act’s design centralises the power to impose charges with the Commission and Minister, meaning individual producers have a structured pathway for both initiating and contesting collective obligations but may still be subject to compulsory costs once a charge is legally imposed following the statutory process (s 14).

This section lists statutory duties and rights created by the Act, with section references and practical implications.

Duties imposed on producers and prescribed persons

Comply with notice for statistical information: The Commission may require prescribed statistical information in a specified form and timeframe (s 13(1)); failing without reasonable excuse is an offence with a $1,000 fine (s 13(2)).
Provide information and records to authorised officers: Under Part 3A an authorised officer may direct a relevant person to give information, answer questions or produce relevant records for compliance purposes (s 19D(1)). Directions must state times and may specify form and verification (s 19D(3)-(4)). Non-compliance without reasonable excuse is a $1,000 penalty (s 19E).
Avoid giving false or misleading information: It is an offence to give false or misleading information to authorised officers, to the Commission under s 13 notices, or to any person under information requirements connected to production, processing, sale or purchase or charges (s 19G(2)); penalty $1,000 (s 19G(2)-(3)).

Rights and protections for producers and others

Vote in polls and seek establishment/allocation/removal: Producers may request polls to establish committees (s 10(1)) or allocate produce to a committee (s 11A(1)), and may vote in polls under the procedures (ss 10, 11B, 11C, 14A, 15). The Commission must publish notices and invite submissions (s 10(1B); s 11A(4)-(5)).
Review of producer list decisions: A person aggrieved by inclusion or omission from a producers list can apply to the State Administrative Tribunal for review (s 16(2)).
Non-admissibility of compelled information: Information or records provided in response to a direction under s 19D(1) cannot be used in criminal proceedings against the individual from whom it was obtained, except for perjury or an offence under s 19G(2) (s 19F(2)). This provides limited procedural protection for compelled disclosures.
Right to at least one vote and weighted voting rules: Where the Commission makes a weighted voting determination, each producer must have at least one vote and votes are to be proportionate to production across the prior three-year period (s 16A(2)); determinations require sufficient industry data and a finding that weighted voting is in the industry’s best interests (s 16A(3)). Producers receive copies of such determinations (s 16A(4)).

Duties and powers of the Commission

Establish, allocate, remove and dissolve committees; appoint members; conduct polls; wind up committees (s 6(1)(a)-(f), (fa), (g), (h)).
Supervise and direct committees and their expenditure (s 6(1)(g)); provide staff assistance (s 6(1)(fa)); and provide other services as Minister may direct (s 6(1)(h)).
Determine and impose charges for services with Minister approval, accounting for cost and other factors (s 14(1)-(2)). The Commission is entitled to recover costs of polls from committee funds when deposits are insufficient (s 16B).
Maintain accounts and credit committee receipts to the Agricultural Produce Commission Account; apply funds to Commission functions (ss 7-8; s 18(1)-(4)). Financial administration is under the Financial Management Act and Auditor General Act (s 20(1)).
Designate authorised officers and exercise Part 3A compliance powers (s 19B; ss 19C-19D).

Ministerial duties and rights

Appoint Commission members and chair, and publish selection criteria and advertise vacancies; require disclosure of conflicts (s 5(1), (3)-(4), (5)).
Give written directions to the Commission which must be implemented (s 6A(1)); directions must be disclosed in the Commission’s annual report (s 6A(2)).
Approve charges the Commission seeks to impose (s 14(1)), and approve staff employment by the Commission (s 9).

Other statutory features affecting duties and rights

Trust and account rules: Charges collected by persons are held on trust for the producers’ committee pending payment to the Commission as prescribed (s 14(4)). Committees must credit all moneys received into the Agricultural Produce Commission Account (s 18(1)) and apply funds exclusively for the services for which the charges were imposed (s 18(2)), with limited reallocation rules (s 18(3)).
Entry to orchards for fruit fly control: Persons engaged by the Commission may, with producers’ committee authorisation, enter orchards to bait or spray subject to notice and consent conditions; notice must be given at least 24 hours before entry (s 12A(1)-(4)).

Practical implications. Producers must engage with notice and polling machinery to influence the creation of committees and services. If committees are established and charges lawfully imposed, producers become payers of collective services. Producers have procedural rights (polls, submissions, SAT review for list inclusion), but the Commission retains multiple discretionary decision points (s 10(3); s 10(8); s 11C(2); s 14(1), with Ministerial approval). Compliance duties (records and information) create ongoing administrative obligations and modest statutory penalties for non-compliance or false information (s 13(2); s 19E; s 19G).

The Act sets out a discrete enforcement architecture combining administrative compliance powers, monetary penalties for non-compliance and false information, record‑keeping and financial recovery mechanisms, and judicial avenues for recovery and review.

Monetary penalties and criminal-like offences

Failure to comply with a notice to furnish statistical information under s 13 is a fine of $1,000 (s 13(2)).
Failure to comply with a direction by an authorised officer under s 19D (to provide information, answer questions or produce records) without reasonable excuse attracts a fine of $1,000 (s 19E).
Giving false or misleading information to an authorised officer, the Commission under s 13, or any person where information relates to production, processing, sale or purchase or the payment or collection of charges is an offence with penalty $1,000 (s 19G(2)-(3)). The section defines false or misleading by false statements, material omissions and false documents (s 19G(3)).
Regulations may prescribe penalties not exceeding $2,000 for breaches of regulations (s 25(2)(f)). The Act itself lists the specific $1,000 fines; regulation-making power allows higher statutory fines for regulatory contraventions.

Administrative enforcement powers

Authorised officers. The Commission may designate employees as authorised officers (s 19B). For compliance purposes the authorised officer may direct relevant persons to provide information or produce relevant records, examine and copy records and retain them for a reasonable period (s 19D(1)-(2)). Directions may be oral or written, but directions for producing records must be in writing (s 19D(3)-(4)). The concept of "compliance purposes" is defined to include monitoring payment/collection of charges, compliance with information requirements, and investigating suspected contraventions (s 19C).
Retention and copying. An authorised officer may retain a produced record as long as reasonably necessary (s 19D(2)). This authorises temporary seizure and copying for investigative and compliance work.
Self‑incrimination protection. Individuals are not excused from complying with directions on grounds of self-incrimination (s 19F(1)). However compelled information or records are not admissible in evidence in proceedings against the individual, except for perjury or an offence under s 19G(2) (s 19F(2)). This limits the use of compelled material in criminal prosecutions beyond perjury or false information offences.

Financial recovery

Recovery of charges: Any moneys due to the Commission or a producers’ committee may be recovered by the Commission in any court of competent jurisdiction (s 22(1)). The Act previously contained a paragraph (2) that was deleted; recovery is now standard civil recovery.
Charges paid to persons are held on trust for the producers’ committee until paid to the Commission in accordance with regulations (s 14(4)). This creates fiduciary obligations for intermediaries who collect charges.

Administrative remedies and review avenues

State Administrative Tribunal review: A person aggrieved by inclusion or omission from the list of producers used for polls may apply to the State Administrative Tribunal for review (s 16(2)). The compilation notes point to the State Administrative Tribunal Act for relevant transitional matters.
Evidentiary presumptions: The Act includes statutory evidentiary presumptions in s 23 that make publication in the Gazette or production of a Gazette copy evidence of matters contained therein, and certificates purporting to be signed by prescribed officers are prima facie evidence of list inclusion. These presumptions can streamline enforcement and recovery but also place the onus on respondents to produce contrary evidence (s 23).

Operational enforcement constraints and checks

Limits on authorised officer powers: Part 3A restricts the purposes for which information may be obtained (s 19C compliance purposes definition) and creates procedural safeguards for how directions are given and the form required (s 19D).
Limited monetary penalties: The statutory fines are modest ($1,000) relative to potential commercial stakes. Regulations may increase penalties up to $2,000 for regulatory breaches (s 25).
Non-admissibility protects compelled respondents from criminal liability in many circumstances, but perjury and false information offences remain prosecutable (s 19F(2); s 19G).

Enforcement practice implications. The enforcement design prioritises information gathering and administrative remedies over heavy criminal sanctions. Authorised officers' ability to retain records and require information facilitates oversight of charging schemes and compliance with service delivery obligations, while statutory evidence presumptions and civil recovery routes enable the Commission to collect charges and enforce financial obligations. Producers and intermediaries collecting charges are put under fiduciary-like duties (s 14(4)). The Minister’s power to direct the Commission (s 6A) and to access Commission information (s 6B) provides an additional layer of oversight that can affect enforcement priorities.

The Act explicitly imports and interacts with other statutes and administrative regimes. The following are the principal statutory interconnections contained in the text.

Financial administration and audit

Financial Management Act 2006 and Auditor General Act 2006: The Commission and its operations are subject to the financial administration, audit and reporting provisions of those Acts (s 20(1)). The Agricultural Produce Commission Account is established as an agency special purpose account under the Financial Management Act (s 7(2)). Committees must maintain accounts in a manner and form approved by the Treasurer (s 20(2)). These cross-references mean the Commission and committees must comply with public sector financial controls, appropriation/agency account rules, and Auditor General scrutiny.
Treasurer powers. The Treasurer may advance moneys to the Commission to meet deficiencies and recoup such advances when it is appropriate (s 8(2)-(3)). The Treasurer’s role creates a fiscal backstop and a potential recoupment pathway outside producers’ charges.

Administrative law and review

State Administrative Tribunal Act: The Act permits review by the State Administrative Tribunal of decisions about inclusion or omission from producer lists (s 16(2)). The compilation notes record amendments conferring jurisdiction to the SAT. This creates an administrative law review path for procedural disputes connected to polls and membership lists.
Interpretation Act 1984. Sections 43 and 44 of the Interpretation Act apply to directions issued under s 11(3) (s 11(4)-(5)), meaning directions published in the Gazette have a statutory status akin to subsidiary legislation in certain respects and are subject to interpretation rules.

Land and biosecurity laws

Land Administration Act 1997. The Act adopts the definition of pastoral lease from the Land Administration Act (s 3). That definition is used to exclude certain livestock pastoral lease enterprises from the definition of "agricultural industry".
Biosecurity and pest control. Section 12A specifically authorises entry to orchards for fruit fly control schemes established by a producers’ committee, with notice and consent safeguards. Section 19A permits the Minister by Gazette notice to declare specified pests or diseases to which special rules apply and broadens the definition of producer where such a scheme is being established. The compilation notes reference the Biosecurity and Agriculture Management Repeal and Consequential Provisions Act 2007 in historical amendments, indicating prior interaction with Victorian/Wa biosecurity legislative frameworks.

Parliamentary accountability and access

Parliamentary Commissioner and parliamentary purposes. Section 6B allows Ministerial access to Commission information for parliamentary purposes and official business. The long title and earlier versions of the Act referred to amendments to the Parliamentary Commissioner Act 1971 and the Constitution Acts Amendment Act 1899, but those amendment provisions were later deleted by the 2021 amendments (compilation notes). Nonetheless s 6B creates an express mechanism for Ministerial oversight and parliamentary accountability by permitting the Minister to obtain and copy Commission documents for answering parliamentary questions and complying with House orders (s 6B(1)-(4)).

Evidence and procedural rules

Gazetting and evidentiary presumptions. The Act relies on Gazette publication for notices about establishment, allocation and dissolution of committees (e.g. ss 11(1), 11D(1), 14A(2), 15(5)). Section 23 makes Gazette publication prima facie evidence of the matters contained in notices and of steps taken prior to publication. Certificates signed by prescribed officers are prima facie evidence of producer list inclusion (s 23(d)). These provisions reduce transaction costs in litigation and disputes by shifting initial evidentiary burdens.

Employment and public sector rules

Public sector employment rules may apply to Commission remuneration and appointments. The Schedule requires Ministerial determination of remuneration for members on recommendation of the Public Sector Commissioner in certain circumstances (Schedule cl 2), and Commission appointments and procedures must comply with public sector disclosure and vacancy advertising standards (s 5(3)-(4)).

Regulatory powers

Regulations under s 25 are wide and may prescribe methods for determining producer eligibility, conduct of polls, the compilation of lists, methods of voting, collection/payment of charges, and penalties. This means the operational specifics of how charges are collected and enforced, and how polls are run, will be determined by subordinate regulation rather than the Act itself.

Overall interaction summary. The Act embeds producers’ committees and the Commission within the State’s public finance, audit and administrative law framework, subjects charging and financial flows to Treasurer and Auditor General oversight, links to the SAT for procedural disputes, and allows the Minister and Governor to influence or prescribe operational details through directions and regulations. Practitioners should therefore consider parallel obligations under the Financial Management Act, Auditor General rules, the Interpretation Act and the State Administrative Tribunal Act when advising clients on exercises under this Act.

The compilation table included in the provided text lists a sequence of legislative amendments and reprints from the Act’s inception to the 2021 Amendment Act. The Act began as the Horticultural Produce Commission Act 1988 and has been reconfigured and renamed in later amendments. Key legislative changes recorded in the compilation table and in-circuit textual amendments include the following, with the section numbers that reflect substantive changes where noted in the text.

1988: Original enactment as Horticultural Produce Commission Act 1988 (No. 75 of 1988). Initial commencement of most operative provisions occurred 1 September 1989 per s 2 and Gazette entry.
1993: Horticultural Produce Commission Amendment Act 1993 (No. 29 of 1993) introduced s 6A (Minister directions) and s 6B (Minister access to information) in their original form (see s 6 amendments). The long title and some functions were revised (compilation table).
1994 and 1996: Various statutory technical amendments and financial legislation cross-references, including the Financial Legislation Amendment Act 1996 which affected financial reporting/account matters (relevant to ss 7 and 20).
1998: Agricultural Legislation Amendment and Repeal Act 1998 (No. 9 of 1998) altered definitions and other provisions (s 3 amendments noted).
2000: Horticultural Produce Commission Amendment Act 2000 (No. 20 of 2000) effected the change from "Horticultural" to "Agricultural" in title and broadened the Act’s scope (long title, s 4 heading, various amendments to s 5, s 6, s 7, s 11, s 12, s 14 and s 18 are reflected in the text with "inserted" and "amended" notes citing No. 20 of 2000).
2004-2007: Administrative adjustments including conferral of State Administrative Tribunal jurisdiction (No. 55 of 2004), and Machinery of Government/Financial Legislation amendments aligning financial reporting with the Financial Management Act and Auditor General Act (No. 28 of 2006; No. 77 of 2006). The Biosecurity and Agriculture Management (Repeal and Consequential Provisions) Act 2007 (No. 24 of 2007) is noted in the compilation table. Section 12A (orchard entry for fruit fly control) was inserted by No. 24 of 2007 s 63 but its commencement and later amendments are reflected in the text and compilation notes.
2009-2010: Minor and formatting amendments (e.g. Bankruptcy-related amendments in 2009; standardisation of formatting and public sector reform in 2010 affecting Schedule provisions).
2021: Agricultural Produce Commission Amendment Act 2021 (No. 11 of 2021) introduced comprehensive modernisation. The 2021 Act added Part 3A (Compliance) , authorisation of officers and compliance powers (ss 19B-19F), introduced Division 2 in Part 3 for allocation of responsibility to existing producers’ committees (ss 11A-11D), created provisions for appointment of non-producers to committees (s 11E), updated s 12 to modern service lists and added compensation schemes (s 12(1)(la)), added weighted voting and poll cost recovery regimes (ss 16A; 16B), added s 20A permitting electronic service of documents, and other structural reforms (see references throughout the text to No. 11 of 2021).
Validation and transitional provisions. The 2000 Act contained validation provisions (ss 32-34 quoted in compilation notes) validating appointments and continuity from prior growers’/producers’ committees; the compilation notes record reprints at various dates (2002, 2009, 2013) showing incorporated amendments up to those points.

When advising on historic obligations or existing committees, practitioners must consult the compilation table and reprints to confirm which provisions were in force at a given time. The text provided includes the 2021 amendments that modernised compliance and allocation processes; many sections now bear "inserted: No. 11 of 2021" notes. The Act’s schedule and many sections record the amending Acts and sections that effected the change, enabling a timeline to be reconstructed from the compilation table and marginal notes in the text.

The provided text contains no judicial decisions, judicial interpretations, or references to particular litigation. The compilation and notes do, however, identify administrative review pathways and relevant tribunals which are the likely venues for disputes arising under the Act.

State Administrative Tribunal (SAT). Section 16(2) confers a right for a person aggrieved by inclusion or omission from a producers’ list to apply to the State Administrative Tribunal for review. The compilation notes include multiple entries (2004 amendment) referring to the conferral of jurisdiction to the SAT and transitional matters under the State Administrative Tribunal Act 2004. Practically any dispute about list inclusion/omission would proceed to SAT rather than to the courts in the first instance.
Evidentiary presumptions and certificates (s 23) and Gazette publication requirements (ss 11; 11D; 15) create procedural matters that could be challenged in litigation, for example where a party contests the adequacy of notice, the accuracy of the producer list, or the Commission’s compliance with procedural requirements prior to imposing charges or dissolving a committee. The Act itself provides the evidentiary framework by which a Commission’s published notices and certified documents are prima facie evidence of the facts they assert (s 23).
Civil recovery actions. Section 22(1) permits recovery of moneys due to the Commission or a producers’ committee in any court of competent jurisdiction. Accordingly, contested recoveries of charges could give rise to civil proceedings in the courts. The Act’s s 19F protections limit use of compelled information in such proceedings, but perjury and false-information offences remain actionable (ss 19F-19G), which could see parallel criminal or regulatory proceedings.
Administrative discretion challenges. The Act preserves substantial Commission discretion in multiple places (e.g. s 10(3) and s 10(8) allow the Commission to decline to conduct a poll or to refuse establishment despite a favourable poll; s 11C(2) allows the Commission to refuse allocation of responsibility to an existing committee after a poll). Disputes over the lawfulness of such discretionary decisions could be subject to judicial review principles if an affected person seeks to challenge the legality of a decision (e.g. for jurisdictional error, failure to consider relevant factors, or bad faith). The Act provides statutory procedures but does not limit judicial review; however the text contains no express privative clauses preventing judicial review.
No reported cases in the text. Because the source supplied is the statute compilation only, no reported judicial decisions are included. Practitioners should search case law databases for any SAT or court decisions interpreting the Act or its provisions, particularly after the 2021 compliance additions and the insertion of allocation and weighted voting provisions (ss 11A-11D; 16A-16B).

In the absence of cases in the provided text, the statutory review mechanisms and evidentiary presumptions give an initial picture of typical dispute types: producer list composition, adequacy of notice and polling procedure, lawfulness and reasonableness of Commission or Ministerial directions, challenges to imposition and collection of charges, and recovery actions for unpaid charges.

The Act contains several provisions that can produce unexpected consequences or procedural traps if practitioners, producers or committees do not pay attention. Below are concrete "gotchas", each tied to the statutory text.

Commission discretion despite favourable polls (s 10(8); s 11C(2)). A poll in favour of establishing a producers’ committee or allocating additional produce does not bind the Commission to act. The Commission may refuse if it considers establishment or allocation is "not desirable or practicable", meaning parties may incur deposit and polling costs without guaranteed formation. Applicants should plan for this discretionary hurdle.
Deposit costs can be forfeited temporarily and create cash-flow issues (ss 10(5)-(6); 11B(4), 11B(5), 16B). Requesting producers must deposit sums for the cost of the poll and estimated initial establishment expenses. While these sums are repayable if the Commission resolves to establish or allocate responsibility (ss 10(6); 11B(5)), poll costs that exceed deposits may be recovered from committee funds (s 16B), potentially leaving committees with unexpected liabilities after establishment.
Ministerial control and Ministerial access to documents (ss 6A; 6B). The Minister may give directions the Commission must follow (s 6A(1)), and the Minister may demand and copy Commission information (s 6B(1)-(3)) for parliamentary or public business. This limits Commission autonomy and means producers’ committees and the Commission must expect Ministerial scrutiny and possible shifts in policy direction.
Charges require Ministerial approval (s 14(1)). Committees and the Commission may determine service costs, but charges require Minister approval before imposition. Producers should factor in timing and political risk for approval steps.
Trust obligations for collected charges (s 14(4)). Parties collecting charges hold them on trust until delivered to the Commission per regulations. Intermediaries accepting payment on behalf of committees could face personal liability if they mishandle funds.
Self‑incrimination vs compelled disclosure (s 19F). Compelled information cannot be used against the discloser in criminal proceedings except for perjury or false information offences, but compelled records may still be used for civil recovery or administrative enforcement. Producers must be careful when responding to directions, they remain exposed to perjury and false information prosecution.
Modest statutory fines (ss 13(2); 19E; 19G) and regulatory ceiling (s 25(2)(f)). Monetary penalties in the Act are relatively low ($1,000) and regulations can prescribe up to $2,000. For high-value agricultural enterprises, these penalties may be insufficient deterrents and enforcement may rely more on administrative sanctions, civil recovery and reputational risk.
Weighted voting requires three‑year production data and an express best‑interests finding (s 16A(2)-(3)). The Commission cannot adopt weighted voting unless it has sufficient industry data and is satisfied weighted voting is in the industry's best interests. If data is poor, weighted voting cannot be implemented. Parties seeking weighted voting should ensure robust production records over three years.
Non-producer members can participate but not vote (s 11E). Producers’ committees may nominate non-producers for appointment if certain conditions are met (s 11E(2)), but such non-producers cannot vote (s 11E(3)). External expertise can be brought in, but voting control must remain with producers.
The Commission is not the Crown (s 4(3)), but officers and members have statutory indemnity for good faith acts (s 24). This has implications for contractual relationships and availability of Crown prerogative defences. While members and officers are protected from personal liability for good faith acts, the Commission’s status as not an agent of the Crown may affect sovereign immunities or procurement arrangements.
Orchard entry for fruit fly control requires at least 24 hours’ notice unless consent, with successive entries tied to that notice (s 12A(2)-(4)). Practically, committees must manage operational scheduling and landholder relations to comply with notice provisions; failure to observe notice rules could expose authorised persons to complaints or breach claims.
Reallocation of unused funds (s 18(3)). Money no longer required for the originally charged service may be reallocated by the Commission to another authorised service. Producers should track earmarked funds and engage with the Commission early if they object to reallocations.
Gazette publication and evidentiary effect (ss 11; 11D; 15; 23). Notices published in the Gazette are given statutory evidentiary weight. Parties should ensure Gazette notices are accurate and timely because they will carry strong evidentiary presumptions in any dispute.
Voluntary associations attract joint and several liability (s 19(2)). When a group of producers asks the Commission to perform functions and the Commission agrees, every group member becomes jointly and severally liable for approved charges. Small producers joining voluntary bodies should be aware of potential unlimited liability exposure to other members’ obligations.
Regulations fill operational gaps (s 25). Many operational matters are delegated to regulations (poll procedure, voting method, collection mechanisms, and penalties). Advice and compliance cannot rely on the Act alone; practitioners must inspect relevant regulations to understand detail and procedural obligations.

These "gotchas" arise from textual provisions and interplay between compulsory steps, ministerial oversight, and delegated regulation. Legal advice should treat the Act as a framework statute where many operational risks are resolved in subordinate instruments and administrative practice.

Practical compliance involves procedural readiness for producers, producers’ committee members, Commission staff and intermediaries who collect charges. Below are steps and checklists aligned to statutory duties and the Act’s architecture.

For producers initiating a request to form a producers’ committee or allocate produce to an existing committee

Prepare a written request meeting s 10(1A) or s 11A(3): specify the produce, objects sought, geographic scope (if part-State), and attach the producers’ committee’s written approval when allocating to an existing committee (s 11A(3)(d)). Ensure the request is in the correct form and delivered to the Commission.
Budget for deposit(s): the Act requires deposit of reasonable poll costs and estimated initial establishment costs (s 10(5); s 11B(4)). Confirm the Commission’s current deposit amounts and payment method, and document payment receipts.
Anticipate and prepare submissions: the Commission must publish notice and invite submissions (s 10(1B); s 11A(4)-(5)). Engage with other producers, prepare clear submissions explaining the proposed objects and financial impacts, and make those submissions within the specified timeframes.
Collect and prepare production data: if weighted voting is being sought (s 16A), secure three years of production data to demonstrate sufficiency and be ready to justify why weighted voting serves industry interests (s 16A(3)).

For producers who are members of a producers’ committee or subject to a charge

Understand the committee’s authorising instrument: confirm which services the committee is authorised to provide (s 12). Any new service requires a poll and committee must follow s 12(3).
Be aware of charging process and Ministerial approval: the Commission determines cost and with Minister approval may impose charges (s 14(1)-(2)). Check Gazette notices or Commission communications for charges and regulation-based payment directions (s 14(3); s 25(2)(ea)).
Maintain records: keep accurate production records and financial records to support voting weight, to respond to statistical notices (s 13), and to produce in compliance with authorised officer directions (s 19D). Ensure records are retrievable in the form required (paper/electronic) and can be statutorily verified if required.
Respond to information notices and authorised officers: if served with a notice under s 13 or a direction under s 19D, comply within the specified timeframe. Consider statutory protections under s 19F but do not ignore directions , failure to comply without reasonable excuse is an offence (s 13(2); s 19E).

For producers’ committees

Governance and constitution: ensure membership, quorum and procedural rules are in line with Commission directions and the Schedule (s 11(3)-(4); Schedule cl 6). Non-producer appointments must preserve producer majority and non-producers cannot vote (s 11E(2)-(3)).
Financial administration: establish and operate the account structure in accordance with the Financial Management Act obligations and ensure all moneys are credited to the Agricultural Produce Commission Account (ss 7(2)-(3); s 18(1); s 20(1)-(2)). Keep proper books as required by the Commission and Treasurer (s 18(4); s 20(2)).
Polls and new services: for any new services beyond those authorised, conduct a poll and charge the poll costs to the committee’s general funds (s 12(3)-(4)). Maintain transparency about poll methodology as regulations will specify polling procedures (s 17; s 25(2)(b)).
Charging collection and trust obligations: if collecting charges, act as a trustee for moneys until payment to the Commission as prescribed (s 14(4)). Establish internal controls for receipt, accounting and remittance in compliance with FMA requirements.
Manage defunct or failing committees: if the Commission dissolves or removes responsibility under ss 14B, 15 or 15A, be prepared to cooperate with the Commission-appointed liquidator and ensure assets and records are available for winding up (s 15(2); s 15(3B)).

For the Commission

Procedural compliance: publish notices and invite submissions as required (s 10(1B); s 11A(4)-(5)); ensure Gazette notices correctly set out the scope and dates for establishment/allocation/dissolution (ss 11(1); 11D(1); 15(5)).
Decision-making records: when exercising broad discretions (s 10(3), (8); s 11C(2)), document the financial detriment analysis and factual bases to defend decisions and to comply with transparency requirements.
Authorised officers and compliance: designate authorised officers in writing (s 19B), provide them with training on lawful directions and information-handling (s 19D), ensure retention and copying practices respect privacy and statutory limits, and create internal protocols for handling compelled disclosures given the limited admissibility of such material (s 19F).
Financial controls: maintain accounts, credit receipts to the agency special purpose account and comply with FMA and Auditor General requirements (ss 7(2); 18(4); 20).
Ministerial interactions: plan for and document Ministerial directions (s 6A), and systematise provision of information to the Minister where requested (s 6B). Ensure annual reporting discloses any directions given under s 6A(2).

For intermediaries and collectors of charges

Trust obligations and recordkeeping: money collected for committees is held on trust until remitted to the Commission (s 14(4)). Establish ring-fenced accounts and robust remittance procedures to avoid breach of trust risks.
Compliance with regulations: review regulations prescribing payment/collection mechanisms and persons responsible (s 25(2)(ea); s 25(2)(ea) and s 25(2)(f) for penalties). Failure to comply with regulatory obligations can attract fines up to $2,000.

Cross-cutting compliance tips

Check the Gazette and Commission notices regularly. Gazette publication is frequently the vehicle for operative changes including dates when committees commence or cease responsibility (ss 11(1); 11D(1); 15(5); s 23 evidentiary rules).
Preserve production data. Weighted voting and poll eligibility rely on prior production records (s 16A).
Engage early with the Commission on anticipated service delivery and cost models. Commission approval and Ministerial sign-off (s 14) are required before charging, so timing matters.
Seek clarification or SAT review early if omitted from producer lists (s 16(2)). Administrative remedies are available but time-limited.

By following the above process checklists and embedding accountancy, records, and governance controls consistent with the Financial Management Act, producers and committees can reduce legal and operational risk under the Act.
