Home Building Contracts Regulations 1992

The Regulations focus on four classes of operational rule: monetary thresholds, prescribed forms and notices, insurance parameters, and the enforcement/infringement framework. Each concept is functionally specific.

1. Monetary thresholds and scope

   • Regulation 2A prescribes two amounts for the statutory definition of “home building work contract” in section 3(1) of the Act: $7,500 (lower) and $500,000 (upper). The Schedule 1 notice reiterates that the Act covers contracts with a contract price greater than $7,500 and less than $500,000. That band determines whether the Act’s implied terms, prohibitions and procedural requirements apply to a particular contract.

2. Deposit and payment rules

   • Schedule 1 (the prescribed homeowner notice) describes permitted payments: a deposit before work begins capped at 6.5% of contract price in ordinary cases, and progress payments for work done or goods supplied thereafter. Regulation 3A creates a narrow exception for cabinetry work where off‑site work exceeds 50% of contract value. In that case the builder may demand a deposit of not more than 20% before commencement, expressly for cabinetry contracts described in regulation 3A(1).

3. Home indemnity insurance (HII)

   • The Regulations set insurer liability framing and minima for HII required under Part 3A of the Act. Regulation 5 limits any policy excess to $500 or less. Regulations 7A, 7B and 7C prescribe a $40,000 limit for loss of deposit coverage (s 25D(1)(a)(i)), and $200,000 minimum amounts for other specified cover requirements for builders and owner‑builders (s 25D(1)(e)(i) and s 25G(1)(c)(i)). Regulation 7 prescribes $20,000 as the minimum amount relevant to s 25A, aligning with the Schedule 1 notice that HII is compulsory for building work above $20,000 (with exceptions for associated work alone). Schedule 1 also summarises the effects and scope of HII, such as the kinds of loss covered (loss of deposit, non‑completion, failure to rectify), the situations that trigger HII (insolvency, death, cessation, disappearance or non‑registration on financial grounds of the builder), and the claim period (up to 6 years after practical completion).

4. Forms and enforcement

   • Regulation 3 prescribes the homeowner notice (Schedule 1) required by s 4(2). Regulations 9 and 10 prescribe Form 2 (infringement notice) and Form 3 (withdrawal of infringement notice) in Schedule 9 for the purposes of s 31B(3) and s 31B(7) respectively. Regulation 8 lists which Act provisions are infringementable and sets the modified penalties for each listed provision, mapping specific Act sections to monetary amounts for out‑of‑court disposition.

5. Contractor classes and owner‑builder rules

   • Regulation 6A prescribes classes of building service contractors (individual, partnership, company) for the purposes of the Act’s definitions of builder and owner‑builder in s 25A. That affects when certain statutory duties and exceptions apply to owner‑builders contracting with building service contractors.

These concepts tie to incentives and compliance choices. Thresholds channel which contracts attract statutory obligations; deposit caps and HII affect builders’ cashflow and balance‑sheet risk management; the specific HII amounts constrain insurer exposure and thus premium pricing; prescribed forms and infringement penalties create standardised compliance and enforcement paths that aim to lower transaction costs but which also create administrative obligations the builder must satisfy before accepting payment.

Primary affected parties are builders, owner‑builders, homeowners (owners), insurers, building service contractors, the Building Commissioner/Building Services Board and lending institutions. The Regulations also have secondary effects on subcontractors, suppliers and the market for building insurance.

• Builders and building contractors

  • Builders doing home building work within the monetary band greater than $7,500 and less than $500,000 (regulation 2A and Schedule 1) are directly governed by the Act and therefore must comply with the prescribed notice (regulation 3, Schedule 1), deposit limitations, written contract formalities set out in Schedule 1, HII obligations under Part 3A as specified in the Regulations (regulations 5, 7A, 7B), and risk of infringement notices listed in regulation 8. Regulation 6A prescribes building contractor classes, so those entities must ensure correct classification and registration where necessary.

• Owner‑builders and owners

  • Owners (people for whom work is done) are the recipients of the Schedule 1 notice, they must be provided a copy before signing a contract (regulation 3 requiring Schedule 1), and they are protected by statutory caps and procedures summarised in Schedule 1. Owner‑builders are affected because the Regulations prescribe minimum cover amounts applicable to owner‑builders in regulation 7C, and regulation 6A determines which classes of contractor interact with owner‑builders under s 25A.

• Insurers and the home indemnity insurance market

  • Insurers writing HII under Part 3A must comply with the maximum excess cap in regulation 5, and under the Regulations they face prescribed minima for cover and prescribed limits for loss of deposit (regulations 7A, 7B, 7C). Those numbers determine insurer exposure on certain claims and therefore influence premiums, underwriting standards and product availability.

• Building Commissioner, Building Services Board, courts and State Administrative Tribunal

  • The Building Commissioner receives complaints and administers dispute resolution under the Building Services (Complaint Resolution and Administration) Act 2011 as referenced in Schedule 1; the Building Services Board is the recipient of payments under Form 2 (Schedule 9 Form 2). Regulation 8 creates an infringement‑notice enforcement path for specified offences, which the Building Services Board and authorised officers will administer using Form 2 and Form 3 (regulations 9 and 10).

• Lenders and subsequent purchasers

  • Lenders and subsequent owners benefit from HII and the prescribed cover minima because HII covers successive owners for defects or failures within the specified conditions; lenders also exercise inspection rights under Schedule 1 and may require evidence of HII before advancing funds.

• Subcontractors and suppliers

  • Indirectly affected because deposit and payment caps affect a builder’s cashflow, which may alter the timing of payments to subcontractors and suppliers. Builders may change contracting strategies to mitigate limited upfront payments or increased insurance costs.

The Regulations create distributional effects. Builders pay for HII premiums and administrative compliance; insurers underwrite specified exposures; owners gain statutory protections including limits on deposit demands, prescribed notice content and the right to a written contract; the state enforcer apparatus has standardised forms and infringement penalty tooling to administer compliance. The Regulations also interact with owner‑builder arrangements and the market for cabinetry versus off‑the‑shelf goods via regulation 3A’s cabinetry definition and deposit rule.

The Regulations work with Schedule 1 to crystallise specific duties on builders and rights for owners, and to establish administrative duties for enforcement agencies.

Duties of builders (expressed in the prescribed notice and Regulations)

• Pre‑contract notice: Give a copy of the Schedule 1 notice to the owner before the owner signs the contract, per regulation 3 prescribing the form for s 4(2). Schedule 1 explains this requirement and supplies the exact prescribed form.
• Written contract requirements: Ensure the contract is written, dated and signed by both parties or their representatives, and give the owner a copy as soon as practicable after signing and before work starts, as stated in Schedule 1. Failure to comply gives the owner termination rights as explained in Schedule 1.
• Deposit limits: Demand only permitted pre‑commencement payments. Unless regulation 3A applies, the pre‑commencement deposit may not exceed 6.5% of the contract price; if regulation 3A applies to certain cabinetry work with off‑site work exceeding 50% of contract value, the builder may demand up to 20% (regulation 3A, Schedule 1).
• Home indemnity insurance: Take out HII where mandatory under the Act and give the owner a certificate confirming cover before commencing work or before demanding any payment, per Schedule 1. Regulations 7, 7A, 7B and 7C prescribe minimum sums and limits relevant to specified cover elements under the Act.
• Insurance policy terms: HII policies may have an excess of no more than $500 (regulation 5).
• Variations and prime costs: Put all contract variations in writing, signed and dated by both parties and provide a copy before the work resulting from the variation starts; ensure prime cost sums are estimated at or above the lowest reasonable cost to avoid prosecution for understating prime costs, as described in Schedule 1.
• No prohibited clauses: Do not include "rise and fall" clauses; only limited price increases are permitted and subject to specific exceptions set out in Schedule 1. Do not include provisions that are unconscionable, harsh or oppressive.
• Inspection: Do not prevent the owner or the owner’s authorised person or the lending institution from inspecting work within the restrictions allowed in Schedule 1.
• Defects liability: Rectify notified defects if the owner notifies a defect within 4 months after practical completion, unless a longer period is expressly agreed in the contract.
• Procedural duties: For contracts conditional on statutory approvals, both parties must do what they reasonably can to secure those approvals within 45 working days; where delays occur, schedule‑specified notice and compensation or termination rights are triggered.

Rights of owners

• Pre‑signature information: Receive the prescribed Schedule 1 notice before signing, and receive a copy of the contract before work begins.
• Deposit protection: Be protected against excessive deposit demands, as deposits are capped and HII covers loss of deposit up to the prescribed $40,000 limit where applicable (regulation 7A).
• Insurance evidence: Require evidence of HII prior to payment or commencement of work.
• Contractual remedies: Terminate a contract in specified statutory situations such as noncompliant cost‑plus contracts, breaches concerning deposit limits, or certain price increases after approval delays, as explained in Schedule 1.
• Inspection and rectification: Inspect the work, require defect rectification when notified within the statutory window, and seek redress via the Building Commissioner under the Building Services (Complaint Resolution and Administration) Act 2011 within the stated limitation periods.
• Dispute resolution: Make a complaint to the Building Commissioner within 3 years from the date the owner became entitled to take legal action about contract disputes; for service standard complaints, a 6 year window applies from completion (Schedule 1). Remedies under the Commissioner are capped at $100,000, with the State Administrative Tribunal able to make orders up to $500,000 on referral.

Enforcement and administrative duties

• Infringement notices: The Regulations, through regulation 8 and Schedule 9, tie specific Act offences to modified penalties and prescribe Form 2 and Form 3 for service and withdrawal of infringement notices. The Form 2 procedure makes payment within 28 days the out‑of‑court disposition, with non‑payment exposing the recipient to court proceedings.
• Recordkeeping and proof: Builders must be able to demonstrate that they complied with notice, contract, insurance and variation requirements to responsive regulators and, if necessary, courts.

Where the Regulations cite specific Act provisions (for example section references in regulation 8’s table), those mapped provisions determine the underlying statutory duty and whether an infringement notice is available; the Regulations standardise how agencies enforce those duties and quantify the out‑of‑court penalties for particular contraventions.

The Regulations establish both the civil administrative pathway for minor contraventions via infringement notices and the statutory context for criminal prosecution or civil action under the Act. Enforcement mechanisms combine administrative fines, court proceedings and regulatory dispute resolution.

Infringement notices and modified penalties

• Regulation 8 identifies which offences under the Act may be the subject of an infringement notice under s 31B, and sets the modified penalty for each listed provision in the Table contained in regulation 8. The Table maps Act provisions to monetary amounts. Examples from the Table include:
  • s 4(4): $400;
  • s 5(2): $100;
  • s 5(3): $1,000;
  • s 10(1) and s 10(5): $1,000 each;
  • s 25C(1): $2,000;
  • s 25C(2): $500;
  • s 26(1): $200.
• Regulation 9 prescribes Form 2 in Schedule 9 as the form of an infringement notice for s 31B(3). Form 2 states the procedure, including that the recipient may elect to have the matter heard by a court rather than pay, that payment must be made within 28 days to avoid that election being treated as declined, and that payment must be remitted to the Building Services Board at the specified address (Schedule 9 Form 2).
• Regulation 10 prescribes Form 3 (Schedule 9) for withdrawing an infringement notice under s 31B(7); Form 3 records whether the modified penalty was paid and whether a refund is enclosed.

Administrative and judicial pathways

• The Regulations do not create new powers of prosecution, but they operationalise s 31B’s infringement notice mechanism and require regulatory officers to use the prescribed forms and amounts.
• Schedule 1 reiterates that some contraventions attract prosecution and fines under the Act, and it sets out administrative routes for consumer complaints: complaints to the Building Commissioner under the Building Services (Complaint Resolution and Administration) Act 2011, with statutory monetary caps on orders: $100,000 for the Commissioner and $500,000 for the State Administrative Tribunal on referral.
• Form 2 makes clear that an owner or builder receiving an infringement notice may choose court proceedings instead of paying the modified penalty, but the risk then includes exposure to court costs and potentially higher fines if convicted.

Practical enforcement mechanics

• Authorised officers named in Form 2 for payment receipts include specified officers of the Building Services Board, and the form requires entry of the authorised person’s name and signature.
• The Table in regulation 8 concentrates modified penalties on particular operational provisions such as contract formalities, deposit/payment transgressions, and prescribed HII and owner‑builder obligations under the Act. This produces a predictable enforcement menu for regulators.
• Criminal prosecution remains available for serious or repeated breaches where the Act provides for it; the Regulations’ schedules and forms simply standardise lower‑level enforcement via penalty notices.

Risk allocation and compliance exposure

• Builders face both administrative penalties (modified penalties) for certain listed contraventions, and the threat of prosecution for other breaches the Schedule 1 notice lists as prosecutable offences. Owners may also be liable for some offences under the Act that apply to both parties, and those are encompassed in the Table where so listed.
• The Regulations set fixed monetary values for modified penalties. Those values are modest relative to the contract sizes covered by the Act, which could create an enforcement trade‑off: minor breaches are cheaply remedied by payment of the modified penalty, while more serious breaches will attract prosecution or civil claims via the Building Commissioner.

In sum, the Regulations prescribe the tools and amounts for day‑to‑day enforcement, while Schedule 1 explains to owners the rights and enforcement routes they may pursue under the Act and related complaint legislation. Builders and owners must balance the risk of administrative penalties, potential prosecutions and the costs of compliance or litigation.

The Regulations operate as subordinate legislation to the Home Building Contracts Act 1991 and interact with multiple statutory regimes and administrative actors. The principal interactions, as the source material states, are with the Act itself, Part 3A (home indemnity insurance), the Building Services (Complaint Resolution and Administration) Act 2011, building permit and Water Corporation approval regimes, builder registration requirements, and the State Administrative Tribunal.

Key cross‑statutory interactions

• Home Building Contracts Act 1991: The Regulations implement s 3(1), s 4(2), s 10(1)(a)(ii), s 25A, s 25D, s 25G and s 31B by prescribing amounts, forms and classes noted in regulation cross‑references. The Regulations therefore augment the Act by filling its numerical and procedural lacunae.
• Part 3A (Home indemnity insurance): Regulation 5 caps insurer excess on policies under Part 3A at $500. Regulations 7, 7A, 7B and 7C set the monetary minima and limits that Part 3A references for loss of deposit and minimum cover. Schedule 1 summarises HII provisions, including mandatory applicability above $20,000, exceptions, and claim windows up to 6 years. Those rules interact with insurance law and regulatory oversight of insurers offering HII products.
• Building Services (Complaint Resolution and Administration) Act 2011: Schedule 1 directs dispute resolution to the Building Commissioner under that Act. That statute provides the administrative complaint mechanism, time limits for complaints (3 years for contractual entitlement disputes, 6 years for building services standards), and monetary limits on Commissioner orders ($100,000) and State Administrative Tribunal orders ($500,000), per Schedule 1. That creates a two‑tiered administrative/judicial interaction for resolving building disputes.
• Building permits and Water Corporation approvals: Schedule 1 conditions many contracts on obtaining a building permit and Water Corporation approval within 45 working days. Those regulatory approvals sit in separate statutory regimes (planning/building law and water regulations) and delays in those processes trigger contract rights, price adjustments and termination options under the Act as set out in Schedule 1.
• Registration as a builder: Schedule 1 notes exceptions to HII where builder registration is not required. Built into the HII regime are references to registration thresholds; the Regulations’ definitions accompanying the Act determine when a person must be registered to be a builder and therefore when HII applies.
• State Administrative Tribunal and courts: The Regulations’ enforcement framework and the Schedule 1 notice interact with the civil courts and the State Administrative Tribunal for enforcement and appeals. The Building Commissioner can refer matters to the Tribunal, which can make orders up to the prescribed cap. Infringement notice recipients may elect court proceedings instead of paying the modified penalty, thereby involving the criminal/civil court system.

Administrative cross‑links

• The Building Services Board appears in the Form 2 payment instructions (Schedule 9), tying any infringement payment into the existing administrative infrastructure.
• Amendments listed in the compilation table show prior cross‑links such as the Commerce Regulations Amendment (Infringement Notices) Regulations 2019 and Consumer Protection Regulations Amendment Regulations 2019, suggesting that the infringement notice process and consumer protection interactions are harmonised across regulatory frameworks.

Practical implications of these interactions

• Builders must navigate multiple regulatory regimes concurrently: they must satisfy building permit and water approvals, maintain registration where required, obtain HII where mandatory and ensure their contracts conform to the Act and the Regulations. Delays or non‑compliance in one regime (eg failure to obtain a permit) have contract consequences under the Act as set out in Schedule 1.
• Insurers must underwrite HII consistent with standards prescribed by the Regulations; the $500 excess cap and prescribed cover minima limit how insurers can structure products for the home building market.
• Dispute resolution routes are split between administrative remedies and the courts, with monetary limits on administrative orders that parties must consider when selecting dispute resolution strategies.

Overall, the Regulations do not create new cross‑statutory obligations but provide the numeric and form inputs the Act requires to operate within the broader building, insurance and administrative enforcement framework.

The Regulations have been frequently amended since initial proclamation in 1992. The compilation table in the source documents each amendment instrument, its publication and commencement dates. Key amendments and insertions relevant to the current operative instrument include:

• 1992: Home Building Contracts Regulations 1992 originally published 3 April 1992, commenced 4 April 1992 (regulation 2). This established the Regulatory framework accompanying the Home Building Contracts Act 1991.
• 1994-2001: Multiple amendments across the 1990s and 2000 updated technical provisions and reprinted the Regulations (amendments in 1994, 1996, 1997, 1998, 2000, 2001). The 2001 amendments (Gazette 31 Jul 2001) added the infringement notice framework and Schedule 9 forms (see reg 8, 9, 10) and restructured forms, with commencement 1 August 2001 for many changes.
• 1997: Regulation 5 (home indemnity insurance maximum excess of $500) was inserted via the Home Building Contracts Amendment Regulations 1997, Gazette 24 Jan 1997, with commencement 1 Feb 1997.
• 1998: Regulation 7 prescribing a $20,000 minimum amount for s 25A was inserted by the 1998 amendment (Gazette 17 Jul 1998) and later amended in 2007.
• 2003: The Schedule 1 homeowner notice was substantially updated by the Home Building Contracts Amendment Regulations 2003 (Gazette 2 Sep 2003). Note that earlier r 4 and 4A were deleted in 2003.
• 2007: Regulation 2A prescribing the monetary thresholds for the definition of "home building work contract" (regulating the $7,500 and $500,000 amounts) was inserted via the 2007 amendment (Gazette 29 Jun 2007).
• 2011: Regulation 6A (prescribing building service contractor classes) was inserted by the 2011 amendment (Gazette 26 Aug 2011).
• 2019: Commerce Regulations Amendment (Infringement Notices) Regulations 2019 (Pt. 5) and subsequent consumer protection amendment instruments in 2019 and 2020 updated cross‑references and regulatory enforcement mechanics; the 2019 instrument commenced 27 Apr 2019.
• 2020: Regulation 3A (prescribed payment for cabinetry work permitting up to a 20% deposit where off‑site work exceeds 50% of the contract) was inserted by SL 2020/66, with commencement 27 May 2020.
• 2022: Regulations 7A, 7B and 7C prescribing the $40,000 loss of deposit limit and $200,000 minimum amounts for insurance cover were inserted by SL 2022/172, with commencement 1 December 2022 for substantive provisions.
• 2025: An amendment entry in the compilation table shows Building Regulations Amendment Regulations 2025 Pt. 3 (SL 2025/144) with commencement 1 Sep 2025; Schedule 1 is noted as amended by SL 2025/144 r 6 in the source. This indicates the homeowner notice was updated in 2025.

Observations on amendment pattern

• The Regulations have been updated periodically to adjust dollar thresholds, add procedural forms, refine insurance minima and respond to cross‑regulatory enforcement needs. The most recent substantive monetary adjustments recorded in the source are the 2022 insertions for insurance minima and the 2020 insertion addressing cabinetry deposits. The schedule shows sustained updating across three decades, indicating active maintenance by the Parliament or relevant minister under delegated rule‑making powers.

For users, the amendment history matters because the Regulations are the vehicle by which the Act’s broad provisions are translated into operational numbers and forms. Practitioners should consult the compilation table and the current reprint to confirm that the amounts and forms applicable to a particular contract reflect the most recent amendments recorded in this instrument.

The Regulations and the attached Schedule 1 notice, as supplied, do not include any case law, judicial decisions or litigation history. The compilation material lists the Regulations and their amending instruments, but no court decisions or tribunal determinations are recorded or cited within the enacted text or the prescribed notice.

Implications for practice

• Because no litigation history is contained in the source, practitioners cannot rely on precedent or judicial interpretation within the instrument itself; they must consult external case law databases, tribunal decisions and administrative determinations for any interpretive guidance about the Act’s application or the Regulations’ operation in contested disputes.
• The Regulations’ clarity on numerical limits and prescribed forms reduces some ambiguity that might otherwise require judicial resolution, but many of the Act’s substantive terms referenced in Schedule 1 (such as "unconscionable, harsh or oppressive", or what precisely constitutes "unforeseen circumstances") are legal standards that may have been litigated elsewhere. The absence of litigation history in the Regulations means that legal interpretation of those standards is sourced in the Act and case law beyond this instrument.

If a practitioner requires judicial interpretations of the Act’s provisions, or rulings on enforcement via infringement notices or the Building Commissioner’s powers, those must be sought by case law research external to the Regulations themselves.

The Regulations and the prescribed Schedule 1 notice contain several operational points that commonly trip up practitioners and market participants. These are practical traps where compliance formality, timing, or a seemingly small drafting choice produces significant legal effects.

1. Contract scope determined by narrow monetary band

   • The Act, as described in Schedule 1 and implemented by regulation 2A, applies only where the contract price is more than $7,500 and less than $500,000. Contracts priced below or above those thresholds will fall outside the Act’s protections and mandatory formalities. Practitioners should not assume the Act applies to every residential building contract; check the contract price carefully. This is particularly important for aggregate contracts or splitting of work: artificial contract splitting to fall below thresholds raises compliance risk and potential penalty.

2. Cabinetry deposit exception

   • Regulation 3A allows a 20% deposit for cabinetry work where off‑site work constitutes more than 50% of the contract value. The definition of “cabinetry work” excludes off‑the‑shelf cabinets, and “off‑site work” is narrowly defined. Builders could structure work as off‑site cabinetry to lawfully increase deposit demand, but the Regulation’s conditions must be strictly satisfied. A mismatch between described scope and actual work location could attract prosecution or allow owners to terminate.

3. Cost‑plus contracts largely excluded, but procedural trap

   • Schedule 1 states cost‑plus contracts must be headed “cost plus contract” and both parties must sign a statement acknowledging the Act does not apply except for HII in certain insolvency‑related circumstances. Failure to use the prescribed heading and statement gives the owner termination rights. Builders using cost‑plus arrangements must therefore ensure the contract wording is precise, because a drafting omission produces a statutory termination remedy.

4. Deposit caps vs progress payments

   • Ordinary deposits are capped at 6.5% of the contract price (Schedule 1), with the cabinetry exception noted above. Builders who demand larger upfront payments risk both owner termination and prosecution. Conversely, the Regulations do not cap progress payments; badly drafted progress payment formulas or excessive progress milestones may still be vulnerable under other Act prohibitions such as “unconscionable” or “misleading” conduct.

5. Prime cost and provisional sum estimates

   • Schedule 1 requires prime cost items to be estimated at or above the lowest reasonable cost. Understating those figures is an offence exposing the builder to prosecution and fines. Practitioners drafting contracts with PC sums must ensure conservative, evidenceable estimates.

6. "Rise and fall" prohibition with narrow exceptions

   • The Act disallows rise and fall clauses, but Schedule 1 allows price increases linked to increased government taxes or mandatory law compliance, or certain delays in starting work not caused by the builder. If a permitted price increase exceeds 5% (in the event in clause (c)), the owner can terminate within 10 working days of receiving written notice, and must compensate the builder for reasonable costs. Builders must calculate increases carefully and provide timely written notice to owners; failure to do so can result in contractual termination risk.

7. Approvals condition and timing

   • Contracts are conditional on building permit and Water Corporation approval within 45 working days, and written acceptance of any conditions attached to those approvals. Builders and owners must take “what they reasonably can” to meet the 45‑working‑day period. Delays shift rights and pricing options. Practitioners must manage the timelines and evidentiary record establishing causation for delays.

8. HII timing and scope

   • Builders must take out HII and provide an insurance certificate before demanding any payment or commencing work, per Schedule 1. HII does not generally cover money paid in advance other than a deposit and may not apply to associated work alone. Additionally, certain work is exempt from HII where no building permit is required or registration as a builder is not required. Builders who misrepresent HII status or accept payments without providing the HII certificate risk both administrative penalties and exposure to claims by owners.

9. Defect notification window

   • Owners must notify defects within 4 months after practical completion for mandatory rectification obligations, unless the contract allows a longer period. Builders must retain contemporaneous records to evidence completion dates and responses to defect notifications; otherwise disputes over timing can frustrate rectification obligations and create exposure.

10. Infringement notice decisions

    • Regulation 8’s Table shows many operational provisions are subject to infringement notices with fixed modified penalties. The amounts are modest relative to contract values and may be treated by some as a routine cost of doing business; however, an infringement notice leaves a regulatory mark and the recipient could elect court proceedings instead. Practitioners should weigh whether paying a modified penalty is preferable to contesting proceedings, and whether repeated low‑value contraventions risk escalation to prosecution.

11. Administrative caps on remedies

    • Schedule 1 states the Building Commissioner can make orders up to $100,000, while the State Administrative Tribunal can make orders up to $500,000 on referral. That monetary cap constrains owners seeking larger sums for loss; for higher value disputes, parties may need to pursue the courts. Practitioners should advise clients on these limits when choosing dispute pathways.

12. Record and timing strictness

    • Many rights are time‑limited: complaints to the Building Commissioner must be made within 3 years from when the owner became entitled to take legal action for contract breaches, and service complaints within 6 years. Infringement payments must be made within 28 days. Missing these windows can foreclose remedies.

These “gotchas” arise largely from tight drafting of thresholds, timing rules and prescribed forms. Practitioners must treat the Regulations as constraining drafting choices and affect operational sequencing: give the homeowner notice before signature, evidence HII before payment, limit deposits to permitted percentages, and execute variations strictly by the written, dated and signed process.

This section is a focused compliance checklist for builders, owner‑builders, insurers and owners, grounded in the Regulations and the Schedule 1 prescribed notice. It emphasises documentary steps, timing and numerical ceilings that the source makes mandatory or prescriptive.

For builders and building contractors

1. Pre‑contract steps

   • Deliver the Schedule 1 prescribed notice to the owner before they sign the contract, as required by s 4(2) and implemented by regulation 3. Keep a dated delivery record or signed acknowledgement from the owner.
   • Ensure the contract is in writing, dated and signed by both parties or their authorised representatives. Retain a copy and deliver the owner’s copy as soon as practicable and before any work begins.

2. Deposit and payment rules

   • For ordinary building contracts, limit any pre‑commencement deposit to at most 6.5% of the contract price (Schedule 1). If supplying cabinetry as defined in regulation 3A and off‑site work is more than 50% of total value, you may demand up to 20% but only if the 3A conditions and definitions are strictly met. Document how work is allocated between off‑site and on‑site to support the deposit percentage.
   • Do not accept or demand other forms of money paid in advance other than deposits or progress payments for work done or goods supplied; build appropriate scheduling of progress claims into the contract.

3. Home indemnity insurance

   • Before commencing work or demanding any payment, obtain HII where the Act requires it, and give the owner the certificate of insurance. Confirm that the policy excess does not exceed $500 (regulation 5).
   • Ensure the policy satisfies the prescribed limits: loss of deposit coverage up to the $40,000 limit where relevant (regulation 7A) and minimum cover amounts of $200,000 where the Act requires (regulations 7B and 7C). Keep copies of the policy and certificate on file and include policy details in the contract file.

4. Cost‑plus arrangements

   • If contracting on a cost‑plus basis, ensure the contract is headed "cost plus contract" and includes the required acknowledgement signed by both parties that the Act does not apply to it except for the HII requirement stated in Schedule 1. If either omission occurs, the owner may have termination rights.

5. Contract drafting and variation procedures

   • Exclude "rise and fall" clauses, unless the narrow exceptions in Schedule 1 apply. If you include an exception allowed by the Act, provide express written notice to the owner that complies with the 45 working day rule and price rise notification thresholds; where the price increase exceeds 5%, give owners the statutorily prescribed 10 working day termination window.
   • Use explicit, conservative estimates for prime cost and provisional sum items. Record the basis for each PC or PS estimate to demonstrate a reasonable lowest cost figure.
   • Put all variations in writing, signed and dated by both parties, and give the owner a copy before commencing work arising from the variation, except in the limited exceptions noted in Schedule 1 (directions by a building surveyor under written law, or unforeseen circumstances correctly documented).

6. Inspections and defects

   • Do not impede owner or lender inspections, except as permitted by the contract (eg normal working hours). Keep records of inspection requests and attendance.
   • Maintain a defects register and respond promptly. If an owner notifies a defect within 4 months after practical completion (or a longer contractually agreed period), arrange rectification or otherwise document response steps.

7. Administrative compliance and enforcement

   • Familiarise authorised staff with the infringement notice process and ensure systems for responding to Form 2 notices within 28 days are in place. Keep documentary proof of HII certificates and contract copies to contest any allegation of non‑compliance.
   • Where the builder is an individual, partnership or company (the classes set out in regulation 6A), ensure registration and other statutory obligations are met to avoid HII exemptions or invalidities.

For owners (homeowners and purchasers)

1. Before signing

   • Insist on receiving the Schedule 1 notice before signing, and check the contract is written, dated and signed. Do not sign unless you have received a copy of the contract and the HII certificate where HII is required.
   • Confirm the contract price is within the expected band and check deposit demands against the statutory caps: generally no more than 6.5% unless reg 3A applies, in which case cabinetry off‑site work may allow up to 20%.

2. Insurance and risk

   • Require sight of the HII certificate before payment or commencement. If the building work is above $20,000, HII is generally compulsory subject to exceptions noted in Schedule 1. Keep the insurance certificate and policy details for future claims.

3. Variations, approvals and delays

   • If approvals are delayed beyond 45 working days, carefully check notices from the builder about price increases. If a price rise exceeds 5%, you can terminate within 10 working days of written notice, subject to compensation of the builder’s reasonable costs. Retain records of communications and approvals.
   • Provide the builder notice of defects within the 4 month window after practical completion to preserve statutory rectification rights, unless the contract specifies a longer defect notification period.

4. Disputes and remedies

   • If dissatisfied, follow the pre‑complaint requirement in Schedule 1: give written notice to the other party describing the remedy sought and the evidence intended to be relied upon, and provide a copy to the Building Commissioner when lodging a complaint. Note the time limits for complaints (3 years for contract entitlement disputes; 6 years for service standard complaints).
   • Understand the monetary caps on administrative remedies ($100,000 through the Building Commissioner; $500,000 through the State Administrative Tribunal on referral) and assess whether court proceedings are necessary for larger claims.

For insurers

• Ensure HII products comply with the $500 maximum excess cap (regulation 5), and meet the prescribed minima in regulations 7A, 7B and 7C where those provisions reference insurer liability. Product terms must align with Part 3A of the Act as explained in Schedule 1.

Recordkeeping and audit trail

• Across all parties, keep robust records: delivery and acknowledgment of Schedule 1 notice, HII certificates, signed contracts and signed variations, prime cost estimates and the evidentiary basis for them, inspection logs and defect notifications, correspondence about approvals and price variations, and any infringement notices and responses. These records will determine the outcome of disputes and the viability of defences against infringement notices or prosecutions.

Practical checklist summary

• Deliver Schedule 1 notice before signature.
• Provide HII certificate before demanding any payment or commencing work where HII is necessary.
• Limit deposits to 6.5% unless reg 3A cabinetry exception strictly applies.
• Ensure written, dated, signed contracts and give copy before work starts.
• Use conservative prime cost figures and document basis.
• Variations signed, dated and copied before commencing varied work.
• Keep inspection and defect logs; act within 4 month defect notice window.
• Respond to infringement notices or elect court proceedings within 28 days as appropriate.
• For cost‑plus contracts, comply with the required heading and statement.

Following these steps aligns practice with the Regulations and the prescribed owner notice; divergence risks administrative penalties or contract termination rights for the other party.
