#### 48P Power to adjourn proceedings where insurable event arises 48P Power to adjourn proceedings where insurable event arises > > (1) This section applies to proceedings in relation to a building claim that does not arise under a building cover contract entered into under this Act. > > > (2) If, during the course of any proceedings before the Tribunal in relation to a building claim, it appears to the Tribunal that a party to the dispute has the right to make a claim under a building cover contract entered into under this Act, the Tribunal may adjourn the proceedings to allow the claim to be made and determined. > > > (3) If proceedings are adjourned under this section and the claim in relation to the building cover contract is settled, the proceedings are taken to have been finalised, unless the Tribunal otherwise orders. > > > (4) The provisions of this section are in addition to, and do not derogate from, the provisions of section 51 (Adjournment of proceedings) of the [Civil and Administrative Tribunal Act 2013](/view/html/inforce/current/act-2013-002). > > **s 48P:** Ins 2001 No 51, Sch 4 \[1\].
