#### 139A Continuing offences 139A Continuing offences > > (1) This section applies to a provision of this Act or the regulations requiring a person to do, or stop doing, something (a continuing requirement provision) regardless of whether— > > > > > (a) the requirement is imposed by a notice or in another way, or > > > > > (b) the person is required to do, or stop doing, something within a specified period. > > > (2) A person who is guilty of an offence because the person contravenes a continuing requirement provision— > > > > > (a) continues, until the requirement is complied with and despite the fact a specified period has expired or time has passed, to be liable to comply with the requirement, and > > > > > (b) is guilty of a continuing offence for each day the contravention continues. > > > (3) This section does not apply to an offence if the relevant provision of this Act or the regulations does not provide for a penalty for a continuing offence. > > > (4) This section does not apply to the extent a requirement imposed on a person is revoked. > > **s 139A:** Ins 2023 No 44, Sch 1\[16\].
