#### 139 Proceedings for offences 139 Proceedings for offences > > (1) Proceedings for an offence against this Act are to be dealt with— > > > > > (a) summarily before the Local Court, or > > > > > (b) summarily before the Supreme Court in its summary jurisdiction. > > > (1A) If proceedings for an offence against this Act are brought in the Local Court, the maximum monetary penalty that the Local Court may impose for the offence is 200 penalty units, despite any higher maximum monetary penalty provided in respect of the offence. > > > (1B) Proceedings for an offence against the regulations are to be dealt with summarily before the Local Court. > > > (2) Any such proceedings must be commenced by an information laid within 3 years after the commission of the offence. > > **s 139:** Am 1996 No 122, Sch 5 \[9\]; 2001 No 51, Sch 7 \[9\]; 2004 No 101, Sch 4 \[10\]; 2007 No 94, Sch 2.
