#### 16 What happens to current occupants under existing oral agreements? 16 What happens to current occupants under existing oral agreements? > > (1) In this section, relevant agreement means an agreement that, if this Act had been in force at the time that the agreement was made, would be an occupation agreement. > > > (2) If a relevant agreement that is not in writing or that is only partly in writing was in force before the commencement of this section, that agreement continues in force until a new occupation agreement is made under this Act. > > > (3) If a new occupation agreement is not made within 12 months after the commencement of this section, and the relevant agreement continues in force, the agreement is taken, from a date that is 12 months after the commencement of this section, to include every term set out in Schedule 1 (except clause 25) and the regulations (with the blank spaces filled in with the appropriate details). A term of an occupation agreement is void to any extent to which it is inconsistent with this or any other Act or any term included in the agreement by section 15 (3).
