Hire-Purchase (General) Regulations 1975

The regulations repeatedly operate through a small number of administrative‑law concepts: prescribed forms, stated decision factors, standardised disclosure, and infringement‑notice enforcement.

Prescribed forms: Regulation 2 defines “Form” as a form in Schedule 1. Regulation 3 mandates that an owner seeking the Commissioner’s consent to take possession under section 12A of the Act must use Form 1 (see Schedule 1, Form 1). Regulation 4(1) requires a hirer seeking relief under section 36A to use Form 2 (Schedule 1, Form 2). The forms are detailed: Form 1 captures owner, hirer and guarantor particulars, instalment history, amounts paid and outstanding and reasons for the request; Form 2 requires the hirer to attach a copy of the agreement, provide instalment and benefit registration dates, family and financial details, and to state what relief is sought.

Decision factors and information powers: Regulation 4(2) lists eight discrete matters the Commissioner must have regard to when considering a Form 2 application. These include the likely duration of sickness or unemployment (4(2)(a)-(b)), the hirer’s and household’s financial circumstances (4(2)(c)-(d)), whether the goods are necessary for the hirer’s livelihood and the consequences that a breach would have on the hirer’s finances (4(2)(e)), the hirer’s equity in the goods (4(2)(f)), the hirer’s contractual obligations on breach (4(2)(g)), and consequences for any guarantor (4(2)(h)). Regulation 4(3) gives the Commissioner an express power to require the hirer (and any guarantor) to produce information the Commissioner considers necessary.

Standardised disclosure of rebate rights: Regulation 5 prescribes the full text of the explanation to be given to hirers about the statutory rebate under section 11 of the Act. It requires the explanation to be printed in “10 Point Roman capitals as specified therein” and to follow the text and examples set out in the regulation and Schedule 1. The prescribed explanation describes the hirer’s entitlement to complete the purchase by paying the net balance and to a statutory rebate, explains why earlier instalments contain a larger proportion of the terms charges, and sets out numerical examples showing how a rebate would operate in a 12‑month contract with $260 terms charges (examples (A) to (C)).

Enforcement via infringement notices: Regulation 6 declares the offences listed in Schedule 2 to be amenable to infringement notices under the Criminal Procedure Act 2004. It sets the modified penalty for the offence prescribed in Schedule 2 (entering into a contract not containing required provisions or not complying with form requirements under s 3 of the Act) at $1,000 (Schedule 2). Regulation 6 authorises the Commissioner to appoint authorised officers or approved officers in writing, requires the Commissioner to issue officers with identifying certificates, badges or identity cards, and fixes Form 3 as the infringement notice and Form 4 as the withdrawal form for Criminal Procedure Act purposes.

Institutional connections: The regulations repeatedly refer to the “Commissioner” and to the Commissioner for Consumer Protection as the decision‑maker and administrative locus. The note in Form 1 and Form 2 draws a further connection to the State Administrative Tribunal (SAT) by informing applicants and owners that they may apply to SAT to review a decision of the Commissioner. The infringement notice form ties enforcement consequences to the Fines, Penalties and Infringement Notices Enforcement Act 1994, specifying consequences if the modified penalty is not paid within 28 days.

Documentary precision and compliance mechanics: The regulations insist on exact presentation and content. For example, regulation 5 requires a specific block of text in a prescribed point size and case. Form 3 embeds the 28‑day payment window and payment channels, and Form 2 includes explicit procedural steps: service obligations and written instrument requirements for Commissioner decisions.

The regulations create direct obligations and procedural routes that affect four principal groups: owners (creditors in hire‑purchase agreements), hirers (consumers who hire goods under hire‑purchase agreements), guarantors, and administrative officers of the Commissioner’s office who will implement enforcement.

Owners: Owners are affected in at least three ways. First, if an owner wishes to take possession of goods under the Act where 75% of the total amount payable has been paid, the owner must apply in the form prescribed by the regulations (regulation 3, Form 1). Form 1 requires the owner to state the instalment history, amounts paid, reasons for the request and to supply particulars. Second, owners face a possible infringement mechanism: Schedule 2 prescribes as an infringement‑notice offence entering into a contract that does not contain the required provisions or that fails to comply with form requirements (Schedule 2 , s. 3), and the modified penalty for that offence is $1,000. Third, owners are a party to the Commissioner’s decision processes: Form 2 is to be served on the owner and on any guarantor (Form 2 note 1); the Commissioner’s grant or refusal of relief must be reduced to a written instrument and served on the hirer, owner and guarantor (Form 2 note 3).

Hirers: Hirers are affected by the statutory disclosure requirement (regulation 5) and by the relief pathway established in regulation 4 and Form 2. Hirers seeking relief from the consequences of breach because of sickness or unemployment must apply on Form 2, provide detailed financial, employment and benefit information, and may be required by the Commissioner to produce additional information (regulation 4(3)). The regulation specifies what the Commissioner must consider when determining a relief application (regulation 4(2)(a)-(h)), which shapes the evidence hirers must supply. The rebate explanation (regulation 5) affects hirers’ information rights and their calculation of net balances in order to exercise the statutory right under section 11 of the Act to complete purchase and claim a rebate.

Guarantors: Guarantors are directly implicated. Form 1 and Form 2 ask for guarantor details. Regulation 4(2)(h) requires the Commissioner to have regard to the consequences for any guarantor when considering relief under s 36A. The Form 2 note makes it mandatory that a copy of the application be served on every guarantor (Form 2 note 1). A Commissioner decision granting relief varies not only the hire‑purchase agreement but also “any contract of guarantee relating to it” to the extent necessary (Form 2 note 2), which materially alters guarantors’ continuing obligations.

Authorised/approved officers: The Commissioner may appoint persons or classes of persons as authorised or approved officers for the purposes of Part 2 of the Criminal Procedure Act 2004 (regulation 6(3)). These officers are authorised to issue infringement notices for the prescribed offences; the Commissioner must issue each authorised officer with a certificate, badge or identity card identifying the officer as authorised to issue infringement notices (regulation 6(4)). The appointed officers therefore gain enforcement powers and the obligations that come with issuing, withdrawing (Form 4), and managing infringement notices.

Administrative agencies and courts/tribunals: The Commissioner’s office is the administrative decision‑maker and enforcement manager. The State Administrative Tribunal is the judicial review avenue: both Form 1 and Form 2 include a note informing owners, hirers and guarantors that they may apply to the SAT to review a Commissioner decision (Form 1 note; Form 2 note 4). Enforcement linkages expose alleged offenders to action under the Criminal Procedure Act 2004 and, in default, cascading enforcement under the Fines, Penalties and Infringement Notices Enforcement Act 1994 (Form 3 content).

Peripheral parties: Payment agents and the Department’s cashier are specified recipients for modified penalties in Form 3 (Schedule 1, Form 3 instructions). The prescribed address and payment channels in Form 3 impose operational obligations on the Department to receive and account for payments and refunds (Form 4).

Geography and procedural scope: The regulations are Western Australia regulations and operate in that jurisdiction. The compilation table lists commencement and amendment dates that determine which version applies at a particular time. Regulation 2 defines “section” as a section of the Act, so the regulations operate only in tandem with the substantive provisions of the Hire‑Purchase Act 1959.

This section isolates the principal administrative duties the regulations impose and the rights they affirm, citing the relevant regulation and form text.

Owner duties

• Apply in Form 1 when seeking Commissioner consent under s 12A: Regulation 3 requires the owner’s application for consent to take possession under s 12A to be in Form 1. Form 1 requires the owner to provide name and address particulars (owner, hirer, guarantor), short description of goods, amounts payable and paid, instalment arrangements, and reasons for the request. The owner is informed that an adverse Commissioner decision may be reviewed in the State Administrative Tribunal (Form 1 note). These procedural requirements become preconditions for the owner to engage the statutory power under s 12A.

• Ensure statutory contract content: Schedule 2 prescribes an offence (s. 3) for entering into a hire‑purchase contract that does not contain the required provisions or does not comply with the required form, with a modified penalty of $1,000. That places a compliance duty on owners at the contract formation stage to include the statutorily required provisions and the prescribed form elements.

Hirer duties and rights

• Right to statutory rebate and disclosure: Regulation 5 fixes the precise disclosure the hirer must be given about the section 11 statutory rebate. The disclosure explains the entitlement to complete the purchase by paying the net balance due and to receive a statutory rebate, contains the calculation formula and numerical worked examples, and requires the statement to be printed in 10 Point Roman capitals. Thus the hirer acquires an information right; the owner has a duty to provide that information in the prescribed shape and presentation.

• Right to apply for relief under s 36A: Regulation 4(1) requires that a hirer seeking relief for breach due to sickness or unemployment must apply in Form 2. Form 2 sets out the information the hirer must provide, including details of sickness/unemployment, benefit registration, instalment history, family financial circumstances and the relief being sought. The Form 2 note (note 2) states that where relief is granted, the hire‑purchase agreement and any contract of guarantee are varied to the extent necessary. Form 2 also imposes a service duty: a copy of the application must be served on the owner and every guarantor (Form 2 note 1). The Commissioner’s decision must be in writing and served on hirer, owner and guarantor (Form 2 note 3).

• Obligation to produce information on request: Regulation 4(3) gives the Commissioner a power to require the hirer and any guarantor to produce information the Commissioner considers necessary. This is an express administrative information‑gathering duty on the parties once an application is made.

Guarantor duties and rights

• Service and consequential relief effects: Form 2 requires service on every guarantor and asks the applicant to provide guarantor particulars. Regulation 4(2)(h) requires the Commissioner to have regard to the consequences for any guarantor. The Commissioner’s grant of relief varies any contract of guarantee “to the extent necessary” (Form 2 note 2). Guarantors therefore have both procedural protections (service and opportunity to seek review via SAT) and exposure (their obligations can be altered by a Commissioner decision).

Enforcement duties and rights

• Authorised officers and infringement notices: Regulation 6(3) authorises the Commissioner to appoint persons or classes of persons as authorised or approved officers for issuing infringement notices under Part 2 of the Criminal Procedure Act 2004. Regulation 6(4) requires the Commissioner to issue identification to those officers. Regulation 6(5) prescribes that an infringement notice is Form 3 and a withdrawal is Form 4. Form 3 details the alleged offence, the modified penalty, payment instructions, the 28‑day payment period and the warning that failure to pay can lead to enforcement action under the Fines, Penalties and Infringement Notices Enforcement Act 1994.

• Modified penalty for s. 3 offence: Schedule 2 prescribes that an offence under s. 3 (entering into a contract not containing required provisions or not complying with requirements as to form) attracts a modified penalty of $1,000 for the purposes of the Criminal Procedure Act 2004.

Rights of review

• State Administrative Tribunal review: Both Form 1 and Form 2 inform the applicant (owner or hirer/guarantor) that an aggrieved person may apply to the State Administrative Tribunal for review of a Commissioner decision (Form 1 note; Form 2 note 4). The regulations also prescribe that Commissioner decisions to grant or refuse relief must be given by instrument in writing and served on the relevant parties (Form 2 note 3), which creates a clear locus for administrative review.

Documentary and presentation duties

• Prescribed presentation of rebate explanation: Regulation 5 requires that the statutory rebate explanation to be given pursuant to section 11 appear in “10 Point Roman capitals” and in the precise text and examples set out in the regulation. That is a mandatory presentation duty on the party giving the disclosure.

Procedural obligations

• Service obligations: Form 2 note 1 requires service of the application on the owner and every guarantor. Form 1 and Form 2 both specify what content must be included and notify parties of review rights. These are procedural duties that are prerequisites to invoking or challenging the Commissioner’s powers.

The regulations create a narrow enforcement regime that operates mainly via infringement notices, identification and appointment of authorised officers, and established enforcement pathways in other statutes.

Infringement‑notice offences and modified penalties

• Schedule 2 identifies the prescribed offence: an offence under s. 3 of the Hire‑Purchase Act 1959 , entering into a contract not containing required provisions or not complying with requirements as to form , is listed and given a modified penalty of $1,000 (Schedule 2). Regulation 6(1) confirms that offences specified in Schedule 2 are offences for which an infringement notice may be issued under Part 2 of the Criminal Procedure Act 2004.

• The modified penalty specified in Schedule 2 is the modified penalty for the purposes of s 5(3) of the Criminal Procedure Act 2004 (regulation 6(2)). This incorporates the infringement‑notice mechanism and its procedural framework into enforcement for that specific statutory breach.

Authorised officers and identification

• Regulation 6(3) authorises the Commissioner to appoint in writing persons or classes of persons to be authorised officers or approved officers for the purposes of the Criminal Procedure Act 2004. Regulation 6(4) requires the Commissioner to issue to each authorised officer a certificate, badge or identity card identifying the officer as authorised to issue infringement notices. These provisions set the internal administrative mechanics by which the Department’s staff will exercise infringement powers.

Infringement notice form and content

• Regulation 6(5) prescribes that an infringement notice is to be in the form of Form 3 and a withdrawal of infringement notice in the form of Form 4. Form 3 sets out the alleged offence, the section of the Act, the modified penalty, the date and time, the officer details and instructions for payment. Importantly, Form 3 states the usual default consequences if the modified penalty is not paid within 28 days: prosecution or enforcement action under the Fines, Penalties and Infringement Notices Enforcement Act 1994, with specified examples of enforcement measures (driver’s licence suspension, vehicle licence suspension or cancellation, disqualification, immobilisation or removal of number plates, publication of details, garnishee of earnings or bank accounts, seizure and sale of property). Those consequences are not created by the Hire‑Purchase regulations but are the statutory enforcement consequences under the fines/enforcement legislation, and Form 3 informs the alleged offender of that pathway.

Withdrawal and refund procedure

• Form 4 is the prescribed withdrawal notice. It records the withdrawal of a previously issued infringement notice and includes provisions for refunds if the modified penalty was already paid. The form sets out how to claim a refund where appropriate.

Escalation to prosecution

• Form 3 explicitly informs the alleged offender that if they do not pay the modified penalty within 28 days they may be prosecuted or enforcement action may be taken under the Fines, Penalties and Infringement Notices Enforcement Act 1994. Regulation 6(1) does not preclude prosecution; rather it provides an alternative enforcement path via infringement notices.

Administrative review of Commissioner decisions

• Although not a penalty in the criminal sense, the regulations provide for administrative review routes. Forms 1 and 2 both notify parties that an aggrieved person may apply to the State Administrative Tribunal (SAT) to review a decision of the Commissioner (Form 1 note; Form 2 note 4). That creates an institutional check on discretionary decisions under the regulations.

Limits of enforcement in the regulations

• The regulations prescribe only one infringement‑notice offence in Schedule 2, namely the s. 3 contract‑content/form offence. They do not themselves create criminal penalties for other breaches of the procedural duties in the regulations (for example, failing to serve a Form 2 application on a guarantor), although consequences of failing to comply with primary Act provisions may exist in the Act itself. The enforcement architecture in the regulations therefore concentrates on ensuring correct contractual content and gives the Commissioner an administrative enforcement tool for that subset of compliance failures.

The regulations operate as procedural companions to the Hire‑Purchase Act 1959 and expressly link to other Western Australian statutes for enforcement and review. The text contains explicit cross‑references and operational ties that shape legal pathways.

Connections to the Hire‑Purchase Act 1959

• Regulation 2 defines “section” as a section of the Act. Several regulations require action in relation to specific Act provisions: regulation 3 implements the Act’s section 12A by prescribing Form 1 for owner applications for consent to take possession where 75% of the total amount payable has been paid; regulation 4 implements Act section 36A by prescribing Form 2 for hirer relief applications for sickness/unemployment; regulation 5 prescribes the explanation for the statutory rebate under section 11 of the Act; and Schedule 2 prescribes an infringement offence under section 3 of the Act. The regulations therefore do not stand alone: their operation depends on the substantive powers, offences and rights created by the underlying Act.

Criminal Procedure Act 2004

• Regulation 6 ties specified offences in Schedule 2 to the Criminal Procedure Act 2004’s infringement‑notice mechanism. Regulation 6(1) states that the offences specified in Schedule 2 are offences for which an infringement notice may be issued under Part 2 of the Criminal Procedure Act 2004. Regulation 6(2) sets the modified penalties for the purposes of s 5(3) of that Act. Regulation 6(5) prescribes the form of the infringement notice and the withdrawal for the purposes of the Criminal Procedure Act 2004. The effect is to import the procedural architecture of that Act for dealing with contraventions of Schedule 2.

Fines, Penalties and Infringement Notices Enforcement Act 1994

• Form 3 (the infringement notice) expressly warns that failure to pay a modified penalty within 28 days may lead to enforcement action under the Fines, Penalties and Infringement Notices Enforcement Act 1994 and lists examples of enforcement measures under that Act. This links the infringement‑notice stage to the heavier enforcement mechanisms (driver’s licence consequences, garnishee, seizure, etc.) available under the enforcement statute.

State Administrative Tribunal Act and SAT jurisdiction

• Form 1 and Form 2 both include a note that an owner, hirer or guarantor aggrieved by a decision of the Commissioner may apply to the State Administrative Tribunal for review. Although the regulations do not quote the SAT Act, they create a direct procedural right to seek administrative review. The procedural content of Form 2 also requires Commissioner decisions to be given by written instrument and served on parties (Form 2 note 3), which provides the necessary record for any SAT review.

Administrative law principles and information powers

• Regulation 4(3) gives the Commissioner express power to require the hirer and any guarantor to produce such information as the Commissioner considers necessary when considering applications under s 36A. That power sits within the administrative domain created by the Act and the regulations. Any challenge to the exercise of that power would arise under general public‑law principles and procedures available to parties, including potential SAT review.

Payment and departmental procedures

• Form 3 specifies payment channels (postal cheque/money order payable to “Approved Officer , Hire‑Purchase Act 1959”, or in person at the Department’s cashier at a particular address). Those details implicitly link the regulation to departmental financial procedures and accounting rules, though the regulations do not set those procedures directly.

Compilation and amendment law

• The compilation table records amendments made by subordinate instruments (Equality of Status Subsidiary Legislation Amendment Regulations 2003; Hire‑Purchase (General) Amendment Regulations 2004; 2006; 2013; Commerce Regulations Amendment (Infringement Notices) Regulations 2020). The regulations therefore interact with the Administrative Orders and amendment rules that regulate how subsidiary laws are changed and reprinted. Practitioners must read the current reprint as modified by those instruments.

Absence of other cross‑statutory changes in the text

• The regulations do not, by their text, reference consumer credit codes from other jurisdictions, the national Consumer Credit Code (if operative elsewhere), or Commonwealth statutes beyond the social security and employment agencies referenced in Form 2 as places where a hirer might register for sickness or unemployment benefits. Any interaction with federal social‑security law is factual rather than legal: the Commissioner is to have regard to whether the hirer has registered for benefits, not to administer those benefits.

The compilation table embedded in the regulations sets out the recorded amendment instruments and commencement dates that have changed the regulation since the original 1975 instrument. The following items are recorded in the compilation table and should be consulted to understand the present form of the regulations:

• Hire‑Purchase (General) Regulations 1975 , original instrument commenced 30 January 1975 (30 Jan 1975 p. 235‑9).
• Equality of Status Subsidiary Legislation Amendment Regulations 2003, Part 14 , published 30 June 2003 (30 Jun 2003 p. 2581‑638), commencement 1 July 2003 (see r. 2 and Gazette notice). Reprint 1 of the regulations as at 5 December 2003 incorporates that amendment.
• Hire‑Purchase (General) Amendment Regulations 2004 , published 30 December 2004 (30 Dec 2004 p. 6922), commenced 1 January 2005. Form 1 and Form 2 show amendment notes consistent with this instrument.
• Hire‑Purchase (General) Amendment Regulations 2006 , published 22 September 2006 (22 Sep 2006 p. 4115‑18), commencement 22 September 2006. Regulation 2 (defined term for section) and new insertion of regulations 3 and 4 and 6 are recorded as inserted on that date (see marginal notes).
• Hire‑Purchase (General) Amendment Regulations 2013 , published 20 August 2013 (20 Aug 2013 p. 3835), with certain parts commencing on 20 August 2013 and other parts on 21 August 2013 (see r. 2 and Gazette). The compilation table indicates Form 3 was inserted 22 September 2006 and later amended on 20 August 2013 and by SL 2020/163 r. 34.
• Commerce Regulations Amendment (Infringement Notices) Regulations 2020, Part 17 , SL 2020/163, published 25 September 2020, commenced 29 September 2020. This instrument is recorded as making consequential changes to infringement notice forms and related provisions.

Amendment annotations in the Schedule and Forms: The regulation text also contains marginal notes (for example, “[Regulation 2 inserted: Gazette 22 Sep 2006 p. 4116]”) and the Forms carry amendment notes indicating the Gazette entries that altered those Forms (Form 1 amended: Gazette 30 Dec 2004 p. 6922; Form 2 amended: Gazette 30 Jun 2003 p. 2604; 30 Dec 2004 p. 6922; Form 3 inserted: Gazette 22 Sep 2006 p. 4117; amended: Gazette 20 Aug 2013 p. 3835; SL 2020/163 r. 34; Form 4 inserted: Gazette 22 Sep 2006 p. 4117‑18). These marginal notes and Form amendment notes are part of the official reprint history and indicate that the present forms and regulations have been updated at those points.

Practical impact of amendments

• The amendments in 2006 (Gazette 22 Sep 2006) appear to have introduced the current structure for Forms 1-4 and Schedule 2 and the regulation 6 provisions linking to the Criminal Procedure Act 2004. The 2013 and 2020 amendments appear to have adjusted Form 3 (and possibly the infringement‑notice process) to align with wider changes in infringement‑notice administration across commerce legislation (see 2013 and 2020 entries). The detailed content of each amending instrument should be consulted for precise textual changes.

Reprints

• The compilation table notes Reprint 1 as at 5 December 2003 (which includes the 2003 amendment) and Reprint 2 as at 23 January 2009 (which would include earlier amendments up to that date). Subsequent amendments (2004, 2006, 2013, 2020) have been made after those reprints and are recorded; practitioners should consult the consolidated/current reprint or the Western Australian legislation database to ensure they are working with the up‑to‑date text.

The regulatory text supplied contains no judicial decisions, case citations, or litigation annotations. The regulations themselves make provision for administrative review (Form 1 and Form 2 note the right of an aggrieved owner, hirer or guarantor to apply to the State Administrative Tribunal for review of a Commissioner decision), but they do not record any SAT or court decisions concerning the exercise of the Commissioner’s powers, the interpretation of the prescribed forms, or the enforcement provisions in Schedule 2.

What the instrument records about dispute resolution and review

• Form 1 includes the note: “An owner aggrieved by a decision of the Commissioner not to give consent may apply to the State Administrative Tribunal for a review of the decision.” That creates an administrative review route but does not report outcomes.

• Form 2 includes a four‑point note: service obligation, the legal effect of a grant of relief (variations to the hire‑purchase agreement and any contract of guarantee to the extent necessary), requirement that a grant or refusal be provided by instrument in writing and served, and the notification that an owner, hirer or guarantor aggrieved by the Commissioner’s decision may apply to SAT for review. Again this records process but not litigation outcomes.

Implication for researchers and practitioners

• The absence of litigation history in the instrument means that practitioners cannot rely on the regulation text alone for interpretive guidance from courts or tribunal decisions. To assess how the Commissioner has exercised discretion (for example under regulation 4(2) and 4(3)), or how SATs have interpreted the procedural requirements and adequacy of disclosure (for example regulation 5’s prescribed rebate explanation), practitioners must search SAT and court databases for decisions referencing the Hire‑Purchase Act 1959 and these regulations. The regulation itself advises the pathway (SAT) but does not supply litigated examples.

• Any legal arguments about the Commissioner’s obligations, the sufficiency of Form 2 evidence, the lawfulness of a demand for possession under s 12A in the shape required by Form 1, or the validity of infringement notices under Schedule 2 will depend on external case law and administrative law principles not contained in the regulations.

This instrument sets precise procedural requirements and leaves little flexibility in presentation and process. The following are practical pitfalls and points that commonly cause compliance failure or disputes, grounded in the regulation and form text.

Mandatory use of prescribed forms

• Regulated applications must use the exact form. Regulation 3 requires the owner’s application under s 12A to be in Form 1; regulation 4(1) requires the hirer’s s 36A application to be in Form 2. Failure to use the prescribed form may render an application procedurally defective and could affect timeliness, service or the Commissioner’s ability to deal with the application. Schedule 2 also criminalises entering into a contract not containing the required provisions or not complying with requirements as to form (s. 3), and that offence carries a $1,000 modified penalty. In practice, that creates a compliance risk for owners who use customised documents rather than the prescribed contractual wording and presentation mandated by the Act.

Rebate disclosure presentation requirement

• Regulation 5 requires the rebate explanation to be given pursuant to the First Schedule of the Act and to be printed in type known as “10 Point Roman capitals as specified therein” and then reproduces the entire textual block and worked examples. The prescribed typographical requirement is precise and may be treated strictly by regulators; a failure to present the text in the required font/size/case could itself be regarded as non‑compliance with statutory disclosure obligations.

Service and notification obligations

• Form 2 note 1 requires that a copy of a hirer’s application for relief be served on the owner and every guarantor. Practitioners must not overlook the service requirement: improper service could lead to delay, provide grounds for challenge, or deprive the owner or guarantor of procedural rights such as making submissions to the Commissioner or seeking SAT review. Form 2 note 3 further requires the Commissioner’s grant or refusal to be an instrument in writing and served on the hirer, owner and every guarantor.

Commissioner’s information power and evidentiary obligations

• Regulation 4(3) permits the Commissioner to require the hirer and any guarantor to produce information the Commissioner considers necessary. Applicants should expect follow‑up requests and prepare to produce documentary evidence of benefit registrations, medical certificates, employment records, bank statements and instalment histories. Failure to provide information may affect the Commissioner’s exercise of discretion.

Narrow scope of infringement offences in Schedule 2

• Schedule 2 prescribes only one infringement‑notice offence (s. 3 contract content/form). That creates a specific compliance target and may lead regulators to focus enforcement activity on contract wording and form compliance. It also means that many procedural failures under the regulations (for example, small lapses in service of Form 2) are not directly listed as infringement offences; enforcement for other non‑compliant conduct may instead fall to administrative remedies or to prosecution under other applicable provisions of the Act, if any exist.

28‑day payment window and enforcement consequences

• Form 3 sets a strict 28‑day window for payment of a modified penalty to avoid prosecution or enforcement under the Fines, Penalties and Infringement Notices Enforcement Act 1994. The form provides payment channels and an address; failure to follow those instructions within 28 days exposes the alleged offender to a wide range of enforcement measures. Practitioners should note that the enforcement measures listed in Form 3 (driver’s licence suspension, garnishee, seizure) are consequences of the enforcement statute, not the Hire‑Purchase regulations per se, but Form 3 is the practical document that starts those processes.

Variations to guarantees on grant of relief

• Form 2 note 2 states that where relief is granted the hire‑purchase agreement and any contract of guarantee relating to it are “varied to the extent necessary.” That means a Commissioner grant of relief can alter guarantor obligations even without their consent. Guarantors should therefore register an interest in any application and may need to take steps to safeguard their position; they are entitled to be served with the Form 2 application but might find relief decisions alter their obligations.

Administrative discretion and potential delay

• The Commissioner’s exercise of discretion under regulation 4 entails balancing multiple factors. The presence of a formal application, an information‑gathering power in regulation 4(3), and an administrative review route to SAT may produce delay. Owners seeking prompt possession under s 12A must factor in the time taken for the Commissioner to process Form 1 applications and any subsequent SAT review.

Precision of numerical rebate examples

• Regulation 5 gives worked examples for a 12‑month agreement with $260 terms charges and shows how rebates change with months remaining. Practitioners must ensure their software or manual calculations follow the statutory method and that the disclosure supplied to hirers matches the prescribed examples to avoid disputes about calculation methodology.

Record‑keeping and evidence

• Because the forms require detailed financial and family particulars and the Commissioner may request further information, both owners and hirers should retain records of instalment payments, communications, benefit registrations, medical certificates and guarantor notices. The regulations frame these records as prerequisites to decisions.

Amendment tracking

• The compilation table shows multiple amendments. Practitioners must verify they are using the current forms and the current version of the regulations as amended (not older reprints), particularly in respect of infringement forms and the modified penalty amounts.

This section sets out concrete steps and templates of action for owners, hirers, guarantors and departmental officers to operationally comply with the regulations. It is intended as a procedural checklist grounded in the regulation text and forms.

For owners (creditors under hire‑purchase agreements)

1. Contract drafting and form compliance

   • At contract formation ensure the hire‑purchase agreement contains all provisions required by the Hire‑Purchase Act 1959 and complies with any prescribed form requirements. Schedule 2 makes entering into a contract that lacks required provisions or required form elements an offence (s. 3) subject to a $1,000 modified penalty. Keep a template checklist to verify inclusion of required clauses and the statutory rebate disclosure.

2. Statutory rebate disclosure

   • Provide the exact statutory rebate explanation required by regulation 5 to hirers at the appropriate time in the transaction, in the text and with the presentation specified (10 Point Roman capitals). Ensure your consumer‑facing documents reproduce the prescribed text and worked examples.

3. Possession‑consent (section 12A) procedures

   • If seeking the Commissioner’s consent to take possession where 75% of the total amount payable has been paid, prepare and lodge Form 1 (regulation 3, Schedule 1). Complete the instalment history, amounts paid and outstanding, and reasons for the request. Keep proof of lodging and be prepared to respond to Commissioner queries. Be aware an owner aggrieved by a refusal may apply to SAT.

4. Responding to Form 2 applications

   • If served with a Form 2 application, acknowledge receipt promptly, assemble any material you wish to put to the Commissioner (e.g. account statements, valuations, submissions about hardship and equity), and track deadlines. Form 2 note 3 indicates the Commissioner’s decision is to be in writing and served on owner, hirer and guarantor.

For hirers (consumers)

1. Executing the Form 2 application correctly

   • If seeking relief under s 36A for sickness or unemployment, complete Form 2 in full and attach a copy of the hire‑purchase agreement. Provide full details of instalments, last payment dates, next payment dates, remaining payments, and particulars of any guarantor. Be precise in stating the relief sought.

2. Evidentiary preparation

   • Prepare documentary evidence the Commissioner may require: medical certificates, dates of cessation of work, Departmental benefit registration or confirmation, employer details, bank statements, proof of unemployment registration, and particulars of family dependants and income. Regulation 4(2) lists factors the Commissioner must have regard to and regulation 4(3) allows the Commissioner to require information.

3. Service obligations and rights

   • Serve a copy of the completed Form 2 on the owner and every guarantor as required by Form 2 note 1. Retain proof of service. Understand that a grant of relief can vary the hire‑purchase agreement and any contract of guarantee (Form 2 note 2). If the Commissioner refuses relief, be prepared to apply to the State Administrative Tribunal for review (Form 2 note 4).

For guarantors

1. Monitor applications and preserve rights
   • Ensure you are served with any Form 2 applications. If you are served, consider filing submissions to the Commissioner documenting the likely consequences for you and any defences you have. Understand that the Commissioner must have regard to the consequences for any guarantor (regulation 4(2)(h)) and that grants of relief may vary guarantees.

For departmental officers and the Commissioner’s office

1. Appointment and identification of authorised officers

   • If issuing infringement notices, ensure appointments are made in writing under regulation 6(3) and that each authorised officer is issued a certificate, badge or identity card (regulation 6(4)).

2. Form issuance and record keeping

   • Use Form 3 for infringement notices and Form 4 for withdrawals as prescribed in regulation 6(5). Maintain accurate records of notices issued, payments received, withdrawals processed and refunds made. Form 3 prescribes the information that must appear on an infringement notice, including the modified penalty and payment instructions.

3. Service and decision writing for Form 2 and Form 1

   • For any decision which grants or refuses relief, ensure a written instrument is prepared, signed and served on hirer, owner and every guarantor (Form 2 note 3). Keep a dated file with proof of service to support any subsequent SAT review.

4. Processing Form 2 applications

   • When considering a Form 2 application, systematically address each factor listed in regulation 4(2)(a)-(h) and document how the evidence submitted supports findings on each factor. If more information is required, use the power in regulation 4(3) to request it and record the request, the deadline and the response.

Compliance checklists and operational controls

• Contracts: Maintain an up‑to‑date contract template that incorporates all required statutory wording, the rebate disclosure in the prescribed format (regulation 5), and a clause confirming the hirer’s right to the statutory rebate and the mechanics.

• Forms and filing: Store the current Forms 1-4 in editable and printable formats; ensure staff use the latest reprint. Include a compliance checklist when filing or serving forms: who must be served, proof of service, attachments required (e.g. copy of agreement for Form 2), and internal deadlines for responding to Commissioner requests.

• Training and audit: Train customer‑service staff and credit officers on the rebate calculation method as illustrated by regulation 5’s examples; audit a sample of agreements regularly for form and content compliance to preempt a Schedule 2 charge.

• Time management: Track the 28‑day payment period in the infringement process and set internal reminders to escalate non‑payment through the enforcement pathways. For applicants and owners, factor in time for the Commissioner’s decision and the potential for SAT review; do not assume immediate outcomes.

• Records retention: Retain originals and scanned copies of all agreements, instalment records, notices given to hirers, copies of Form 1 and Form 2 applications, service proofs, and Commissioner decisions for at least the period during which enforcement or review may be sought.

By following the procedural steps required by the regulations , use of prescribed forms, precise disclosure of rebate rights in the required format, prompt service, and systematic evidence collection , parties reduce the risk of administrative non‑compliance, infringement notices and downstream enforcement actions.
