HIH Royal Commission (Transfer of Records) Act 2003

The Act constructs a limited statutory regime for the custody, transfer, and treatment of records produced to the HIH Royal Commission. The main statutory concepts are identified and defined in the Act.

Transferred record: Central to the regimen is the defined term “transferred record” in s 3. It covers: (a) records ASIC has custody of under s 4(1) or under regulations made for s 6; and (b) electronic copies provided to ASIC under s 5 or under regulations for s 6 (s 3). This definition creates a single label for physical items in ASIC custody and for electronic copies placed with ASIC.

Record: The Act adopts the Archives Act 1983 meaning of “record” (s 3). That imports the Archives Act’s broader statutory definitions and consequences for Commonwealth records, rather than recasting the term within the HIH Act itself. The Act links the entitlement to custody to the Archives Act construct that certain items are “deemed” Commonwealth records under subsection 22(2) of the Archives Act (s 4(1)).

Custody and deemed direction: Section 4(1) operates “by force of this section” to make ASIC entitled to custody of qualifying records, and it treats that entitlement as if a direction under subsection 22(3) of the Archives Act were in force. In practical statutory terms, the Act substitutes a direct statutory entitlement for any separate administrative direction process that might otherwise be required under the Archives Act.

Electronic versions and objective coding data: The Act distinguishes between physical custody and electronic provision. Section 5 compels the Commonwealth to provide electronic copies of electronic versions it holds of documents produced to the Commission, together with any “objective coding data.” The Act does not define “objective coding data,” so the term is incorporated without definition.

Protected information and interaction with ASIC Act: Section 7(1) takes transferred records to have been disclosed to ASIC for the purposes of any of ASIC’s functions and to have the status of “protected information” for the purposes of section 127 of the Australian Securities and Investments Commission Act 2001. The statute thereby ties transferred records into ASIC’s statutory information regime.

Preservation of Royal Commission evidentiary limits and privilege: Section 8 expressly preserves the operation of section 6DD of the Royal Commissions Act 1902 in relation to the transferred records, and s 9 preserves legal professional privilege even after transfer or provision of electronic copies.

Regulations: Sections 6 and 10 provide mechanisms for extending or clarifying the Act’s operation, including giving the regulations power to provide for custody of other records and to require further materials to be provided, and giving the Governor‑General authority to make necessary regulations.

Timing and scope: The Commonwealth must ensure provision “as soon as practicable after the commencement” for both physical custody (s 4(2)) and electronic copies (s 5). The Act’s substantive scope is explicitly limited to records produced to the HIH Royal Commission and to records that meet the Archives Act deeming provision.

The statutory effects assign roles and duties to specific institutional actors and create consequences for holders and owners of material produced to the HIH Royal Commission.

Commonwealth: The Act places positive obligations on the Commonwealth (an executive branch actor or the record‑holding agencies) to provide or make available qualifying records to ASIC. Section 4(2) requires the Commonwealth to ensure physical records to which s 4(1) applies are provided or made available “as soon as practicable after the commencement” (s 4(2)). Section 5 places an equivalent obligation on the Commonwealth for electronic copies of electronic versions, including objective coding data (s 5). The Act therefore shifts the logistical burden of locating, copying and transferring material to Commonwealth custodians.

ASIC: The Act confers an entitlement to custody of specified records to ASIC by statute (s 4(1)). ASIC acquires a statutory right to retain physical records transferred under s 4(1) for as long as ASIC considers desirable for its functions and powers, even in the face of owner requests for return (s 7(2)). The Act also treats transferred records as having been disclosed to ASIC for the purposes of its functions and as having “protected information” status under s 127 of the ASIC Act (s 7(1)). Regulational powers in s 6 may expand ASIC’s custody or access to further records.

Persons and entities who produced documents to the HIH Royal Commission: The Act affects any person, corporation or other entity that produced documents or things to the Commission because those items, if they qualify as Commonwealth records under the Archives Act deeming provision, fall within the custody transfer. The Act’s note to s 4(1) makes explicit that s 4(1) applies to documents or things actually produced to the HIH Royal Commission; the obligation to provide electronic copies operates under s 5 (s 4 note, s 5). Owners of documents therefore face a statutory pathway for those produced items to be transferred to ASIC custody regardless of their ownership interest.

Owners of records and custodians: Owners may request the return of documents or things, but s 7(2) authorises ASIC to retain possession despite such requests while ASIC considers retention desirable for its functions and powers. The Act does not create a private right to prevent transfer, nor does it provide a right to immediate return.

Legal practitioners and documents subject to legal professional privilege: Section 9 expressly preserves legal professional privilege in transferred records and in material referred to in transferred records, stating that privilege does not cease merely because ASIC is entitled to custody or because electronic copies are provided (s 9). This affects solicitors, clients and in‑house counsel who produced privileged material to the Commission.

Archivists and records managers: The Act imports the Archives Act meaning of “record” (s 3) and works through the Archives Act deeming rules (s 4(1) referring to subsection 22(2) of the Archives Act). Those responsible for Commonwealth record‑keeping must therefore apply Archives Act concepts to determine what must be transferred and copied.

Regulatory actors and future regulators: Because regulations may extend access to other records (s 6) and the Governor‑General may make necessary regulations (s 10), future executive decisions can expand the circle of persons and materials affected by ASIC custody beyond those explicitly named in the Act.

This section sets out the positive duties imposed and the statutory rights conferred by the Act, with section references.

Commonwealth’s duties to provide records and copies: The Commonwealth must ensure that records to which s 4(1) applies are provided or made available to ASIC “as soon as practicable after the commencement of this Act” (s 4(2)). Separately, if the Commonwealth has an electronic version of a document or thing produced to the HIH Royal Commission and that electronic version is a Commonwealth record under the Archives Act deeming rule, the Commonwealth must ensure an electronic copy of that electronic version and of any associated objective coding data is provided or made available to ASIC as soon as practicable after commencement (s 5). These duties are non‑delegated statutory obligations on the Commonwealth as record holder.

ASIC’s entitlement and custody rights: ASIC is, by force of s 4(1), entitled to custody of qualifying records, and this entitlement is treated as if a direction under subsection 22(3) of the Archives Act 1983 were in force after commencement (s 4(1)). The Act grants ASIC a statutory entitlement rather than relying solely on administrative arrangements. ASIC may retain possession of a record or thing of which it is entitled to custody under s 4(1) for so long as ASIC considers it desirable to do so for the purposes of any of its functions and powers, despite a request from the owner for return (s 7(2)). This is a clear statutory retention right for ASIC.

Treatment as disclosed and as protected information: The transferred records are taken to have been disclosed or given to ASIC for the purposes of any of its functions and powers (s 7(1)(a)). Transferred records are also taken to have the status of “protected information” for the purposes of section 127 of the Australian Securities and Investments Commission Act 2001 (s 7(1)(b)). The Act therefore prescribes both the functional premise for ASIC’s handling of the material and the technical status under the ASIC Act’s information regime.

Regulatory powers to expand duties and rights: Section 6 permits the regulations to provide for ASIC’s access to other records of or relating to the HIH Royal Commission. The regulations may provide that ASIC is entitled to custody of such records or may require those records or electronic copies (with or without objective coding data) to be provided or made available to ASIC (s 6). Section 10 gives the Governor‑General power to make regulations required or permitted by the Act or necessary or convenient to give effect to it (s 10).

Legal professional privilege: The Act protects legal professional privilege. Section 9 states a transferred record, or material in or referred to in a transferred record, does not cease to be the subject of legal professional privilege merely because ASIC is entitled to custody under s 4(1) or regulations under s 6, or because an electronic copy is provided to ASIC under s 4(2) or s 5 or under regulations for s 6. That provision is an explicit statutory protection for privileged communications.

Preservation of Royal Commission non‑admissibility protection: Section 8 affirms that nothing in the Act affects the operation of section 6DD of the Royal Commissions Act 1902 in relation to transferred records. The Act’s note explains that s 6DD limits admissibility of statements or disclosures made to a Royal Commission or of the fact that a person produced a document or thing to a Royal Commission. The Act therefore keeps existing evidentiary limits in place.

No specified penalties in the Act: The Act does not create criminal or civil penalties for non‑compliance within its text. Duties are framed as obligations on the Commonwealth to ensure provision or making available, and the regulations power exists for further prescription. The absence of specified penalties in the statutory text means that enforcement mechanisms, if any, would need to be derived from other instruments or regulations (s 10) or through administrative processes.

The Act itself does not create new criminal offences, monetary penalties, or direct civil enforcement mechanisms against private parties. It operates primarily by conferring rights and imposing duties on the Commonwealth and on ASIC, with a delegated power to make regulations that could prescribe further matters.

No express penalties or enforcement sections: There is no section in the Act that prescribes penalties, sanctions, or infringement regimes for failure to provide records, for unauthorised disclosure, or for non‑compliance. Duties on the Commonwealth are expressed as positive obligations to “ensure” provision or making available (s 4(2), s 5). Those are internal obligations on the Commonwealth and do not, on their face, create private causes of action or criminal sanctions within the Act.

Administrative enforcement: The primary practical enforcement tool is the statutory entitlement conferred on ASIC by s 4(1) and the Commonwealth’s obligation to provide records (s 4(2), s 5). The mechanism for enforcing those obligations in practice would be administrative: the Commonwealth agencies holding records must comply with the transfer obligation and government oversight or internal legal advice would normally secure compliance. If the Commonwealth failed to comply, remedial options would typically be administrative and political, though the Act itself does not identify specific remedies.

Regulations could prescribe enforcement: Section 6 allows regulations to provide for ASIC access to other records and to require provision of records or electronic copies. Section 10 gives the Governor‑General power to make regulations required or permitted by the Act or necessary or convenient to carry it out. Those regulations could, in principle, create enforcement mechanisms, procedural steps, or penalties. The Act does not, however, itself make such prescriptions; any regulatory enforcement framework would need to be located in regulations made under s 10.

Protected information status and limits on disclosure: Section 7(1)(b) takes transferred records to have the status of “protected information” for the purposes of section 127 of the Australian Securities and Investments Commission Act 2001. The Act does not state the operational consequences of that status, but the linkage to s 127 incorporates whatever disclosure, secrecy or handling rules section 127 of the ASIC Act imposes. Enforcement tied to misuse or inappropriate disclosure of “protected information” would therefore be governed by the ASIC Act’s regime rather than by this Act directly.

Retention despite owner request: Section 7(2) gives ASIC a statutory right to retain records of which it has custody under s 4(1) even if the owner requests return. The Act does not prescribe enforcement steps to challenge ASIC’s retention, nor does it specify time limits or review mechanisms for such retention. Any recourse for owners would need to be sought under general law, administrative law principles, or through other statutory regimes, none of which are specified in this Act.

Evidentiary protection preserved: Section 8 preserves section 6DD of the Royal Commissions Act 1902 in relation to transferred records, which limits admissibility of certain statements or disclosures. The Act’s operation therefore continues to affect the evidential use of material in proceedings, and enforcement against improper use of Commission material in litigation remains subject to the Royal Commissions Act protection.

The Act explicitly operates through, and in relation to, several existing Commonwealth statutes. It imports and preserves key features of those laws rather than creating standalone doctrines.

Archives Act 1983: The Act repeatedly ties the scope of transfer to the Archives Act. Section 3 defines “record” as having the same meaning as in the Archives Act 1983. Section 4(1) applies to records that are “deemed, by subsection 22(2) of the Archives Act 1983, to be Commonwealth records for the purposes of that Act.” Section 4(1) goes on to treat the entitlement to custody as if a direction under subsection 22(3) of the Archives Act were in force. The practical effect is that the identification of items subject to transfer must be performed against the Archives Act’s deeming criterion and the procedural framework of subsection 22(3), although s 4(1) effectively creates a statutory substitute direction for the specific purpose of transferring HIH Royal Commission records to ASIC.

Royal Commissions Act 1902: Section 8 of this Act expressly states nothing in the Act affects the operation of section 6DD of the Royal Commissions Act 1902 in relation to transferred records (s 8). The explanatory note in s 8 explains that s 6DD limits admissibility in proceedings against a person of statements or disclosures made by the person to a Royal Commission, or of the fact that the person produced a document or thing to a Royal Commission. The Act therefore preserves those evidentiary protections for persons who gave evidence or produced documents to the HIH Royal Commission.

Australian Securities and Investments Commission Act 2001: The Act gives transferred records the status of “protected information” for the purposes of section 127 of the Australian Securities and Investments Commission Act 2001 (s 7(1)(b)). By doing so, the Act folds transferred records into the statutory information regime that governs how ASIC may use and disclose certain types of information. The specific consequences of that status are governed by s 127 of the ASIC Act rather than by this Act, but this Act ensures transferred records are treated within that framework.

Regulations and delegated legislation: Sections 6 and 10 allow the regulations to supplement and expand the Act’s operation. The regulations may provide for ASIC to have custody of other records, or require records or electronic copies (with or without objective coding data) to be provided to ASIC (s 6). Section 10 empowers the Governor‑General to make regulations required or permitted by the Act or necessary or convenient to carry it into effect. Those regulations will sit within the broader statute‑book and must be read in conjunction with the Archives Act, the Royal Commissions Act, and the ASIC Act where relevant.

Legal professional privilege and general law: Section 9 preserves legal professional privilege in transferred records and material referred to in them. This provision operates alongside common law and statutory rules governing privilege. The Act’s non‑derogation for privilege ensures that the transfer or provision of copies does not, in itself, extinguish privilege, but the operation and waiver of privilege otherwise remain governed by law outside the Act.

Administrative law and statutory interpretation: The duties imposed on the Commonwealth to provide records “as soon as practicable after commencement” (s 4(2), s 5) raise typical administrative law issues where interpretation of “as soon as practicable” and reasonableness of procedures may be contested. The Act itself does not prescribe processes, time frames, or review rights; those questions would be tested by reference to administrative law principles and any applicable regulations.

The Act text supplied contains no amendments, repeals, or substitute provisions beyond the single enacted version. The printed instrument includes the assented date and the enacted text, but does not record any subsequent amending instruments or schedules.

Commencement: The Act commences on the day it receives Royal Assent (s 2). The front matter of the supplied text records the assent date as 30 June 2003. The Act therefore took effect from Royal Assent under its express commencement provision.

No amending provisions in the text: The Act contains no sections that amend any other Act directly. It operates by reference and by conferral of custody and by creating statutory deeming effects in relation to existing Acts (Archives Act 1983, Royal Commissions Act 1902, Australian Securities and Investments Commission Act 2001). The regulations power (s 10) contemplates future regulatory instruments but does not itself effect textual amendment of other statutes.

No recorded subsequent changes in the provided material: The supplied legislation text does not include schedules, later notes, or editorial history indicating that the Act has been amended since assent. The Act therefore, according to the source text, stands in the form as printed. Any later amendments or repeals would not be visible in this source and are not addressed here.

Regulations unresolved at enactment: The Act contemplates that regulations may be made to expand ASIC’s access or custody rights (s 6, s 10). Those regulations are delegated instruments and would form part of the Act’s practical amendment‑like operation, but they are separate instruments and are not included in the Act text provided.

The Act text contains no references to litigation, no transitional dispute provisions, and no reported proceedings. The printed instrument includes the minister’s second reading speech citations but does not record any court decisions, challenges, or litigation arising under the Act.

Absence of litigation record in the source: Because the provided text is the enacted statute and does not include case law or later judicial consideration, there is no litigation history to summarise within this source. The Act does not itself set out any judicial review or specific dispute resolution mechanisms beyond ordinary legal processes available under Commonwealth law. Any litigation arising from the Act’s operation , for example, disputes about whether a particular item is a Commonwealth record under the Archives Act deeming rule, whether objective coding data must be produced, whether privilege has been waived, or whether ASIC’s retention was unreasonable , would be addressed in external case law not contained in this text.

Potential dispute points implied by the Act (not litigation records): While no actual cases are recorded in the Act, the statutory text suggests areas likely to generate litigation or administrative review in practice: scope of “as soon as practicable” obligations (s 4(2), s 5); meaning and scope of “objective coding data” (s 5); whether particular documents meet the Archives Act deeming test (s 4(1)); the operation of section 6DD of the Royal Commissions Act after transfer (s 8); and claims that privilege has been lost or waived despite s 9. The Act itself contains none of these disputes or outcomes.

This Act is concise but contains several drafting choices and cross‑references that create practical uncertainties and material consequences. The following points highlight areas where close attention is required.

“Deemed by subsection 22(2) of the Archives Act 1983”: The Act relies on the Archives Act deeming rule as the trigger for s 4(1). Whether a particular document is a Commonwealth record therefore depends on the Archives Act’s operation, not on this Act. Practically, records managers must apply the Archives Act to determine inclusion. The Act does not itself restate the Archives Act rule (s 4(1); s 3).

The Act applies only to documents actually produced to the HIH Royal Commission: Section 4(1) and its note make explicit that s 4(1) applies to documents or things that were actually produced to the HIH Royal Commission. Materials related to the Commission but not produced to it are not automatically within s 4(1) unless regulations under s 6 provide otherwise. Owners should therefore verify whether a particular item was actually produced to the Commission (s 4 note, s 3).

Electronic copies regime is broader than custody: Section 5 requires the Commonwealth to provide electronic copies of electronic versions the Commonwealth holds even if physical custody under s 4(1) does not apply to the physical item. That means the Commonwealth’s duty to provide electronic versions can capture materials not otherwise transferred as physical custody matters (s 5). The Act also requires transfer of “any associated objective coding data” (s 5), yet “objective coding data” is not defined in the Act, creating potential disputes about scope and completeness.

Ambiguity in “objective coding data”: The term is included without definition (s 5). Records custodians and data managers must therefore make judgment calls about what constitutes “objective coding data” for a given electronic item. The lack of definition may produce differing operational interpretations and consequent compliance costs or disputes.

“As soon as practicable after commencement”: Both s 4(2) and s 5 use the phrase “as soon as practicable after the commencement of this Act.” That is a standard but indeterminate legal standard. The Act supplies no timetable or priority list. The ambiguity creates potential administrative risk and may produce contention if third parties or oversight bodies challenge compliance timelines.

Retention despite owner requests: Section 7(2) permits ASIC to retain custody despite owner requests for return so long as ASIC considers retention desirable for its functions and powers. Owners thus lack an express statutory right to immediate return; recourse would rely on administrative review or other statutory processes. That s 7(2) bar on compelled return is operationally significant for owners.

Privilege preserved, but not fully protective of disclosure risk: Section 9 expressly states that transferred records or material in them do not cease to be subject to legal professional privilege merely because of transfer. However, the Act does not prohibit ASIC from using privileged material internally, seeking waivers, or relying on other disclosure regimes where privilege is contested. The Act removes only the automatic loss of privilege caused by the transfer itself (s 9).

Interaction with Royal Commissions Act 1902 s 6DD: Section 8 preserves s 6DD’s limits on admissibility in proceedings. That protection applies to transferred records. Users should not assume transfer to ASIC waives evidentiary protections conferred by the Royal Commission’s statutory regime (s 8).

Regulations can expand scope materially: Section 6 allows regulations to provide for ASIC’s access to “other records of, or relating to, the HIH Royal Commission,” including entitlement to custody or mandatory provision of records or electronic copies, with or without objective coding data. Future regulations could significantly expand the set of records subject to transfer or provision, and s 10 contemplates the Governor‑General making regulations for carrying into effect the Act. Stakeholders should monitor regulation‑making activity (s 6, s 10).

No penalties or timelines: The Act does not prescribe penalties for non‑compliance or timeline enforcement mechanisms. Compliance depends on administrative implementation by the Commonwealth and ASIC, and on any future regulations. That leaves some enforcement uncertainty if a record holder does not comply promptly (s 4(2), s 5).

Protected information status depends on ASIC Act: Section 7(1)(b) takes transferred records to be “protected information” for the purposes of s 127 of the ASIC Act. The consequences of that status are therefore governed by the ASIC Act; readers must consult s 127 of that statute to understand disclosure permissions and restrictions.

Definition dependence: Because “record” is defined by reference to the Archives Act, parties should not treat the Act as self‑contained. Determinations about inclusion require cross‑reference to the Archives Act (s 3).

This section sets out practical compliance steps for the principal actors under the Act, stated in a way that maps directly to the statutory duties and rights.

For Commonwealth record holders (agencies, departments, archives)

• Identify scope: Inventory all documents and things actually produced to the HIH Royal Commission, and determine which of those are “deemed” Commonwealth records under subsection 22(2) of the Archives Act 1983, because only those are captured by s 4(1) (s 3, s 4(1)). Document the basis for each inclusions decision.

• Physical transfer or availability: For items captured by s 4(1), take steps to provide or make them available to ASIC “as soon as practicable” after commencement. Create a prioritized transfer plan, with custodial chain of custody documentation, to show the Commonwealth has acted to comply with s 4(2).

• Electronic transfer and coding data: For any electronic versions held by the Commonwealth of documents produced to the Commission that are Commonwealth records under the Archives Act deeming rule, prepare electronic copies for transfer to ASIC, including any associated objective coding data (s 5). Because “objective coding data” is not defined, keep a record of the methodology used to identify, extract and package what the agency treats as objective coding data. Consider including file metadata, timestamps, indexing fields, and other objective attributes, and document those inclusions.

• Preservation of privilege markers: Where materials are subject to legal professional privilege, maintain privilege markings and supporting legal advice correspondence during transfer. Record retention of privilege assertions in transfer documentation to support the operation of s 9.

• Legal and records advice: Obtain records‑management and legal advice on whether particular items are Commonwealth records under the Archives Act and on the appropriate form and format for electronic transfer. Keep contemporaneous decision records.

For ASIC

• Receipt and custody protocols: Prepare custodial and security procedures for receiving transferred records, in particular for chain‑of‑custody documentation, data integrity verification of electronic copies, and secure storage consistent with “protected information” status under the ASIC Act (s 7(1)(b)).

• Retention policy: Because s 7(2) allows ASIC to retain custody for as long as ASIC considers desirable for its functions and powers, develop an internal retention policy setting criteria for retention, review intervals, access controls, and procedures for handling owner requests for return. Document ASIC’s reasons for retention decisions to support administrative accountability.

• Privilege management: Ensure procedures recognise and preserve legal professional privilege in transferred records, consistent with s 9. Record any communications or waiver requests and legal advice sought.

• Information handling consistent with s 127 of the ASIC Act: Treat transferred records in accordance with the “protected information” rules in s 127 of the ASIC Act. Ensure staff handling the material are trained in the handling and disclosure limitations imposed by that regime.

For owners of records and their legal advisers

• Monitor and ascertain status: Owners should ask the Commonwealth agency identified as the record holder whether particular documents they produced to the HIH Royal Commission will be provided to ASIC and on what basis (s 4(1), s 4(2), s 5). Seek written confirmation where possible.

• Assert and document privilege: If documents are claimed to be subject to legal professional privilege, document the basis and assert privilege in writing to the relevant Commonwealth agencies and to ASIC upon transfer (s 9). Preserve copies and logs that demonstrate the privileged nature of documents pre‑transfer.

• Requests for return: Be aware that s 7(2) authorises ASIC to retain custody despite owner requests for return. If a return is needed quickly, owners should engage with ASIC early, present reasons for return, and be prepared to pursue administrative review or other legal remedies if necessary.

• Metadata and coding data: Owners should ask about the scope of “objective coding data” if concerned about categorisation or searchable metadata being shared with ASIC (s 5). Where metadata might contain sensitive information, raise that point during communications with the Commonwealth and ASIC.

For records managers and IT staff

• Prepare exportable electronic packages: Build export packages that include electronic copies and clearly identified objective coding data. Use open formats and preserve file integrity (hashes, checksums) to minimise later disputes about completeness (s 5).

• Documentation trail: Maintain a documented audit trail that records when documents were identified as Commission productions, the decision process under the Archives Act deeming rule, extraction of objective coding data, transfer dates, recipients, and any communications with ASIC.

Regulations and future changes

• Monitor regulations: Because s 6 and s 10 permit regulations to expand ASIC’s custody and access, all relevant actors should monitor the Commonwealth Gazette and relevant registers for regulations made under the Act. When regulations are made, map new obligations into organisational compliance plans.

Administrative and legal review options

• Administrative escalation: If the Commonwealth fails to provide records “as soon as practicable,” agencies or owners can seek internal administrative escalation and seek clarification or a timetable.

• Legal advice: If disputes arise about whether a document is a Commonwealth record under the Archives Act, whether objective coding data is required, whether privilege is maintained, or whether ASIC’s retention is lawful, obtain legal advice promptly. The Act does not specify private enforcement routes; litigation or judicial review would rely on general administrative law principles rather than on express enforcement provisions in the Act.

Record retention and disposal

• Disposal policies: Coordinate with the National Archives principles (as incorporated by reference) when considering disposal or destruction of documents that may relate to the HIH Royal Commission, since the Act ties the matter to the Archives Act deeming rules (s 3, s 4(1)).

Concluding practical note: The Act places primary logistical duties on the Commonwealth to locate, package and transfer qualifying records and electronic copies (s 4(2), s 5). Entities that produced material to the HIH Royal Commission should proactively engage with the Commonwealth and with ASIC to clarify status, preserve privilege, and minimise operational surprises.
