Higher Education Support (Student Learning Entitlement) Guidelines 2021

Student Learning Entitlement (SLE) is the aggregate cap on the amount of subsidised study (measured in EFTSL - Equivalent Full-Time Student Load) that a Commonwealth supported student may use over a lifetime. The Act provides for three distinct pools: ordinary SLE, additional SLE, and lifelong SLE. The guidelines fill in the details of when and how each arises.

Ordinary SLE is the default entitlement and its amount is set in the Act (not in this instrument). The guidelines only refer to it in the context of the reduction and re-credit order. Additional SLE is an extra entitlement for students enrolled in courses that require more than the standard 7 EFTSL. The guidelines specify that a student has additional SLE if they are enrolled in an undergraduate course of study (not honours or graduate entry bachelor) with a course load greater than 6 EFTSL. The amount is calculated by a formula set out in section 7 which, from the text and images in the instrument, appears to involve subtracting 6 EFTSL from the course load and then performing further adjustments depending on the type of course. The image cannot be reproduced here, but the context suggests that for these courses the additional SLE is essentially the course load minus 6 EFTSL, possibly with an additional component for any embedded honours or graduate entry components. For honours courses of study with a course load less than or equal to 1 EFTSL, and for postgraduate courses or graduate entry bachelor courses, additional SLE is granted and the amount is the course load minus 1 EFTSL (based on the formula in subsection 7(2), which appears to subtract 1 EFTSL). However, the exact arithmetic must be derived from the images and the provider must apply the formula as written.

Lifelong SLE arises in two situations. First, under subsection 9(1), a person has lifelong SLE if they are or were enrolled in a unit of study as part of a course of study with a higher education provider. This is a very broad trigger, but the entitlement only vests on the later of 1 January 2032 or the 1 January immediately after 10 years from the person’s first commencement in a unit (subsection 10(1)). The amount is fixed at 3 EFTSL (subsection 11(1)). Second, under subsection 9(2), lifelong SLE arises when a provider restructures a course in a way that requires the person to undertake additional units to complete it. The amount in that case equals the total EFTSL value of those additional units (subsection 11(2)). This lifelong SLE vests on the day of the restructure (subsection 10(2)).

Reduction order is critical for administrative consistency. Section 13 requires providers to reduce a person’s ordinary SLE first, then additional SLE, and finally lifelong SLE. This means that lifelong SLE acts as a reserve that is only consumed after the other two pools are exhausted. Re-crediting under section 15 reverses the reduction in the reverse order, restoring ordinary SLE first if it was reduced, then additional, then lifelong. This mirrors the reduction sequence.

Special circumstances are defined in Part 6 for the purpose of re-crediting SLE when a student withdraws from a unit after the census date. The criteria are: circumstances beyond the person’s control (section 17), which must be unusual, uncommon or abnormal and not due to the person’s action or inaction; circumstances that did not make their full impact until on or after the census date (section 18); and circumstances that make it impracticable for the person to complete the unit requirements (section 19). The guidelines give examples: medical, family, employment, or course related circumstances. This three-part test must all be satisfied for a provider to be satisfied that special circumstances exist.

These guidelines directly affect every Commonwealth supported student in Australian higher education. Any student who ever enrolled in a unit of study at a higher education provider will have an SLE entitlement that is governed by these rules, even if they have not yet used it. The most immediate impact is on students in courses that exceed the standard 7 EFTSL, such as double degrees, combined degrees, or undergraduate courses with heavy vocational components. Those students will rely on additional SLE to complete their studies without losing Commonwealth support. Postgraduate students (including graduate entry bachelor students) are also affected because they do not receive ordinary SLE, but may receive additional SLE under Part 2, and may also access lifelong SLE after 2032 or upon a course restructure. Students who began their studies before 2022 will have a lifelong SLE entitlement that vests on 1 January 2032 (or later depending on their first commencement date). This affects long-term education planning, particularly for mature age students or those considering later life study.

Higher education providers are the primary duty bearers. They must track each student’s three SLE balances at all times. When a student enrols in a unit and remains past the census date, the provider must reduce the student’s SLE amount under section 76-1 of the Act. The guidelines mandate the order of reduction: ordinary first, then additional, then lifelong. This imposes a compliance burden on provider administration systems. Providers must also assess and adjudicate re-credit applications under the special circumstances criteria. The guidelines give providers discretion, but that discretion is circumscribed by the definitions in sections 17-19. A provider that wrongly refuses a re-credit may face student complaints and potential review under the Act.

Administrators and compliance officers within providers, as well as IT system developers, must ensure that student records capture all three SLE types and that reduction and re-credit calculations are performed correctly. The system must also handle the separate treatment of enabling courses (excluded from lifelong SLE under subsection 9(2)) and the different calculation methods for additional SLE for various course types. Given the complexity, providers may need to invest in system upgrades.

Students who change courses, take breaks, or have their courses restructured face particular impacts. For example, a student who uses all their ordinary SLE but has additional SLE available will continue in Commonwealth support; but once both ordinary and additional are exhausted, the student’s continued eligibility depends on lifelong SLE. The 2032 vesting date may catch students by surprise, especially those who commenced study many years ago. The course load definition (the minimum aggregated EFTSL value of all units required to complete the course) may be ambiguous for courses with multiple majors or elective streams, potentially disadvantaging students who need more units than the minimum.

Finally, the Commonwealth Department of Education is indirectly affected as these guidelines operationalise the fiscal constraints built into the Act. The order of reduction means that the government’s subsidy liability is first allocated to the default ordinary SLE, then to the additional SLE for more expensive courses, and only lastly to lifelong SLE. This ordering likely reflects an attempt to ensure that the most ‘standard’ subsidy is consumed first, preserving the more constrained pools for special circumstances.

Duties on providers. The primary duty is set out in section 13: when a provider reduces a person’s SLE amount under subsection 76-1(1) of the Act (which occurs when a student remains enrolled in a unit past the census date), the provider must reduce the student’s ordinary SLE, additional SLE, and lifelong SLE in that strict order and sequentially until the total equivalent to the EFTSL value of the unit has been deducted. The provider may not choose a different order or allocate the reduction arbitrarily. This duty is mandatory and not subject to a contrary agreement. If the provider fails to follow the order, the reduction may be invalid, leading to administrative complications and potential over-consumption of other SLE types.

A second duty arises under section 15: if a provider re-credits a person’s SLE amount under sections 79-1(1) or 79-20(1) of the Act (following a withdrawal under special circumstances), the provider must re-credit the amounts that were previously reduced, in the reverse order. This is essentially an unwind of the reduction. The provider must maintain records of the exact reduction history to execute the re-credit correctly.

A third duty is to assess applications for re-credit in accordance with Part 6. The provider must be satisfied that all three conditions are met: beyond control, impact on or after census date, and impracticability to complete. The guidelines provide some examples but do not exhaust the possibilities. The provider must apply the test reasonably and consistently. A decision that is manifestly unreasonable may be subject to review under the Act or the Administrative Decisions (Judicial Review) Act 1977.

Rights of students. Students have the right to apply for re-credit of SLE if they believe special circumstances exist. They also have the right to be informed of their current SLE balances, including the breakdown among ordinary, additional, and lifelong SLE. The guidelines do not explicitly create a right to request a statement, but the Act’s overall scheme implies a right to transparency. Students are entitled to have their re-credit application processed according to the guidelines rather than arbitrary provider policies. If a provider refuses re-credit, the student may seek internal review and then external review through the Commonwealth Ombudsman or the Administrative Appeals Tribunal (as provided for in the Act). The guidelines do not impose a duty on students to monitor their SLE, but as a practical matter a student who remains unaware of their consumption may find themselves with insufficient SLE to complete a later enrolment.

The guidelines themselves do not create penalties. They are a legislative instrument that sets out procedures and criteria under the Act. Enforcement flows from the Act. If a provider fails to follow the reduction order in section 13, the reduction of SLE may be ineffective, which could lead to the student being wrongly classified as having enough SLE when they do not, or vice versa. The Act provides for sanctions against providers for non-compliance with their obligations, including suspension or revocation of their approval to offer Commonwealth supported places. The Department may also withhold funding or impose conditions.

For students, the consequence of not following the special circumstances criteria is straightforward: they will not have their SLE re-credited, meaning the entitlement remains consumed and their remaining entitlement is reduced. That may shorten their ability to continue in Commonwealth supported study. The guidelines thus operate as a gatekeeper. There is no criminal penalty for a student who wrongly claims special circumstances, but a false or misleading statement may attract liability under the Criminal Code Act 1995 (Cth) for providing false information to a Commonwealth entity.

The provider’s discretion in assessing special circumstances is not unlimited. If a provider consistently applies a narrower definition than the guidelines allow, a student may challenge that decision. The absence of a prescribed penalty in the guidelines does not reduce the legal risk for providers; misapplication could lead to adverse administrative review findings and reputational damage.

These guidelines are made under section 238-10 of the Higher Education Support Act 2003. They operate as part of a broader legislative framework that includes the Act’s substantive provisions on SLE: sections 73-10 (additional SLE), 73-15 (lifelong SLE), 76-1 (reduction of SLE), 79-1 and 79-20 (re-crediting of SLE), and 79-5 (special circumstances). The guidelines fill in details delegated by those provisions. They do not override the Act; where the Act is clear, the guidelines must be consistent. For example, the Act provides that a person has a lifelong SLE if the circumstances set out in guidelines are met. These guidelines provide those circumstances. Similarly, the Act says the amount of additional SLE is worked out under guidelines; these guidelines provide the formula.

The guidelines also interact with the Student Assistance Act 1973 and the Social Security Act 1991 only indirectly, because a student’s SLE status can affect their eligibility for income support payments (e.g., Youth Allowance) that require the student to be undertaking full-time study. However, the guidelines themselves do not address social security.

At the provider level, these guidelines must be read alongside the provider’s own rules and policies. A provider’s internal policies on census dates, withdrawal procedures, and academic progress must align with the guidelines’ definitions of special circumstances. For instance, a provider’s policy that excludes employment related circumstances from re-credit would be inconsistent with section 19(1)(c) of the guidelines, which specifically includes employment related circumstances. The provider would be bound by the guidelines, not its own policy, should the two conflict.

The guidelines do not interact with the Fair Work Act 2009 or state industrial laws. There is no direct interplay with the Education Services for Overseas Students Act 2000 because SLE applies only to domestic Commonwealth supported students. The guidelines also do not affect the operation of the Tertiary Education Quality and Standards Agency Act 2011 (TEQSA) except insofar as a provider’s non-compliance with these guidelines could be a factor in TEQSA’s assessment of provider standards.

The instrument is dated 10 December 2021. It was made by the Minister for Employment, Workforce, Skills, Small and Family Business. It commenced on the later of the day after registration and immediately after the commencement of Schedule 4B to the Higher Education Support Amendment (Job-Ready Graduates and Supporting Regional and Remote Students) Act 2020. That commencement condition aligns the guidelines with the substantive amendments that introduced the SLE regime. The source document does not show any subsequent amendments. As of the date of this instrument, it remains unamended. However, the SLE framework is still relatively new and the guidelines may be modified in the future to address practical difficulties, such as the ambiguity in the additional SLE formula or the broadness of the lifelong SLE trigger. Any future amendments will be registered on the Federal Register of Legislation. The absence of amendment history does not imply stability; it more likely reflects the youth of the instrument.

The source document does not cite any cases. These guidelines are a delegated legislative instrument and have been in force only since 2022. Given that the higher education sector often produces disputes over fee arrangements and Commonwealth support decisions, it is plausible that the interpretation of these guidelines (especially the special circumstances criteria) may be litigated in the future. However, as of the publication of the instrument, there is no reported litigation history. Practitioners should note that the Administrative Appeals Tribunal may hear applications for review of provider decisions under the Act, and the guidelines’ definitions will be central to those proceedings. The absence of cases does not mean the guidelines are free from ambiguity; rather, it suggests that the system has not yet been stress-tested through adversarial challenge. Providers should act as if their decisions will be scrutinised and should document reasons thoroughly.

The additional SLE calculation formula is incomplete on the face of the document because the images have not been rendered. Providers must obtain the official HTML or PDF version from the Federal Register of Legislation to see the precise arithmetic. The alt text is absent. A provider that relies on the text alone may miscalculate. The definition of ‘course load’ as the ‘minimum aggregated EFTSL value’ may cause problems for courses with multiple pathways or where the minimum is lower than the actual load a student undertakes. A student who undertakes additional units beyond the minimum might not receive additional SLE coverage for those extra units because the entitlement is calibrated to the course load, not the student’s personal enrolment pattern. That could lead to exhaustion of ordinary SLE earlier than expected.

The lifelong SLE trigger of 1 January 2032 or 10 years from first commencement is easy to overlook. Students who first commenced study before 2022 will not get lifelong SLE until 2032 at the earliest. A student who started in 2021 will have lifelong SLE vest on 1 January 2032 (subsection 10(1)(a) - the later of 1 Jan 2032 and 10-year period). This means that lifelong SLE is not immediate for most current students; it is a future entitlement. The 10-year period starts from the first unit of study, not necessarily from the first Commonwealth supported unit. A student who first enrolled in a fee-paying unit may still trigger the 10-year clock. The provider must track this from the student’s earliest enrolment, which may be with a different provider.

Special circumstances criteria appear generous, but the requirement that the circumstances must be ‘unusual, uncommon or abnormal’ (section 17(2)) raises the bar above mere inconvenience. A provider may take a narrow view, and the student may not know what evidence to provide. The examples in section 19 are not exhaustive but also not mandatory; a provider could decide that a particular death in the family does not meet the test if it was foreseeable. The language ‘a reasonable person would consider is not due to the person’s action or inaction’ imports an objective test, but the provider applies it. Students with pre-existing medical conditions that worsen may find the provider arguing that the condition was not beyond their control if they chose to enrol knowing it.

The reduction order in section 13 means that lifelong SLE is the last to be consumed. This is protective for students who only have lifelong SLE, but it also means that if a student has both ordinary and lifelong SLE, the provider must consume the ordinary SLE first. A student who later wants to preserve ordinary SLE for a different course cannot ask the provider to reduce lifelong SLE first. The order is inflexible. Similarly, re-crediting under section 15 only reverses the reduction in the original order; if a student’s ordinary SLE was reduced, it will be re-credited first. But if the student has since had their ordinary SLE reduced for other units, the re-credit might only partially restore the balance. The example in section 15 shows a clean case, but real world circumstances may involve multiple reductions and re-credits, making tracking complex.

The guidelines do not address how to handle SLE when a student transfers between providers. The reduction and re-credit rules are per provider, but the student’s overall SLE is aggregated. A provider may not have a complete history. This creates a risk of double reduction or double re-credit if systems are not integrated.

For providers: The most important step is to implement an administrative system that can track three separate SLE balances for each student: ordinary, additional, and lifelong. This system must record the initial amounts (ordinary from the Act, additional from the course type and load, and lifelong from the date formula). The system must apply the reduction order in section 13 every time a student remains enrolled past the census date. The reduction must be applied at the unit level: for each unit, the EFTSL value is deducted first from ordinary, then additional, then lifelong. The system must also handle partial reductions when the student’s ordinary balance is less than the unit’s EFTSL value, and so on.

For re-crediting, the system must store the reduction history so that when a re-credit is approved, it can restore the exact same amounts in reverse order. The system should not simply add a generic re-credit; it must allocate to the specific SLE type that was reduced for that unit. Providers should audit their processes to ensure that the reduction order is consistently applied across all units and that there is no manual override.

Special circumstances assessments: Providers must publish clear policies that incorporate the three-part test from Part 6. Staff who assess re-credit applications must be trained to apply the definitions. Decisions should be documented with reasons addressing each element: (1) were the circumstances beyond the student’s control (unusual, uncommon, abnormal), (2) did the full impact occur on or after the census date (including circumstances that worsened or became apparent later), and (3) did the circumstances make it impracticable to complete the unit (including the inability to study, attend, or complete assessment). The examples in section 19 are illustrative; providers should not treat them as exhaustive but should apply a similar standard. It is advisable for providers to create an internal guideline that expands on each example with typical evidentiary requirements (medical certificates, death notices, employer letters, etc.), but without narrowing the defined categories.

Student communication: Providers must inform students about their SLE entitlements at enrolment and annually. Special effort should be made to explain the lifelong SLE vesting date, as many students will not be aware that they have a future entitlement. Students should be warned that the order of reduction is mandatory and that they cannot choose which SLE pool is used. Providers should also advise students about the re-credit process and the need to apply promptly after special circumstances arise.

Record keeping: Because the reduction and re-credit rules require tracking across time, providers must retain records of each unit enrolment and the associated reduction allocation. This data may need to be retained for the duration of a student’s entire study history, potentially decades for lifelong SLE calculations. A failure to keep accurate records could result in incorrect reductions and liability for over or under payment of Commonwealth subsidies.

System testing: Providers should test their SLE management systems with various scenarios: students with only ordinary SLE, students with ordinary plus additional, students with all three types, and students whose course load triggers additional SLE under the formula. The formula in section 7 must be implemented exactly as legislated. Given the images are not reproducible in this text, providers must obtain the official graphical version and ensure the formula is correctly programmed, including the subtraction and addition of any components.
