Higher Education Support (OS-HELP) Guidelines 2023

OS‑HELP assistance is a loan provided under the Higher Education Support Act to eligible students to help with the costs of undertaking overseas study that counts towards their Australian course of study. The guidelines do not affect eligibility criteria set out in the Act; they focus on the selection and administration process. A central concept is the “overseas study” definition: study undertaken outside Australia that counts towards the course requirements of the student’s enrolled course with their home provider. This means the study must be credit-bearing and part of an Australian award. The “six month period” is the unit around which OS‑HELP is structured; a student can receive OS‑HELP for one six‑month period, and if they undertake a second six‑month period that is a continuation of the first, they may receive a second loan, but the provider cannot assess entitlement more than six weeks before the second period begins (s 7(11)). The guidelines forbid overlapping six‑month periods (s 7(9)). The “supplementary amount for Asian language study” is an additional loan amount available if the student undertakes language study that relates to their overseas study in Asia. The guidelines restrict this: a student cannot receive the supplementary amount if they are taking the Asian language study as part of a course of study for which they are Commonwealth supported or in receipt of FEE‑HELP assistance (s 8(1)). The provider must be satisfied that the language study provides appropriate preparation, and the language study must relate to the overseas study in Asia (s 8(2)-(3)). The definition of “Asia” in Chapter 3 lists 26 countries as per the Australian Bureau of Statistics classification. Notable inclusions: North Korea, Myanmar, Timor‑Leste; exclusions: China excludes SARs and Taiwan, but Taiwan is listed separately, and Hong Kong and Macau are listed as SARs. The “OS‑HELP debt confirmation form” is the mechanism by which a selected student acknowledges the debt and provides key details: the loan amount, the commencement date of the six‑month period, the date the student will begin overseas study, and any other information required by the provider’s policy. The provider must not pay the loan before the student signs and returns that form. The concept of “order of merit” is central: providers must have criteria to rank applicants and select from that order, presumably because demand may exceed the allocated number of loans. The guidelines do not prescribe what those criteria must be, only that they be included in the policy. This leaves providers free to set academic merit, personal statement, financial need, or other factors, subject to the Act’s fairness requirements.

These guidelines directly affect higher education providers that choose to offer OS‑HELP assistance. Not all providers are required to offer it; participation is voluntary. For those that do, compliance is mandatory because the Act requires providers to act in accordance with these guidelines. Providers bear the administrative burden of drafting, publishing, and applying an OS‑HELP assistance policy that meets the specific content requirements of s 7(2). They must establish application windows, assessment criteria, order of merit, payment timing, debt confirmation procedures, and conditions. They must notify applicants of outcomes within two months. They must also monitor loan caps: the Department advises each provider of its allocation, and the provider cannot exceed that number (s 9). The note states a national cap of 20,000 loans per year, which constrains total program size. Providers must also oversee the debt confirmation process and ensure a student does not specify a commencement date earlier than the actual start of overseas study (s 7(8)). The second affected group is students. Only students enrolled in a course of study with a participating provider and who meet the eligibility criteria under the Act may apply. The guidelines do not expand eligibility; they control selection. Students must follow the provider’s application process, provide information, and complete the debt confirmation form with accurate details. Students who are Commonwealth supported or using FEE‑HELP for Asian language study cannot receive the supplementary amount (s 8(1)). Students undertaking a second six‑month period face a timing restriction: the provider cannot determine entitlement more than six weeks before that period begins (s 7(11)). The Department of Education is affected as the administrator of the program; the guidelines require providers to notify the Department of suspected false or misleading information (s 7(15)). The Department also advises providers of their loan allocations and may receive reports. Ultimately, taxpayers are affected because OS‑HELP loans are public money, and the 20,000 loan cap reflects a budget constraint.

The guidelines impose duties primarily on higher education providers. The central duty is to maintain an OS‑HELP assistance policy that accords with the guidelines and with the fairness requirements in Subdivision 19‑D of Part 2‑1 of the Act, and to make that policy publicly available (s 7(1)). The policy must include: application process and dates; assessment criteria and order of merit; method for determining loan amounts including any minimum; payment timing; debt confirmation form requirements; and any conditions (s 7(2)). Providers must select students in accordance with that policy (s 7(3)). They must also be the first point of contact for applicants (s 7(4)) and make information available to all students (s 7(5)). A key duty is to require a signed and completed OS‑HELP debt confirmation form before any payment is made (s 7(6)). The form must include the loan amount, the commencement date for the six‑month period, the date the student will begin overseas study, and any other information specified in the provider’s policy (s 7(7)). Providers must ensure the commencement date is not before the start of study (s 7(8)). They must not select a student for overlapping six‑month periods (s 7(9)). For a continuation period, the provider cannot determine the student meets entitlement requirements more than six weeks before that period starts (s 7(11)). Administratively, the provider must notify applicants of the outcome in writing within two months of receiving the application or within two months of the closing date, whichever is later (s 7(12)). If an offer is made and later the provider determines the student is not entitled, the provider must withdraw the offer if unpaid and notify the student in writing (s 7(14)). If the provider knows or suspects a student provided false or misleading information, it must immediately notify the Department and provide the application and any requested information (s 7(15)). Payment must be in a single payment unless the student also receives a supplementary amount for Asian language study, which may be paid separately (s 7(16)). Payment cannot be made more than six months before the commencement of the six‑month period (s 7(17)). For supplementary amounts, providers must not select a student who is taking Asian language study as part of a course for which they are Commonwealth supported or using FEE‑HELP (s 8(1)). The provider must be satisfied the language study is appropriate preparation and relates to the overseas study in Asia (s 8(2)-(3)). If the language study is not at the same provider, the provider must require evidence of enrolment or application (s 8(4)). Students have the right to apply under the provider’s policy, to be considered according to the published criteria, and to be notified of the outcome. They have a duty to provide accurate information and to sign the debt confirmation form. They do not have a right to a loan; selection is at the provider’s discretion within the policy and allocation limits.

The guidelines themselves do not create penalties or enforcement mechanisms. They are a legislative instrument made under the Act, and penalties arise from the Act and other applicable laws. The most significant enforcement consequence is that providers that fail to comply with these guidelines may be in breach of the Act. Section 118‑15 of the Act requires higher education providers to comply with the principles and procedures in these guidelines when selecting students. A failure to comply could lead the Department to take administrative action, such as reducing or withdrawing the provider’s allocation of OS‑HELP loans, or imposing conditions on its approval as a provider. More broadly, the Act contains civil penalty provisions for false or misleading statements, including those made by students in applications or debt confirmation forms. If a provider knows or suspects false or misleading information has been provided, s 7(15) of the guidelines requires it to immediately notify the Department and provide relevant materials. The Department may then investigate and pursue penalties under the Act, which could include repayment of the loan, civil penalties, or criminal prosecution depending on the severity. For students, providing false or misleading information to obtain OS‑HELP can result in a debt to the Commonwealth and potential legal action. The guidelines do not specify a process for the Department to impose sanctions on providers for breaching the guidelines beyond reporting obligations. However, because the guidelines are binding, any administrative decision by a provider that breaches them could be subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 or internal merits review mechanisms within the provider. The effectiveness of enforcement depends on the Department’s willingness to monitor provider compliance. The guidelines do not impose reporting obligations on providers regarding their overall compliance; only specific reporting of suspected false information is required. This creates a gap: a provider could inconsistently apply its own policy without consequence unless a student complains or the Department conducts an audit. The 20,000 loan cap is enforced by the Department advising each provider of its allocation; exceeding that allocation would likely lead to the Department not approving the additional loans or requiring repayment. There are no financial penalties explicitly stated in the instrument.

The guidelines are made under the Higher Education Support Act 2003 and must be read together with that Act. The Act sets the framework for OS‑HELP: eligibility criteria (s 118‑1), entitlement (s 118‑5), amounts (s 118‑10), and the requirement for providers to follow principles and procedures in selecting students (s 118‑15). The guidelines fill in those procedures. The Act’s fairness requirements in Subdivision 19‑D of Part 2‑1 also apply; the provider’s OS‑HELP policy must accord with those requirements as in force from time to time (s 7(1)). The guidelines do not override the Act; where a provision in the guidelines conflicts with the Act, the Act prevails. The definition of “overseas study” in the guidelines (s 4) is consistent with the Act’s concept; the interpreter must ensure alignment. The guidelines interact with the Higher Education Support (HELP Debt) Guidelines and other instruments that govern repayment and indexation of HELP debts, because an OS‑HELP loan is part of a person’s HELP debt. Some interactions are indirect: if a student receives the supplementary amount for Asian language study, that amount is also a HELP debt. The guidelines also interact with the Privacy Act 1988 because providers collect personal information from applicants and debt confirmation forms, and must notify the Department of suspected false information. Providers must ensure their handling of that information complies with privacy obligations. The guidelines do not affect migration law directly, but overseas study may require a student visa; providers have no obligation under these guidelines to check visa status, but the Act’s eligibility (s 118‑1) includes a requirement that the student be an Australian citizen or holder of a humanitarian visa. This is not restated in the guidelines. The Australian Education Act 2013 and other Commonwealth education funding laws may also be relevant if the provider receives other support. The definition of “Asia” in Chapter 3 uses the Australian Bureau of Statistics classification, which may differ from other Commonwealth definitions of Asia for trade or foreign policy purposes. This could cause confusion if a student studies in a territory not listed (e.g., Central Asian countries not listed are excluded from supplementary amount eligibility). The guidelines do not interact with state or territory laws directly, except to the extent that a provider must comply with local laws when operating overseas; the guidelines do not address that.

These guidelines were made on 29 September 2023 by the Minister for Education, Jason Clare. They commenced on the day after registration on the Federal Register of Legislation. The instrument replaces and repeals the OS‑HELP Guidelines 2013 in their entirety (Schedule 1). There is no indication of any interim amendments between 2013 and 2023. The 2013 Guidelines were the previous version; the 2023 guidelines are a standalone remake. The explanatory material that would typically accompany such a remake is not provided in the source text, but the instrument itself shows no substantial structural changes from what one might expect; it retains the same framework of provider policy, selection procedures, debt confirmation, Asian language supplementary amount, and Asia definition. The note about the total number of loans not exceeding 20,000 was present in the 2013 Guidelines. No amendment history is provided within the instrument (e.g., no table of amendments). Since its commencement, no further amendments appear; the instrument is current as of the date of this analysis. Any future amendments would be published as separate amending instruments. Practitioners should check the Federal Register of Legislation for any subsequent changes, especially if the Act is amended, because the guidelines must stay consistent.

The source text does not mention any litigation history, and no cases are cited within the guidelines. As a legislative instrument prescribing administrative procedures, the OS‑HELP Guidelines 2013 and 2023 are unlikely to have been directly litigated. However, they may have been referenced in judicial review proceedings concerning a provider’s decision to select or not select a student. Any such cases would typically involve the provider’s compliance with its own policy and the fairness requirements of the Act. Without specific case details from the source, we can note that the absence of cited litigation does not mean none exists; it simply means the instrument does not reference any. A practitioner researching a dispute should search for administrative law cases involving OS‑HELP decisions, particularly under the Administrative Decisions (Judicial Review) Act 1977 or state supreme court judicial review. The guidelines themselves are unlikely to be the subject of a constitutional challenge because they are made under a valid Commonwealth head of power (education). The definition of “Asia” might theoretically be challenged as unreasonable, but such a challenge would be difficult given the broad discretion in classifying regions for policy purposes. The requirement for providers to notify the Department of suspected false information could raise questions about procedural fairness, but again no reported decisions are known from the source.

Several provisions carry traps for the unwary. Under s 7(8), a provider must ensure the student does not specify a commencement date in the debt confirmation form that is before the date the student begins overseas study. If the student’s travel is delayed, the form might be invalid, potentially requiring a new form and delaying payment. Section 7(9) prohibits overlapping six‑month periods, which seems straightforward, but a student who starts a second period even one day before the first period ends would breach the rule. The provider must check dates carefully. Section 7(11) restricts assessment for a continuation period: the provider cannot determine entitlement more than six weeks before the second period starts. This means a provider cannot process a continuation application too early; they must wait until within six weeks of the start date. If the provider processes it early and pays before that window, it may be invalid. The payment timing in s 7(17) is also a trap: a provider cannot make payment more than six months before the commencement of the six‑month period. Combined with s 7(11), this creates a narrow window for payments near the start of the period. The requirement to pay in a single payment (s 7(16)) means the provider cannot split the OS‑HELP amount into multiple payments unless the student also receives a supplementary amount for Asian language study, which may be paid separately. This prevents providers from making part payments as the student’s expenses accrue. The supplementary amount for Asian language study has its own trap: s 8(1) bars selection if the student is taking the language study as part of a course for which they are Commonwealth supported or in receipt of FEE‑HELP. This is not about the language study being separately funded; it is about the course of study leading to the award. A student doing an Asian language subject within their degree may be disqualified from the supplementary amount if that degree is Commonwealth supported. The provider must verify the student’s fee status. The definition of “Asia” in Chapter 3 includes Taiwan separately but excludes Taiwan from the China listing. This means a student studying in Taiwan can receive the supplementary amount, but a student studying in mainland China cannot count Taiwan as part of China for this purpose. The note says total loans per year will not exceed 20,000 for all providers, but that is a note, not a mandatory provision in the instrument itself; the binding cap is s 9, which says a provider must not select more than the number advised in writing by the Department. The Department’s allocation letter may set a lower cap, and there is no right to appeal that allocation. Another procedural trap: s 7(14) says if a provider determines a student is not entitled after offering, the provider must withdraw the offer if unpaid and notify in writing. There is no provision for what happens if the student has already received a payment; presumably the debt becomes repayable under the Act. Providers must have robust processes to check eligibility before payment. Finally, s 7(15) requires immediate notification to the Department if the provider knows or suspects false or misleading information. “Suspects” is a low threshold; providers may feel obliged to report minor inconsistencies, potentially over‑reporting and burdening the Department.

Compliance for a higher education provider begins with drafting and maintaining an OS‑HELP assistance policy that meets every requirement in s 7(2). The policy must be publicly available, updated as needed to reflect changes in these guidelines or the Act, and must comply with the fairness requirements in Subdivision 19‑D of Part 2‑1. Practically, this means the provider should document: application opening and closing dates; the information applicants must provide (e.g., proof of enrolment overseas, course requirements, academic record); the criteria used to assess applications and to establish an order of merit (e.g., academic merit, relevance of study, financial need, equity considerations); how the provider determines the loan amount (including any minimum amount); how and when payments are made (along with restrictions on payment dates); requirements for the debt confirmation form (what information it must contain and when it must be signed); and any conditions attached to the loan. The provider must then select students strictly in accordance with that policy (s 7(3)). Before any payment, the provider must obtain a signed and completed OS‑HELP debt confirmation form (s 7(6)). The provider must verify that the commencement date on the form is not before the student actually begins overseas study (s 7(8)). The provider should check for overlapping six‑month periods (s 7(9)). For students undertaking a second six‑month period, the provider must not process the assessment more than six weeks before the second period starts (s 7(11)). Payment must be in a single lump sum unless the student also receives a supplementary amount for Asian language study, in which case that amount may be paid separately (s 7(16)). Payment must not be made more than six months before the commencement of the relevant six‑month period (s 7(17)). On the administrative side, the provider must notify applicants of the outcome in writing within two months of receiving the application or within two months of the closing date, whichever is later (s 7(12)). If an offer is made but later the provider determines the student is not entitled before payment, the offer must be withdrawn and the student notified in writing (s 7(14)). If the provider knows or suspects false or misleading information, it must immediately notify the Department and provide the application and any other relevant materials (s 7(15)). For supplementary amounts for Asian language study, the provider must not select a student who is taking the language study as part of a course for which they are Commonwealth supported or receive FEE‑HELP (s 8(1)). The provider must be satisfied the language study is appropriate preparation for the overseas study in Asia and that it relates to that study (s 8(2)-(3)). If the language study is at a different provider, the provider must require evidence of enrolment or application (s 8(4)). The provider must also monitor its allocation: each year the Department provides a maximum number of students it can select. The provider must not exceed that number (s 9). It should maintain records of selections to ensure compliance. Finally, the provider should regularly review its policy and processes against any updates to the guidelines or the Act. Training of staff involved in OS‑HELP administration is advisable to avoid procedural errors that could lead to a challenge or loss of funds. Students should read the provider’s policy carefully, meet application deadlines, provide accurate information, and complete the debt confirmation form honestly, ensuring the commencement date matches the actual start of overseas study.
