What it does
These Regulations prescribe the application fees and procedural conditions for four distinct categories of approval under the Higher Education Act 2004 (NT): establishment or recognition of a university in the Territory; approval for an overseas higher education institution to operate in the Territory; accreditation of higher education courses offered by non‑university providers; and approval for a provider to offer courses to overseas students in the Territory. Mechanically, the Regulations set fee amounts expressed in "revenue units" (the value of which is defined by the Act, not these Regulations), provide for reduced fees in certain circumstances, and introduce the concept of a "modified accreditation process" that shifts administrative and cost burdens onto the applicant.
The fee structure is not uniform. For university establishment the base fee is 42,700 revenue units, with a halved fee of 21,360 revenue units for a second application made within six months of a refusal, provided the second application addresses the reasons given in the information notice. For overseas institutions, the fee is the sum of course fees at 14,700 revenue units per course, but with a steep discount to 3,675 revenue units for each additional course that is "assessable in the same process" as determined by the Minister. For non‑university providers seeking accreditation, the fee varies depending on whether the applicant participates in a modified accreditation process (3,250 revenue units per course), whether the course is accredited under a corresponding law (6,500 revenue units), or whether a concurrent‑accreditation scenario applies under Ministerial Council procedures (also 6,500 revenue units). In the default case the fee is 14,700 revenue units. For courses to overseas students, the fee is a flat 350 revenue units per course. The Regulations also deem multiple applications made at the same time to be a single application for fee calculation purposes, which can either increase or decrease the total fee depending on the discount structure.
