What it does
This instrument is a formal notice of approval under the Higher Education Support Act 2003 (the Act). It approves the application of Australian Chiropractic College Limited (ABN 84 612 258 072, ACN 612 258 072) as a higher education provider under section 16-25 of the Act, records the decision required by paragraph 16-50(1a), and gives written notice of approval required by paragraph 16-50(1b) (see opening recital and items (a)-(d)). The delegate exercising the Minister’s powers is named as Damian Coburn, Assistant Secretary, HELP and Provider Integrity Branch.
The approval is conditional. Conditions are imposed under paragraph 16-60 of the Act and are set out in full in the notice. They impose ongoing financial, governance, reporting and disclosure obligations on the provider for the period of its approval. Financial conditions include maintaining a current ratio of 1.0 or above and a positive equity position (conditions 1 and 2). The notice further restricts the provider’s ability to extend guarantees and loans to directors or related entities (condition 3), and restricts providing assets as security except where those securities arise from commercial loans with a recognised financial institution (condition 4). The notice requires annual financial reporting to the department in accordance with the Financial Viability Instructions: Applicants and Providers of FEE-HELP by 31 December each year (condition 5), and audited financial statements in respect of a named trustee entity by the same date while that trustee remains in operation (condition 6).
Operational and disclosure obligations are also imposed. The provider must notify the department within 10 working days of events affecting its capacity to meet the Act’s quality and accountability requirements, and must notify changes to directors, company structure or constitution within 10 working days (conditions 7 and 8). It must advise the department, as soon as practicable, of regulatory activity by TEQSA or other regulators and of regulatory activity under Australian Consumer Law and fair trading laws (conditions 9 and 10). Student-facing disclosure obligations require advising applicants in writing of the provider’s accreditation status with the Council of Chiropractic Education Australia using the Council’s recommended statement until unconditional accreditation is attained (condition 11), and advising applicants in writing of total course cost and the likelihood of out-of-pocket expenses due to the HELP Loan Limit (condition 12). Finally, the provider must report student data into the Higher Education Information Management System (HEIMS) monthly for two years from the approval date (condition 13).
