What it does
This instrument, the Higher Education (Courses of Study in Respect of Which Students are Ineligible for Enrolment as Commonwealth Supported Students) Determination 2017, made by the Minister for Education and Training, operates as a targeted statutory determination under paragraph 36-15(2)(b) of the Higher Education Support Act 2003 (the Act) (see s 1 and s 3). Its operative effect is narrow and mechanical: it proscribes the enrolment of students as Commonwealth supported students in two categories of course of study, namely Research Masters degree and Research Doctoral degree (s 5(a)-(b)). The instrument commences on the day it is registered on the Federal Register of Legislation (s 2) and is dated 24 September 2017 (signature by Simon Birmingham).
Mechanically, the Determination accomplishes three primary acts. First, it replaces and revokes the earlier determination registered 19 August 2004 (F2007B01075) (s 4). Second, it specifies the courses of study for which students may not be enrolled as Commonwealth supported students (s 5). Third, it provides a savings clause addressing the status of students who were enrolled in such units before the Determination commenced, by stating that they will continue to be regarded as not having been enrolled in those units as Commonwealth supported students (s 6).
The instrument does not itself set fees, subsidies, eligibility criteria for other funding schemes, nor penalties or enforcement mechanisms. It asserts a single categorical exclusion from the status of "Commonwealth supported student" for the two named course types and clarifies that this exclusion applies to students both before and after commencement (s 5; s 6). Authority for this exclusion is expressly stated as paragraph 36-15(2)(b) of the Act (s 3); the Determination does not include explanatory material on policy objectives or implementation mechanics beyond the text reproduced in ss 1-6.
