#### 14 Unlawful provision of higher education courses 14 Unlawful provision of higher education courses > A person must not represent that an Australian institution provides any degree or post-graduate course, or is authorised to provide any degree or post-graduate course, unless: > > > (a) the institution is: > > > > > (i) an Australian or overseas university, or > > > > > (ii) an Australian or overseas higher education institution, and > > > (b) in the case of a course provided otherwise than by an Australian university: > > > > > (i) the course is accredited under Division 2 in relation to the institution, or > > > > > (ii) if the institution is an overseas university or higher education institution, the course is approved in accordance with the National Protocols. > > Maximum penalty: 200 penalty units. > > **s 14:** Am 2008 No 14, Sch 1 \[9\].
