51 Notice of judgment to be served on certain persons and its effect (1) Where, in a proceeding for the administration of the estate of a deceased person or the execution of the trusts of a deed or instrument, or for the partition or sale of hereditaments, a judgment or order has been pronounced or made: (a) under Order 15 or Order 34; or (b) affecting the right or interests of persons not parties to the action; the Court or a Justice may direct that persons interested in the estate or under the trust or in the hereditaments shall be served with notice of the judgment or order. (2) After service with notice of the judgment or order, those persons shall be bound by the proceedings in the same manner as if they had originally been made parties, and they may attend the proceedings under the judgment or order. (3) A person so served may, within twenty-eight days after the service, apply to the Court or Justice to set aside or vary the judgment or order.
