Heritage Rivers Act 1992

The Act organises its regulatory architecture around a small set of legal constructs that determine scope, duties and prohibitions.

• Heritage river area and natural catchment area. These are statutory place‑based designations created by reference to the parts lists and plans in Schedules 1 and 2 (ss 5-6). The Schedules describe areas by plan identifiers lodged in the Central Plan Office and by metric buffers from river banks. Compliance with the Act therefore requires cross‑referencing the schedules and the lodged plans.

• Public land. The Act applies to “public land” as defined in s 3(1), a definition that imports multiple other Acts. Public land includes unalienated Crown land, certain reserved land under the Crown Land (Reserves) Act 1978, State forest under the Forests Act 1958, parks under the National Parks Act 1975, land vested in specified public authorities and land declared to be public land under the Land Conservation Act 1970. The Act therefore operates as a constraint primarily on Crown and vested public land within the mapped areas (s 3).

• Managing authority. The person or organisation responsible for management of public land in a heritage river or natural catchment area is a “managing authority” (s 3). The Act does not fix a single managing body; instead it contemplates multiple types of managing authorities and expressly allows joint management “whether or not that responsibility is exercised alone or together with any other person or authority” (s 3, s 7(3)). The Act also references Catchment Management Authorities when relevant and permits the Minister to request those authorities prepare plans (s 8(1), s 3 definition).

• Duties and powers. The statutory duties are framed as obligations to “take all reasonable steps” to protect significant attributes and to provide for recreation and education “in so far as it is consistent with the authority's duty to manage the area responsibly” (s 7(1)). Natural catchment areas must be “maintained in an essentially natural condition” (s 7(2)). Managing authorities are given a broad power to do “everything that is necessary or convenient” to give effect to the Act (s 7(3)).

• Management plans. The Act establishes a planning mechanism. If requested by the Minister, a managing authority or Catchment Management Authority must prepare a management plan specifying matters set by the Minister (s 8(1), s 9(1)(a)). Plans must be exhibited for public inspection for at least 60 days (s 8(3)), the managing authority must have regard to comments (s 8(4)) and plans do not take effect until the Minister approves them (s 8(5)). Management plans are subject to parliamentary disallowance (ss 8A-8C).

• Prescriptive prohibitions. The Act sets out specific prohibitions for heritage river areas (no impoundments, controlled water diversions, timber harvesting restrictions) and natural catchment areas (a long list of forbidden activities including clearing, timber harvesting, plantation establishment, mining, new water storages and diversions, grazing, road works and powered water craft) (ss 10, 12). Schedules 3, 4 and 5 map these prohibitions to named areas and record Land Conservation Council recommendations that must be observed when preparing plans (s 9(1)(b), Schedules 4 and 5).

• Parliamentary and executive checks. Management plans, agreements and regulations are subject to parliamentary oversight and disallowance. Management plans must be laid before each House and can be disallowed within prescribed sitting day timeframes (ss 8A-8C). Agreements entered under s 17 must be tabled and may be declared of no effect by either House within 10 sitting days (s 17(2)-(4)). Regulations may be disallowed under the Subordinate Legislation Act process (s 18(3)-(4)).

• Priority and emergency exceptions. The Act states its prohibitions prevail over other Acts and instruments to the extent of inconsistency (s 15). It creates a narrow emergency power allowing a managing authority to act contrary to the Act, an approved management plan or relevant Land Conservation Council recommendations where there is an immediate risk of personal injury or damage to property (s 16).

• Cross‑statutory references. Doctrinally the Act is heavily cross‑referenced: definitions and processes depend on the Land Act 1958 (bed and bank definitions), the Water Act 1989 (water diversion, licences, bulk entitlements), the Catchment and Land Protection Act 1994, the Land Conservation Act 1970, the Yarra River Protection (Wilip‑gin Birrarung murron) Act 2017 and the Great Ocean Road and Environs Protection Act 2020 for specified plan relationships and consistency obligations (s 3, s 9(2)-(2B)).

These concepts show the Act functions as a land and water use regulation regime focused on mapped areas of public land, deploying management plans, ministerial approvals, parliamentary oversight and specific use prohibitions to protect nature conservation, recreation, scenic and cultural heritage attributes.

The Act affects a set of specific actors in materially different ways.

• Managing authorities. The primary operational duty falls on “managing authorities” of public land in heritage river areas and natural catchment areas. Managing authorities must “take all reasonable steps” to protect significant attributes and to provide for recreation, education and landscape appreciation consistent with responsible management duties (s 7(1)-(2)). They must prepare management plans when requested by the Minister, publish draft plans for at least 60 days, have regard to submissions, and obtain Ministerial approval before a plan takes effect (ss 8(1), 8(3)-(5), 9). The Act grants managing authorities the power to do “everything necessary or convenient” to give effect to the Act (s 7(3)). Managing authorities also have statutory authority to enter agreements under s 17 and to take emergency action under s 16.

• Ministers and Governor in Council. The Minister has control over whether a management plan is requested, the content matters required of plans and approval of plans (ss 8(1), 8(1A), 8(5), 9(1)(a)). The Governor in Council can approve certain water diversions in areas otherwise restricted (s 10(2)-(4)). The Minister must also cause tabling of agreements and certain notices to Parliament (s 17(2); s 8A(2)). Parliament’s role in disallowance matters affects the Minister’s decisions and the executive’s regulatory bandwidth (ss 8A-8C, 18(3)).

• Land and water users. Private sector parties and other public bodies that seek to conduct activities within heritage river areas and natural catchment areas face direct constraints. For example, new impoundments cannot be constructed in heritage river areas (s 10(1)); in areas listed in Schedule 3 Column 2 “no new water diversions” are permitted without Governor in Council approval (s 10(2)); in areas listed in Schedule 3 Column 3 a new water diversion upstream must not “significantly impair the nature conservation, recreation, scenic or cultural heritage attributes” (s 10(3)); and timber harvesting is prohibited in Schedule 3 Column 4 areas (s 10(5)). Natural catchment areas are subject to a broad prohibition list (s 12). These provisions create legal constraints for irrigators, forestry operators, mining and extractive industry proponents, road builders, graziers and recreational powered water craft users.

• Owners and administrators of public land. Disposal of public land in these areas is constrained: unalienated Crown land may not be disposed of by grant or conveyance and land vested in public authorities may not be transferred without Ministerial approval (s 14). That restricts the capacity of public authorities to divest land in order to raise funds or reallocate use.

• Catchment Management Authorities and other statutory bodies. The Act explicitly contemplates Catchment Management Authorities preparing plans when asked by the Minister (s 8(1)). The duty of managing authorities must be exercised “in so far as it is consistent with the authority's duty to manage the area responsibly” (s 7(1)), which will require interplay with statutory duties under other Acts that govern those bodies.

• Parliament. The Act gives Parliament an active supervisory role. Management plans, certain agreements and regulations are subject to parliamentary tabling and disallowance processes (ss 8A-8C, 17(2)-(4), 18(3)-(4)). Clerks are required to publish notices of disallowance in the Government Gazette when a plan or part of a plan is disallowed (s 8C).

• The Crown. The Act binds the Crown (s 4), limiting public sector land management choices, subject to the usual constitutional limits upon how far legislation can bind Crown capacities.

Who pays. The Act places duties on managing authorities to take “all reasonable steps” to protect attributes and maintain natural conditions (s 7). The costs of implementing management plans, conducting public exhibitions, enforcing restrictions, maintenance and emergency works fall on the managing authority and, by extension, the relevant public budget. For private parties, compliance costs include additional approvals, design constraints to avoid “significant impairment” of attributes, potential prohibition of profitable activities (e.g., timber harvesting or new water diversions in certain areas), and transaction costs for obtaining Governor in Council approvals where available (s 10(2)).

Who decides. The Minister drives plan initiation and approval (ss 8(1), 8(5)), the Governor in Council approves exceptions for water diversions (s 10(2)), managing authorities implement plans and manage day‑to‑day operations (s 7), and Parliament may disallow plans, agreements and regulations (ss 8A-8C, 17(3), 18(3)). Practical activity permissions will often require consultation or approvals from multiple bodies because the Act cross‑references other statutory regimes (s 3 definitions; s 9(2)-(2B)).

The Act sets out the central statutory duties, confers specific powers and also records particular rights for the executive and Parliament.

Duties of managing authorities

• Protection and recreation obligations. For heritage river areas a managing authority “must, in so far as it is consistent with the authority's duty to manage the area responsibly” take all reasonable steps to protect significant nature conservation, recreation, scenic or cultural heritage attributes and, subject to that protection duty, provide opportunities for recreation, landscape appreciation and education (s 7(1)(a)-(b)). The duty to maintain the river part “without further interference with its free flowing state” is also expressed (s 7(1)(c)).
• Natural catchment areas. A managing authority of a natural catchment area must take all reasonable steps to ensure the area is maintained in an “essentially natural condition” (s 7(2)).
• Broad operational power. Managing authorities “have the power to do everything that is necessary or convenient for it to do to give effect to this Act” (s 7(3)). That is a wide enabling power for operational actions consistent with statutory duties.

Management plan duties and rights

• Preparation on ministerial request. If the Minister requests, the managing authority or Catchment Management Authority “must” prepare a management plan for an area within the time and inclusive of matters specified by the Minister (s 8(1)). The Minister may request a plan only after consulting the Minister responsible for the controlling Act or Catchment Management Authority and if the Minister considers there is no adequate existing plan or strategy (s 8(1A)).
• Public exhibition and consideration. Draft management plans must be exhibited for at least 60 days, and the managing authority must have regard to any comments made during that exhibition period (ss 8(3)-(4)).
• Ministerial approval before effect. No management plan takes effect until approved by the Minister, after consultation with the Minister responsible for the Act under which the land is controlled or managed or the Catchment Management Authority (s 8(5)).
• Amendment and revocation. A management plan may be amended or revoked by a managing authority or Catchment Management Authority with the Minister’s approval and after required consultation (s 8(6)). The making, amendment or revocation is subject to parliamentary disallowance (ss 8A-8C).

Prohibitions and conditional permissions

• Heritage river areas. No impoundment may be constructed or extended in a heritage river area (s 10(1)). Schedule 3 identifies heritage areas where no new water diversions are permitted unless approved by the Governor in Council (s 10(2)), and other areas where new water diversions upstream of the lowest point of the heritage area must not “significantly impair” the attributes of the area (s 10(3)). Timber harvesting is expressly prohibited in specified heritage river areas (s 10(5); Schedule 3 Column 4). The schedule and Schedule 4 also carry Land Conservation Council recommendations that a management plan must be consistent with (s 9(1)(b); Schedule 4 entries).
• Natural catchment areas. A wide range of activities “must not be permitted or take place” in natural catchment areas including clearing indigenous flora, timber harvesting, plantation establishment, mining and exploration (subject to some LCC recommendations), extractive industries, new water storages or diversions, waterway management, grazing of domestic animals, making or upgrading roads, discharging effluent, introducing non‑indigenous fauna, stocking with indigenous fauna except for conservation purposes, and use of powered water craft (s 12). Schedule 5 contains LCC recommendations tied to specific catchments that a plan must observe (s 13).

Restrictions on disposal

• Disposal of public land is limited. Public land in a heritage river area or natural catchment area must not be disposed of: unalienated Crown land cannot be granted or conveyed; land vested in a public authority cannot be transferred without Ministerial approval (s 14). This is a substantive constraint on divestment decisions by public bodies.

Priority and invalidation

• Prevails over inconsistency. The Act provides that nothing in section 7 or any other Act or instrument is to be taken as authorising activities to the extent they are prohibited or regulated by this Act, an approved management plan or certain LCC recommendations (s 15(1)). An instrument made under any Act is of no effect to the extent it purports to authorise contravening activities (s 15(2)). That gives the Act direct primacy within its subject matter.

Emergency power

• Exception for immediate risk. A managing authority may carry out an activity otherwise prohibited by the Act, an approved management plan or an LCC recommendation in an emergency where there is immediate risk of personal injury or damage to property (s 16). The exception is narrowly expressed and fact based.

Regulatory and parliamentary rights

• Regulations may impose penalties. The Governor in Council may make regulations concerning control, management, use of areas and management plans and may impose penalties not exceeding five penalty units for contravention of regulations (s 18(1)-(2)(d)).
• Parliamentary disallowance. Management plans, parts of plans, agreements and regulations are subject to parliamentary tabling and possible disallowance under the timeframes and processes set out in ss 8A-8C, 17 and s 18(3)-(4).

Rights to enter agreements and tabling

• Managing authorities’ right to contract. Managing authorities may enter agreements with other public authorities, municipalities, departments and other bodies with respect to exercise of powers under the Act (s 17(1)). Such agreements must be tabled and may be declared of no effect by either House within 10 sitting days (s 17(2)-(4)).

The duties are expressed mostly as obligations to take “all reasonable steps” and to avoid specified activities, while several governance levers give the Minister, Governor in Council and Parliament decisive roles in approvals and oversight.

The Act itself contains limited express penal provisions but establishes mechanisms that affect enforcement through management plans, regulations and the invalidation of instruments authorised under other Acts.

Express penalties in the Act

• Regulatory penalty ceiling. The Act empowers the Governor in Council to make regulations and provides that regulations may impose penalties not exceeding five penalty units for contravention of the regulations (s 18(2)(d)). The Act does not itself specify offences for most of its substantive prohibitions in ss 10 and 12; instead enforcement is enabled through subordinate regulation or by application of other statutory regimes.

Instrument invalidation

• Instruments authorising contraventions are of no effect. Section 15(2) provides that an instrument made, granted or issued under any Act is of no effect to the extent that it authorises activities in contravention of the Act or an approved management plan or specified Land Conservation Council recommendations. This operates as a civil invalidation mechanism: an authorising licence, permit or instrument cannot be relied on to override the prohibitions in this Act.

Management plans and parliamentary disallowance

• Parliamentary oversight as corrective mechanism. Management plans, and the making, amendment or revocation of those plans, may be disallowed by either House under the timetable set out in ss 8A-8C. If disallowed, disallowance has the same effect as revocation (s 8B) and must be notified in the Government Gazette (s 8C). Similarly, regulations may be disallowed under the Subordinate Legislation Act process (s 18(3)-(4)). These parliamentary mechanisms operate as political and administrative checks rather than criminal enforcement measures.

Emergency actions

• Emergency discretion without prior sanction. In immediate risk situations, managing authorities may act contrary to the Act, an approved management plan or specified Land Conservation Council recommendations to deal with immediate risk of personal injury or damage to property (s 16). The Act does not prescribe retrospective reporting or exemption processes beyond the power itself.

Agreements and parliamentary review

• Agreements can be invalidated by Parliament. Agreements entered into under s 17 are required to be tabled and either House may declare an agreement to be of no effect within 10 sitting days after notice is tabled. The Minister must publish notice of such a resolution in the Government Gazette (s 17(2)-(4)).

Practical enforcement pathways

• Delegation to other statutory regimes. Because the Act does not create the bulk of criminal offences for each prohibited activity, enforcement in practice will depend on (a) regulations made under s 18 that create offences and specify penalties, (b) instruments and enforcement powers under other Acts that operate consistently with this Act, and (c) civil litigation, administrative invalidation and judicial review of administrative decisions that authorise activities in contravention of the Act (s 15(2)). The Act’s invalidation rule means that, where an authorising instrument is inconsistent, the authorising instrument has no effect to the extent of the inconsistency.

Limit on penalties

• Low statutory penalty cap for regulations. The maximum penalty for contravening regulations made under s 18 is capped at five penalty units. That ceiling suggests that the Act’s enforcement architecture expects either heavier sanctions to be provided elsewhere or that the Act’s primary effect is regulatory prevention through planning, prohibition and invalidation rather than by substantial criminal fines within this Act itself.

Notification obligations

• Gazettal obligations. The managing authority or Catchment Management Authority must publish notice of a management plan and any amendment or revocation in the Government Gazette (s 8(8)). The Clerk of the Parliaments must cause notice of disallowance to be published (s 8C). Agreements declared of no effect must be notified in the Government Gazette (s 17(4)). These procedural steps create public records that can facilitate enforcement and judicial scrutiny.

Limits on legal effect

• Crown binding subject to constitutional limits. The Act states it binds the Crown “so far as the legislative power of the Parliament permits” (s 4), signalling that enforcement against the Crown may encounter the usual constitutional and statutory limits.

In short, enforcement under the Act rests on a mix of: (a) specific prohibitions that invalidate inconsistent authorisations under other Acts (s 15); (b) delegated regulations which may create offences and penalties up to five penalty units (s 18); (c) the management plan approval and parliamentary disallowance architecture (ss 8-9, 8A-8C); and (d) administrative and possibly judicial processes to confront authorisations that purport to permit prohibited activities.

The Act is deliberately interconnected with multiple other Victoria Acts and instruments. It both imports definitions and constrains instruments under other statutory regimes.

Cross‑references and imported definitions

• Definitions. Several key terms reference other Acts. “Bank” and “bed” reference s 384(1) of the Land Act 1958 (s 3). “Public land” is defined by reference to the Crown Land (Reserves) Act 1978, the Forests Act 1958, the National Parks Act 1975, the Melbourne Water Corporation Act 1992 and the Land Conservation Act 1970 (s 3). “Catchment Management Authority” is defined with reference to the Catchment and Land Protection Act 1994 (s 3). “Water diversion” is explicitly defined as the taking of water under a bulk entitlement, licence to take and use water or agreement under the Water Act 1989 or any other Act and any works associated with that taking (s 3). “Waterway” is given the same meaning as in the Water Act 1989 (s 3).

Priority rule

• Prevails over inconsistent provisions. Section 15 expressly states that nothing in section 7 or any other Act or instrument is to be taken to authorise activities to the extent they are prohibited or regulated by this Act, an approved management plan or certain Land Conservation Council recommendations described in Schedules 4 and 5. Instruments under other Acts are “of no effect” to the extent they authorise activities in contravention (s 15(2)). This creates a statutory principle of priority for the Act within its subject matter, meaning other statutory authorisations are subordinated to the extent inconsistent.

Interaction with the Water Act 1989

• Water diversion controls. The Act’s regulation of “water diversions” operates by reference to the licensing and bulk entitlement regime within the Water Act 1989. A “water diversion” for the purposes of this Act includes taking under bulk entitlements and licences (s 3). The Act sets two operational constraints: in certain heritage river areas no new water diversions are permitted without Governor in Council approval (s 10(2), Schedule 3 Column 2); in other heritage river areas a new water diversion upstream must not significantly impair the area’s attributes (s 10(3), Schedule 3 Column 3). Section 10(4) allows the Governor in Council to approve diversions that would otherwise be constrained. Practically, proponents and water authorities must ensure any proposed water entitlement or licence is consistent with these statutory standards; otherwise the Crown or an instrument under the Water Act could be invalid to the extent it authorises the activity (s 15(2)).

Interaction with Land Conservation Act and Land Conservation Council recommendations

• Plan consistency requirement. Management plans must be consistent with any Land Conservation Council recommendations for which notice has been given under s 10(3) of the Land Conservation Act 1970 (s 9(1)(b)). Schedules 4 and 5 list specific LCC recommendations that must be observed in certain areas. The Act therefore formalises LCC recommendations as relevant constraints in the management plan context.

Interaction with planning and strategic instruments

• Yarra, declared areas and Great Ocean Road. For particular areas the Act requires that plan preparation must have regard to other strategic instruments: a management plan affecting the Yarra River Heritage Area must have regard to a Yarra Strategic Plan (s 9(2)); plans affecting land in a “declared area” must have regard to a Statement of Planning Policy as it applies (s 9(2A)); and plans affecting the Great Ocean Road region must have regard to an approved Great Ocean Road strategic framework plan (s 9(2B)). These clauses integrate the Act’s plan process with broader spatial planning instruments enacted under other statutes, creating layered obligations for managing authorities.

Interaction with Crown land and disposals

• Disposal restrictions. Section 14 restricts disposal of public land in heritage river and natural catchment areas and requires Ministerial approval for transfers of vested land. That interacts with processes under the Crown Land (Reserves) Act, the Melbourne Water Corporation Act and other statutes affecting tenure and land administration.

Regulations and subordinate instruments

• Delegated regulation and parliamentary oversight. Regulations under s 18 can be made for the control, management and use of heritage river areas and natural catchment areas and may leave matters to the Minister. Regulations may be disallowed by Parliament under the Subordinate Legislation Act process (s 18(3)-(4)). Thus delegated instruments are an important mechanism for fleshing out operational detail and penalties where the principal Act is silent.

Transitional and savings interactions

• Preservation of prior authorisations. Section 22(1) preserves the continuity and effect of instruments authorising grazing in natural catchment areas or heritage river areas if they predate the Act’s commencement. Section 22(2) allows replacement or maintenance of impoundments existing immediately before commencement of section 6 of the Heritage Rivers (Further Protection) Act 2006. Section 23 contains further transitional provisions about proceedings and the effect of amendments. These savings create temporal carve‑outs that interact with rights and enforcement under other Acts and pre‑existing licences.

Practical consequence

• Cross‑agency coordination required. Because the Act imports definitions and links to multiple other statutory regimes (Land Act, Water Act, Catchment and Land Protection Act, Land Conservation Act, Planning and Environment Act, Yarra and Great Ocean Road Acts), implementation requires coordination across land administration, water allocation, conservation, planning and local government agencies. The Minister’s consultation obligations and managing authorities’ obligations to have regard to other strategic plans institutionalise that coordination (s 8(1A), ss 9(2)-(2B)).

In sum, the Act sits as a place‑based regulatory overlay which curtails activities authorised under other statutes to the extent of inconsistency, integrates Land Conservation Council and place‑based strategic instruments into management planning, and requires administrators to co‑ordinate with other statutory agencies.

The version supplied incorporates amendments up to 1 December 2020. The statutory endnotes and Table of Amendments included with the text record multiple amending Acts and the parts of the Heritage Rivers Act affected. Key historical milestones and notable amendments recorded in the Act’s endnotes are as follows.

• Original enactment and commencement. The Heritage Rivers Act 1992 was assented to on 16 June 1992 and most of the Act came into operation on 10 September 1992; section 20 had earlier operation from 1 November 1990 (Endnotes, Interpretation of enactment dates).

• Heritage Rivers (Amendment) Act 1998, No. 32/1998. Assent 19 May 1998. This amending Act substituted parts of Schedule 1 (Sch. 1 Pt 1 and subsequent parts), inserted or amended several definitions in s 3 (including bank, bed, left bank, right bank) and made other textual amendments noted in the marginal notes. The 1998 amending Act also caused transitional provisions to be inserted (s 23) addressing proceedings and the continuity of acts done in relation to land affected by the amendments. Specific commencement notes indicate ss 1-4, 8, 9 and others had specified commencement dates.

• Public Sector Reform (Miscellaneous Amendments) Act 1998, No. 46/1998. Assent 26 May 1998. This Act effected style and definitional changes; the endnotes record an amendment to s 3 and the incorporation of ILA s 39B references where relevant.

• National Parks (Otways and Other Amendments) Act 2005 No. 60/2005. Assent 20 September 2005. The endnotes record amendments to Schedule 1 Part 12 (Mitchell and Wonnangatta Rivers Heritage Area) with commencement on 11 December 2005.

• National Parks and Crown Land (Reserves) Acts (Amendment) Act 2006 No. 57/2006. Assent 15 August 2006. The endnotes show this Act amended Sch. 1 Pt 16 and other cross‑references.

• Heritage Rivers (Further Protection) Act 2006 No. 68/2006. Assent 19 September 2006; commencement 20 September 2006. This is a significant amending Act for the Heritage Rivers Act. It inserted and amended a number of key provisions including:

  • Substitution and expansion of s 8(1) and insertion of s 8(1A) clarifying the Minister’s request power to require plans, and insertion of s 8(8) concerning Gazette publication (s 4(1), s 5).
  • Insertion of the disallowance regime for management plans (ss 8A, 8B, 8C) (s 5).
  • Substitution of s 9 and insertion of obligations to have regard to certain strategic plans in specified areas (ss 6 and 9).
  • Amendment of s 10 and the Schedules to add or refine restrictions on water diversions and other uses (s 7).
  • Amendments to s 15 and s 16 to align with the new provisions (s 8).
  • Amendments to the regulations power including disallowance provisions (s 9).
  • Transitional amendments to s 22 and other parts (s 10).

• Yarra River Protection (Wilip‑gin Birrarung murron) Act 2017, No. 49/2017. Assent 26 September 2017; commencement noted in endnotes for relevant sections on 1 December 2017. This Act amended s 9 by inserting s 9(2) to require regard to a Yarra Strategic Plan when the Minister requests a plan for land forming part of the Yarra River Heritage Area.

• Parks and Crown Land Legislation Amendment Act 2017, No. 53/2017. Assent 24 October 2017; relevant commencement 15 December 2017. This Act effected further amendments, including to s 3 definitions arising from broader parks and crown land legislative changes.

• Planning and Environment Amendment (Distinctive Areas and Landscapes) Act 2018, No. 17/2018. Assent 29 May 2018; commencement of s 15 on 30 May 2018. This amending Act added s 9(2A) requiring plan preparers to have regard to a Statement of Planning Policy for declared areas when the Minister requests a plan.

• Great Ocean Road and Environs Protection Act 2020, No. 19/2020. Assent 23 June 2020; commencement of s 92 on 1 December 2020. This Act added s 9(2B) requiring regard to an approved Great Ocean Road strategic framework plan where relevant, and defined “Great Ocean Road region” and the approved strategic framework plan as applicable to the Heritage Rivers Act’s plan process.

Commencement and saving details are recorded in the endnotes for each amending Act. The 2006 amendments are particularly consequential for the Act’s governance of management plans and the parliamentary disallowance process. Throughout, amendments have tended to either refine the mapping and geometry of protected areas in Schedule 1 and Schedule 2, import definitions and cross‑references, or add plan‑consistency obligations with other strategic statutory instruments.

The Act’s published endnotes make clear which amendments are in force in the version provided. Any practitioner relying on the text for operational decisions should check the latest consolidated version and Central Plan Office records for the current boundaries and any subsequently enacted amendments or instruments made under the Act.

The text of the Heritage Rivers Act 1992 and its endnotes do not record any judicial decisions or cases applying or interpreting the Act. There are no cases named or summarised in the Act text or the legislative endnotes provided. The Act itself, however, structures several administrative and parliamentary dispute resolution and review mechanisms which reduce or shift some contested questions away from ordinary prosecutorial enforcement toward administrative, parliamentary and civil law processes.

Internal statutory dispute and review mechanisms

• Parliamentary disallowance. Management plans, and particular regulatory instruments, are subject to parliamentary disallowance procedures (ss 8A-8C, 18(3)). Agreements entered under s 17 must be tabled and may be declared of no effect by either House within 10 sitting days (s 17(2)-(4)). These are non‑judicial checks that can resolve conflicts about the content or policy appropriateness of plans, regulations or agreements without litigation.

• Instrument invalidation. Section 15(2) declares that an instrument under any Act is of no effect to the extent that it purports to authorise activities contravening this Act or an approved management plan. Practically, disputes over whether a permit or licence authorises a prohibited activity could lead to declaratory relief in the courts, judicial review of administrative decisions, or litigation over the validity of the authorising instrument.

Potential judicial issues implicit in the Act

• Interpretation of qualified duties. Managing authorities’ obligations are framed as “take all reasonable steps” and “in so far as it is consistent with the authority’s duty to manage the area responsibly” (s 7). The precise contours of what steps are “reasonable” and what is “consistent with” an authority’s other duties are fact driven and could be the subject of judicial review or litigation if a party alleges dereliction or regulatory overreach.

• Meaning of “significantly impair”. Section 10(3) prohibits new water diversions upstream that “must not significantly impair the nature conservation, recreation, scenic or cultural heritage attributes” of an area. The statutory test is qualitative and fact specific; disputes about what constitutes “significant impairment” may invite judicial interpretation or expert evidence in any legal challenge to a decision to grant or refuse approval, or to the validity of an authorising instrument under the Water Act where claimed to be inconsistent.

• Scope of “public land” and mapping disputes. The Act’s effect depends on accurate identification of land as “public land” in the sense defined in s 3 and the spatial boundaries in Schedules 1 and 2 which refer to plans lodged in the Central Plan Office. Litigation could arise over whether a parcel lies within a mapped area, whether a particular piece of land counts as “public land” under the Act’s definition, or whether an activity occurs on land within the statutory buffers described in Schedule 1.

• Interplay with other statutes. The Act’s priority rule (s 15) could generate litigation over whether a particular authorising instrument under another statute is inconsistent with this Act. Courts may be asked to resolve whether an instrument is valid and, if not, whether the invalidity affects third parties or administrative arrangements.

Absence of cases in the text

• No cases named in the supplied material. Because the supplied Act text and endnotes do not list litigation, practitioners must consult external legal databases and court records for reported decisions, if any, that interpret or apply the Heritage Rivers Act. The Act’s administrative features mean many disputes about plans or agreements may be resolved through parliamentary disallowance or internal review rather than litigation, but the potential for judicial review remains where parties seek declaratory relief, injunctions or orders challenging administrative acts or instruments.

Practical implication

• Expect administrative and statutory review channels to be salient. Given the Act’s construction, initial challenges will commonly engage administrative remedies, parliamentary disallowance and instrument invalidation before reaching litigation. Where litigation does occur it will likely focus on statutory interpretation of key terms such as “significantly impair”, “reasonable steps” and on the correct application of the Act’s priority rule vis‑à‑vis other statutory instruments.

In summary, the Act contains multiple administrative pathways for contestation but the statutory text as supplied does not record any court decisions. Practitioners should search external litigation databases to identify any authority interpreting the Act and, where no authority exists, prepare for mixed administrative and judicial dispute processes centred on the interpretive issues noted above.

The Act contains a number of technical features, definitional traps and procedural timeframes that can produce unexpected outcomes if not carefully attended to.

1. Dependency on external definitions and plans

• Spatial boundaries are not self‑contained. Schedules 1 and 2 identify areas by reference to plans lodged in the Central Plan Office with specific LEGL plan numbers. Practitioners must consult those plans to determine exact boundaries; reliance on the textual schedule descriptions alone can be misleading (Schedules 1 and 2).
• Definitions are cross‑referenced. Key terms such as “bed”, “bank”, “water diversion”, “public land”, “waterway” and “Catchment Management Authority” are defined by reference to other Acts (s 3). Interpretation therefore requires checking the cited provisions in the Land Act 1958, Water Act 1989, Catchment and Land Protection Act 1994 and others.

2. Qualified duties and enforcement ambiguity

• Duties are phrased “in so far as it is consistent with the authority's duty to manage the area responsibly” and “take all reasonable steps” (s 7). These qualifications reduce the clarity of mandatory actions and can be mobilised by managing authorities to justify inaction or limited measures. The phrase “take all reasonable steps” is fact specific and potentially litigable.
• The Act’s substantive prohibitions are not uniformly criminalised in the principal Act. Instead, enforcement depends on regulations (s 18) or other Acts and the Act’s invalidation mechanism (s 15). Practitioners should not assume a contravention of ss 10 or 12 will automatically attract a criminal sanction under this Act.

3. Governor in Council exception for water diversions

• “No new water diversions” in Schedule 3 Column 2 areas is qualified by s 10(2) which allows a Governor in Council approval by notice in the Government Gazette. This creates a political executive exception point that can be exploited in some circumstances. Proponents should be aware that an apparently absolute ban may be overridden administratively.

4. Tight tabling and disallowance timeframes

• Management plans must be laid before each House within seven sitting days of Gazette notice and may be disallowed by a House if a notice of resolution is given and passed within statutory sitting day limits (s 8A). The sitting day counting rules (including treatment of prorogation or dissolution) in s 8A(4) may catch practitioners unaware. Failure to table or to observe timeframes could lead to retrospective invalidation (s 8B). The procedural complexity is a practical risk for managing authorities and the Minister.

5. Low regulatory penalty ceiling

• Regulations under s 18 may only impose penalties not exceeding five penalty units. If the default enforcement mechanism for contraventions is a regulation under this Act, the financial sanction could be nominal. Enforcement may therefore rely on other Acts or alternative compliance mechanisms, which may not be obvious to stakeholders.

6. Transitional savings

• Pre‑existing authorisations retained. Section 22(1) preserves the effect of previous instruments authorising grazing that predate the Act. Section 22(2) allows replacement or maintenance of impoundments that existed immediately before commencement of section 6 of the Heritage Rivers (Further Protection) Act 2006. Practitioners should not assume absolute prohibitions; vintage licences and authorisations may survive.

7. Emergency power is narrow

• Section 16 allows prohibited actions in an emergency “in which there is an immediate risk of personal injury or damage to property”. The Act does not spell out reporting obligations after such emergency actions or how subsequent approvals are to be obtained. Managing authorities should document facts and consider seeking retrospective approval or parliamentary notification where appropriate.

8. Interaction with strategic plans may widen obligations

• Sections 9(2)-(2B) require having regard to the Yarra Strategic Plan, a Statement of Planning Policy in declared areas, and the Great Ocean Road strategic framework plan as applicable. These obligations can expand the substantive criteria that a management plan must meet and can import additional policy constraints or objectives from other Acts and instruments.

9. Disposal restrictions restrict public land transactions

• Section 14 prevents disposal of public land within designated areas without Ministerial approval. Public authorities planning asset sales or transfers need to check whether their land is captured and should expect Ministerial involvement; failure to secure approval may render transfers void or otherwise contestable.

10. Multiple overlapping agencies and duties

• The Act contemplates managing authorities, Catchment Management Authorities, Ministers responsible for the controlling Act, and Governor in Council approvals. The need for consultation under s 8(1A) and s 8(5) heightens coordination risk; absence of clear agency allocation in particular places can lead to delay or inconsistent management.

These are operational and legal “gotchas” that require close attention to the Act’s cross‑references, plan records, parliamentary timeframes, transitional savings and the limited direct penal architecture. Practical compliance involves mapping statutory duties to budgetary capacity, governance arrangements and cross‑agency processes.

Compliance requires active administrative processes, statutory cross‑checks and procedural discipline. The following is a practical compliance checklist for managing authorities, proponents and public authorities that interact with heritage river areas or natural catchment areas.

1. Confirm area and tenure

• Consult Schedules 1 and 2 and the Central Plan Office plans referenced in them (LEGL plan numbers) to establish whether the land or watercourse in question lies within a heritage river area or natural catchment area (ss 5-6, Schedules 1-2).
• Determine whether the land is “public land” as defined in s 3(1) since the Act operates primarily over public land.

2. Identify applicable prohibitions and LCC recommendations

• Check Schedule 3 to see whether the area is listed under Column 2 (no new water diversions), Column 3 (new water diversions must not significantly impair attributes) or Column 4 (no timber harvesting) and apply the relevant rules in s 10.
• For specific areas, check Schedule 4 and Schedule 5 for Land Conservation Council recommendations that management plans must be consistent with (s 9(1)(b); Schedules 4-5).

3. Engage the Minister and prepare management plans when required

• If the Minister requests a management plan, ensure the plan includes the matters specified by the Minister and is prepared within the prescribed timeframe (s 8(1)). The Minister must consult the responsible Minister or Catchment Management Authority before requesting a plan (s 8(1A)).
• Publish the proposed plan for public inspection for at least 60 days and have regard to submissions (ss 8(3)-(4)).
• Secure Ministerial approval before the plan takes effect; a plan cannot be implemented without that approval (s 8(5)). Ensure the plan is consistent with statutory requirements including LCC recommendations and applicable strategic plans such as the Yarra Strategic Plan, Statements of Planning Policy for declared areas or the Great Ocean Road strategic framework plan where relevant (s 9(1)(b), s 9(2)-(2B)).

4. Coordinate with other statutory agencies

• Engage the Minister responsible for the Act under which the land is controlled or managed, Catchment Management Authorities and water authorities early in plan development and project proposals (s 8(1A), s 8(5), s 9(2)-(2B)). For proposals involving water diversions, consult Water Act processes and ensure any proposed licence or bulk entitlement does not conflict with s 10 constraints.

5. For proponents of water diversions, timber operations, mining, grazing or road works

• Check whether the activity is expressly prohibited under s 10 (heritage river areas) or s 12 (natural catchment areas). Where a prohibition applies, cessation or redesign of proposed activity may be required.
• In Schedule 3 Column 2 areas, seek Governor in Council approval if the activity is a new water diversion and an approval pathway is possible (s 10(2)). In Schedule 3 Column 3 areas, design the diversion to avoid “significant impairment” of the protected attributes and document assessments supporting the conclusion that the activity will not significantly impair those attributes (s 10(3)). Be aware s 10(4) allows Governor in Council approvals that can override the “must not significantly impair” test in some circumstances.

6. Disposal and tenure transactions

• If proposing disposal, transfer or conveyance of public land within a heritage river area or natural catchment area, obtain Ministerial approval as required by s 14 before proceeding. Do not assume administrative autonomy to transfer vested land without the Minister’s consent.

7. Recordkeeping and reporting for emergency actions

• If emergency action under s 16 is required, ensure contemporaneous records are maintained evidencing immediate risk to life or property and the necessity of the action. Consider, where practicable, notifying the Minister and preparing a subsequent report describing the circumstances and remedial measures.

8. Agreements and tabling obligations

• Where entering formal agreements under s 17, prepare the prescribed form notice and ensure the Minister tables the notice before each House within 10 sitting days (s 17(2)). Understand that either House may declare the agreement of no effect within 10 sitting days (s 17(3)), so progress dependent on the agreement should be planned with that window in mind.

9. Regulatory compliance and offences

• Monitor regulations made under s 18 for any specified offences and penalties relevant to particular activities. The Act authorises penalties not exceeding five penalty units for contraventions of regulations (s 18(2)(d)). If no adequate regulatory enforcement exists under this Act for a given activity, identify other statutory regimes (e.g., Water Act, Forests Act, Environment Protection Act) that may impose regulatory requirements and penalties.

10. Internal governance and budgeting

• Budget for management plan preparation, public exhibition, monitoring and enforcement activities; these are statutory expectations on managing authorities (s 7, s 8). Ensure staffing and expertise for ecological assessments where “significant impairment” or “essentially natural condition” determinations are required.

11. Legal and risk advice

• Obtain legal advice on interpretive issues such as the scope of “significantly impair”, the consequences of instrument invalidation under s 15(2), cross‑statutory interactions with the Water Act and the Land Conservation Act, and potential exposure to judicial review or contractual repudiation claims.

12. Public information and transparency

• Ensure management plans, notices of made or amended plans, and any revocation are published in the Government Gazette as required (s 8(8)). Publication obligations aid transparency and reduce challenge risk.

13. Transitional entitlements

• If relying on pre‑existing authorisations (e.g., grazing authorisations preserved by s 22(1) or impoundment maintenance preserved by s 22(2)), secure documentary evidence of pre‑existing instruments and dates to support the continued lawful status.

14. Parliamentary timetable awareness

• Be mindful of the sitting day timeframes for disallowance of plans, regulations and agreements (ss 8A-8C, 17, 18(3)). Engage parliamentary liaison officers to manage the timing of tabling and to anticipate potential disallowance risks.

Following these steps will align operational practice with the Act’s statutory architecture. Where the statutory provisions are silent or unclear, conservative design that avoids “significant impairment” of protected attributes and early ministerial and agency consultation will reduce the risk of later administrative invalidation or parliamentary disallowance.
