48 Sale of place, object or land the subject of recommendation S. 48(1) amended by No. 5/2023 s. 47(2). (1) Despite section 49, if any place, object or land that is the subject of a recommendation under section 37 has been offered for sale by auction, the Heritage Council, with the agreement of the owner of the place, object or land, may defer the consideration of the recommendation until after the auction. S. 48(2) amended by No. 5/2023 s. 47(2). (2) The owner of a place, object or land to which subsection (1) applies must inform the purchaser of the place, object or land of the deferral of consideration of the recommendation. S. 48(3) amended by No. 5/2023 s. 47(3). (3) If the owner of a place, object or land which is the subject of a recommendation under section 37 fails to comply with subsection (2), the contract of sale is not invalid, but is voidable at the option of the purchaser.
