38 Executive Director recommendations for exempted works or activities S. 38(1) amended by No. 5/2023 s. 38(1). (1) If the Executive Director makes a recommendation to the Heritage Council that a place, object or land should be included in the Heritage Register, the Executive Director may include in the recommendation categories of works or activities which may be carried out in relation to the place, object or land without the need for a permit under Part 5. S. 38(2) amended by No. 5/2023 s. 38(2). (2) The Executive Director must not make a recommendation referred to in subsection (1) in relation to any categories of works or activities if the Executive Director considers that the works or activities may harm the cultural heritage significance of the place, object or land. S. 38(3) amended by No. 5/2023 s. 38(3). (3) The Executive Director may consult with the owner of the place, object or land before making the recommendation.
