37 Executive Director recommendations in respect of nominations (1) After considering a nomination under Division 2 and any further information provided under section 33, the Executive Director must recommend to the Heritage Council— (a) that the place or object should be included in the Heritage Register, and the category or categories in which it should be included; or (b) that the land should be included in the Heritage Register as part of a place; or (c) that part of the place or object should be included in the Heritage Register, and the category or categories in which it should be included; or (d) that part of the land should be included in the Heritage Register as part of a place; or (e) that the place or object should not be included in the Heritage Register; or (f) that the land should not be included in the Heritage Register as part of a place. (2) If the Executive Director makes a recommendation that a place, or part of a place, should not be included in the Heritage Register, the Executive Director may refer the nomination to the relevant planning authority or the Minister administering the **Planning and Environment Act 1987** to consider the inclusion of the place or part of the place in a planning scheme in accordance with the objectives set out in section 4(1)(d) of that Act.
