141 Effect of recording of notice of covenant or agreement If a notice of a covenant has been recorded under section 140— (a) any burden of the covenant runs with the land affected; and (b) the Heritage Council or the National Trust, as the case requires, may enforce the covenant against persons deriving title from the person who entered into the covenant as if it were a restrictive covenant, despite the fact that the covenant— (i) may be positive in nature; or (ii) is not for the benefit of any land of the Heritage Council or the National Trust. Part 8—Orders Division 1—Interim protection orders 142 Scope of Division (1) Subject to subsection (2), this Division applies despite anything in or authorised by the **Building Act 1993** or any other Act. (2) This Act is subject to any regulation or emergency order under the **Building Act 1993** relating to the securing, pulling down or removal of dangerous buildings.
