78 Regulation may exempt work
(1) A regulation may declare work to be exempt from the requirement
for a work approval (exempt work).
(2) However, the declaration may be made only for work that will not
detrimentally affect the heritage significance of a heritage place or

(3) Without limiting subsection (1), the declaration may be made for
repair or maintenance work.
Examples of repair or maintenance work
1 Painting a place in a colour that conforms to the existing colour scheme.
2 Repairs to a place using the same types of materials and construction
methods as originally used.
79 Application of Part
This Part applies if a heritage officer is satisfied:
(a) a person is carrying out, or is about to carry out, work; and
(b) the work constitutes a serious and imminent threat to the
heritage significance of a heritage place or object; and
(c) an order under this Part is necessary for the conservation of
the place or object.
