35 Minister's decision not to declare heritage place or object
(1) This section applies if, on the Council's recommendation for the
place or object, the Minister decides not to declare the place or
object to be a heritage place or object.
(2) The Minister must give written notice to the Council of the Minister's
decision and the reasons for it.
(3) In addition, the Minister must give an information notice for the
or object in the public consultation period; and
(c) if the assessment of the place or object was made on a
heritage nomination made by another person – the person.
(4) If the Minister has, under Division 6, made a provisional declaration
for the place or object to be a heritage place or object, the Minister
must:
(a) by Gazette notice, revoke the declaration; and
(b) publish notice of the revocation on the Agency's website.
