HEMP INDUSTRY REGULATIONS 2020

The instrument is organised around a small number of controlling concepts that determine how licence-based hemp activity is governed. Key concepts, with the controlling regulation references, are:

• Licence classes and fees. The Regulations differentiate three licence types referenced to the Act: commercial, class A research and class B research (regulation 3 definitions; regulation 4 prescribes application fees in revenue units; regulation 6 prescribes renewal fees equal to the application fee). Amendment fees are separately prescribed (regulation 5). The CEO may waive fees in whole or part for Agency applications for research licences (regulation 7).
• Fit and proper standard. The suitability threshold requires applicants to be fit and proper people; the instrument specifies that certain convictions within the prior 10 years disqualify a person (regulation 9). The disqualifying offences are listed and reference indictable offences involving dishonesty or specified drug offences as set out in the regulation.
• Prescribed licence conditions. A set of general conditions is declared mandatory for all licences (regulation 10). These include consignment notices for supply of live plants, tissue culture or viable seed, a prohibition on importing outside Australia unless permitted under Commonwealth Customs rules, a prohibition on suggesting low THC hemp is psychoactive, notification of planting location with GPS within seven days, and limits on cultivation material supply sources (regulations 11 and 12).
• Commercial licence-specific constraints. Minimum commercial cultivation size is 2 hectares (regulation 16). Seed for human or animal consumption must be denatured unless the recipient will denature it (regulation 17(1)). Viable seed may be supplied for propagation only to specified recipients and only where the parent crop has a THC concentration in leaves and flowering heads of not more than 0.5 per cent (regulation 17(2)). Leaf material cannot be supplied or used as stock feed, and crop stubble cannot be used for landscaping outside a cultivation area (regulation 17(3)-(4)). Commercial licence holders are prohibited from producing cannabis resin, extracting or isolating substances (for example cannabinoids and terpenes) and from processing hemp leaf or unfertilised flower heads, subject to specified Commonwealth-authorised exceptions (regulation 18).
• Research purpose limitation. Class B research licences are conditional on activities being conducted only for the purpose of producing low THC hemp (regulation 21).
• Sampling, testing and THC threshold. Sampling must be representative and aimed at producing results that reflect the average THC concentration of the crop (regulations 26(1) and 27(2)). Sampling and testing is to be carried out by an inspector rather than a police officer (regulation 26(2)). Laboratories that analyse THC must be accredited by the National Association of Testing Authorities (regulation 27(3)). THC concentration is measured as a percentage of dry weight (regulation 27(1)).
• Surrender, seizure and destruction protocols. Surrendered or seized hemp must be catalogued, stored securely and destroyed if THC concentration exceeds 1 per cent, with destruction supervised by an inspector and return permitted where THC is 1 per cent or less (regulation 22). Licensees must destroy plants above 1 per cent THC and plants cultivated or possessed contrary to licence conditions, with inspector supervision; inspectors step in to seize and destroy where licensee fails to act (regulation 23).
• Cost recovery and infringement. The Territory may recover reasonable costs as a debt for sampling, testing and dealing with seized or surrendered material including destruction (regulation 8). The instrument establishes when an inspector may serve infringement notices, the required contents, expiation by payment, payment mechanics and the power of the CEO to withdraw notices within a 28-day window (Part 5, regulations 28 to 33 and the Schedule).

These concepts frame enforcement (inspectors and CEO authority), technical compliance (sampling, NATA laboratories, dry weight measurement), financial requirements (fees, cost recovery, infringement prescribed amounts) and activity limits for commercial and research licences (supply and production prohibitions, minimum area, purpose limits).

The Regulations affect a defined network of actors involved in the hemp industry in the Northern Territory. The primary groups are:

• Applicants and licensees under the Hemp Industry Act. The Regulations make specific provisions for commercial licence holders and class A and class B research licence holders (regulation 3 definitions; regulations 4 to 6; regulations 15 to 18; regulation 21). Licensees must meet suitability requirements, pay prescribed fees, comply with general and class-specific conditions, and deliver annual reporting (regulations 9, 4-6, 10-14, 14).
• Licensed persons who carry out activities authorised by a licence under section 8(4) of the Act. They are subject to obligations such as providing consignment notices for live plants, tissue culture or viable seed (regulation 11), notifying the CEO of planting locations (regulation 12(1)), and not cultivating from unauthorized genetic material (regulation 12(2)).
• Inspectors and the CEO. Inspectors are assigned operational roles: they may sample, catalogue, store and supervise destruction of hemp, and may serve infringement notices if they believe on reasonable grounds that an offence has occurred (regulations 22(2)-(5), 26(2), 28). The CEO has administrative discretion including fee waivers for Agency research licence applications (regulation 7), directing reporting content (regulation 14(3)), returning surrendered/seized hemp where THC is 1 per cent or less (regulation 22(6)), and withdrawing infringement notices within 28 days and prior to payment (regulation 32).
• Laboratories accredited by the National Association of Testing Authorities. Any analysis to determine THC concentration under the Act must be conducted by a NATA-accredited laboratory (regulation 27(3)). These laboratories therefore participate in the compliance chain by delivering authoritative test results that trigger destruction or return decisions.
• Persons authorised under corresponding laws. The Regulations reference corresponding laws in regulation 3 and allow supply of viable seed to persons authorised by a licence under a corresponding law, and import constraints linked to Commonwealth Customs rules (regulation 17(2)(b); regulation 11(3)). This affects interstate and cross-jurisdiction trade and movements of propagation material.
• Persons receiving or handling hemp for food, animal feed or landscaping. Commercial licensees are restricted from supplying hemp seed for human or animal consumption unless seed is denatured (regulation 17(1)). They must not supply hemp leaf as stock feed or raw/processed crop stubble for landscaping outside cultivation areas (regulation 17(3)-(4)). These rules affect buyers, processors and downstream users.
• The Commissioner of Police. While police are excluded from conducting sampling under regulation 26(2), the Commissioner of Police has a role in the return of seized/surrendered hemp where THC is 1 per cent or less, together with the CEO (regulation 22(6)).
• The Territory as a claimant of debts. The Territory may recover reasonable costs incurred in sampling, testing and dealing with seized or surrendered material as a debt owed by licensees (regulation 8). That positions the Territory as a creditor when it undertakes compliance activity that imposes direct costs.

Less directly affected actors include suppliers of propagation material, seed denaturation and processing service providers, and insurers and financiers who underwrite cultivation operations, because the Regulations set minimum plot sizes, destroy thresholds, and obligations that have cost and operational impacts. The infringement notice mechanism affects any person inspected and alleged to have committed an offence specified in the Schedule, giving inspectors a civilised but enforceable administrative alternative to court prosecution (Part 5 and Schedule).

The Regulations allocate discrete duties to licensees, inspectors and the CEO, and create specific rights for licensees and the Territory. Key duties and rights, organised by actor, follow.

Duties of licensees and applicants:

• Pay prescribed application, amendment and renewal fees for licences, measured in revenue units, unless a waiver applies (regulations 4 to 6; regulation 7). The CEO may waive fees for Agency class A or B research licence applications (regulation 7).
• Meet the fit and proper person requirement; persons found guilty of listed offences within 10 years are disqualified (regulation 9).
• Comply with general operational conditions: provide an approved-form consignment notice when supplying live hemp plants, tissue culture or viable seed (regulation 11(1)-(2)); do not import hemp unless licensed or permitted under Commonwealth Customs rules (regulation 11(3)); avoid stating or implying low THC hemp is psychoactive (regulation 11(4)).
• Notify the CEO of planting location including GPS coordinates within seven days of planting a cultivation area (regulation 12(1)).
• Only cultivate from propagation material supplied by an authorised person under the Act or a corresponding law (regulation 12(2)).
• Notify the CEO within seven business days of any changes to register information required under section 39(2) of the Act (regulation 13).
• Provide annual reports to the CEO describing activities under the licence, in the time and manner the CEO specifies, and include information specified by the CEO on direction (regulation 14).
• For commercial licence holders, meet additional conditions: ensure cultivation area is at least 2 hectares (regulation 16); denature seed supplied for human or animal consumption or ensure recipient will denature it (regulation 17(1)); supply viable seed for propagation only to another licensee or to a person authorised under a corresponding law and only where parent crop leaves and flowering heads have THC concentration not more than 0.5 per cent (regulation 17(2)); do not supply hemp leaf as stock feed or raw/processed crop stubble for landscaping outside a cultivation area (regulation 17(3)-(4)); and do not produce cannabis resin, extract or isolate substances, or process hemp leaf or unfertilised flower heads, except to the extent authorised as a permitted medicinal cannabis activity under a Commonwealth licence and permits (regulation 18).
• Class B research licensees must confine activity to producing low THC hemp (regulation 21).
• Destroy hemp plants with THC concentration of more than 1 per cent (regulation 23(1)) and destroy hemp plants cultivated or possessed contrary to the licence (regulation 23(2)), as soon as practicable and under inspector supervision (regulation 23(3)-(4)).

Duties and powers of inspectors:

• Catalogue and provide receipts for surrendered or seized hemp and store it securely to minimise degradation (regulation 22(2)-(3)).
• Conduct sampling and testing in a manner that provides a representative sample and in a timeframe producing results reflecting average crop THC concentration, subject to the requirement that sampling must be done by an inspector rather than a police officer (regulation 26(1)-(2); regulation 27(2)).
• Supervise and, if necessary, undertake the destruction of hemp that has THC above the specified threshold, and seize and destroy plants if a licensee fails to do so (regulations 22(4)-(5); 23(4)-(5)).
• Serve infringement notices where they believe on reasonable grounds an infringement notice offence has occurred (regulation 28).

Rights and duties of the CEO:

• Waive fees in whole or part for Agency applications in relation to research licences (regulation 7).
• Specify timing and manner for annual reports and direct inclusion of specified information (regulation 14).
• Return surrendered or seized hemp with THC concentration of 1 per cent or less (regulation 22(6)).
• Withdraw an infringement notice within 28 days after it is served and provided payment has not been made (regulation 32).

Rights of persons receiving infringement notices:

• The person may expiate the offence by paying the prescribed amount within 28 days after service to avoid further action (regulation 29(2)(a); regulation 30).
• The person may elect to have the offence dealt with by a court instead of paying, by completing and returning a statement of election contained in the notice (regulation 29(2)(b)-(c)).
• If a person does nothing, a summons may be issued requiring attendance before the Local Court (regulation 29(2)(d)).
• Payment mechanics are specified; electronic payment is not effective until the payee’s account is credited and cheque payment is not effective unless the cheque clears on first presentation (regulation 31).

Financial enforcement right:

• The Territory has the right to recover reasonable costs incurred in sampling, testing and dealing with seized or surrendered hemp, including destruction, as a debt owed by the licensee (regulation 8).

Technical standards and evidentiary duties:

• THC concentration must be measured as a percentage of dry weight (regulation 27(1)); sampling and timing must be representative (regulation 26(1) and regulation 27(2)); and testing must be done by a NATA-accredited laboratory (regulation 27(3)), which embeds evidentiary quality requirements into enforcement actions that trigger destruction or return.

These duties and rights create a compliance architecture balancing administrative oversight, testing standards, information flows and financial liabilities tied to both normal regulated operations and enforcement incidents.

The Regulations create a two-tiered enforcement framework: (1) an infringement notice regime for specified offences that permits expiation by payment, and (2) retained prosecutorial and seizure powers exercised by inspectors and the CEO, including destruction of hemp exceeding specified THC thresholds.

Infringement notice regime:

• Inspectors may serve an infringement notice where they believe on reasonable grounds that a person has committed an infringement notice offence (regulation 28). The notice must include prescribed particulars: name and address if known, date of service, date/time and place of the offence, a description of the offence, the prescribed amount payable, and the agency to which payment is due, plus a statement explaining expiation, election to go to court, and consequence of inaction (regulation 29(1)-(2)).
• Payment of the prescribed amount as set out in the infringement notice expiates the offence and prevents further proceedings unless the notice is withdrawn by the CEO (regulation 30; regulation 32). The person may instead elect court action by completing the provided statement of election (regulation 29(2)(b)-(c)).
• The Schedule specifies three infringement notice offences by reference to provisions of the Act and sets the prescribed amount as a number of penalty units: section 26(2) of the Act attracts 1 penalty unit, section 27(2) attracts 2 penalty units, and section 29(2) attracts 5 penalty units (Schedule). The Regulations define prescribed amount as the monetary value of the number of penalty units specified in the Schedule (regulation 3 definition).
• Payment mechanics are specified: electronic payments are not effective until the payee’s bank account is credited, and cheque payments are not effective unless the cheque clears on first presentation (regulation 31). The CEO may withdraw an infringement notice within 28 days after service and before payment (regulation 32(1)-(2)).

Administrative enforcement, seizure and destruction:

• Inspectors catalogue, receipt and securely store surrendered or seized hemp (regulation 22(2)-(3)). If the hemp has a THC concentration of more than 1 per cent (measured as percentage of dry weight), the hemp must be destroyed under inspector supervision as soon as possible after the inspector becomes aware of the concentration (regulation 22(4)-(5); regulation 27(1)-(3)).
• The CEO or Commissioner of Police may return hemp to the licensee if THC concentration is 1 per cent or less (regulation 22(6)).
• Licensees with a commercial licence must destroy any hemp plant cultivated under the licence with THC concentration of more than 1 per cent, and must destroy any hemp cultivated or possessed contrary to the licence, promptly and under inspector supervision; where the licensee fails to act, an inspector must seize and destroy the plant or arrange destruction under inspector supervision (regulation 23(1)-(5)).
• The Territory may recover reasonable costs incurred in sampling, removing, analysing or destroying hemp as a debt from the licensee (regulation 8). This creates a direct financial enforcement lever in addition to administrative action and criminal or regulatory prosecutions.

Interaction with criminal prosecutions:

• Part 5 does not prejudice or affect the start or continuation of proceedings for an infringement notice offence for which an infringement notice was served unless the offence is expiated (regulation 33(1)). The Part does not require an infringement notice to be served nor prevent prosecution for offences for which an infringement notice was not served, and it allows multiple infringement notices for the same offence to be served; payment in accordance with any served notice may expiate the offence where multiple notices exist (regulation 33(2)-(3)). These clauses preserve prosecutorial discretion and do not convert all breaches into civil expiable matters.

Operational implications for enforcement:

• Inspectors, not police officers, are tasked with sampling and testing responsibilities (regulation 26(2)), which directs investigatory weight to the Agency’s inspectors. Laboratories must be NATA-accredited for testing to be accepted under the Act and Regulations (regulation 27(3)). The measurement technology and sampling representativeness requirements place evidentiary standards around THC determinations that trigger destruction obligations (regulation 26 and regulation 27).

Taken together, the enforcement architecture combines administrative expiation mechanics, statutory destruction thresholds tied to measured THC concentration, cost recovery for compliance activity, and preserved criminal prosecutorial pathways. The Schedule links specific Act provisions to penalty units, but the monetary value depends on the value of a penalty unit at the relevant time.

The Regulations explicitly connect the Territory’s hemp regime to Commonwealth and other jurisdictions' legal instruments and to national technical accreditation standards. The main interaction points in the instrument are:

Corresponding laws and cross-jurisdictional licences:

• The definition of corresponding law in regulation 3 lists several interstate and Commonwealth instruments, including the Customs (Prohibited Imports) Regulations 1956 (Cth), the Narcotic Drugs Act 1967 (Cth), and industrial hemp Acts of Australian states and territories. That definition is used in several provisions to permit supply or import activities only when consistent with those laws (regulation 3; regulation 11(3); regulation 17(2)(b)). This creates an interlocking framework: persons authorised under corresponding laws may be valid recipients of viable seed or are otherwise recognised as legitimate participants for cross-jurisdiction trade.

Customs and import control:

• The Regulations require that a licensed person must not import hemp from outside Australia unless licensed or permitted under the Customs (Prohibited Imports) Regulations 1956 (Cth) (regulation 11(3)). This defers to federal import control and aligns Territory prohibitions with Commonwealth customs restrictions.

Commonwealth narcotics and medicinal cannabis regime:

• Regulation 18(4) provides a specific carve-out for commercial licence holders who are authorised to produce resin, extract or otherwise process hemp under a medicinal cannabis licence and accompanying permits under the Narcotic Drugs Act 1967 (Cth). Thus, activity that would otherwise be prohibited under the Territory Regulations is lawful to the extent covered by Commonwealth authorisations, creating a conditional overlap where Commonwealth licensing supplies an exemption to Territory prohibitions.

Testing accreditation standards:

• The requirement that THC analysis be performed by a laboratory accredited by the National Association of Testing Authorities (NATA) (regulation 27(3)) links the Territory’s enforcement evidence chain to national laboratory accreditation standards, ensuring that measured THC concentrations used to trigger destruction or return decisions meet recognised quality assurance criteria.

Debt recovery and general civil law:

• Regulation 8 enables the Territory to recover reasonable costs as a debt owed to the Territory. That uses ordinary civil debt recovery mechanisms, and thus interacts with the Territory’s general debt recovery processes and any applicable insolvency or enforcement law.

Interaction with the Hemp Industry Act 2019:

• Many provisions are framed as prescribed conditions or fees under the referenced sections of the Act. For example, regulation 4 prescribes the fee for an application under section 9(2)(b) of the Act, regulation 5 prescribes fees under section 17(3)(b), regulation 6 prescribes renewal fees under section 18(3)(b), regulations 10 to 14 are prescribed as conditions for all licences (regulation 10). The Regulations therefore operate within the powers granted by the Act, specifying details that the Act delegated to subsidiary legislation.

Evidence and procedural consistency:

• Part 5’s infringement notice process interacts with the Territory’s general enforcement and court system. Regulation 33 preserves the possibility of court prosecution where an infringement notice was not served or where the person chooses court rather than expiation. The Schedule links offences to penalty units under the Act, thereby tying administrative sanction levels under the Regulations to the Act’s substantive offence provisions.

Sampling and police powers:

• Regulation 26(2) requires sampling and testing to be done by an inspector other than a police officer, which limits police involvement in sampling. At the same time, regulation 22(6) allows the CEO or Commissioner of Police to return surrendered or seized hemp if THC is 1 per cent or less. These provisions coordinate roles between the Agency’s inspectors and police functions while keeping sampling within inspector competency.

Inter-jurisdictional seed movement:

• Regulation 17(2)(b) permits supply of viable seed to persons authorised by licence under a corresponding law. That clause recognises licences from other jurisdictions and sets a threshold for viable seed movement that is contingent on the parent crop THC concentration, thereby aligning cross-border seed movement with both Territory and other jurisdictions’ regulatory regimes.

Overall, the Regulations point to a policy of regulatory co-ordination: they enforce Territory-specific technical and administrative requirements while deferring to Commonwealth import and narcotics law where applicable, and they link enforcement evidence to nationally recognised laboratory standards.

The instrument includes an endnotes section summarising its notification and amendment history up to 23 May 2025. Relevant timeline entries and amendments recorded in the Regulations are:

• Original instrument: Hemp Industry Regulations 2020 (SL No. 7, 2020). The Regulations were notified on 6 May 2020 and commenced on that date (Endnotes, list of legislation).
• Statute Law Amendment (Territory Economic Reconstruction) Act 2022 (Act No. 5, 2022) appears in the Endnotes with an assent date of 14 April 2022 and a commencement note indicating parts commenced and other removals effective 25 May 2022 (Endnotes, list of legislation). Specific regulations affected by that Act are noted in the list of amendments, with regulations 16, and rr 19-20 and r 24 removed or amended as recorded (Endnotes, list of amendments).
• Agriculture Legislation Amendment Regulations 2025 (SL No. 4, 2025) were notified 22 May 2025 and commenced on 23 May 2025 (Endnotes, list of legislation). The summary of amendments indicates that regulation 3, regulation 12, regulation 15, regulation 17 and regulation 18 were amended by No. 4, 2025 at specific rule numbers (Endnotes, list of amendments: "r 3 amd No. 4, 2025, r 4", "r 12 amd No. 4, 2025, r 5", "r 15 amd No. 4, 2025, r 6", "r 17 amd No. 4, 2025, r 7", "r 18 amd No. 4, 2025, r 8"). Regulation 16 was amended by Act No. 5, 2022, s 107; regulations 19-20 and regulation 24 were repealed by Act No. 5, 2022, s 108 (Endnotes, list of amendments).
• The endnotes include a key to abbreviations and a list of legislation entries citing both the SL No. and commencement dates for the original instrument and subsequent amending instruments. The consolidated as-in-force date specified at the head of the provided text is 23 May 2025.

The amendment history recorded in the Endnotes identifies precise textual changes to the Regulations at the rule and clause level but does not include the full pre-amendment text that was replaced. Practitioners needing the specific prior formulations should consult earlier versions of the Regulations or transitional provisions in the amending instruments. The Endnotes indicate that certain provisions were repealed by the 2022 Act and other regulations were amended as part of the Agriculture Legislation Amendment Regulations 2025, showing an evolving regulatory approach in response to policy changes or administrative streamlining.

The Regulations as provided include no mention of litigation, court decisions, or judicial consideration. The instrument contains no footnotes, schedule notes or annotations that record case law or disputes arising from its application. Part 5 and other clauses preserve court processes in that a person served with an infringement notice may elect to have the matter prosecuted in court rather than expiate by payment (regulation 29(2)(b)-(c); regulation 33(2)(b) preserves liability to prosecution where an infringement notice was not served).

Because the Regulations are subordinate legislation, any litigation testing their validity, interpretation or administrative exercise of powers would appear in the Territory courts’ reported decisions or in administrative review records, none of which are included in the instrument. The Endnotes record amendments and repeals but do not record judicial review outcomes.

For research or practice purposes where litigation history is material, the absence of cases or reported decisions in the text means a practitioner should search the Northern Territory court databases and administrative tribunal records for any decisions involving these Regulations or the underlying Hemp Industry Act 2019. The Regulations themselves preserve the procedural pathway to courts for persons electing to contest offences and do not oust judicial review of administrative decisions where applicable under general administrative law principles.

The Regulations contain several technical thresholds, time limits, and procedural requirements that can produce unexpected compliance costs or operational constraints. The following are discrete "gotchas" to watch for, each grounded in the cited regulation.

1. Two different THC thresholds with different legal consequences.

   • Supply and cultivation tolerances for viable seed and subsequent destruction thresholds are set at different levels. Viable seed may be supplied to authorised recipients only if the parent crop has a THC concentration in leaves and flowering heads of not more than 0.5 per cent (regulation 17(2)). By contrast, hemp that is surrendered or seized must be destroyed if it has a THC concentration of more than 1 per cent (regulation 22(4)); licensees must destroy plants with THC concentration of more than 1 per cent (regulation 23(1)). That gap between 0.5 per cent and 1 per cent creates a narrow policy window where viable seed supply is constrained even though destruction is not mandated until a higher measured level.

2. Sampling representativeness and timing are legally required.

   • The Regulations require sampling that produces results reflecting the average THC concentration of the crop (regulation 27(2)) and sampling must be done to provide a representative sample (regulation 26(1)). Sampling is to be conducted by an inspector rather than a police officer (regulation 26(2)). The combination means licensees cannot rely on ad hoc or private testing during an inspector’s investigation and must be ready to accept inspector sampling that targets average crop metrics.

3. NATA-accredited laboratory requirement defines admissible analysis.

   • Any analysis under the Act to determine concentration of THC must be conducted by a laboratory accredited by the National Association of Testing Authorities (regulation 27(3)). If a licensee relies on a non-accredited lab, those results will not satisfy the statutory standard and may not block inspector action.

4. Commercial minimum area excludes small-scale growers.

   • The minimum commercial cultivation area is 2 hectares (regulation 16). Small or boutique growers cannot qualify for a commercial licence under that threshold and will need to use research licences or other pathways, if available.

5. Practical constraints on supply chains for viable seed.

   • Viable seed for propagation may only be supplied to another licensee or to a person authorised by a corresponding law, and only when the parent crop THC in leaves and flowering heads is not more than 0.5 per cent (regulation 17(2)). That restricts legally permissible transfers of propagation material, potentially complicating seed movement between jurisdictions or to private growers.

6. Denaturation requirement before seed supply for consumption.

   • Hemp seed for human or animal consumption must be denatured by the licensee or by the recipient (regulation 17(1)). This imposes a processing obligation prior to supply into food or feed channels, with associated costs and verification demands.

7. Strong restrictions on processing and extraction.

   • Commercial licence holders are prohibited from producing cannabis resin, extracting or isolating substances, and processing hemp leaf or unfertilised hemp flower heads, unless they hold a medicinal cannabis licence and relevant Narcotic Drugs Act permits (regulation 18(1)-(4)). This creates an operational boundary between industrial hemp operations and medicinal cannabis processing. The carve-out requires coordination with Commonwealth licensing, which can be administratively complex.

8. Short notification windows.

   • Licensees must notify the CEO of the cultivation location, including GPS coordinates, within seven days after planting (regulation 12(1)). Changes to register information must be notified within seven business days (regulation 13). These short timelines require robust internal record-keeping and rapid administrative capability.

9. Cost recovery as a debt can create immediate cashflow exposure.

   • Regulation 8 permits the Territory to recover reasonable costs incurred for sampling, testing and dealing with seized or surrendered material, including destruction, as a debt. That puts direct financial risk on licensees following enforcement activity, including where the Territory undertakes destruction under inspector supervision (regulation 22(5) and regulation 23(5) are cited in regulation 8(c)).

10. Infringement notice payment mechanics and limited withdrawal window.

    • The prescribed amounts for infringement notices are expressed in penalty units in the Schedule, but payment is effective only when credited to the payee’s bank account for electronic payment and when a cheque clears on first presentation (regulation 31). The CEO may withdraw an infringement notice, but only within 28 days after service and before payment is made (regulation 32). Licensees relying on cheque payments risk inadvertent late effective payment timing.

11. Prohibition on marketing low THC hemp as psychoactive.

    • Regulation 11(4) forbids stating or implying that low THC hemp is psychoactive. Commercial marketing strategies must be reviewed to avoid language that could attract enforcement.

12. Role limitations for police in sampling.

    • Sampling and testing must be done by an inspector and not a police officer (regulation 26(2)). While this clarifies roles, it may create procedural friction where police are involved at an earlier stage of an investigation.

These practical traps require careful documentary practices, rapid notifications, controlled seed movements, accredited testing strategies and financial provisioning for potential cost recovery.

The Regulations set a range of procedural, technical and documentary requirements. The following compliance checklist translates the Regulations into concrete actions a licence applicant or licensee should take. Each item cites the controlling regulation(s) that create the requirement.

1. Verify applicant suitability before applying (regulation 9).

   • Conduct internal criminal-history checks against the disqualifying offences listed in regulation 9(2). If any listed convictions exist within 10 years of intended application, the person is not a fit and proper person for a licence.

2. Prepare for and budget fees and possible waivers (regulations 4-7).

   • Budget for application fees in revenue units: commercial licence 1,033 revenue units, class A research 1,446 revenue units, class B research 2,479 revenue units (regulation 4).
   • Budget amendment fees (83 revenue units) and renewal fees equal to the application amount (regulations 5 and 6).
   • If an Agency is applying for a class A or B research licence, consider applying for a CEO waiver under regulation 7.

3. Put administrative processes in place for rapid notifications (regulations 12(1), 13).

   • Implement a procedure to notify the CEO of the location of any cultivation area, including GPS coordinates, within seven days of planting (regulation 12(1)).
   • Maintain and promptly update register information; notify the CEO within seven business days of any change required under section 39(2) of the Act (regulation 13).

4. Ensure consignment documentation and import compliance (regulation 11).

   • Use the approved form for consignment notices when supplying live hemp plants, tissue culture or viable seed (regulation 11(1)-(2)).
   • If planning to import hemp from outside Australia, ensure an appropriate import permission under the Customs (Prohibited Imports) Regulations 1956 (Cth) is in place (regulation 11(3)).
   • Review marketing materials to avoid wording that states or implies low THC hemp is psychoactive (regulation 11(4)).

5. Control propagation material sourcing and seed handling (regulation 12(2) and regulation 17).

   • Source seed, cuttings and germplasm only from persons authorised under the Act or a corresponding law (regulation 12(2)).
   • If supplying seed for consumption, denature seed before supply or ensure the recipient will denature it (regulation 17(1)).
   • For supply of viable seed for propagation, ensure parent crop leaf and flowering head THC concentration is not more than 0.5 per cent and that recipients are another licensee or authorised under a corresponding law (regulation 17(2)).

6. Maintain production boundaries and avoid prohibited activities (regulation 18).

   • Do not produce cannabis resin, extract or isolate substances such as cannabinoids or terpenes, nor process hemp leaf or unfertilised flower heads, unless expressly authorised under a medicinal cannabis licence and Narcotic Drugs Act permits (regulation 18(1)-(4)). If such activities are intended, secure the necessary Commonwealth licences and permits and document the scope of authorisation.

7. Prepare for representative sampling and accredited testing (regulations 26 and 27).

   • Expect inspectors to conduct sampling that is representative and designed to reflect average crop THC concentration (regulation 26(1); regulation 27(2)). Maintain contemporaneous field records to demonstrate outstanding cultivation practices and to contest methodological issues if necessary.
   • Use NATA-accredited laboratories for any voluntary testing intended to be relied upon under the Act, because analysis under the Act must be done by a NATA-accredited lab (regulation 27(3)).
   • Understand that THC measurement is percentage of dry weight and ensure any internal testing measures conform to this standard (regulation 27(1)).

8. Institute a destruction protocol and liaison with inspectors (regulations 22 and 23).

   • Implement an internal protocol for prompt destruction of plants with THC concentration greater than 1 per cent, including steps to notify an inspector and to conduct destruction under their supervision (regulation 23(1)-(4)).
   • Keep contingency plans and financial reserves for the possibility that an inspector will seize and destroy plants where the licensee fails to act, and be aware that the Territory may recover reasonable costs as a debt for sampling, testing and destruction activities (regulation 8; regulation 22(5); regulation 23(5)).

9. Keep accurate records and prepare annual reporting (regulation 14).

   • Maintain operational records sufficient to prepare the annual report the CEO requires, and be ready to include additional information if the CEO issues a direction under regulation 14(3).
   • Keep records of consignment notices, seed origin documentation, GPS coordinates and laboratory results to support compliance and to respond to any inspector queries or infringement notices.

10. Prepare for infringement notice procedures (Part 5).

    • If served with an infringement notice, review it for the required contents (regulation 29(1)). Decide whether to expiate by paying the prescribed amount within 28 days or to elect court proceedings by completing the statement of election (regulation 29(2)(a)-(b); regulation 30).
    • Be mindful of payment mechanics: electronic payments are effective only when credited; cheques must clear on first presentation (regulation 31). If the CEO has served an infringement notice, be aware that the CEO may withdraw it within 28 days after service and before payment (regulation 32).

11. Account for cross-jurisdictional interactions (regulation 3; regulation 17(2)(b); regulation 11(3)).

    • If planning cross-border supply or receipt of viable seed, confirm the recipient’s licence status under a corresponding law. If planning to import, ensure compliance with Commonwealth customs requirements.

12. Legal and operational review.

    • Periodically review operations against the Regulations and the Act, especially in light of amendments recorded in the Endnotes (for example amendments enacted by the Agriculture Legislation Amendment Regulations 2025 and the Statute Law Amendment (Territory Economic Reconstruction) Act 2022). Keep records of the version of the Regulations relied upon for operations.

Practical implementation tip: Prepare a compliance binder that includes copies of licences, consignment notices, GPS-linked planting logs, seed provenance statements, NATA lab test certificates, destruction notices and communications with inspectors. That evidentiary trail supports timely notifications, defends against contested sampling methodology, and demonstrates good faith compliance where cost recovery or infringement action is threatened.

Following these steps directly addresses the obligations and rights created by the Regulations and reduces the risk of inspector intervention, enforced destruction and attendant cost recovery.
