#### 16 Cancellation of licence 16 Cancellation of licence > > (1) A licence may be cancelled by the Secretary— > > > > > (a) if the licensee contravenes any provision of this Act or the regulations, whether or not the licensee has been convicted of an offence for the contravention, or > > > > > (b) on such other grounds as may be prescribed by the regulations. > > > > Note— > > > > Failing to comply with the conditions of a licence is a contravention of the Act. > > > (2) The Secretary must cancel a licence if the Secretary is satisfied that, if the licensee were applying for a new licence, the application would be required by this Act to be refused. > > > (3) A licence is cancelled by the Secretary by serving on the licensee a written notice stating that the licence is cancelled. The cancellation takes effect when the notice is served or on a later date specified in the notice. > > > (4) The Secretary may, by serving a further written notice on the holder of a licence, cancel a notice cancelling a licence before the notice takes effect. > > **s 16:** Am 2022 No 59, Sch 1.20\[3\]–\[7\].
