What it does
The Act creates a Tasmanian constitutional framework for applying specified versions of the Commonwealth Help to Buy Act 2024 and referring a defined set of related legislative matters to the Commonwealth Parliament. Its main mechanisms are adoption under s 4, a limited amendment reference under s 6, and provisions for terminating those arrangements under ss 7-8. It also declares certain Tasmanian housing assistance matters to be “excluded matters” for the purposes of s 41A of the Commonwealth Act, and establishes a process for the State to object to matters under s 46 of that Act.
The Act does not set out the substantive eligibility rules, financial terms or administration of Help to Buy arrangements. It adopts versions of the Commonwealth Act, subject to specified exclusions, and gives meaning to some terms by referring to the Commonwealth Act (ss 3-4). Because the text of the Commonwealth Act is not included here, this note cannot describe those program rules or assess how the adopted provisions operate in detail.
The Act received Royal Assent on 5 June 2026 and commences on that day (ss 1-2). The adoption and amendment reference begin when the relevant provisions come into operation (ss 4(3), 6(4)). The Governor may later terminate either adoption, or the amendment reference, by proclamation published in the Gazette (s 7). Section 8 preserves specified effects of laws already made under the amendment reference if that reference ends before the relevant adoption ends.
