sch.1-sec.26 Limits on Help to Buy Program Directions

The Minister must not give a direction under sub section 24 (1) that is inconsistent with this Act (including the object of this Act) or the Housing Australia Act 2018 (including the object of that Act). The Minister must not give a direction under paragraph 24(1)(a) that has the purpose, or has or is likely to have the effect, of directly or indirectly requiring the Board or Housing Australia: to enter into a particular Help to Buy arrangement; or to enter into a Help to Buy arrangement in relation to a particular residential property; or to enter into a Help to Buy arrangement with a particular individual or individuals; or to take, or not to take, particular action relating to a Help to Buy arrangement. (sch.1-sec.26-ssec.1) The Minister must not give a direction under sub section 24 (1) that is inconsistent with this Act (including the object of this Act) or the Housing Australia Act 2018 (including the object of that Act). (sch.1-sec.26-ssec.2) The Minister must not give a direction under paragraph 24(1)(a) that has the purpose, or has or is likely to have the effect, of directly or indirectly requiring the Board or Housing Australia: to enter into a particular Help to Buy arrangement; or to enter into a Help to Buy arrangement in relation to a particular residential property; or to enter into a Help to Buy arrangement with a particular individual or individuals; or to take, or not to take, particular action relating to a Help to Buy arrangement.

• (a) to enter into a particular Help to Buy arrangement; or
• (b) to enter into a Help to Buy arrangement in relation to a particular residential property; or

• (d) to take, or not to take, particular action relating to a Help to Buy arrangement.
