What it does
This Regulation prescribes the information that must be held in and supplied to the national database of heavy vehicles, and sets limited access rights for registered operators. It operates as a companion instrument to the Heavy Vehicle National Law, commencing in each participating jurisdiction when Chapter 12, Part 12.2A of that Law commences in that jurisdiction (s 2). The Regulation requires the Regulator to include specified vehicle-level fields (s 4) and operator-level fields (s 5) in the database. It imposes obligations on registration authorities to supply those fields to the Regulator (s 6(1), s 7(1)) and to supply additional optional fields where those fields are held on a vehicle register (s 6(2)-(3), s 7(2)-(3)). The Regulator is required to record vehicle defect notices when it is notified of their issue (s 8), and to amend the database when a registration authority notifies it of changes in recorded information (s 9). The only express access right in the Regulation is that a registered operator may request information about their vehicle or their operator record, subject to an administrative fee and delivered in the form of a certificate (s 10(1)-(3)). Schedule 1 supplies the dictionary of defined terms used by the Regulation (s 3).
Mechanically, the Regulation centralises a defined set of registration data held under participating jurisdiction laws into a national database managed by the Regulator, creates a duty on registration authorities to transmit that data, requires the Regulator to record and maintain defect notice entries and updates, and provides a paid, certified disclosure route for registered operators to obtain their own database records. The instrument does not itself set fees, specify technical formats or data standards, state penalties, or prescribe disclosure to third parties beyond the registered operator right in s 10.
