26G Category 2 offence
26G Category 2 offence
A person commits an offence if—
(a) the person has a duty under section 26C; and
(b) the person contravenes the duty; and
(c) the person’s contravention exposes an individual, or class of individuals, to a risk of death or serious injury or illness.
Maximum penalty—
(a) if an individual commits the offence—$150000; or
(b) if a corporation commits the offence—$1500000.
