What it does
This Regulation adopts a schedule of infringement notice offences and penalties connected to the Heavy Vehicle (Adoption of National Law) Act 2013 and to the Heavy Vehicle National Law and related national regulations by prescribing which offending provisions may be dealt with by an infringement notice and the fixed monetary amounts payable for those notices. It commences on 1 July 2022 (s 2). The instrument repeals the Heavy Vehicle (Adoption of National Law) Regulation 2013 and saves acts or matters that had effect immediately before that repeal so they continue to have effect under this Regulation (s 4(1)-(2)). The Regulation also defines, for the Regulation, the shorthand "the Act" to mean the Heavy Vehicle (Adoption of National Law) Act 2013 (s 3).
Mechanically, the core content is a Schedule 1 that lists a large number of offences under the Heavy Vehicle National Law (NSW) and two named national regulations (Fatigue Management; Mass, Dimension and Loading) and specifies the dollar amount payable for an infringement notice for each listed offence. The Schedule identifies different monetary levels depending on the nature of the offence. For example, some provisions attract two or three tiered amounts depending on whether the breach is designated minor, substantial or severe risk, while other provisions distinguish by technical categories such as whether the heavy vehicle standard relates to a speed limiter (Section 60(1)(a) v (b)). The Schedule also includes unusual formulations such as a monetary penalty equal to 10 per cent of the maximum penalty where the driver fails to keep a document, device or other thing in the driver’s possession (Schedule 1 entry for section 568(3)(b)).
The Schedule is applied to the Act by an application provision (sch.1-sec Application). That provision explicitly links the Schedule to the Act’s section 12(6), stating that each listed provision is an offence for which an infringement notice may be issued and that the amount payable is the amount specified opposite the provision. The application provision also restricts the issuing of infringement notices where a listed provision is qualified by words limiting the kind of offence or the circumstances in which it applies; in such cases an infringement notice may be issued only for the limited kind or circumstances set out in the provision (sch.1-sec Application(1)-(2)). The Schedule has been subject to amendments noted in the Regulation, with entries showing amendments in 2023, 2024 and 2025 (sch 1 note).
