93 Criteria for variation of registration S. 93(1) amended by No. 46/1998 s. 7(Sch. 1). (1) In determining whether to vary or to refuse to vary the registration of a health service establishment, the Secretary must consider any relevant criteria that the Secretary would be required to consider in determining any application under this Part. S. 93(2) amended by Nos 99/1995 s. 17(a)–(c), 46/1998 s. 7(Sch. 1). (2) If an application under section 92 relates to any matter for which an approval in principle under Division 1 is in force, the Secretary must not refuse to vary the registration on any ground inconsistent with that approval in principle.
