Health Professionals (Special Events Exemption) Act 2000

The Act builds on a small number of tightly framed legal concepts that govern eligibility, scope, timing and exemptions.

• Special event and exemption period. The Minister may declare by order an event or class of events to be a "special event" (s 6(1)). The order must specify the exemption period or periods when the Act’s authorisations apply, and the procedure for giving notice (s 6(3)). The exemption period may include time before or after the event (s 6(4)). Orders are subsidiary legislation (s 3(2)), so they are legally enforceable instruments that set the operative window and administrative steps.

• Visitor. "Visitor" is a functional definition linking the patient population to the event: primarily foreign residents in the State for official participation or preparation for participation in a special event, plus non‑resident support staff and certain Australian residents who are members of a majority‑foreign group in the State for the same purpose (s 4). The visitor definition delimits who may lawfully receive services from visiting health professionals under these exemptions.

• Visiting health professional. The person who supplies the services must be a resident of another country, be engaged to provide services to a visitor, not be registered in Western Australia, and have provided notice in accordance with the order (s 5). That definition excludes Australian residents from qualifying as a "visiting health professional", subject to the narrow visitor exception in s 4(c) which applies to visitors rather than to visiting health professionals.

• Scope equivalence and medicine limits. Visiting health professionals may only provide services that are lawfully provided in WA by a registered practitioner of the like profession (s 8(1)). They are likewise limited in relation to medicines (s 8(2)). The Minister may vary these constraints by order, either by imposing further conditions, or by exempting individual visiting health professionals or classes from those statutory conditions (s 8(3)-(4)). Regulations may also prescribe conditions (s 8(5)-(6)).

• Medicines and radiation. Separate authorisations are available by order. The Minister may authorise supply of medicines according to a visiting health professional’s prescription or to supply to visiting health professionals as if they were registered professionals, provided the supplier is authorised under the Medicines and Poisons Act to supply those medicines to a registered professional and the Minister is satisfied adequate arrangements exist to ensure medicines are used only in connection with authorised services (s 9(1)-(2)). The Minister may likewise authorise visiting health professionals to request licensed holders under the Radiation Safety Act 1975 to undertake diagnostic or therapeutic procedures (s 10).

• Exemptions from offences. Provides criminal law protection in respect of certain offences for acts done in compliance with the Act (s 11). This includes providing authorised health care services and administering, possessing, prescribing or supplying medicines lawfully imported or obtained in Australia that may be lawfully handled by a registered health professional of the like profession (s 11(1)(a)-(b)). The Act also protects visitors who use or possess medicines provided under the Act (s 11(2)) and suppliers who comply with the Act (s 11(3)-(4A)). The regulations can extend the list of offences to which these exemptions apply (s 11(4)).

• Limits to oversight. A complaint may not be made against a visiting health professional under the Health and Disability Services (Complaints) Act 1995 or a Health Registration Act, and no disciplinary action under those Acts may be taken in respect of a visiting health professional (s 13(1)). This excludes administrative or disciplinary routes that ordinarily apply to registered practitioners. The statutory protection does not preclude criminal proceedings for offences (s 13(2)).

• Ministerial discretion and subsidiary law. The Act delegates substantive details, including event selection, exemption periods, notice procedures, conditions, medicine and radiation authorisations, and exclusions, to ministerial orders (s 6; s 8(3); s 9; s 10; s 14). Orders are subsidiary legislation (s 3(2)). Regulations may also make provisions and create offences (s 16). If regulations conflict with conditions in ministerial orders, the regulation prevails to the extent of the inconsistency (s 8(6)).

• Temporal and compliance trigger. The statutory authorisations operate only during the exemption period and only if the visiting health professional complies with the Act, regulations and any relevant conditions (s 12(1)-(2)). Failure to comply removes the operation of the authorisations.

Together these concepts create a framework that is event‑driven, temporally bounded, conditionally licensed by ministerial order, and limited to non‑resident providers delivering services only to defined "visitors", with criminal law exemptions carefully tethered to compliance with the Act and its subsidiary instruments.

The Act allocates legal rights and responsibilities among distinct groups. Identify the statutory actors and the likely affected domestic stakeholders.

• Visiting health professionals. By definition they must be individuals who are residents of another country, are engaged to provide services to a visitor, are not registered under the Health Registration Act in WA, and have given notice per the order (s 5). The Act creates a temporary legal authorisation to provide health services during an exemption period (s 7; s 12(1)). Visiting health professionals are directly affected by scope constraints (s 8), medicine and radiation authorisations (s 9-10), and the need to follow the notice procedure and any conditions imposed (s 6(3); s 8(3)-(4)). They also benefit from statutory exemptions from certain offences if they comply (s 11(1)).

• Visitors (patients). Defined in s 4, visitors are primarily non‑resident participants and support staff attending special events, and some Australian residents who are members of a predominantly foreign group. They are the only people who may be provided with health care under the Act by visiting health professionals (s 7). Visitors are protected from committing offences under the Medicines and Poisons Act 2014 and the Misuse of Drugs Act 1981 for using or possessing medicines supplied under this Act (s 11(2)).

• Registered health professionals and local services. The Act preserves the lawful business of registered practitioners (s 15), but mechanically it allows unregistered visitors to perform services in competition with local registered providers during the exemption period if the visiting professional’s services fall within the scope of a registered professional of the like profession (s 8(1)). This creates potential short‑term substitution effects during events. Also, suppliers authorised to provide medicines under s 9(1) may need to treat prescriptions from visiting health professionals as if issued by registered professionals, if authorised by the Minister (s 9(1)(b); s 11(3)-(4A)).

• Suppliers and holders of licences. Pharmacies, licensed suppliers, and radiation licence holders are affected. The Minister may authorise a person or class to supply a medicine in accordance with a visiting health professional’s prescription or to supply to visiting professionals as if they were registered (s 9(1)). Any such authorised supplier must itself be authorised under the Medicines and Poisons Act 2014 to supply to registered professionals of the like profession (s 9(2)(a)), and must operate subject to conditions in the order (s 9(3); s 11(3)-(4A)).

• Regulators and the Minister. The Minister has primary decision‑making power to declare special events, set exemption periods, prescribe notice procedures, impose or relax conditions, and authorise medicine supply and radiation requests (s 6; s 8(3); s 9; s 10). Regulations may be made by the Governor and can override conflicting conditions imposed under ministerial orders to the extent of inconsistency (s 8(6); s 16).

• Complaints bodies and registration boards. The Act removes the option to make complaints under the Health and Disability Services (Complaints) Act 1995 and prevents disciplinary action under Health Registration Acts against visiting health professionals (s 13(1)). Consequently, registration boards and complaints bodies will find certain disputes outside their statutory jurisdiction where the provider is a visiting health professional acting within the Act.

• Event organisers. While the Act does not expressly assign duties to organisers, organisers will necessarily be involved in ensuring visiting health professionals are engaged in a way that satisfies notice procedures and that appropriate arrangements for medicine use and radiation are in place if authorisations are sought (s 6(3); s 9(2)(b)).

Who pays and who decides. The Minister decides which events qualify, the exemption periods, and the administrative procedure (s 6). Visiting health professionals and their employers or event organisers bear the administrative burden of complying with the notice procedure and any conditions. Suppliers and licence holders must decide whether to accept prescriptions or supply medicines under ministerial authorisation, and they must meet the statutory requirement of being authorised under the Medicines and Poisons Act where required (s 9(2)(a)).

Concentrated vs diffuse effects. Benefits are concentrated: visiting providers gain a temporary right to practise; specific suppliers may gain business from event‑related demand. Costs are potentially diffuse: residents who rely on regulatory safeguards have a reduced route for complaint in respect of non‑registered providers, and local registered practitioners may face short‑term competition. The Act contains mechanisms (conditions, orders, regulation supremacy) to limit and manage these trade‑offs, but the legal recordable channels for redress are materially altered for the period of exemption (s 13).

Set out the principal statutory duties, permissions and limitations imposed by the Act, with section references.

Rights and permissions

• Right to provide services during exemption period. A qualifying visiting health professional is authorised to provide health care services to a visitor for whom they have been engaged (s 7; s 12(1)). The authorisation operates only during the exemption period for the event and only if notice was given in accordance with the order (s 12(1)).

• Exemption from certain offence provisions. Where the visiting health professional complies with this Act, they do not commit offences under a Health Registration Act, the Medicines and Poisons Act 2014, the Radiation Safety Act 1975 or the Misuse of Drugs Act 1981 for acts done in accordance with the Act (s 11(1)). This includes providing authorised services, handling medicines lawfully imported or obtained in Australia that a registered practitioner of like profession may handle, requesting licensed radiation work while authorised, and using professional titles ordinarily used (s 11(1)(a)-(f)).

• Suppliers: lawfully supply under ministerial authorisation. A person authorised under s 9(1) and otherwise authorised under the Medicines and Poisons Act may supply medicines in accordance with prescriptions issued by an authorised visiting health professional, without committing an offence under the medicines or misuse of drugs statutes, subject to the statutory conditions (s 9; s 11(3)-(4A)).

• Visitor protections as users of medicines. Visitors do not commit offences under the Medicines and Poisons Act 2014 or the Misuse of Drugs Act 1981 for using or possessing medicine provided under this Act (s 11(2)).

Duties, limitations and conditions

• Residency and engagement requirement. A visiting health professional must be a resident of another country and engaged to provide services to a visitor (s 5(a)-(b)). They must not be registered in Western Australia (s 5(c)). Notice must be given in accordance with the order under s 6 (s 5(d)).

• Scope equivalence. Visiting health professionals may only provide services that a registered health professional of the like profession may lawfully provide in the State (s 8(1)). Similarly, they may not administer, possess, prescribe or supply medicines other than those lawfully handled by a registered professional of the like profession (s 8(2)). The Minister may impose further conditions or grant exemptions by order (s 8(3)).

• Compliance requirement. The authorisations and exemptions operate only while the visiting health professional complies with the Act, the regulations and any conditions imposed by or under the Act (s 12(2)). Failure to comply removes the protection and authorisation.

• Procedure and documentary compliance. The operation of rights depends on administrative compliance: the Minister’s order must specify the notice procedure and the visiting professional must have given the notice in accordance with that procedure (s 6(3); s 5(d)). The precise procedural requirements are set in subsidiary legislation rather than as statutory elements in the primary Act.

• Medicines: supplier authorisation and ministerial satisfaction. The Minister may authorise supply of medicines only where the supplier is authorised under the Medicines and Poisons Act to supply to a registered professional of the like profession, and where the Minister is satisfied that adequate arrangements exist to prevent misuse (s 9(2)(a)-(b)). Orders may impose conditions (s 9(3)).

• Radiation requests: order‑based authorisation. A visiting health professional may request licensed radiation diagnosis or therapy only where an order authorises that request (s 10(1)-(3)).

• Regulatory offences and penalties. The Governor may make regulations that prescribe matters necessary for carrying out the Act and create offences that attract penalties not exceeding $1 000 (s 16(1)-(2)). Any regulation that conflicts with a ministerial condition is to the extent of the conflict, prevailing (s 8(6)).

Limits on administrative recourse and accountability

• No disciplinary complaints under specified Acts. A complaint may not be made under the Health and Disability Services (Complaints) Act 1995 or a Health Registration Act against a visiting health professional, and no disciplinary action may be taken under those Acts against a visiting health professional (s 13(1)). However, this does not prevent criminal proceedings for offences under those Acts (s 13(2)).

Ministerial powers and discrete delegations

• Ministerial declaration and exclusions. The Minister decides which events qualify, the exemption periods and the notice procedure (s 6(1)-(3)). The Minister may by order declare the Act, or a provision of it, does not apply to a specified person or class of persons (s 14). The Minister may impose or lift conditions, and authorise medicine supply and radiation requests (s 8(3); s 9; s 10). Orders are subsidiary legislation (s 3(2)).

Taken together, the Act creates targeted permissions while channeling substantive detail and conditions into ministerial orders and regulations, and it replaces some regulatory accountability mechanisms for the event period by restricting complaints and disciplinary action in respect of visiting practitioners.

The Act itself does not create an extensive penalty regime, but it sets the boundaries for criminal liability, regulatory offences, and administrative enforcement. It relies heavily on compliance with orders and regulations for enforcement links.

Regulatory offences and penalties

• Regulations may create offences. Section 16(2) permits regulations under the Act to create offences, each punishable by a penalty not exceeding $1 000. The Act therefore contemplates subsidiary law will contain some of the enforceable rules and sanctions. The precise content and penalties of those regulations are not in the Act; the power exists to set them by regulation.

Interaction with other offences

• Exemptions do not amount to blanket immunity. Section 11 creates specific exemptions from offences under a Health Registration Act, the Medicines and Poisons Act 2014, the Radiation Safety Act 1975 and the Misuse of Drugs Act 1981 for acts done in accordance with the Act. Those exemptions are conditioned on compliance with the Act, and on meeting certain statutory requirements such as lawful importation or acquisition of medicines (s 11(1)(b)(i)). The Act expressly preserves the ability to bring proceedings for offences under the Acts referred to in s 13(1) , s 13(2) clarifies that the restriction on complaints and disciplinary action does not prevent criminal prosecution. Therefore, where conduct falls outside the Act’s authorisation, ordinary offence provisions remain enforceable and prosecutions may proceed.

Operational enforcement via compliance

• Operation tied to compliance. Section 12(2) makes the operation of the authorisations contingent on compliance with the Act, the regulations and any conditions. This is the primary enforcement mechanism: if a visiting health professional fails to comply, the authorisation is not in force and the person may be liable for otherwise applicable offences under other legislation.

Administrative limitations on disciplinary action

• No complaints and no disciplinary action under certain Acts. Section 13(1) prevents complaints under the Health and Disability Services (Complaints) Act 1995 and disciplinary action under Health Registration Acts in respect of visiting health professionals. That removes a regulatory enforcement route that normally applies for registered practitioners, so administrative sanctions under those Acts are not available against visiting health professionals for the period they are acting within the Act. This shifts enforcement focus from administrative disciplinary tools to criminal or civil remedies where applicable.

Ministerial orders and regulatory supremacy

• Conditions and conflicts between orders and regulations. The Minister may impose conditions in orders (s 8(3); s 9(3); s 10(3)). The regulations may prescribe conditions, and in the event of inconsistency, the regulation prevails (s 8(5)-(6)). Enforcement of regulated offences therefore may override a ministerial condition, to the extent of conflict, placing substantive enforcement authority in the regulations.

Practical enforcement actors

• Criminal prosecutions under existing statutes. Where a visiting health professional acts beyond the Act’s authorisation, or in breach of the Act or regulations, the ordinary criminal enforcement mechanisms of the Health Registration Act, the Medicines and Poisons Act 2014, the Radiation Safety Act 1975 and the Misuse of Drugs Act 1981, among others, remain available (s 11; s 13(2)).

• Event organisers, suppliers and licence holders. Suppliers and licence holders who act under ministerial authorisation must ensure they are authorised under other statutes (e.g. Medicines and Poisons Act) to supply medicines to registered professionals where required by s 9(2)(a). Failure to ensure that statutory precondition could expose suppliers to liability under those statutes.

Record keeping, notice and procedural compliance as enforceable inputs

• Notice requirement and ministerial procedures. The effectiveness of authorisation depends on the notice procedure set in the order (s 6(3); s 5(d)). Compliance with the notice procedure is therefore material to whether the visiting health professional enjoys the statutory exemption. Non‑compliance results in the authorisation not operating (s 12(2)).

In short, the Act relies on a mixture of ministerial orders, regulation, and the existing criminal law to enforce its terms. It curtails certain administrative oversight mechanisms for visiting health professionals while preserving criminal prosecutions for breach. The regulations, not the primary Act, are the primary vehicle for creating specific offences and penalties up to $1 000 (s 16(2)).

The Act is expressly designed to intersect with several other statutory regimes and to operate as a limited carve‑out from ordinary registration, medicines, radiation and complaints law, subject to conditions.

Health Registration Regimes

• National Health Practitioner Regulation National Law (WA). The Act references the Health Registration Act as the National Health Practitioner Regulation National Law (Western Australia) (s 3(1)). Section 11(1) exempts a visiting health professional from committing an offence under a Health Registration Act for providing authorised services under this Act, so long as the conditions in this Act are met. Section 13(1) removes the complaints and disciplinary routes under Health Registration Acts in respect of visiting health professionals. Therefore, the Act operates as a temporary exception to registration and disciplinary procedures under the National Law when its requirements are satisfied.

Medicines Regulation

• Medicines and Poisons Act 2014. The Act defines "medicine" by reference to s 3 of the Medicines and Poisons Act 2014 (s 3(1)). Section 9 imposes conditions on authorising supply of medicines , any supplier authorised under an order must themselves be authorised under the Medicines and Poisons Act 2014 to supply to registered practitioners of the like profession (s 9(2)(a)). Section 11(1)(b) and s 11(3)-(4A) create exemptions from offences in the Medicines and Poisons Act 2014 for visiting health professionals, visitors, and suppliers who act in accordance with the Act, subject to the statutory conditions. The regulations may prescribe other offences to which those exemptions apply (s 11(4)). The effect is that the Medicines and Poisons Act remains the controlling statute for medicines authorisation, with the Act enabling limited exceptions when the Medicines and Poisons Act’s own authorisation preconditions are met.

Radiation Safety Law

• Radiation Safety Act 1975. Section 10 authorises visiting health professionals to request licensed holders under s 26(1)(a) of the Radiation Safety Act 1975 to undertake diagnosis or therapy only if such an authorisation is made by ministerial order under s 6. Section 11(1)(d) exempts visiting health professionals from committing offences under the Radiation Safety Act for making such authorised requests. Therefore the Act creates a limited pathway for visiting professionals to interact with licensed radiation services subject to ministerial authorisation and conditions.

Controlled Substances

• Misuse of Drugs Act 1981. Section 11(1) and s 11(2) include provisions protecting visiting health professionals and visitors from committing offences under the Misuse of Drugs Act in respect of authorised activities, and s 11(3)-(4A) extend limited protections to suppliers. These protections are conditional and confined to acts done in accordance with this Act and its orders.

Complaints and disciplinary regimes

• Health and Disability Services (Complaints) Act 1995. Section 13(1) prevents complaints under this Act about visiting health professionals, and prevents disciplinary action under Health Registration Acts in respect of visiting health professionals. Section 13(2) makes clear criminal proceedings remain available. Thus, the Act disapplies specific administrative oversight routes during the exemption period.

Subsidiary law and statutory hierarchy

• Orders as subsidiary legislation. Section 3(2) declares that orders under this Act are subsidiary legislation as defined in the Interpretation Act 1984. This means the Minister’s orders are legally binding subordinate instruments subject to the usual constraints of subsidiary legislation, including requirements for publication in the Gazette (s 6(1)).

• Regulation supremacy over ministerial conditions. Section 8(6) provides that in the event of inconsistency between a regulation made under s 8(5) and a condition imposed under s 8(3), the regulation prevails to the extent of the inconsistency. Therefore regulations can override conditions imposed in ministerial orders in specified respects.

Preservation of registered practitioners’ rights

• Act does not prejudice registered practitioners. Section 15 stipulates the Act does not prejudice or affect the lawful occupation, trade or business of any person who is registered. This clause is declaratory and does not override ministerial powers or the exemptions provided to visiting health professionals; rather it preserves that registered practitioners continue to have lawful occupation rights separate from the framework of the Act.

Administrative exclusions and targeted non‑application

• Ministerial carve‑outs. Section 14 allows the Minister to declare by order that the Act, or a specified provision of the Act, does not apply to or in respect of a specified person or class of persons. This is an interactional tool permitting targeted application or non‑application in respect of existing statutory frameworks.

In sum, the Act is not a standalone regulatory scheme. It is expressly integrative and conditional on compliance with other statutes, and it uses ministerial orders and regulations to manage the detailed intersections with health registration, medicines, radiation safety and complaints law. The Act’s exemptions from offences under those statutes are narrowly tied to compliance with its procedural and substantive requirements.

The compilation table in the Act lists the principal amendments and reprints up to the last recorded note in the text. The Act commenced on the day it received Royal Assent, 14 April 2000 (s 2; compilation table). Subsequent amendments reflected the evolving statutory landscape of regulated professions and the medicines regime.

Key items in the compilation table

• 2000: Health Professionals (Special Events Exemption) Act 2000 assented and commenced 14 April 2000.

• 2005-2007: Multiple professional statutes inserted definitions and/or alignment with the Act, reflected in Sch. 3 cl. references for Psychologists Act 2005, Optometrists Act 2005, Podiatrists Act 2005, Chiropractors Act 2005, Physiotherapists Act 2005, Osteopaths Act 2005, Occupational Therapists Act 2005. The compilation table lists staggered commencement dates for those amendments between 2007 and 2008.

• 2006: Optical Dispensers Repeal Act 2006 s 4 appears in the table with commencement 11 May 2006, affecting the Act’s defined professions or references.

• 2006-2008: Medical Radiation Technologists Act 2006, Nurses and Midwives Act 2006, and Medical Practitioners Act 2008 amendments are recorded with respective commencement dates, indicating alignment with those professions and the National Law transitions.

• 2010: Standardisation of Formatting Act 2010 and Health and Disability Services Legislation Amendment Act 2010 are listed, including the insertion of s 13’s amendment (No. 33 of 2010 s 58) which affects complaints and disciplinary provisions.

• 2010 (cont.): Health Practitioner Regulation National Law (WA) Act 2010 (No. 35 of 2010) effected changes to the Health Registration Act references and related provisions; parts of that Act commenced across 2010 and 2012.

• 2014: Medicines and Poisons Act 2014 (No. 13 of 2014) amended the Act, including insertion of s 9 and amendments to s 8 and s 11. The compilation table records its assent on 2 July 2014 and commencement of relevant provisions on 30 January 2017. Specific citations in the Act indicate s 9 was inserted by No. 13 of 2014 s 163 and s 8 was amended by No. 13 of 2014 s 162. Section 11 was amended by No. 13 of 2014 s 164.

Reprints and consolidation

• Reprint 1: The Act as at 12 October 2007 included amendments up to that date.

• Reprint 2: The Act as at 7 March 2014 included the later amendments listed up to that date.

Notes and marginal references in the Act

• Section 3 contains a bracketed list of amending Acts and provisions showing how definitions and cross‑references have evolved (s 3 amended by multiple statutes between 2005 and 2014).

• Amendments inserted specific powers, for example, the supply of medicines authorisation in s 9 was inserted by the 2014 Medicines and Poisons Act amendments (s 9 inserted: No. 13 of 2014 s 163). The Act’s text records these amendment sources adjacent to the amended sections.

What the compilation shows

• The Act has been adjusted to align with the broader reorganisation and professional registration changes in WA, including the migration to the National Health Practitioner Regulation National Law framework, and the later medicines regulation reform through the Medicines and Poisons Act 2014. Several profession‑specific Acts referenced in the compilation table indicate amendment to the Act’s defined list of health care services (s 3(1)(a)) over time.

• The 2014 amendments are particularly notable because they introduced an express medicines supply authorisation regime (s 9) and updated relevant definitions, reflecting an attempt to better coordinate the Act with the Medicines and Poisons statutory scheme.

No further amendment entries are provided in the text beyond those listed in the compilation table. The Act also contains a statutory review requirement to occur five years after commencement (s 17), with the Minister required to prepare and table a report. The compilation table does not state whether that review was carried out or the contents of any report.

The text of the Act and the compilation table do not record any cases, judicial decisions, or litigation history. No case names, decisions or judicial interpretations are included in the statutory text provided. Section 13 addresses litigation modes by preventing complaints and disciplinary proceedings under specific Acts for visiting health professionals while preserving the option of bringing proceedings for offences under those Acts (s 13(1)-(2)). That provision suggests the legislature intended criminal or civil remedies rather than administrative disciplinary action for visiting health professionals, but the Act itself does not include records of any judicial disputes or how courts have interpreted it.

What the Act indicates about potential litigation topics

• Constitutional or jurisdictional challenges. The Act delegates substantial discretion to the Minister to declare special events and specify procedural requirements (s 6). If disputes arise about the validity of an order under the Interpretation Act 1984 (orders are subsidiary legislation, s 3(2)), judicial review could be a possible legal route, but the Act does not record any such decisions.

• Conflicts with registration frameworks. Because the Act creates exemptions from offences and bars complaints and disciplinary action under Health Registration Acts for visiting health professionals (s 11; s 13), potential litigation might concern the boundary between authorised activity and unlawful practice, or whether a visiting professional exceeded the permitted scope. Again, no judicial authorities are provided in the text.

• Medicines and radiation disputes. The Act’s integration with the Medicines and Poisons Act 2014 and Radiation Safety Act 1975 (s 9; s 10) could raise litigation questions about whether ministerial conditions were met, whether suppliers had authority under the Medicines and Poisons Act 2014 for a particular supply, or whether medicines were used only in connection with authorised services as required by s 9(2)(b). The Act does not provide any recorded judicial resolutions.

In short, the statutory text supplied contains no litigation history or case list. Users seeking jurisprudential guidance should search judicial databases for decisions that interpret the Act or ministerial orders under it, because the Act’s legal operation depends heavily on orders and regulations that may have attracted judicial consideration not recorded in the Act itself.

Identify specific traps, operational pitfalls, and counterintuitive features that practitioners and organisers should note, with precise statutory references.

1. Visiting health professional must be a resident of another country. Section 5(a) requires the visiting health professional to be a resident of another country. This excludes Australian residents from qualifying as visiting health professionals, even if they are in the State for the event. The Act creates a narrow exception for visitors who may be Australian residents (s 4(c)), but that applies only to the visitor definition, not the visiting health professional definition. Practically, this means an Australian practitioner cannot rely on this Act to practice without registration; they must be properly registered or rely on other statutory pathways.

2. Authorisation depends on following the notice procedure set by the Minister. The visiting health professional must give notice "in accordance with the procedure specified in the order under section 6" (s 5(d); s 6(3)). Failure to follow that procedure means the authorisation does not operate (s 12(2)). The precise content of the notice procedure is not in the primary Act; it will be set out in the Minister’s order and is therefore a procedural condition that can be dispositive.

3. Exemptions are conditional and limited in time. Authorisations operate only during the exemption period specified in the Minister’s order and only while the visiting health professional complies with the Act, the regulations and any conditions (s 6(3); s 12(1)-(2)). If a visiting professional continues to see patients outside the exemption period, they will not be protected by the Act.

4. Scope is defined by equivalence to registered practitioners. Section 8(1) restricts visiting professionals to providing services that may lawfully be provided in WA by a registered health professional of the like profession. Determining "like profession" and the exact lawful scope in WA can be complex and requires mapping the visiting professional’s competence to local scopes of practice. Misalignment could expose a visiting professional to criminal liability if they exceed the scope in practice.

5. Medicines supply requires dual preconditions. The Minister may authorise suppliers under s 9(1) only if the supplier is otherwise authorised under the Medicines and Poisons Act 2014 to supply the medicine to a registered health professional of the like profession, and the Minister is satisfied adequate arrangements exist to prevent misuse (s 9(2)(a)-(b)). The supplier must therefore check both the Medicines and Poisons Act authorisation and the terms of the ministerial order. A supplier who dispenses in error could face liability under the Medicines and Poisons Act if the ministerial preconditions were not met.

6. Complaints and disciplinary routes are curtailed. Section 13(1) prevents complaints about visiting health professionals under the Health and Disability Services (Complaints) Act 1995 and prevents disciplinary action under Health Registration Acts. This means an ordinary patient complaint process and professional disciplinary procedures will not be available against visiting health professionals in respect of acts done while authorised under the Act, possibly limiting consumer remedies to civil claims or criminal prosecution where applicable. This is a significant change to expected accountability mechanisms during the exemption period.

7. Exemptions do not remove criminal liability outside authorised acts. The Act’s exemptions apply only to acts done in accordance with the Act (s 11(1)). Criminal or civil liability may still attach where a visiting professional acts outside the authorised services, fails to comply with conditions, or commits offences under other statutes. Section 13(2) explicitly preserves proceedings for offences.

8. Regulation can override ministerial conditions. Section 8(6) provides that to the extent of any inconsistency between a regulation and a condition imposed under s 8(3), the regulation prevails. This creates a potential source of legal complexity where an order imposes one condition but a later regulation differs.

9. Ministerial power to exclude persons. Section 14 allows the Minister to declare that the Act or a specified provision does not apply to a particular person or class. This is an instrument of discretion that event organisers must check to confirm whether any visiting professional is excluded from authorisation despite otherwise meeting the statutory definition.

10. Record of amendments and changed professions. The list of amendments in the compilation table shows that the list of professions in the definition of "health care services" and cross‑references have changed over time (s 3(1); compilation table). Practitioners should verify the current definition in the consolidated statute and any relevant orders to ensure that a specific profession is covered.

11. The Act does not authorise registered practitioners to operate outside their registration. Section 15 affirms the Act does not prejudice or affect the lawful occupation or trade of any registered person, but a registered person must still be registered and cannot rely on the visiting health professional route. The Act does not create a relaxation option for registered locals.

12. Deletions in the text. The statute contains an editorial note that subsection 11(c) has been deleted. Practitioners should consult the consolidated, current statute and the Gazette orders to see any historical changes that may affect prior practices or interpretations.

These "gotchas" are concrete statutory traps for event organisers, visiting practitioners, suppliers and regulators, because the Act delegates material details to ministerial orders and regulations, makes approvals contingent on procedural compliance, limits ordinary complaint and disciplinary paths, and ties medicines and radiation interactions to other statutory authorisations.

This section translates the Act’s statutory mechanics into a practical compliance checklist for event organisers, visiting health professionals, and suppliers. It assumes orders and regulations exist for the event; practitioners must consult the specific ministerial order published in the Gazette for precise procedural requirements (s 6(1)-(3); s 3(2)).

For event organisers

• Liaise with the Minister or relevant department early. The Minister must declare the event a special event by order published in the Gazette (s 6(1)). Organisers should engage early to ensure the event qualifies under the Minister’s criteria, and that the exemption period matches operational needs (s 6(2)-(4)).

• Obtain and circulate the order. Secure the Minister’s order(s) declaring the event special and specifying the exemption period(s) and the notice procedure (s 6(3)). Circulate the order’s requirements to visiting professionals, suppliers and local clinical leads.

• Ensure appropriate arrangements for medicines and radiation. If medicines are to be supplied or radiation services requested, ensure the Minister has been satisfied that adequate arrangements exist to restrict medicine use to authorised services (s 9(2)(b)), and that any licence holders are aware of conditions under s 10. Document logistics, chain of custody, storage, and supervision arrangements.

For visiting health professionals

• Confirm eligibility under s 5. The visiting professional must be a resident of another country, engaged to provide services to a visitor, not be registered in WA, and have given notice per the order (s 5(a)-(d)). Australian residents cannot be visiting health professionals under the Act.

• Follow the notice procedure exactly. The authorisation only operates if notice is given in accordance with the Minister’s order (s 5(d); s 6(3)). Keep copies and proof of submission. Non‑compliance removes the statutory protection (s 12(2)).

• Limit practice to lawful scope. Provide only the health care services that a registered health professional of the like profession may lawfully provide in WA (s 8(1)). Review the local scope of practice and any orders imposing further conditions or exemptions (s 8(3)-(4)).

• Medicines and documentation. Do not administer, possess, prescribe or supply medicines except as a registered professional of the like profession could, unless there is a ministerial authorisation and the medicine is lawfully imported or obtained in Australia (s 8(2); s 11(1)(b)(i)-(ii); s 9). Keep records proving lawful importation or acquisition and compliance with any supply conditions.

• Radiation requests. Only request licensed radiation services if the order under s 6 authorises visiting health professionals to make such requests (s 10(1)-(3)).

• Maintain compliance with orders and regulations. The statutory protection is expressly conditional on compliance with this Act, the regulations and any conditions (s 12(2)). Keep contemporaneous records showing compliance.

• Insurance and contracts. While the Act does not address insurance, visiting professionals should ensure appropriate indemnity cover for work in WA, and clarify contractual responsibilities with organisers. The Act does not modify civil liability rules; the exemption from offences is statutory and conditional.

For suppliers and pharmacies

• Check statutory authorisation in s 9(2)(a). The Minister must be satisfied the supplier is authorised under the Medicines and Poisons Act 2014 to supply the medicine to a registered professional of the like profession (s 9(2)(a)). Confirm your licence status under the Medicines and Poisons Act before complying.

• Verify ministerial order conditions. If the order authorises supply to visiting health professionals, ensure you comply with any conditions in the order and maintain required records (s 9(3); s 11(3)-(4A)).

• Maintain chain of custody and use‑limitation arrangements. The Minister must be satisfied that adequate arrangements exist to ensure medicines are only used in connection with authorised health services (s 9(2)(b)). Implement, document and retain evidence of these arrangements.

• Be cautious about dispensing. If in any doubt about whether a visiting professional is authorised at the time of supply, do not dispense. The statutory exemptions apply only to compliant acts.

For regulators and complaints bodies

• Note the limits on complaints. The Act excludes complaints under the Health and Disability Services (Complaints) Act 1995 and disciplinary action under Health Registration Acts in respect of visiting health professionals acting in accordance with the Act (s 13(1)). Regulators should update guidance and triage processes to reflect that administrative complaint routes may not apply to visiting professionals during the exemption.

• Preserve criminal and civil options. Criminal prosecutions and other proceedings for offences remain available (s 13(2)). Where conduct appears to fall outside authorised acts, action through criminal, civil or other statutory enforcement routes remains possible.

Record keeping and audit readiness

• Retain all relevant documentary evidence. Orders, notices, proof of foreign residency, engagement contracts showing the person is engaged to provide services to a visitor, evidence of lawful import/acquisition of medicines, and records demonstrating compliance with ministerial and regulatory conditions should be kept for an appropriate retention period.

• Prepare to show compliance during the exemption period. Since authorisations operate only during the exemption period and contingent on compliance (s 12(1)-(2)), being able to demonstrate compliance will be critical in the event of regulatory inquiry or prosecution.

Check for exclusions and ministerial orders

• Ensure no Ministerial exclusion applies. Section 14 allows the Minister to declare the Act does not apply to specific persons or classes. Confirm the visiting professional is not excluded by order.

Regulatory monitoring and reviews

• Expect regulation and orders to evolve. The Act empowers the Governor to make regulations and the Minister to issue orders. Monitor the Gazette and departmental communications for changes, given that regulation can prevail over ministerial conditions if inconsistent (s 8(6)).

In all cases, stakeholders should examine the specific ministerial order(s) applying to the special event, and any regulations made under the Act, because the Act’s permissions and requirements are often expressed and operationalised through those instruments (s 6(3); s 3(2); s 16). Legal advice should be sought for complex cases, particularly those involving medicines, controlled substances, or radiation, or where the mapping between a visiting professional’s competence and the local scope of practice of a registered professional is unclear.
