The Bill introduces and relies on a small set of core legal concepts. Each concept is defined or operationalised in the text; below, the Bill text itself is quoted or cited as the authority.

• Disqualified person. The National Law inserts a definition: "disqualified person means a person (a) whose registration has been cancelled by a responsible tribunal; or (b) who has been disqualified by a responsible tribunal from applying for registration, or being registered, in a health profession" (National Law s 5 insertion; see clause 16 of the Bill).

• Reinstatement order. The National Law defines "reinstatement order" as "an order of a responsible tribunal that a disqualified person is eligible to apply to a National Board for registration under Part 7" (National Law s 5 insertion). The new reinstatement procedure is set out in new National Law part 8, division 12A (ss 198A-198E).

• Reinstatement application and tribunal role. A disqualified person may apply to the responsible tribunal that made the disqualification to seek a reinstatement order (s 198A(1)-(2)). The tribunal must determine whether, at the time of the hearing, making a reinstatement order is "appropriate" and may consider fitness to hold registration and capacity to practise competently and safely (s 198B(1)-(2)). The tribunal must take into account complaints or notifications made about the person even if those were made before the disqualifying decision (s 198B(3)). The tribunal may dismiss the application or grant the order and may impose conditions and set review periods for conditions (s 198E).

• Restriction on applying for registration. The National Law now provides that a disqualified person cannot apply for registration under the Law unless a responsible tribunal has made a reinstatement order in relation to the disqualified person (new s 77A). Responsible tribunals may impose a period during which a person may not apply to a responsible tribunal for a reinstatement order (s 196(4)(aa) as amended; s 198E(5)-(6)).

• Register entries for sexual misconduct decisions. The National Law requires a National Board to record "additional information" in the National Register or Specialists Register where a tribunal decided a practitioner behaved in a way constituting professional misconduct and a basis for the decision was sexual misconduct (s 225A(1)). The content required is listed in s 225B and includes tribunal date, tribunal name, a statement that professional misconduct included sexual misconduct, and any sanctions relating to sexual misconduct (s 225B(1)).

• Protected action. The Health Ombudsman Act defines "protected action" in the reprisal context broadly to include making a health service complaint in good faith; making a notification under the National Law parts referenced; and giving information, documents or assistance in investigations or other processes under the Act or the National Law (amended s 261(7)). The National Law contains a similar definition tied to making notifications under the Law or providing assistance in investigations (new s 237A(2)).

• Reprisal and criminal liability. The Health Ombudsman Act expands conduct that constitutes a reprisal to include threats or intimidation to dissuade protected action, and dismissal or refusal to employ a person because of protected action (amended s 261). The Bill raises the maximum penalty for taking a reprisal in the Health Ombudsman Act to 375 penalty units or two years imprisonment for an individual, and 750 penalty units for a corporation (s 262). The National Law imposes civil pecuniary penalties for comparable reprisal conduct (s 237A: $60,000 individual, $120,000 corporate).

• Non-disclosure agreements. Both the Health Ombudsman Act and the National Law render NDA provisions void to the extent they prevent or limit protected actions (Health Ombudsman Act new s 263A(1); National Law new s 237B(1)). Both Acts further require certain "relevant persons" (employers, health service providers and practitioners in defined categories) not to enter NDAs unless the agreement clearly states it does not limit the protected actions, with statutory penalties for contravention (Health Ombudsman Act s 263A(2) penalties; National Law s 237B(2) penalties). Each Act defines "non-disclosure agreement" and "relevant person" for its context (s 263A(3) and s 237B(3)).

• Tribunal assistance and QCAT jurisdiction adjustments. The Health Ombudsman Act clarifies that QCAT may hear applications by disqualified persons for reinstatement orders under the National Law and adjusts related QCAT constitution provisions and assessor assistance rules (amendments to ss 94-97, insertion of s 125A and amendments to s 126).

These concepts are implemented via statutory duty and record keeping obligations, the conferral of new tribunal powers, changes to criminal and pecuniary penalties, and the creation of procedural rights to apply for reinstatement. The Bill is self-contained in defining its principal terms and how they interact across the two Acts and the National Law.

The Bill lists categories of persons and bodies that will have new duties, rights or exposure to sanctions. The text itself sets the groups and roles; they include:

• Disqualified persons. Persons whose registration has been cancelled by a responsible tribunal or who have been disqualified by a responsible tribunal from applying for registration or being registered in a health profession (National Law s 5 inserted definition; see clause 16). Disqualified persons are given a statutory right to apply for a reinstatement order (new s 198A) but are barred from applying for registration unless a reinstatement order is made (new s 77A).

• Responsible tribunals. The tribunals that hear professional misconduct and registration matters will now hear reinstatement applications and may impose restrictions on applying for reinstatement orders (new part 8, div 12A; amendments to s 196 include new power to impose a period during which the person may not apply to a responsible tribunal for a reinstatement order (s 196(4)(aa))).

• National Boards. Boards maintaining National Registers and Specialists Registers must record additional information where a tribunal decision involves sexual misconduct (ss 225A-225B). Boards are required to include specified statements and, if applicable, copies or links to published decisions (s 225B). Boards must also remove information if an appellate process stays, overturns or modifies the tribunal decision (s 225A(5)-(6)).

• Registered health practitioners and former registered practitioners. These persons are the subjects of the register-recording rules (ss 225A-225B) and the non-disclosure agreement prohibitions where applicable (National Law s 237B(3)).

• Employers, former employers, health service providers and similar relevant persons. The Health Ombudsman Act defines "relevant person" to include employers and health service providers and imposes obligations not to enter NDAs that limit protected actions, unless the NDA expressly states the carve-out (s 263A(2)-(3)). The National Law frames "relevant person" in s 237B(3) as employers, health service providers whose services are provided by registered practitioners, or registered practitioners themselves. Those persons face specified penalties if they enter invalid NDAs or fail to include required wording.

• Health Ombudsman, director of proceedings and investigators. The Health Ombudsman Act expands definitions of protected action that cover making a formal complaint, providing information or assistance in investigations, and the Act raises penalties for reprisals (amended ss 261-262). The National Law amendments include a corresponding protection and carve-out for notifications made under the Law (s 237A-237B).

• QCAT. The Queensland Civil and Administrative Tribunal is given express jurisdiction to hear reinstatement applications and to make orders provided for by the National Law (Health Ombudsman Act ss 94(2)(aa), 96(2A), 97(2)(d) and new s 125A which applies assessor assistance rules to reinstatement applications).

• Courts and appeal bodies. The register-recording rules expressly require removal of register entries where a tribunal decision is stayed or overturned on appeal (s 225A(5)). The National Law Act amendments also adjust which bodies are parties to reinstatement proceedings by reference to whether the decision that created the disqualification was referred by a National Board or by the director of proceedings on behalf of the Health Ombudsman (National Law Act s 51A).

• Corporations and officers. Increased penalties apply to corporations in reprisal contexts (Health Ombudsman Act s 262), and the National Law sets pecuniary penalties for reprisals and NDA contraventions as against bodies corporate (s 237A, s 237B).

In short, the Bill targets the regulated cohort (registered practitioners and former registrants), the regulatory institutions (National Boards, responsible tribunals, Health Ombudsman, QCAT), and employers and service providers who use confidentiality instruments. The statutory audience for compliance duties is explicitly named in the relevant sections that define "relevant person", "non-disclosure agreement", and "protected action".

The Bill creates explicit statutory duties and rights, many tied to behaviour around complaints, notifications and record-keeping. Key duties and rights are:

Duties

• National Boards must record additional information about tribunal decisions involving sexual misconduct: When satisfied the tribunal decided professional misconduct and that sexual misconduct was a basis for the decision, the Board "must record the information (the additional information) mentioned in section 225B" in the National Register or Specialists Register (s 225A(4)). The Board must not record, or must remove, the information where the tribunal decision is stayed, overturned or modified on appeal so that the section no longer applies (s 225A(5)-(6)). Section 225B sets the form and content of the information to be recorded.

• Relevant persons must not enter into NDAs that prevent or limit protected actions: Under the Health Ombudsman Act (s 263A(2)) and the National Law (s 237B(2)), a relevant person must not enter into an NDA unless the agreement "sets out, clearly and in writing, that the agreement does not limit a person from" making complaints/notifications or providing information or assistance in investigations. Both provisions attach penalties for contravention (Health Ombudsman Act s 263A(2) , 30 penalty units individual, 60 units corporate; National Law s 237B(2) , $5,000 individual, $10,000 corporate).

• Persons must not take specified reprisal conduct: The Health Ombudsman Act adds prohibitions on threats or intimidation to deter protected action and on dismissal or refusal to employ because of protected action (amended s 261(2A)-(3) renumbering). The National Law includes analogous prohibitions and civil pecuniary penalties (new s 237A).

Rights

• Disqualified persons have a statutory right to apply for a reinstatement order: A disqualified person may apply to "a responsible tribunal" for a reinstatement order (s 198A(1)). The Bill also specifies which responsible tribunal is "appropriate": the tribunal of the participating jurisdiction in which the disqualifying decision was made (s 198A(2)).

• Persons making complaints or notifications retain the right to make those communications and give information in investigations despite NDA provisions: Both Acts expressly render NDA clauses void to the extent they limit protected actions, preserving the right to make health service complaints, to notify under the National Law, and to give information or assistance in investigations (Health Ombudsman Act s 263A(1); National Law s 237B(1)).

• Tribunals have procedural discretion: Responsible tribunals have explicit discretion to dismiss or grant reinstatement orders and to decide the conditions to attach to registration if a National Board re-registers the person (s 198E(1)-(4)). Tribunals may impose a period during which the disqualified person cannot apply for reinstatement (s 198E(5)) and may, in the Health Ombudsman Act context, disqualify, restrict, or prohibit practitioners from applying for registration or using titles (amendment to s 107(4) inserting subparagraphs including s 107(4)(aa) restriction on applying to QCAT for a reinstatement order).

Procedural and information duties

• Boards must follow s 226(1) and (2) as applicable to the register-recording requirement and must ensure additional information remains unless authorised to be removed (s 225A(7)-(8)).

• In the Health Ombudsman Act, assessors must assist tribunals in proceedings that relate to reinstatement applications, with two assessors chosen by the principal registrar for those proceedings (amendments to s 126).

Notification, appeal and removal mechanics

• If a tribunal decision is stayed or overturned on appeal, the additional register information must not be recorded or must be removed (s 225A(5)). The National Law also specifies that, to the extent recording the information would contravene a court order, the Board must not include or must remove the information (s 225A(6)).

Enforcement duties

• The Health Ombudsman Act and National Law prescribe penalties for breach of the NDA-entering duty, for reprisals and for other contraventions. The Bill raises maximum penalties in the Health Ombudsman Act for reprisal to include imprisonment for individuals (s 262) and sets monetary penalties in the National Law for reprisals and NDA contraventions (ss 237A-237B).

These duties and rights collectively change how regulators, employers, and practitioners must handle complaints, confidentiality, and re-entry into regulated practice. The text is prescriptive about who must do what, which tribunal will decide which applications, and the form of register entries when sexual misconduct forms part of a tribunal's misconduct findings.

The Bill expands and clarifies enforcement mechanisms and prescribes a range of penalties. The statutory text provides the sources and caps of penalties:

• Health Ombudsman Act reprisal penalties. Section 262 of the Health Ombudsman Act is amended to prescribe the maximum penalties for taking a reprisal: for an individual, 375 penalty units or two years imprisonment; for a corporation, 750 penalty units (see s 11 of Part 2 amendments). The Act also broadens the conduct that constitutes a reprisal to include threats or intimidation to deter protected actions and dismissal or refusal to employ because of protected actions (amended s 261).

• Health Ombudsman Act NDA penalties. The Health Ombudsman Act now makes it an offence for a "relevant person" to enter into a non-disclosure agreement unless it expressly disclaims any limitation on protected actions. Contravention attracts penalties of 30 penalty units for an individual and 60 penalty units for a corporation (new s 263A(2)).

• National Law reprisal penalties. The National Law inserts s 237A, which makes it an offence to use threats or intimidation to discourage notifications, to dismiss or refuse to employ because of a notification, or to subject a person to other detriment or reprisal because of a notification or assistance. The maximum penalties are specified as $60,000 for an individual and $120,000 for a body corporate (s 237A(1)).

• National Law NDA penalties. Section 237B(2) prescribes maximum penalties for entering an NDA without the required carve-out: $5,000 for an individual and $10,000 for a body corporate.

• Enforcement pathways. The Bill does not create a new enforcement agency. Enforcement is through existing institutions identified in the text. For reprisal conduct under the Health Ombudsman Act, criminal liability is created (s 262), which implies prosecution mechanisms under the Act. The National Law specifies civil pecuniary penalties for reprisals and NDA contraventions (ss 237A-237B) and leaves enforcement to the mechanisms available under the National Law (for example, power of National Boards or courts to impose penalties), though the Bill text itself does not set out a new enforcement authority for those specific penalties.

• Tribunal and administrative orders. Tribunals retain and gain powers with enforcement consequences: tribunals may disqualify practitioners, cancel registration, impose prohibitions or restrictions, and now impose periods during which a person may not apply for reinstatement (amendments to s 196 and new s 198E(5)). The Health Ombudsman Act expands QCAT jurisdiction to hear reinstatement applications (s 94(2)(aa)) and for QCAT to make orders arising from National Law matters (s 96(2A)). Tribunals may also impose costs orders for reinstatement proceedings in the revised National Law (new s 198D inserted by Part 3), but Part 4 of the Bill contains an amendment in the National Law Act that appears to omit s 198D in the "National Law provisions" (see Part 4, s 51B). This interplay requires careful reading when determining whether costs orders are available in particular participating jurisdictions (see the "Gotchas" section below and the transitional provisions).

• Removal of register entries upon successful appeal. The National Law requires Boards not to include, or to remove, additional register information where the tribunal decision is stayed or overturned, or modified to the extent the section no longer applies (s 225A(5)-(6)). This provides an automatic corrective mechanism tied to appellate outcomes rather than a separate remedial application.

The Bill therefore introduces a mix of criminal (Health Ombudsman Act reprisal with imprisonment exposure), statutory pecuniary penalties (both Acts), and administrative enforcement (tribunal orders, register entries and removals). The specific enforcement agencies and procedural routes for civil penalties under the National Law are not restated in the Bill text; enforcement will rely on the existing enforcement architecture of the Health Ombudsman Act and the National Law.

The Bill directly amends three instruments and expresses multiple cross-references. The text itself locates the new provisions within the broader national regulatory architecture and contains transitional and consequential provisions to govern interactions.

• Interaction between Health Ombudsman Act and National Law. The Bill aligns protected-action definitions across both Acts. The Health Ombudsman Act's reprisal and NDA provisions (new ss 261-263A) reference and protect actions that include notifications under the National Law (Health Ombudsman Act s 261(7)(a)(ii) mentions "a notification under the National Law, part 8, division 2 or 3"). Conversely, the National Law's new protections and NDA rules (ss 237A-237B) refer to notifications made under the National Law or assistance provided under this Law (s 237A(2), s 237B(1)). This cross-referencing establishes a symmetrical protection environment for information flows between the two regimes.

• Register entries and Health Ombudsman decisions. The National Law's register-entry regime (ss 225A-225B) is amended by the National Law Act amendments to capture disciplinary decisions that arise from both National Board referrals and matters referred by the director of proceedings on behalf of the Health Ombudsman (National Law Act s 55A inserts "or the Health Ombudsman Act 2013, section 107(4)(a)" into s 225B(2)(a) and makes related insertions). This change makes register entries responsive to tribunal decisions regardless of whether the matter originated from a National Board referral or a Health Ombudsman referral.

• QCAT and tribunal jurisdiction. The Health Ombudsman Act amendments adjust QCAT jurisdiction (ss 94-97) to ensure QCAT can hear reinstatement applications made under the National Law. The Bill also inserts a transitional provision in the Health Ombudsman Act (part 21, div 4 s 320I) to make the NDA provision (s 263A) apply to NDAs entered before or after commencement and to issues that occurred before or after commencement. The National Law contains a similar transitional provision (part 16 ss 327-329, including s 329 for s 237B).

• National Law Act amendments that are consequential. Part 4 of the Bill amends the Health Practitioner Regulation National Law Act 2009 (the statutory vehicle for the National Law in Queensland). These amendments specify which body is a party to reinstatement proceedings (s 51A clarifies s 198C(b) by distinguishing whether the disqualification arose from a National Board referral or from a Health Ombudsman referral) and remove or alter certain National Law provisions in the "National Law provisions" contained in the Act. For example, s 51B omits s 198D (Costs) as a National Law provision. Later, s 58 replaces s 328 (a transitional clause) with a version that clarifies how pre-commencement disqualifications to specified periods or indefinite disqualifications are treated in respect of applying for reinstatement orders.

• Precedence and conflict rules. The National Law includes an express rule that, to the extent of any inconsistency between the requirements of s 225A/225B and s 232(2), the relevant sections (s 225A/225B) prevail (s 225A(9)). This is an internal conflict-resolution mechanism governing records in the National Register.

• Transitional coverage of NDAs and disqualifications. Both Acts include transitional provisions that apply the NDA provisions to agreements entered before commencement and to issues occurring before commencement (Health Ombudsman Act s 320I; National Law s 329). The National Law's transitional provisions also clarify how existing specified-period disqualifications and indefinite disqualifications are treated with respect to eligibility to apply for reinstatement (s 328).

• Interaction with procedural rules (assessors). The Health Ombudsman Act expands s 126 so that the tribunal is assisted by assessors in proceedings relating to reinstatement orders, and requires assessors for those proceedings to be chosen from the professional panel for the relevant profession. These amendments ensure that reinstatement hearings sit within the existing assessor-assisted disciplinary process architecture.

Overall, the Bill threads the new reinstatement route, register obligations and NDA restrictions through the National Law, the Health Ombudsman Act, and the National Law Act 2009 so that protections for whistleblowing, record-keeping for sexual misconduct findings, and tribunal procedures operate together. The National Law Act adjustments serve as consequential or jurisdictional clarifications for how the National Law operates within Queensland. Users should read the three instruments (as amended) together to understand the final regulatory structure in a participating jurisdiction.

The Bill is structured in four Parts and includes a sequence of specific insertions, amendments and omissions. The textual amendments and their locations in the Bill are as follows; the Bill itself provides the authoritative sequence and numbering.

• Part 1 (Preliminary)

  • Short title and commencement by proclamation (ss 1-2).

• Part 2 (Amendment of Health Ombudsman Act 2013)

  • Amends QCAT jurisdiction to add explicit power to hear applications by disqualified persons for reinstatement orders under the National Law (amendments to s 94(2)(aa), s 96 new para 2A, s 97(2)(d); clauses 4-6).
  • Alters the orders QCAT may make and constitution rules to account for National Law reinstatement orders (s 96 insertion and renumbering; s 97 insertion).
  • Expands the list of orders a tribunal may make concerning registered health practitioners to include disqualification from applying for registration, and adds the ability to impose restrictions from applying to QCAT for a reinstatement order (s 107 amended to insert s 107(4)(aa)).
  • Inserts a new application of division section so rostered assessor assistance rules apply to proceedings concerning reinstatement applications (new s 125A before s 126).
  • Adjusts assessor rules (s 126 amended so assessors are engaged for reinstatement applications and chosen by the principal registrar).
  • Expands the reprisal definition and adds specific prohibitions on threats and dismissal; renumbers and tightens subsections of s 261 (clause 10).
  • Raises penalties for reprisal in s 262 (clause 11).
  • Inserts a non-disclosure agreements provision voiding NDA clauses that prevent protected actions and imposing an express duty on relevant persons not to enter such NDAs unless they include a clear carve-out; introduces penalties (new s 263A; clause 12).
  • Adds a transitional provision to ensure s 263A(1) applies to NDAs entered before or after commencement and to issues occurring before or after commencement (pt 21 div 4 s 320I; clause 13).
  • Inserts terms into Schedule 1 dictionary to incorporate references to "disqualified person" and "reinstatement order" (clause 14).

• Part 3 (Amendment of the Health Practitioner Regulation National Law)

  • Inserts definitions for "disqualified person" and "reinstatement order" into s 5 (clause 16).
  • Inserts new s 77A restricting disqualified persons from applying for registration unless a reinstatement order is made (clause 17).
  • Amends s 196 so that tribunals can impose a period during which the person may not apply to a responsible tribunal for a reinstatement order (s 196(4)(aa); clause 18).
  • Inserts new part 8, division 12A (ss 198A-198E) setting out the reinstatement application process, tribunal considerations, parties to proceedings, costs, and the tribunal's decision-making powers (clauses 20).
  • Inserts ss 225A and 225B requiring recording of additional information in registers for tribunal decisions involving sexual misconduct (clause 21).
  • Inserts ss 237A and 237B into the National Law protecting persons from reprisals and voiding NDAs, with penalties and definitions of "relevant person" (clause 22).
  • Adds transitional provisions in a newly inserted part 16 (ss 327-329) setting out the application of s 77A, application for reinstatement orders for persons subject to specified-period disqualifications immediately before commencement, and the application of s 237B to NDAs entered before or after commencement and to conduct occurring before or after commencement (clause 23).

• Part 4 (Amendment of Health Practitioner Regulation National Law Act 2009)

  • Adjusts parties to proceedings for reinstatement applications to distinguish whether the National Board or Health Ombudsman is the party depending on referral origin (insertion of s 51A amending National Law s 198C(b); clause 25).
  • Omits National Law provision s 198D (Costs) from the National Law provisions as set out in the National Law Act 2009 (s 51B) while Part 3 had inserted s 198D into the National Law itself (clause 25).
  • Amends s 225B via s 55A to capture tribunal decisions originating from the Health Ombudsman Act pathway and to add detail about permanent restrictions on applying for reinstatement and about the application of transitional s 328 (clause 26).
  • Inserts s 56AA to omit ss 237A and 237B from National Law provisions in the National Law Act 2009 (clause 27).
  • Replaces s 328 (Application for reinstatement order) in the National Law Act with a version clarifying treatment of pre-commencement specified-period and indefinite disqualifications (clause 58), and omits s 329 (Application of s 237B) as a National Law provision (clause 59).

Taken together, the Bill first amends the primary instruments (Health Ombudsman Act and National Law) and then makes consequential amendments to the Health Practitioner Regulation National Law Act 2009 to align how those national provisions operate within Queensland. The Bill includes renumbering, insertion and omission tasks; readers should consult the final enacted text in all three instruments to confirm the operative interrelationships after commencement.

The Bill text does not include any court decisions, cases, or litigation outcomes. There is no litigation history recorded within the Bill itself. What the Bill does provide are procedural and remedial rules that will affect litigation risk and appellate pathways going forward:

• Appellate effect on register entries. The National Law requires that additional register information recorded under s 225A must not be recorded or must be removed if, on appeal, the responsible tribunal’s decision regarding professional misconduct is stayed or overturned, or is modified such that s 225A no longer applies (s 225A(5)). This sets a statutory remedy tied directly to appellate outcomes rather than creating a new separate cause of action for removal.

• Tribunal decisions and parties. The National Law Act amendment makes clear which body is a party to reinstatement proceedings in which circumstances (s 51A). That affects which entities can litigate before a responsible tribunal in relation to reinstatement applications and ensures the director of proceedings on behalf of the Health Ombudsman is a possible party where the disqualification arose from a Health Ombudsman-originated referral.

• Tribunal discretion likely to generate litigation. The reinstatement regime gives responsible tribunals discretion to decide whether a reinstatement order is appropriate, to consider fitness and competence (s 198B), to decide conditions that may bind any re-registration, and to set review periods for conditions (s 198E(2)-(4)). Those protective and discretionary assessments can be the subject of judicial review and appeal in standard administrative law channels, though the Bill does not specify appeal routes beyond the usual statutory regime.

• Removal of costs provision in National Law provisions. The Bill inserts a costs provision for reinstatement proceedings in the National Law (s 198D) but then the National Law Act amendments include an omission of s 198D as a "National Law provision" (s 51B). This inter-instrument drafting complexity could prompt litigation over whether costs orders are available in particular jurisdictions or under particular statutory compilations until clarified by practice or judicial interpretation.

• Transitional provisions producing discrete disputes. Transitional clauses (Health Ombudsman Act s 320I; National Law pt 16 ss 327-329) govern whether certain NDAs and prior disqualifications are caught. Those transitional rules will determine whether a particular NDA entered before commencement is void to the extent described, or whether a person subject to a specified period disqualification immediately before commencement must wait until the period ends before applying for a reinstatement order. Disputes about the correct application of those transitional rules may generate litigation.

Because the Bill itself contains no cases or litigation history, practitioners and decision makers will need to monitor how tribunals, courts and administrative bodies interpret the new provisions, particularly in areas where the Bill creates new discretionary standards (appropriateness for reinstatement, the content and permanence of register entries) and where the inter-action between amendments in different instruments may create provisional uncertainty (for example, the costs provision and the National Law Act omissions).

The Bill contains drafting features and cross-instrument changes that create practical pitfalls for regulated parties, tribunals and regulators. The Bill text contains the following potential "gotchas" that require careful reading and operational adjustment:

• Reinstatement route does not equate to automatic re-registration. The Bill creates a reinstatement order that makes the disqualified person "eligible to apply to a National Board for registration under Part 7" (definition of reinstatement order). But the tribunal making a reinstatement order does not itself re-register the person. It merely removes the statutory bar to applying. Re-registration remains a National Board decision under Part 7. The Bill makes clear the tribunal may impose conditions that any re-registration must be subject to, and that those conditions must have review periods (s 198E(2)-(4)). Practically, a successful reinstatement order means a person can apply to a Board, but registration is not guaranteed.

• Disqualified persons are unequivocally barred from applying for registration absent a reinstatement order. New s 77A provides a bright-line rule: "Despite any other provision of this Law, a disqualified person cannot apply for registration under this Law unless a responsible tribunal has made a reinstatement order under this Law in relation to the disqualified person." Practitioners must check whether they are "disqualified persons" per the newly inserted definition before attempting to apply for registration.

• Permanent register entries for sexual misconduct findings unless overturned. Section 225A makes the additional information "remain on the National Register or Specialists Register permanently, unless otherwise authorised to be removed by this Law" (s 225A(8)). Only appellate success that stays, overturns or modifies the tribunal decision removes the entry (s 225A(5)). This formalises a lasting public record for a tribunal finding that includes sexual misconduct as a basis for professional misconduct.

• NDAs are partially void and entering them carries penalties. Both the Health Ombudsman Act and the National Law render NDA provisions void to the extent they prevent or limit protected actions (Health Ombudsman Act s 263A(1); National Law s 237B(1)) and create a positive duty on specified "relevant persons" not to enter into NDAs without the required clear-written carve-out (Health Ombudsman Act s 263A(2) and National Law s 237B(2)). The penalties differ across instruments, and the definition of "relevant person" also differs somewhat between Acts. Employers and providers should not assume an NDA will prevent disclosure about health-service matters or notifications.

• Overlap and inconsistency across instruments. The Bill makes parallel changes in both the Health Ombudsman Act and the National Law, and then makes consequential amendments in the National Law Act 2009. In particular, Part 3 inserts a costs power for tribunals in respect of reinstatement proceedings (s 198D) while Part 4 (National Law Act amendments) includes an omission of s 198D in "National Law provisions" (s 51B). The text therefore contains both an insertion and an omission of what appears to be the same provision depending on whether one is reading the National Law as amended (Part 3) or the National Law provisions in the 2009 Act (Part 4). Users must check the final enacted consolidation to understand the operative position in their jurisdiction.

• Transitional timing traps for people subject to specified periods. The Bill contains transitional rules that prevent persons who, immediately before commencement, were disqualified for a specified period and whose period had not yet ended from applying for reinstatement until the specified period has ended (National Law s 328(1)-(2) as replaced by Part 4). Practitioners must check whether their disqualification was specified period or indefinite and the exact timing relative to commencement to know whether s 198A is available.

• Variable penalties and enforcement pathways. The Health Ombudsman Act introduces criminal penalties for reprisals including imprisonment (s 262) while the National Law applies monetary penalties (s 237A). Because the Bill amends both regimes, parties must determine which statutory regime applies to a given act of reprisal and whether prosecution or administrative enforcement is the realistic avenue. The Bill does not create a single enforcement mechanism; it relies on existing enforcement architectures under the relevant Acts.

• Publication and privacy. Section 225B(1)(b) requires that if the tribunal decision has been published, the Board must record a copy of the decision or a link to it in the register. That obligation intersects with s 225A(6) which requires removal where inclusion would contravene a court or tribunal order. Boards must therefore reconcile public access obligations with any suppressions or orders limiting publication.

• Parties to reinstatement proceedings vary by referral origin. The National Law Act amendment (s 51A) changes who is a party to reinstatement proceedings depending on whether the disqualification resulted from a National Board referral under s 193B or from a matter referred by the director of proceedings on behalf of the Health Ombudsman under Health Ombudsman Act s 103. Practitioners must identify the origin of the disqualification to know which body will appear as the opposing party.

• Assessor selection and participation. The Health Ombudsman Act amendment to s 126 requires two assessors chosen from a professional panel for proceedings related to reinstatement applications. Registry administrators must ensure their principal registrar and assessor panels can supply assessors with the required professional mix and that assessors are available for what might be sensitive reinstatement hearings.

• Discrepancy in terminology and carve-out drafting. The Bill uses slightly different definitions and thresholds across the Health Ombudsman Act and the National Law (for example, the Health Ombudsman Act’s "non-disclosure agreement" is defined in s 263A(3); the National Law’s s 237B(3) defines it in relation to registered health practitioners). Those definitional differences can matter when determining whether a particular NDA falls within the statutory prohibition and which penalty regime applies.

Each "gotcha" arises from explicit text in the Bill. Applying the amendments requires precise identification of the relevant instrument, the timing of events relative to commencement, and whether the disqualification, NDA, or tribunal decision fits the criteria spelled out in the new sections.

The Bill creates discrete compliance obligations for several actors. Below are practical, text‑based steps and checks that affected parties should adopt to reduce statutory risk and ensure observance of the new duties. Each step refers to the Bill provisions that create the obligations.

For National Boards and registries (ss 225A-225B)

• Implement a register-update protocol to detect tribunal decisions where the tribunal decided professional misconduct and sexual misconduct was a basis for that decision (s 225A(1)-(3)). The Board’s legal or case‑management unit must be able to read tribunal decisions and determine whether sexual misconduct was a basis by necessary inference if not expressly stated (s 225A(3)(a)-(b)).

• Create templated entries that comply with s 225B(1)-(2): record date of decision, tribunal name, statement that tribunal decided professional misconduct and that it included sexual misconduct, any sanctions imposed that relate to sexual misconduct, and, if the tribunal decision has been published, include the decision or a link to it.

• Build an appellate flag. If a tribunal decision is stayed, overturned or modified on appeal so the section no longer applies, remove or refrain from entering the additional information (s 225A(5)). If a court order prohibits recording, ensure removal to the extent recording would contravene the order (s 225A(6)).

• Ensure permanence caveat management. The Board must retain the additional information "permanently" unless lawfully authorised to remove it (s 225A(8)). Establish governance for any authorised removal under the Law.

For employers, health service providers and persons entering confidentiality agreements (Health Ombudsman Act s 263A; National Law s 237B)

• Review existing NDAs and settlement agreements to identify any clause that prohibits or restricts disclosure about the "health, conduct or performance" of a health service provider or practitioner, and assess whether such clauses affect the ability to make a health service complaint, a notification under the National Law, or to provide information or assistance in investigations (Health Ombudsman Act s 263A(3) and National Law s 237B(3)).

• For future NDAs that relate to those topics, expressly include a clear written statement that the agreement "does not limit a person from" making complaints in good faith, making notifications under the National Law (where applicable), or supplying information or assistance in investigations (Health Ombudsman Act s 263A(2); National Law s 237B(2)). Failure to include this wording attracts specified penalties.

• Avoid relying on NDAs to shield matters that are covered by the protected action definitions. The Bill renders void any NDA provision that prevents or limits the protected actions (Health Ombudsman Act s 263A(1); National Law s 237B(1)).

For registered practitioners and staff

• Do not dissuade or intimidate employees, contractors or colleagues from making bona fide health service complaints or notifications under the National Law. The statutes expressly prohibit threats, intimidation and dismissal linked to protected actions (Health Ombudsman Act s 261(2A)-(3); National Law s 237A(1)).

• If you are an employer or registered practitioner entering into NDAs with staff, ensure the prescribed carve-out is included and that staff are advised of their persistent right to make protected disclosures.

For disqualified persons and their representatives

• If you are a disqualified person, confirm whether your disqualification was by cancellation or by an express disqualification from applying for registration (definition of "disqualified person"). If you wish to return to practice, you must apply for a reinstatement order to the responsible tribunal that made the disqualification decision (s 198A(1)-(2) and s 77A). Do not apply directly to a National Board for registration unless and until a reinstatement order has been made, because s 77A prevents applications by disqualified persons unless relieved by a reinstatement order.

• Prepare reinstatement applications to address the tribunal’s statutory considerations: fitness to hold registration and ability to practise competently and safely (s 198B(2)). Include material on rehabilitation, supervision arrangements, clinical governance, and any remediation or ongoing monitoring.

• Be aware of possible waiting periods imposed by tribunals: tribunals can impose a period during which the person may not apply for a reinstatement order (s 196(4)(aa); s 198E(5)). If the tribunal imposes such a period and you apply in contravention, s 198E(6) makes making an application in contravention an offence.

For responsible tribunals

• Prepare procedures for hearing reinstatement applications, including use of assessors (Health Ombudsman Act s 126 amendment). Ensure the principal registrar’s assessor selection process is able to provide two assessors from the profession panel for reinstatement applications (Health Ombudsman Act s 126(1)(c)).

• Exercise the tribunal’s discretion to consider pre- and post‑disqualification complaints or notifications (s 198B(3)) and to set conditions and review periods if granting a reinstatement order (s 198E(2)-(4)). If dismissing the application, the tribunal may impose a period during which another application cannot be made; ensure reasoning and orders are clear and compliant with the National Law.

For QCAT and registry administrators

• Update jurisdictional guidance to reflect QCAT’s explicit jurisdiction to hear reinstatement applications under the National Law (Health Ombudsman Act s 94(2)(aa)). Update forms and registries to accept reinstatement applications where appropriate and to process assessor appointments as required by the amended s 126.

For National Boards and registrars dealing with publication and privacy

• Before publishing tribunal decisions or linking decisions from registers, check for any court or tribunal orders that would make publication, or register-recording, contravene the order (s 225A(6)). Where a decision has been published, be ready to record a link or copy in the
