Health (Notification of Stimulant Induced Psychosis) Regulations 2010

The Regulations rest on a few discrete statutory concepts that determine who acts, what is collected, and how information may be used or protected.

Stimulant induced psychosis. The central concept is “stimulant induced psychosis”, defined in regulation 3 as “a psychotic episode caused by the use of a stimulant, whether or not the person experiencing the psychosis has a pre‑existing psychotic disorder.” The definition is outcome‑based: it attaches liability and reporting obligations to a diagnosis of psychosis caused by stimulant use, not to particular clinical presentations or thresholds that the Regulations itself specifies. The effect is to make any such diagnosis a condition of health for the application of Part IXA of the Health Act (regulation 4).

Stimulant. “Stimulant” is defined by an explicit list in regulation 3: amphetamine, cocaine, dexamphetamine, methylphenidate, methylamphetamine, any salts of those substances, and any preparation or admixture containing those substances. The definition therefore captures principal synthetic stimulant drugs, their salts and mixtures. The definition is self‑contained and does not invoke other scheduling or classification schemes in the Regulations themselves; it instead names substances directly.

Notified information. The Regulations define “notified information” to mean both the material in a notification under regulation 5 and information provided to the CEO under regulation 6. That means the register and disclosure prohibitions apply to two discrete streams: initial psychiatrist notifications and subsequent information provided in response to CEO requests (regulation 3).

Psychiatrist. The term “psychiatrist” is not defined within the Regulations; it is given the meaning adopted in the Mental Health Act 2014 section 4 (regulation 3). That cross‑reference limits the duty to a professional category established in separate legislation and means that the duty does not, on its face, extend to non‑psychiatrist clinicians who might diagnose a stimulant‑related psychosis in practice.

Register. The CEO must keep a Stimulant Induced Psychosis Register (regulation 7(1)). The register is required to contain all notified information for each patient who has been prescribed or supplied a stimulant under Medicines and Poisons Regulations 2016 regulation 126 in the previous six months (regulation 7(2)). The register’s form and manner are at the CEO’s discretion (regulation 7(3)). The clause therefore creates a focused dataset: notifications are collected but the register is limited to notifications concerning patients with a recent prescription or supply under the specified medicines/poisons regulation.

Non‑disclosure and exceptions. Regulation 8 prohibits disclosure of identified notified information except with written consent of the person concerned or to a medical practitioner or authorised health professional who is authorised under Medicines and Poisons Regulations 2016 regulation 126 to prescribe or supply a stimulant and who has prescribed or supplied the stimulant to the person (regulation 8(a)-(b)). The word “authorised” is used both in the definition of the exception and in the definition of “approved” (approved means approved by the CEO, regulation 3), building further administrative discretion into form, process, and permitted recipients.

Time limits. There are two 72‑hour time limits. A psychiatrist must notify the CEO within 72 hours of making the diagnosis (regulation 5(1)). A person who receives a CEO request for information must comply within 72 hours after receiving it (regulation 6(2)). The Regulations therefore impose short response windows on both clinicians and third parties.

Penalty structure. Each of the three primary offences carries the same penalty structure: a maximum fine of $1,000 and escalating minimum fines on repeated offending (first $100, second $200, third or subsequent $500) (regulations 5(1), 6(2), 8). The approach is statutory monetary fines only; no custodial penalties are provided in these Regulations.

CEO discretion. Multiple provisions vest choice or control in the CEO: approval of forms (regulation 3 “approved”), written requests under regulation 6(1) are discretionary (CEO “may” request), and the register’s form and manner are “determined by the CEO” (regulation 7(3)). The CEO therefore plays the central administrative and gatekeeping role in implementation.

Cross‑legislative references. The Regulations operate by cross‑reference: they make a condition of health for the purposes of Part IXA of the Health Act (regulation 4), borrow the definition of psychiatrist from the Mental Health Act 2014 (regulation 3), and limit the register to patients prescribed or supplied a stimulant under Medicines and Poisons Regulations 2016 regulation 126 (regulation 7(2)). The Regulations are therefore tightly connected to other legislative instruments.

Listed by role and concrete statutory effect, the Regulations affect the following actors.

Psychiatrists. Psychiatrists who diagnose stimulant induced psychosis have an immediate statutory duty: notify the CEO within 72 hours in an approved form that includes particular identifying and diagnostic details (regulation 5(1)-(2)). The duty attaches at the moment of diagnosis and is enforceable by a monetary penalty structure set out in the same provision. Because “psychiatrist” is defined by reference to the Mental Health Act 2014 s 4, the duty’s scope tracks that definition rather than a general medical classification (regulation 3).

Patients diagnosed with stimulant induced psychosis. Individuals diagnosed with stimulant induced psychosis are the subjects of notifications and of entries on the Stimulant Induced Psychosis Register where they have been prescribed or supplied a stimulant under Medicines and Poisons Regulations 2016 regulation 126 in the previous six months (regulation 7(2)). The Regulations give patients a role through their capacity to give written consent to disclosure of their notified information (regulation 8(a)). The Regulations do not create an express private right or remedy for patients; they specify how notified information is to be treated and the criminal sanctions for non‑compliance by those with statutory obligations.

Persons who hold information relevant to the CEO’s objectives. The CEO may, upon receiving a notification and forming a reasonable belief that a person has information that will assist achieving the objects of Part IXA with respect to the diagnosis, request that person provide the information in writing; the recipient must comply within 72 hours (regulation 6(1)-(2)). This captures family members, other health professionals, pharmacists, treating practitioners, or third parties if the CEO reasonably believes they hold relevant information. The Regulations create an obligation backed by fines for non‑compliance and a statutory defence if the person did not, at the relevant time, have the information (regulation 6(3)).

The CEO. The CEO is the central decision‑maker and repository. The CEO receives notifications, may issue written information requests on reasonable grounds (regulation 6(1)), keeps the register (regulation 7(1)-(3)), approves forms (definition of “approved” in regulation 3) and determines the register’s manner and form (regulation 7(3)). The CEO therefore decides administrative form, exercises gatekeeping discretion over follow‑up inquiries, and determines the structure and storage of the dataset created.

Medical practitioners and authorised health professionals who prescribe or supply stimulants under Medicines and Poisons Regulations 2016 reg 126. The disclosure exception in regulation 8(b) permits persons with access to notified information to disclose it to a medical practitioner or authorised health professional who is authorised under reg 126 to prescribe or supply a stimulant for treatment of the person to whom the information relates, and who has in fact prescribed or supplied the stimulant to that person. That creates a permitted disclosure pathway to prescribers/suppliers for continuity of care.

Persons who, in the course of their duty, have access to notified information. Regulation 8 imposes an ongoing non‑disclosure obligation on any person who, in the course of their duty, has access to notified information from which the identity of the subject is apparent or can be reasonably ascertained. The prohibition applies broadly to anyone with access in the course of their duty, this can include administrative staff, public health officers, other clinicians, and contracted agents, subject to the statutory exceptions.

Third parties and the public. The Regulations do not create a public disclosure or reporting obligation beyond the notified information going to the CEO and possibly into the register; they also impose strict non‑disclosure rules. The practical effect is to restrict wider dissemination of identifying information to consented disclosures and the single permitted healthcare exception in regulation 8(b).

Administrators and compliance units. Employers of psychiatrists and persons who might be requested to provide information must establish processes to ensure the 72‑hour timelines and use of approved forms are met, and to handle the confidentiality rules. The Regulations therefore implicate organisational compliance functions, recordkeeping, and legal advisers advising on patient confidentiality and statutory obligations.

Regulatory linkages. Because the register is limited to those prescribed or supplied stimulants under Medicines and Poisons Regulations 2016 regulation 126 in the previous six months (regulation 7(2)), pharmacists, prescribers, and dispensers who operate under reg 126 are indirectly affected, both as potential recipients of permitted disclosures and as part of the population whose recent prescriptions determine register scope.

Who pays. The Regulations place compliance costs and potential fines on psychiatrists (notification), on parties who receive a CEO request (compliance with information requests), and on persons with duty‑access who might disclose information (disclosure offences). The CEO and departmental budget bear costs of maintaining the register and issuing requests. The Regulations do not provide for reimbursement of reporting costs or administrative overheads.

This section sets out the concrete statutory duties and rights created by the Regulations and the operational choices embedded in them.

Duties on psychiatrists to notify. Regulation 5(1) imposes a duty on a psychiatrist who makes a diagnosis of stimulant induced psychosis to notify the CEO within 72 hours. The notice must be in an “approved form” and include specified identity and diagnostic details (regulation 5(2)). The statutory duty is time‑bounded (72 hours) and form‑bound (approved form). The penalty for non‑compliance is a monetary fine structure (regulation 5(1)).

Duty to respond to CEO information requests. Regulation 6(1)-(2) grants the CEO the power to make a written request for information where a notification has been made and the CEO reasonably believes a person has helpful information. The recipient must comply within 72 hours after receiving the request; failure attracts the same fine structure as the notification offence (regulation 6(2)). The Regulations provide a statutory defence if the person proves they did not have the requested information at the relevant time (regulation 6(3)), which shifts the evidential burden to the person in defending a prosecution.

Content and form duties. Notification must include: full name and address of the patient; sex and date of birth; full diagnostic details including the stimulant involved, if known; and the notifying psychiatrist’s full name, address and telephone number (regulation 5(2)). The notice must be in an “approved form”, i.e., approved by the CEO (regulation 3). The CEO therefore controls the template and the specific administrative interface used.

Register keeping duty. Regulation 7(1)-(3) requires the CEO to keep the Stimulant Induced Psychosis Register and to include in it “all notified information” for each patient who has been prescribed or supplied a stimulant under Medicines and Poisons Regulations 2016 regulation 126 in the previous six months. The CEO determines the manner and form of keeping the register (regulation 7(3)). This is a positive duty on the CEO to maintain a dataset; the scope clause in regulation 7(2) narrows the register’s contents to a subset of notified patients.

Confidentiality duty and permitted disclosures. Regulation 8 imposes a non‑disclosure obligation on any person who, in the course of their duty, has access to notified information from which a person’s identity is apparent or reasonably ascertainable. The prohibition is subject to two exceptions: written consent of the person to whom the information relates (regulation 8(a)) and disclosure to a medical practitioner or authorised health professional who is authorised under Medicines and Poisons Regulations 2016 regulation 126 to prescribe or supply the stimulant and who has prescribed or supplied it to the person (regulation 8(b)(i)-(ii)). The exception is tightly framed: it requires both authorisation under the relevant medicines/poisons regulation and that the practitioner has in fact prescribed or supplied the stimulant to the person.

Rights of recipients and procedural protections. The Regulations provide one explicit defence: a person charged under regulation 6(2) for failure to comply with a CEO information request can raise the defence that the person did not have the requested information at the relevant time (regulation 6(3)). There are no other procedural protections or appeal mechanisms specified in the Regulations themselves for either notifications or register entries; the Regulations do not on their face create a right for a patient to access the register, to correct entries, or to appeal inclusion. Questions of review, access or correction would therefore depend on other legislation or administrative policy, which the Regulations do not address.

CEO discretion and administrative rights. The CEO controls forms (definition of “approved”), may choose to make written requests for information only where the CEO believes on reasonable grounds that a person holds relevant information (regulation 6(1)), and determines the register’s manner and form (regulation 7(3)). The CEO therefore has broad administrative scope for operational design, including data structures, retention, access controls and processes for handling consent and permitted disclosures.

Temporal duties. The Regulations impose short deadlines: notifications and compliance with CEO information requests must occur within 72 hours of the triggering event (regulations 5(1) and 6(2)). These short windows create operational urgency for notifyers and for persons receiving requests.

Penalty rights and liabilities. The Regulations specify criminal sanctions in the form of monetary fines with minimums that rise on repeated offence. That establishes a predictable liability regime rather than an open discretionary penalty. The maximum fine for each category is $1,000, with the statutorily prescribed minima described in regulations 5(1), 6(2) and 8.

Interlocking obligations. The interaction between notification duties, the CEO’s power to request further information, and the confidentiality constraints means that a notifying psychiatrist may generate an expectation of follow‑up from the CEO; persons who later receive a request must balance the statutory duty to provide information against their duties of confidentiality, subject to the narrow exceptions in regulation 8. The Regulations therefore create an operational chain of obligations that rely on careful handling of identity‑bearing information.

The Regulations set a simple, uniform enforcement architecture: monetary fines for three statutory offences, a specific procedural defence for non‑possession of requested information, and administrative discretion for the CEO to call for further information and to keep the register.

Penalty quantum and structure. Each of the following offences carries the same statutory penalty structure: a maximum fine of $1,000 and escalating statutory minimum fines for repeated offending, first offence $100, second $200, third and subsequent $500 (regulations 5(1), 6(2), 8). The three offence categories to which this structure applies are: failure by a psychiatrist to notify (regulation 5(1)); failure by a person to comply with a CEO written information request (regulation 6(2)); and unlawful disclosure by a person with access to notified information (regulation 8). The Regulations therefore use only monetary penalties, with upward step‑changes for recidivism.

Enforcement agents and mechanisms. The Regulations themselves do not specify which body prosecutes or enforces the fines, nor do they set out citation, notice to offender, or enforcement procedure. They instead establish the substantive offences and penalties. Enforcement will therefore proceed through the usual administrative and criminal enforcement channels applicable to fines created under the Health (Miscellaneous Provisions) Act 1911 and Western Australian regulatory practice; the Regulations do not identify a separate enforcement agency or novel enforcement powers.

Procedural defence. Regulation 6(3) provides an explicit statutory defence to a prosecution for failure to comply with a CEO request: it is a defence if the person proves they did not have at the relevant time the information requested. That places an evidential burden on the defendant in such prosecutions to establish non‑possession; the Regulations do not provide analogous defences for notification or disclosure offences.

Limits on enforcement reach. The fines are modest by regulatory penalty standards (maximum $1,000). The Regulations do not provide for higher civil penalties, injunctions, reporting bans, or publication orders, nor for administrative suspension or professional disciplinary action connected to non‑compliance. There is no express power in these Regulations for the CEO to vary notification obligations, to impose administrative penalties, or to compel production by sanction other than criminal prosecution. The CEO’s primary administrative tool is the written request under regulation 6(1), backed by the 72‑hour compliance requirement.

Timing of offences. The offences are triggered by defined acts or omissions within specified windows: the failure to notify within 72 hours of diagnosis (regulation 5(1)); failure to comply within 72 hours after receipt of a CEO request (regulation 6(2)); and disclosure by a person who in the course of their duty has access to notified information which identifies a person, except in flagged circumstances (regulation 8). The tight timeframes can affect the practical enforceability of offences; late notifications, delayed compliance, or inadvertent disclosures may still attract the statutory penalties.

Confidentiality breach scope. Regulation 8 creates an offence for disclosure by persons who “in the course of the person’s duty, has access to any notified information from which the identity of the person to whom the information relates is apparent or can reasonably be ascertained.” That language covers a wide range of personnel, clinical, administrative, contract staff,so enforcement could be directed at individuals rather than institutions. The Regulations do not specify whether employers or agencies can be charged for systemic disclosure breaches, but the statutory wording targets the person who has access in the course of duty.

Recordkeeping and evidentiary issues. The Regulations require use of an approved form and that notifications contain identifiable data (regulation 5(2)); those records become part of “notified information” and thus are subject to the register duty and the non‑disclosure offence. The Regulations do not specify retention periods, destruction requirements, or data security standards; enforcement therefore will rely on general obligations under other legislation and administrative rules for handling health records, not on the Regulations themselves.

Administrative discretion and enforcement choices. Because the CEO determines the form of notification and the register’s manner and form (regulation 7(3)) and may make written requests where the CEO believes on reasonable grounds another person has information (regulation 6(1)), enforcement can be focused or scaled administratively. The Regulations provide the CEO with options for operational prioritisation, but do not mandate particular enforcement thresholds or public reporting on compliance.

The Regulations are compact but operate through explicit cross‑references and thereby interact with at least three other legal instruments and with general statutory regimes covering health records and confidentiality.

Part IXA of the Health (Miscellaneous Provisions) Act 1911. Regulation 4 prescribes stimulant induced psychosis as a condition of health to which Part IXA of the Health Act applies. The Regulations therefore operate as a subordinate instrument implementing Part IXA’s notification framework, but they do not repeat or restate Part IXA’s text. The actual powers, objects and procedures of Part IXA are not reproduced in these Regulations; users must consult the Health Act to understand the Part IXA context, including any broader powers, objectives, or procedural safeguards that Part IXA confers on the CEO or other public officers. The Regulations’ statement (regulation 4) limits itself to prescribing the condition and then provides the detailed notification, information request, register and confidentiality provisions.

Mental Health Act 2014. Regulation 3 defines “psychiatrist” by reference to the Mental Health Act 2014 section 4. That cross‑reference means the class of persons subject to the notification duty is controlled by the Mental Health Act’s definition, not by a general medical registration test in these Regulations. The Mental Health Act may also establish other duties, confidentiality rules, or procedural protections for psychiatrists and for involuntary treatment which could interact with the notification duty in particular cases; those interactions are not specified here and must be resolved by reference to the Mental Health Act’s text and administrative practice.

Medicines and Poisons Regulations 2016, regulation 126. Regulation 7(2) ties the content of the Stimulant Induced Psychosis Register to patients who have been prescribed or supplied a stimulant under Medicines and Poisons Regulations 2016 regulation 126 in the previous six months. That cross‑reference restricts the register to a subset of notified patients and anchors the permitted disclosure exception in regulation 8(b) to the same medicines/poisons regulatory regime. The practical effect is that both the register population and the permitted recipients of identified notified information are defined by whether a prescriber or supplier is authorised under reg 126 and has in fact prescribed or supplied the stimulant to the person. To understand the class of prescribers, the nature of authorised health professionals, and the legal meaning of “prescribed or supplied” for this purpose, the Medicines and Poisons Regulations must be consulted.

Data protection, health records, and privacy laws. The Regulations create a regime for collection, retention and limited disclosure of identifiable health information, but they do not purport to exhaustively regulate data protection, security, retention, or patient access rights. Other statutory regimes and administrative standards that govern health records, privacy legislation, health records legislation, and departmental policies, will operate alongside these Regulations. The Regulations’ prohibition on disclosure (regulation 8) and the CEO’s control over form and register (regulation 7(3)) mean that data governance will be implemented through departmental policy and through the CEO’s determinations, but the Regulations themselves do not set retention, destruction, or access protocols.

Criminal law and professional regulation. The Regulations create criminal offences limited to monetary fines; they do not create new professional disciplinary powers. However, a psychiatrist’s failure to notify or an unlawful disclosure could be referenced in any separate professional misconduct or registration proceedings under medical registration or mental health professional regulatory schemes. The Regulations do not specify how notices to professional regulators should be made or whether Part IXA or the CEO’s actions trigger reporting to registration bodies.

Administrative law. The CEO’s exercise of discretion (for example, forming the “reasonable grounds” required to issue a written request under regulation 6(1), determining whether to make a request, approving forms, and determining the register’s manner) will be subject to administrative law norms, including reasonableness and procedural fairness where applicable. The Regulations do not prescribe internal review or appeal mechanisms for persons aggrieved by the CEO’s decisions; those review routes will exist, if at all, under administrative law or other statutory review regimes.

Interplay of private confidentiality duties. The Regulations impose statutory confidentiality duties on persons who have access to notified information (regulation 8). These duties operate in parallel with, and may supplement, existing professional confidentiality obligations owed under common law and professional codes. The Regulations’ exceptions (written consent and to authorised prescribers/suppliers) therefore create statutory carve‑outs that may override or supplement confidentiality expectations in specific circumstances.

The source includes a compilation table and amendment notes that record the legislative history of these Regulations from their 2010 origin through to changes recorded in 2024. The compilation table and marginal amendment notes in the text are the authoritative history included in the instrument.

Original enactment and commencement. The Health (Notification of Stimulant Induced Psychosis) Regulations 2010 were published 7 January 2011, with regulations 1 and 2 (citation and commencement) commencing on 7 January 2011 and the remainder of the Regulations commencing three months later, on 7 April 2011 (Compilation table).

Amendments in 2015. The Health (Notification of Stimulant Induced Psychosis) Amendment Regulations 2015 were published 29 December 2015 and commenced on 30 December 2015 for regulations other than the usual citation/commencement provisions (Compilation table). The marginal note indicates regulation 3 was amended by Gazette 29 Dec 2015 p. 5172 (see the footnote after regulation 3). The textual amendments to the definitions are reflected in the consolidated text.

Amendments in 2016 (Poisons/Meds). The Health Regulations Amendment (Poisons) Regulations 2016 Part 2 are recorded with a publication entry of 17 January 2017 p. 409-11 and a commencement date of 30 January 2017 (Compilation table). The marginal notes identify amendments to regulations 3, 7 and 8 by Gazette 17 Jan 2017 p. 410 (see the footnotes appended to regulations 3, 7 and 8). These amendments appear to align the instrument with changes to the Medicines and Poisons framework and to update cross‑references.

Reprint. There is a reprint recorded as Reprint 1: The Health (Notification of Stimulant Induced Psychosis) Regulations 2010 as at 29 Mar 2018 that includes the amendments listed up to that date (Compilation table).

Amendments in 2024. The Health Regulations Amendment (Medicines and Poisons) Regulations 2024 Part 3, SL 2024/265, is recorded with a commencement date of 12 December 2024 (Compilation table). The marginal notes indicate regulation 3 was amended (SL 2024/265 r. 31), regulation 7 amended (SL 2024/265 r. 32), and regulation 8 amended (SL 2024/265 r. 33). The consolidated text in this compilation reflects those amendments.

Nature of amendments. The published marginal notes make clear which provisions were amended at each stage: definitions in regulation 3, the register provision in regulation 7, and the non‑disclosure provision in regulation 8. The 2016 and 2024 instrument titles indicate coordination with medicines and poisons regulatory changes; the changes to regulation 7(2) and regulation 8’s exceptions expressly cross‑link to Medicines and Poisons Regulations 2016 regulation 126. The amendments therefore appear to contemporise cross‑references and operational detail as the medicines/poisons regulatory regime evolved.

Commencement structure maintained. The commencement structure in regulation 2 remains the same: regulations 1 and 2 commence on publication; the rest of the Regulations commence three months after publication (regulation 2). The compilation table confirms staged commencements across amendments.

No amendment history beyond compiled entries. The compilation table provides the published dates, Gazette citations and commencement dates for each instrument amending the Regulations. The Regulations as presented are a consolidated text that incorporates the amendments listed up to 12 December 2024. The compilation table is the extent of the instrument’s internal amendment history; any further legislative history beyond these entries is not included in the Regulations’ text.

The Regulations as published and consolidated do not include or cite any judicial decisions, and the compilation table and marginal amendment notes do not record case law. The instrument therefore contains no litigation history within the source text itself.

From the text alone, there are no reported cases, no annotated judicial clarifications, and no recorded challenges presented in the compilation or footnotes. The Regulations create offences, duties and an administrative register, but the source document does not report how courts or tribunals have interpreted its provisions, how prosecutorial discretion has been exercised, or whether administrative decisions under the Regulations have been the subject of judicial review.

For practitioners seeking judicial interpretation or precedent on issues such as the scope of “reasonable grounds” in regulation 6(1), the boundaries of the non‑disclosure prohibition in regulation 8, the definition of “psychiatrist” under the Mental Health Act 2014 s 4 as applied to these Regulations, or the interplay with Medicines and Poisons Regulations 2016 reg 126, the consolidated Regulations do not provide such material. Any litigation history, if it exists, will therefore be external to this source and would require searching public law and health law case databases, tribunal decisions, or prosecutorial records for matters arising under these Regulations or under the parent Health Act Part IXA.

Because the Regulations create criminal offences with modest financial penalties, enforcement may often be administrative or may not generate extensive litigation unless contested prosecutions or administrative review proceedings arise; however, that inference is observational and not based on any cases cited in the source.

The Regulations are short and tightly drafted; several operational risks and counter‑intuitive interactions arise from their wording that practitioners and compliance officers should note.

Notification duty is psychiatrist‑specific. Regulation 5 imposes the notification duty only on “psychiatrists”, which the Regulations define by cross‑reference to the Mental Health Act 2014 section 4 (regulation 3). Clinicians who are not psychiatrists but who may in practice diagnose stimulant‑related psychosis, emergency physicians, general practitioners, or other mental health clinicians, are not explicitly captured by regulation 5. This narrow agent specification means that notifications may not be triggered by the first clinician to encounter the condition, and that care pathways relying on non‑psychiatrist notification will not satisfy the statutory duty.

Register scope is a subset of notifications. Regulation 5 requires psychiatrists to notify all diagnoses of stimulant induced psychosis. Regulation 7(2) narrows the Stimulant Induced Psychosis Register to “all notified information in respect of each patient who has been prescribed or supplied a stimulant under the Medicines and Poisons Regulations 2016 regulation 126 in the previous 6 months.” The practical implication is that a notification can be made for any diagnosed patient, but only notifications relating to patients with recent prescriptions/supplies under the specified medicines/poisons rule are to be included in the register. That creates a possible discontinuity: notifications exist even where the patient is not captured in the register, and the Regulations do not set out what happens to notified information in such cases beyond the confidentiality provisions.

Narrow disclosure exception. Regulation 8 allows disclosure of identified notified information only with written consent or to a medical practitioner or authorised health professional authorised under Medicines and Poisons Regulations 2016 regulation 126 and who has prescribed or supplied the stimulant to the person. The exception therefore does not permit disclosure to other clinicians involved in care unless they meet both the authorisation and actual prescribing/supplying condition. For instance, an emergency department clinician who is not authorised under reg 126 or who has not prescribed/supplied the stimulant to the person may not receive identified notified information lawfully under the exception. That can complicate coordination of care unless consent is obtained or the recipient falls within the exception.

Approved forms and CEO discretion. Notification must be in an “approved form” (regulation 5(2)), and “approved” is defined as approved by the CEO (regulation 3). The CEO also determines the register’s manner and form (regulation 7(3)). Practically, this means compliance depends on obtaining and using the correct form approved by the CEO; failure to do so could expose the notifier to penalty even if the substantive information is provided by other means. Organisations must locate and adopt the CEO‑approved template and any accompanying guidance.

Short timeframes. The 72‑hour windows for notification (regulation 5(1)) and for compliance with CEO requests (regulation 6(2)) are brief. In high‑volume clinical settings or where administrative processes are not geared to the CEO’s forms and timelines, these deadlines may be difficult to meet. Missing the 72‑hour deadline risks fines. The statute offers no express extension mechanism or administrative grace period within the text.

Broad scope of persons who may be asked to provide information. Regulation 6(1) permits the CEO to request information from “a person” who the CEO reasonably believes has relevant information. The Regulations do not limit that to health professionals; family members, retailers, pharmacists, or others could be the subject of a written request if the CEO forms a reasonable belief. Those persons must comply within 72 hours or risk fines, though regulation 6(3) provides a defence if they did not have the information.

Identity threshold for disclosure offence. Regulation 8 criminalises disclosure where the notified information “from which the identity of the person to whom the information relates is apparent or can reasonably be ascertained.” The wording creates a test that is not merely about direct naming; information that allows re‑identification could fall foul of the prohibition. Agencies and staff who handle aggregate or coded datasets should therefore be cautious: de‑identified data that nonetheless enables re‑identification might still be captured.

Defence limited to information non‑possession. The only express statutory defence in the Regulations is the assertion that the person requested did not have the requested information at the relevant time (regulation 6(3)). There are no parallel defences such as compliance with other legal obligations, competing confidentiality duties, or public interest exceptions in these Regulations. That limits statutory defences available to persons called upon to produce information.

No express patient access or correction mechanism. The Regulations do not provide a route for patients to access their register entry, correct errors, or seek deletion. The Regulations also do not specify retention or destruction periods for the register. These omissions mean that patient data governance questions will need to be addressed under other legislation, departmental policy or administrative practice.

Penalties are modest but real. The maximum fine is $1,000, with escalating minima. While the amounts are not large relative to corporate or professional regulatory penalties, they are targeted at individuals (psychiatrists and persons receiving requests), and multiple failures could attract repeated minima. Organisations should not assume the penalty is negligible.

Cross‑reference reliance. The Regulations rely heavily on other instruments (Mental Health Act 2014 for the definition of psychiatrist; Medicines and Poisons Regulations 2016 reg 126 for register scope and permitted disclosure recipients; Part IXA of the Health Act for the statutory context). Understanding practical effect thus requires consulting those instruments.

This section sets out specific, source‑grounded steps and checklist items for the actors principally affected by the Regulations: psychiatrists, persons who may be requested to provide information, organisations employing staff with access to notified information, and the CEO/department.

For psychiatrists who diagnose stimulant induced psychosis (regulation 5)

• Timing: notify the CEO within 72 hours of making the diagnosis (regulation 5(1)). Log the date and time of diagnosis and the date and time the notification was sent to establish compliance.
• Form: use the CEO‑approved notification form. “Approved” is defined as approved by the CEO (regulation 3). Confirm the current approved form with the Department of Health or the CEO’s office and retain a copy of the submitted form for audit purposes.
• Required content: ensure the notification includes the patient’s full name and address; sex and date of birth; full diagnostic details including details of the stimulant involved (if known); and the notifying psychiatrist’s full name, address and telephone number (regulation 5(2)). Do not omit identifying details on the form.
• Recordkeeping: maintain contemporaneous clinical records that substantiate the diagnosis and copies of notifications sent. These records will be material in the event of an audit or prosecution for failure to notify.
• Consent and confidentiality: understand that notification itself feeds into “notified information” (regulation 3) and that persons with access to notified information are subject to the non‑disclosure prohibition (regulation 8). Obtain patient consent where appropriate for disclosures not covered by regulation 8(b).

For persons (clinicians, family, others) who receive a written CEO information request (regulation 6)

• Assess receipt: if you receive a written request issued by the CEO under regulation 6(1), check that it is a genuine CEO request and record the time and date of receipt; the Regulations require compliance within 72 hours after receiving the request (regulation 6(2)).
• Search and response: act promptly to identify whether you hold the requested information. The Regulations create a statutory defence (regulation 6(3)) if you did not have the information at the relevant time, so document searches and the absence of data.
• Legal and confidentiality obligations: if you hold the information, consider whether any other legal duty prevents disclosing it. Regulation 8 governs disclosure by persons who have access to notified information, setting narrow exceptions; however, regulation 6 is a direct statutory request from the CEO, and the Regulations impose a duty to comply. If you face conflicting legal duties, seek legal advice immediately; the Regulations do not themselves provide other statutory defences beyond non‑possession.
• Timeliness and evidence: comply within 72 hours or risk the specified fines. Keep documentary evidence of the production or of searches conducted to establish your good faith and compliance.

For persons with access to notified information (staff, administrators, contractors)

• Access control: ensure only staff who need to see notified information for the performance of their duties have access. The offence in regulation 8 targets persons who “in the course of the person’s duty” have access to notified information and who disclose it unlawfully.
• Non‑disclosure rule: do not disclose notified information that identifies a patient unless you have the patient’s written consent or are disclosing to a medical practitioner or authorised health professional authorised under Medicines and Poisons Regulations 2016 regulation 126 who has prescribed or supplied the stimulant to the person (regulation 8(a)-(b)). Train staff on these narrow exceptions.
• De‑identification caution: where using data for audit or analysis, ensure that de‑identified datasets cannot reasonably be used to re‑identify individuals; the disclosure offence covers information “from which the identity of the person … is apparent or can reasonably be ascertained” (regulation 8).
• Policies and contracts: include confidentiality obligations and compliance policies in employment contracts and third‑party agreements. Ensure contractors handling notified information are contractually bound to comply with the Regulations.

For organisations employing psychiatrists or other relevant staff

• Administrative processes: establish a protocol for prompt notification to the CEO on diagnosis, including a designated officer responsible for ensuring approved forms are used and timelines met.
• Training: provide targeted training to psychiatrists and administrative staff on the 72‑hour timelines, form‑use requirements, and the limited disclosure exceptions.
• Record retention: maintain internal records evidencing diagnosis, notification submission, and searches in response to CEO requests. Keep copies of notifications and correspondence with the CEO.
• Liaison with the CEO: identify a departmental contact point for receiving and responding to CEO written requests and for obtaining the approved form and any operational guidance from the CEO’s office.

For the CEO/department who must implement the register and approval functions

• Approved forms: publish and maintain the CEO‑approved notification form and make it readily available to psychiatrists and health services, including guidance on completion and submission channels.
• Register design: determine the register’s manner and form (regulation 7(3)) and document data security, retention schedules, access controls, and audit trails. Ensure the register contains “all notified information” for patients prescribed or supplied a stimulant under Medicines and Poisons Regulations 2016 regulation 126 in the previous six months (regulation 7(2)).
• Reasonable grounds process: adopt and publish internal guidelines on how the CEO forms “reasonable grounds” to make a written request under regulation 6(1), to ensure consistent and legally defensible decision‑making. Keep records of the basis for any written request.
• Information requests: implement an operational channel for issuing and tracking written requests, receiving responses within the 72‑hour window, recording compliance, and documenting reasons where a person claims not to have the requested information (regulation 6(3)).
• Data governance: align register handling with other applicable privacy and health records laws and departmental policy. Provide clear guidance to staff on the narrow disclosure exceptions in regulation 8 and on handling consent.

Practical checklist

• Identify whether the notifier is a “psychiatrist” as defined by Mental Health Act 2014 s 4.
• Obtain and use the CEO‑approved notification form.
• Notify the CEO within 72 hours after diagnosis, including all required fields in regulation 5(2).
• Keep internal records of diagnosis and notification submission.
• If you receive a CEO written request, search promptly and respond within 72 hours, keeping documentary evidence of searches and responses.
• Do not disclose identified notified information except with written patient consent or to a prescriber/authorised health professional who meets the regulation 8(b) criteria.
• Ensure data handling and de‑identification practices avoid re‑identification risk.
• Where roles or legal conflicts arise, obtain legal advice promptly; the Regulations provide a narrow statutory architecture and cross‑link to other instruments.

Following these steps will address the principal compliance obligations that the Regulations impose. Where matters intersect with the Mental Health Act 2014, the Medicines and Poisons Regulations 2016 regulation 126 or other statutory regimes, consult those instruments and obtain legal advice tailored to the factual circumstances.
