What it does
This Act, cited as the Health Miscellaneous Act 2025, is a short, procedural statute that effects amendments to three existing Acts, repeals two Acts in full, revokes one subordinate instrument, and provides for its own automatic repeal after one year. The Act commences on the day it receives Royal Assent (s 1; s 2). Parts 2, 3 and 4 each state that the amendments effected by that Part have been incorporated into the authorised version of the target principal Act: the Anatomical Examinations Act 2006 (Parts 2; see the repeated textual statements at sections that correspond to ss 3-4), the Food Act 2003 (Part 3; ss 5-9), and the Poisons Act 1971 (Part 4; ss 10-13). Section 14 expressly repeals the legislation listed in Schedule 1, and section 15 revokes the legislation listed in Schedule 2. Schedule 1 lists the Optometry Offences Act 2010 and the Mental Health (Transitional and Consequential Provisions) Act 2013 (Schedule 1 heading and items appear as reproduced in the source). Schedule 2 lists the Tasmanian Health Organisations (Tasmanian Health Service) Order 2015 (No. 23 of 2015). Finally, section 16 provides that the Health Miscellaneous Act 2025 is itself repealed on the first anniversary of its commencement.
Mechanically, the Act does three kinds of things: (1) it directs that textual amendments to three principal Acts are now part of the authorised versions of those Acts (Parts 2-4, multiple short statements); (2) it removes two separate Acts from the statute book by express repeal (s 14, Schedule 1); and (3) it annuls a subordinate legislative instrument by express revocation (s 15, Schedule 2). It does not set out the text of the amendments to the principal Acts inside the body of this Act as reproduced; instead, it states that the amendments have been incorporated into authorised versions. The Act also imposes an explicit temporal limit on itself by providing for automatic repeal after one year (s 16). The source text contains no express penalty, enforcement, or transitional provisions in relation to the repeals, revocation, or the incorporated amendments beyond the directives already noted.
