What it does
This Determination, made under subsection 3C(1) of the Health Insurance Act 1973, creates a mechanism for four specified transcatheter mitral valve repair (TMVr) services to be treated as if they were items in the Medicare Benefits Schedule (MBS). The effect is to allow Medicare benefits to be payable for those services, despite the services not yet having been separately listed in the general medical services table. Section 5(1) operates by deeming each service described in the table at subsection 5(5) to be both a professional service and a medical service, and deeming there to be a corresponding MBS item with a specified fee. The fees are fixed amounts: $52.95 for item 6082 (coordinator attendance at a TMVr suitability case conference), $39.50 for item 6084 (other specialist attendance at that conference), and $1,490.25 each for items 38461 and 38463 (the TMVr procedures themselves). The instrument does not create new legal duties enforceable in isolation; rather, it expands the scope of services attracting Commonwealth subsidy by private insurers and patients alike.
The item descriptions impose strict eligibility conditions. Item 38461 covers TMVr for primary (degenerative) mitral regurgitation where the patient has moderate to severe or severe symptoms (grade 3+ or 4+), left ventricular ejection fraction of 20% or more, and New York Heart Association class II-IV failure. Item 38463 covers functional (secondary) mitral regurgitation with the same severity, but requires LVEF between 20% and 50%, left ventricular end systolic diameter no greater than 70 mm, and persistent symptoms despite maximally tolerated guideline directed medical therapy. Both procedures require a prior TMVr suitability case conference under section 6, and the service must be performed by an accredited practitioner in an accredited hospital, using transfemoral venous delivery unless contraindicated. The same patient cannot receive a service under either item more than once in five years. The instrument also provides for indexation at a factor of 1.024 from 1 July 2025, replacing each fee with a rounded amount.
