What it does
This Determination, made under subsection 3C(1) of the Health Insurance Act 1973 (see s 3), specifies a set of Transcatheter Aortic Valve Implantation (TAVI) related services as "relevant services" for the purposes of the Act and the associated "relevant provisions" (s 6). Mechanically, the Determination does three principal things.
First, it defines new Medicare items for TAVI-related services that are to be treated, for the relevant provisions, as if they were both professional services and medical services, and as if an item in the general medical services table existed specifying the fee for each State equal to the Schedule amount (s 6). The Schedule sets unit fees for: coordination of a TAVI Case Conference (item 6080, $53.80), attendance at a TAVI Case Conference by the non‑operative specialist (item 6081, $40.15), three principal TAVI surgical operation items (38495, 38514, 38522, each $1,514.10), and an adjunct device procedure (item 38523, $275.20). The Schedule also marks certain items with the symbol (H), which the Determination defines as applying only to services performed or provided in a hospital (s 8).
Second, it prescribes precise eligibility and operational conditions that must be met for those items to be claimable. The Determination defines TAVI, a TAVI Practitioner, TAVI Hospital, TAVI Patient, and in particular a TAVI Case Conference, setting out the required team composition, the matters the team must assess, and the requirement that particulars and the recommendation be recorded in writing (s 5 Definitions, Schedule). It requires that coordination and attendance activity connected with a TAVI Case Conference meet particular minimum content and recordkeeping standards to qualify for the modest coordination and attendance fees (Definitions of Attendance and Coordination in s 5(1)). The surgical items each carry clinical and facility conditions, for example intraoperative imaging inclusion, valvuloplasty if required, availability of cardiothoracic surgery and immediate thoracotomy capability for some items, and the presence of a cardiothoracic surgeon if an interventional cardiologist performs the procedure (Schedule).
