What it does
This Determination, made under subsection 3C(1) of the Health Insurance Act 1973 (the Act) (see s 3 of the instrument), creates an MBS-equivalent item for a specific botulinum toxin injection service by treating that service as a clinically relevant service and, for the purposes of the Act and related legislation, as if it were both a professional service and a medical service with a specified fee. Section 5 of the instrument prescribes that a relevant service provided in accordance with the instrument and as a clinically relevant service is to be treated, for the relevant provisions, as if there were an item in the general medical services table that related to the service and specified a fee in relation to each State equal to the fee in the Schedule. The Schedule names the item as 18361 and sets out a description and a fee of $145.65.
The Determination also imports specific application of provisions from the general medical services table. Section 6 directs that clause 5.8.1 of the general medical services table shall have effect as if item 18361 were specified in that clause, and that clause 5.8.2 shall have effect as if item 18361 were specified in subclause 5.8.2(1). The instrument therefore places the new item within the operational rules that attach to those clauses of the general medical services table.
An indexation rule is included. Section 7 fixes an indexation time of 1 July 2025 and prescribes that at that time each item fee in the Schedule be multiplied by 1.024 and then rounded to the nearest 5 cents (with the specific rounding rule that, if the amount is an exact multiple of 2.5 cents, it is rounded down). The instrument notes that indexed fees could be viewed on the Department of Health and Aged Care’s MBS Online website.
Mechanically, then, the instrument (a) creates an MBS-style entitlement to a fixed fee for a defined botulinum toxin injection service identified in Schedule 1 as item 18361, (b) subjects that item to the operational clauses 5.8.1 and 5.8.2 of the general medical services table as if expressly included in them, and (c) provides for an automatic indexation uplift to the Schedule fees at a stated future date using a specified multiplier and rounding rule.
