What it does
This instrument, titled the Health Insurance (Section 3C Diagnostic Imaging Services - Whole Body Magnetic Resonance Imaging Scan) Determination 2022, is a regulation made under subsection 3C(1) of the Health Insurance Act 1973 (see cl 1 and cl 3). Its mechanical effect is to specify a new diagnostic imaging item for Medicare purposes by treating a defined “relevant service” as if there were an item in the diagnostic imaging services table that relates to that service and specifies a fee for each State (see cl 5(a)-(b)). The Schedule to the instrument supplies the item number (63564), a detailed description of the service and the fee, $1,655.20, in Column 3 of the Schedule.
Concretely, the instrument does three things:
-
It defines terms used within the determination (cl 4), including cross-references to terms defined in the Health Insurance Act 1973 (the Act) and to meanings provided in the diagnostic imaging services table (for example, “(R)” has the meaning given by clause 1.2.15(1) of that table) (cl 4(1)).
-
It directs that, for the purposes of subsection 3C(1) of the Act, a specified “relevant service” provided in accordance with the instrument and as a clinically relevant service is to be treated for the “relevant provisions” as both a professional service and a diagnostic imaging service, and as if the diagnostic imaging services table contained an item relating to that service with the specified fee (cl 5).
-
It places operational constraints on the use of the item, including an annual limitation: item 63564 applies only if the same patient has not received a service to which the same item applies within the preceding 12 months (cl 7(1)).
The Schedule identifies the clinical scope of item 63564: an MRI whole body scan for the early detection of cancer where the request is made by a specialist or consultant physician in consultation with a clinical geneticist in a familial cancer or genetic clinic, and the request identifies that the patient has a high risk of developing cancer due to heritable TP53‑related cancer (hTP53rc) syndrome (Schedule, item 63564, Column 2). The Schedule further annotates the item with the codes “(R) (Anaes.)” and the fee $1,655.20 (Schedule, Column 3). Clause 6(1) additionally provides that clause 1.2.17 of the diagnostic imaging services table shall have effect as if the items in Schedule 1 were specified for the purpose of that clause.
